City Council Meeting -Regular Session January 13,1976
City Hall -Council Room 8:00 P.M.
Members Present:Councilman Bob Hill,Bill Moe,Norm Johnson,Jim Barney,Don Swanson,
Kent Jones and Eric Skaug.
ELECTION OP MAYOR:
According to State Law the City Clerk is authorized to conduct election of a Mayor.Rick Gagnler,
City Clerk called for nominations for the office of Mayor.Jim Barney nominated Don Swanson.
Motion by Bob Hill nominations be closed and a unanimous vote be cast for Don Swanson as Mayor.
Second by Johnson.Motion carried.Each Councilman was polled individually and the vote was
unanimous for Don Swanson to be Mayor.
Former Mayor Gordon Ebbert presented Don Swanson with the official gavel and also a packet of
papers carried over from his term of office as Mayor that could be helpful for informational purposes.
INVOCATION:-Daniel Stime -Emmanuel Lutheran Church.
Mayor Don Swanson called the meeting to order and called for approval of the Council Minutes of the
previous meeting of December 23,1975.Motion by Johnson to approve the minutes as written.
Second by Kent Jones.Motion carried.

Warrant No's.4414 through #4553 in the amount of $92,847.83 were approved for payment.
CONSIDERATION OF BIDS - BOOSTER PUMP STATION AND WATER SYSTEM TELEMETERING PROJECT
A letter was read from Jerry Fay,Public Works Director,stating sealed bids were opened on December 31,
1975 and January 7,1976 for the Booster Pump Station and Telemetering Project.The low bidders were
Leonard Plumbing Company of Moses Lake for the Booster Station portion of the project,and Tyee Elect
ric of Moses Lake for the Telemetering.Both contractors rave completed previous projects for the City
in a satisfactory manner,therefore,recommended the City Council award the Pump Station contract to
Leonard Plumbing Company for $22,648.50,and the Telemetering contract to Tyee Electric for $129,920.
This project is partially funded by a 40%Department of Social and Health Services Grant,under Referen
dum #27,and both contracts are subject to their approval.
Motion by Hill that the bids from Tyee Electric and Leonard Plumbing be accepted.Second by Skaug.
Motion carried.
CONSIDERATION OF BIDS -CHLORINE SUPPLY
A letter was read from Asst.Public Works Director M.G.McLanahan,stating bids were opened for
furnishing liquid chlorine to meet the requirement of the Park Department and Sewer Division for 1976.
Two bids were received from:-Jones Chemical,Inc.,and Penwalt Corporation.Jones Chemical sub
mitted the only complete bid for a total of $4,484.Mac added the other bid did not include freight,
and also included an estimate of the amount of chlorine we had to use,putting us in a higher bracket
thanthe amount we would order.He recommended acceptance of Jones Chemicals proposal to furnish
liquid chlorine to the City for 1976.Based on last year's contract,the cost for 1976 will be about
10%higher.
Motion by Johnson to accept Mac's recommendation and award the bid to Jones Chemical,Inc.Second
by Jones.Motion carried.
CONSIDERATION OF BIDS -ABANDONED VEHICLE REMOVAL
A letter was read from City Planner Stan Bech stating bids were opened on January 7,1976 for the Iltf7
removal of abandoned vehicles within the city limits.The low bidder was Moses Lake Auto Wrecking,
Inc.The price for removal is still $10.00 plus tax per vehicle hulk.He recommended accepting their
bid.

Chief Baker added there is a difference In abandoned vehicles and abandoned vehicle huiks,and
the hulks are what we are interested in removing under this contract,and they can only be disposed of
as junk.The abaondoned vehicle falls under a different contract,but they all come through-the
Police Department for approval before they are removed.Also added/the contractor must be *
licensed as a hulk disposer.There are two In the Basin.
Moved by Barney the bid of Moses Lake Auto Wrecking be accepted.
Motion carried.
Second by Johnson.
PUBLIC HEARING -ORDINANCE NO.747 - 1975 BUDGET AMENDMENT -SANITATION FUND-(2nd reading)
Mayor Swanson asked Rick Gagnier,Finance Director/to review the reason for the amendment to
the 1975 Budget.
Rick explained the amendment affects only the Sanitation Fund.The Sanitation Fund's original
1975 appropriation of $180,000 must be Increased to legally pay the year-end bills.Revenues
through November 1975 of $187,000 and expenditures of $198,000 reflect the 1974 carry over pay
ment to Western Refuse made In January of 1975 and also Indicates an increase in our originally
expected revenue for 1975.The accompanying ordinance revises the original 1975 Budget only
for the Sanitation Fund,he emphasized.An additional appropriation of $36,000 is requested.
The money is there,but it takes an ordinance from the Council to appropriate the funds.
Mayor Swanson opened the public hearing and explained the procedure for same to those in the
audience.He called for comments or questions.
Clifford Nicholas,1048 Luta,inquired whether this will have any effect on the garbage service
rates that are established today?Rick Gagnier assured him,none whatsoever.The same rates
that were bid in April of 1974 continue throughout the year,and can only be changed by the Council,
and they will not be affected by this amendment.
There were no further comments or questions from those in the audience.The Mayor,therefore,
closed the public portion of the hearing.He asked if any letters had been received pertaining to
this amendment,and there were none.Mayor Swanson then turned the public hearing over to the
City Council for questions or comments.There were none.
Motion by Hill,second by Johnson to close the public hearing*.Motion carried.
The ordinance was reed by title only.Motion by Johnson to pass the ordinance amending the 19.75
budget for the Sanitation fund.Second by Jones.Motion carried.
ORDINANCE -BASIN WATER SOURCES.INC..FRANCHISE (first reading)
A letter was read from City Manager Chet Waggener stating this franchise was discussed with the
City Council approximately one year ago without a conclusion at that time.The only section of
the franchise lacking agreement related to standards for fire protection.
The City Manager and City Attorney Pat-Acres met with Mr.Throop and Mr.Moberg who have
agreed to accept the proposed franchise with a fifteen-month term,deleting at this time any
reference to fire protection.The fifteen-month term of franchise is proposed to allow the City
Council to consider all pertinent data prior to extending the term of franchise,and to set a date
for further consideration that does not coincide with year-end budget study sessions.Also agreed
to assist Mr.Throop in conducting'flow tests of his system during 1976.Those tests will allow us
to better evaluate fire protection needs for the residents served by this water system,and to make
recommendations to the City Council for inclusion in the franchise renewal.
The City Manager recomended the City Council approve the first reading of the franchise ordinance,
and that a public hearing be scheduled for January 27,1976 to consider adoption of the ordinance.
Bob Hill inquired as to the purpose of the flow tests,and is Mr.Throop paying for those?
Chet Waggener explained the purpose of the tests is to determine the amount of fire protection
that is actually available to the residents in the area served by this franchise.They will need
to be conducted during hot summer months when there is heavy domestic flow and see what is
available for fire flow.At this time we intend to do the flow tests with city crews•with Mr.Throop's
cooperation.This will be a matter of running the pumps,and having him assist in opening gate valves.
Norm Johnson asked if the people from the water company are in agreement with this?Mr.Moberg
stated that we have agreed to let the city run the tests.It may very well be that the water flow in
the hydrants is sufficient as far as the city Is concerned..It may be.a moot question as to whose responsi
bility it is to keep the pressure up in the fire hydrants if it is at a certain level.We wart to see what
the level is;If the level is acceptable to the city,If not,then we are right back to resolving the issue
as to*whose responsibility it is.
Mr.Moberg added they have read the ordinance and are in agreement with the 15-month term.

be scheduled on January 27th.Second by Jones..Motion carried.
ORDINANCE -OFF-STREET PARKING (1st reading)
A letter was read from Stan Bech,City Planner,stating the Planning Commission,during their
regular meeting on December 18, 1975 recommended to the City Council that the off-street park
ing requirements for new residential developments be increased as follows:
2 spaces per unit for all new single family and duplex residential developments.
2 spaces per unit for multi-family developments containing two or more bedrooms.
l|spaces per unit for one bedroom apartments and efficiency units.
These Increases are reflected in the proposed new zoning ordinance which the City Council will
be reviewing.The Planning Commission wishes these parking changes to be implemented now,
rather than wait for the entire new zoning ordinance to be reviewed and approved..He recommend
ed Councl I approval of the first reading of the ordinance and a public hearing be scheduled for
January 27,1976 for consideration of passing the ordinance.
The ordinance was read by title only.
Motion by Kent Jones to accept the first reading of the ordinance and schedule the public hearing
on January 27,1976.Second by Moe.Motion carried.
RESOLUTION NO.747 -RECONVEYING DEEDS TO MIDSTATE LAND COMPANY
A letter was read from City Manager Chet Waggener,stating it has come to our attention that
Midstate Land Company,In July 1975,by quit claim deed granted property to the City of Moses
Lake for road purposes.Those roadways should be dedicated as a part of a subdivision,with
provisions made for necessary improvements to the road and extension of utilities.
In accordance with City of Moses Lake Resolution No.238 whbh provides:. . .."that all
grants of real estate or any interests therein to the City of Moses Lake shall not be accepted by
the City of Moses Lake until a resolution of acceptance has been duly passed by the City Council"...
The City Manager recommended the Council approve the accompanying resolution directing the
City Manager and City Clerk to execute quit claim deeds reconveying the parcels of property to
Midstate Land Company.
Kent Jones Inquired as to how this all came about?Chet Waggener stated that this is property
in the Westlake area.They were recorded,as far as we could determine,by Miss Longston
along with sale of property to a private property owner in that area who is planning to go ahead
with some construction.Probably inadvertently the thought was to give the property to the City
in order to give access to that property.However,our requirement is that the property must have
access to a publicly dedicated right of way,and in doing that there would be a small improvement
to the street in this instance;principally would be extension of the water system.Were we to
accept the deeds in this fashion,that would be accepting property then that would not have been
platted and would not have had the required improvements installed.Miss Longston had been
advised several months ago the City would not accept the deeds,and nothing has happened on it,
therefore,suggesting that we merely reconvey them.
The resolution was read by title only,
Moved by Barney and second by Jones to adopt the resolution.Motion carried.
CERTIFICATION -SEWAGE TREATMENT PLANT OPERATOR -DONALD HICKS -GROUP V
A letter was read from Assistant Public Works Director M.G.McLanahan stating State statutes
make certification of Waste Water Treatment Plant Operators mandatory.The certification program
was instituted to protect our environment and by maintaining a high quality of water in our State,
we have a better opportunity of assuring the coneervation of one of our most valuable resources for
future generations.A test must be taken to qualify for this certificate;the new operator may be
classified as a Grade Vand the more experienced operator may be classified as Grade I, II or III,
depending upon the type of plant he operates.The staff of the Moses Lake operators have spent
many hours training and studying at home for this certification and are to be commended.
Donald Hicks has passed a day-long examination administered by the Department of Ecology to
qualify for this certificate.
MayorSwanson presented the certificate to Donald Hicks and congratulated him forqualifying for
this certificate.

City Council Minutes:4 January 13,1976
has scheduled their Annual Banquet for January 20, 1976. The City Council has a regularly
scheduled Study Session meeting on that date.Perhaps the Council may wish to change that
meeting date to allow Council members to attend the Banquet.
Motion by Hill,second by Johnson to reschedule the Study Session to Wednesday,January 21,
1976.Motion carried.
CITIZEN INPUT
Steve Shinn inquired as to the status of the 1976 pay raises for the non-union employees of.the City?
Chet Waggener stated the non-union employees received a 10%pay raise.
Dave Passey inquired as to the status of Well #11 and how soon that will affect lhe Lakeview
Terrace area ?
M. G.McLanahan,Asst.Public Works Director,explained the well is being drilled and has
been tested once,which was not successful.The contractor is reaming to 20-inch sizeand is at the
300 or 400 foot level.The pilot hole has been drilled to the 700 or 800 foot level.His time .
is up the last of February for drilling to the 800 foot level.I believe there is a clause in the con
tract if he must go deeper that he would have more time.
Also the contract that was let for the telemetering will Incorporate the booster pump into that
system,and it may be a manual operation,but you will have more water than you have had'before
if the Reservoir site can be completed on Nelson Road, which is scheduled around the first part of
July, and you will have the additional pressure you have been promised.
STATUS/INFORMATIONAL
City Manager Chet Waggener:
1. Reminded the Council of the Bicentennial presentation this Thursday evening at the High School
Wrestling Match.

During the Study Session,which has been set for January 21st,we would like to
start review of the Zoning Ordinance with the City Council.That has passed the Planning
Commission some time ago,and it was held up for review by City Council until adoption of the
1976 budget.Hopefully maps will be ready for that Study Session.
3.Chet Waggener stated Eric Skaug suggested tours of city facilities for at least the new Council-
men,and hopefully the rest of the Council to review many of the facilities.In fact,Eric Skaug
commented,some of us still don't know some of these,whether they exist or even where they are.
Eric Skaug suggested the tours would be contingent upon Department Head and Staff schedules.
Chet Waggener stated it had been discussed with staff and talked possibly of two tours and
probably two more when the weather breaks and can get outdoors.First we suggest a tour of all
the Public Works facilities,which would take the better part of one-half day to cover that.We
can arrange that when it will work out best for the Councilmen.Another one-half day tour could
start with the Recreation Center at Central School and move through the Museum,Police,Fire
and basically facilities at City Hall.Probably look at the facilities,not in quality but rather talk
about programs as to what happens In each of the buildings.Later getting into good weather we
could arrange another one-half day program touring our park facilities,and probably another one-
half day looking at more public works facilities that are out-door type facilities,such as pumping
and lift stations,etc.
Eric Skaug volunteered to personally poll each Councilman to determine which dates would
work out best and try to work out tours from there.The Council concurred.
