1976 06 08LJ 2372 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING - REGULAR SESSION June 8, 1976 CITY HALL -COUNCIL ROOM 8:00 p.m. Members Present: Bob Hill, Kent Jones, Bill Moe, Jim Barney,Eric Skaug,Don Swanson, and Norm Johnson. Mayor Don Swanson called the meeting to order and called for approval of the minutes of the last regular session held on May 25,1976.Mr.Moe moved that the minutes be approved as submitted,seconded by Mr.Jones,and passed unanimously. APPROVAL OF BILLS: REGULAR BILLS AMOUNT PAID GENERAL $20,230.74 STREET 4,464.20 FEDERAL REVENUE SHARING 69.16 WATER/SEWER 3,818.91 SANITATION .13,256.08 WATER/SEWER CONSTRUCTION 1972 105,393.79 EQUIPMENT RENTAL 1,386.36 Mr, Hill abstains from voting for that portion of the warrant payment when it includes warrants to be paid to Pacific Northwest Bell Telephone Company. Mr. Jones moved to approve the bills, seconded by Mr. Barney, and passed unanimously. Warrant numbers 5446 - 5532 were approved for payment. I.CITIZENS INPUT Ken Moos, Ron Baker,Dolores Lewis, and Mike Bragg,identified themselves and all wished to speak on the street construction ordinance. II.CONSIDERATION OF BIDS PAVING MATERIALS AND METER BIDS /o/9AletterfromtheAssistantPublicWorksDirector,M.G.McLanahan,stating that J no bids for paving materials were received at the bid opening on June 2,1976,^y/// was read.The letter also stated that McAtee and Heathe is the only local //&(* supplier of asphalt materials and permission is being requested to purchase the necessary materials from this company. This letter also stated that no bids were received for water meters at the bid opening on June 2,1976.Permission is being requested to purchase the necessary water meters from The Badger Meter Company and Hersey Meter Company. Mr.Hill moved that permission be granted for the purchase of asphalt materials from McAtee and Heathe,seconded by Mr.Jones and passed unanimously. Mr. Moe moved that permission be granted for the purchase of water meters from Badger Meter Company and Hersey Meter Company,seconded by Mr.Johnson,and passed unanimously. 2373 CITY COUNCIL MINUTES:2 June 8,1976 COMPUTER DISK SYSTEM A vf\\A letter from the Finance Director,Rick Gagnier,stating that the Eye and Ear \Clinic in Wenatchee was the low bidder on the Disk Drives and that IBM was the only bidder on the required Central Processing Unit upgrade to accommodate the _ Disk Drives,was read.Mr. Gagnier recommended that the Council award the bid to the Eye and Ear Clinic to supply the Disk Drives and to IBM to install the needed Central Processing Unit upgrade. Mr. Hill moved that the bid from the Eye and Ear Clinic for the disk drives and from IBM to install the Central Processing Unit upgrade be accepted,seconded by Mr. Barney, and passed unanimously. III.PETITIONS,COMMUNICATIONS OR PUBLIC HEARINGS PUBLIC HEARING -ORDINANCE -ZONE CHANGE REQUEST -KEN EARL A letter from the City Planner,Stanley Bech,stating that Ken Earl is requesting a zone change on his property north of and adjacent to Sharon Avenue and fronting on Pioneer Way, was read. Mr. Earl is requesting that the present zone of R-1S be changed to R-3 and HS. Mr. Hill wanted to know what extensions would be required for water and sewer connections. Mr. Bech stated that the water supply would come from Pioneer Way and sewer services for the law office would be a septic tank. Mr.Jones wanted to know why the entire property was not being zoned R-3,instead l"-^ of having an HS Zone in there.Mr.Earl replied that he only wanted the corner zoned HS but that the Planning Commission recommended the Highway Service Zone across the front of the property. Mr. Bech stated that the R-3 Zone would permit both the law office and the seminary building,and the Highway Service Zone would be in conformance with the zone across the street. Mr.Hill moved that the Public Hearing be closed,seconded by Mr.Jones and passed unanimously. The Ordinance amending Ordinance No.433 titled the Moses Lake Comprehensive Zoning Ordinance,by changing the official zoning map on the following described parcel of land,was read by title only. Mr.Jones moved that the ordinance be adopted,seconded by Mr.Moe.Mr.Hill stated that he objected to the Highway Service Zone at the corner of Sharon Avenue and Pioneer Way.Mr.Jones also felt that the Highway Service zone could be R-3 instead.The motion passed with Mr.Johnson and Mr.Hill opposed. IV.ORDINANCES AND RESOLUTIONS ORDINANCE -STREET CONSTRUCTION S)V A letter from the City Manager,stating that the attached Ordinance would repeal «certain portions of Chapter 3.20 of the City Code entitled "Subdivision and \ Plats"by establishing revised requirements for the construction of all streets within the corporate limits of the City and also requiring all new utility construc tion within a proposed subdivision be placed underground,was read. V I 2374 CITY COUNCIL MINUTES: 3 June 8, 1976 The ordinance relating to and regulating the construction of streets within the city of Moses Lake and repealing all ordinances or sections of ordinances in conflict herewith was read for the benefit of the audience. Mr.Ken Moos stated that he was opposed to this ordinance because he felt the N developer should have the option of putting in or not putting in the improvements. Mr.Ron Baker stated that he felt this ordinance was being put forward in haste and he would like to recommend to the Council that they direct the city staff to review and write an economic impact statement on what this ordinance will do not only to the developer but to other parties who may want to plat property for their own use.He also stated that the cost of street improvements have risen and that the entire cost should not fall on the developer. Mrs. Dolores Lewis stated that she realized the development of the streets put a burden on the developer but that she was against gravel streets and that some people may not be able to afford an LID. Mr.Mike Bragg stated that he felt that most people consider water and sewer service and paved streets to be standard amenities that would come with the purchase of a lot in a residential area.He also stated that the problem with gravel streets is that people have to put up with the dust and that it does not make the neighborhood a better looking place.He stated that he felt this ordinance should be adoped. Mr.Jones asked what would happen if only one side of a street was developed. He wanted to know if the entire street would have to go in. Mr.Waggener stated that only half of the street would have to be paved. It was the consensus of the Council that this ordinance needed more study. Mr.Waggener stated that the staff would look into ordinances of other cities. Mr. Swanson stated that he felt the Planning Commission should have a voice in this ordinance. Mr.Hill moved that this ordinance be tabled until further information is brought back,seconded by Mr.Johnson,and passed unanimously. REGULAR COUNCIL MEETINGS -FIRST READING A letter from the City Manager,stating that the attached Ordinance adds the third Tuesday of each month as a regular Council meeting and abolishes the regularly scheduled study session, was read. The Ordinance amending Chapter 1.2 of the Moses Lake City Code,entitled "Council Meetings",by changing the section relating to regular meetings and repealing the section relating to study sessions was read by title only. Mr. Barney moved that the ordinance,with the second reading not being required, be approved, seconded by Mr. Skaug, and passed unanimously. ORDINANCE -AMENDING 1976 BUDGET -FIRST READING A letter from the Finance Director,Rick R.Gagnier,stating that a budget /O/O. revision is necessary to appropriate monies for the purpose of purchasing the Disk System,which can be purchased at this time at a substantial savings,was read. 2375 CITY COUNCIL MINUTES:4 June 8,1976^ The ordinance revising the original 1976 Budget Ordinance No.745 to appropriate funds to purchase and install a computer disk system was read by title only.,—• Mr.Hill moved that the first reading of the Ordinance be approved and that a Public Hearing be set for June 22,1976,seconded by Mr.Johnson,and passed unanimously.—r *J ORDINANCE - FACTORY BUILT HOUSING - FIRST READINGjQSI—— A letter from the City Planner,Stan Bech,requesting approval of an ordinance allowing factory built homes to be placed on individual single family lots within certain basic requirements,was read.I The ordinance allowing factory built homes to be placed on individual single '.• family lots within certain basic requirements was read by title only.i Mr.Waggener stated that the seal from the Labor and Industries Department must be on the factory built home. Mr.Acres stated that at the meeting held with the Department of Labor and ' Industries they stated they had approximately 400 homes in Washington that were factory built homes.These factory built homes are built in the East and the State of Washington sends inspectors to the plants to watch the homes being built. Mr.Moe moved that the first reading of the Ordinance be adopted,seconded by Mr.Johnson,and passed unanimously.r**\ RESOLUTION -AUTHORIZATION FOR SIGNING CHECKS A letter from the Finance Director,Rick R.Gagnier,stating that Barbara M. Lesser, Municipal Court Clerk, is required by -the State Auditor to have a separate checking account to handle court monies,was read.Mr.Gagnier requested that she be authorized to sign checks as indicated on the attached resolution. The resolution naming those employees authorized to sign checks on behalf of the City of Moses Lake was read by title only. Mr. Jones moved that the Resolution be adopted, seconded by Mr. Johnson, and passed unanimously. V.REQUESTS TO CALL FOR BIDS None VI.REFERRALS FROM COMMISSIONS SPECIAL USE PERMIT -TRAILER PARK -HAROLD GRAN A letter from the City Planner,Stan Bech,stating that the Planning Commission J I recommended that Mr.Gran not be required to state that he will not oppose an LID as a condition of the Special Use Permit and also,that they felt landscaping was well addressed in the zone regulations covering mobile home trailer parks, was read. •ft)l3te 2376 CITY COUNCIL MINUTES: 5 June 8, 1976 Mr. Bech stated that he wished to clarify the comment in the letter which stated the Planning Commission recommended that Mr. Gran not be required to state that he would not oppose an LID. They actually tabled any action on that item until there was an opinion from the City Attorney.They felt that they could not require a person not to oppose an LID and the City Attorney's opinion was that they couldn't Mr. Moe moved that the Special Use Permit for a trailer park for Harold Gran be granted subject to all trailer pads and utility hookups being completed and approved prior to occupancy of any mobile home,the alley being paved with a suitable hard surface paving prior to occupancy of any mobile home,and all landscaping and screening be completed within one year after issuance of the first occupancy permit,seconded by Mr.Johnson,and passed with Mr.Skaug and Mr. Hill opposed. "VII.OTHER ITEMS FOR COUNCIL CONSIDERATION /OO^j, PROPOSALS FOR AIRPORT LEASES A letter from the Public Works Director, Jerry Fay, stating that discussions were held with parties interested in leasing Commerical Lot #4 and Building, was read. He also stated that three schedules of service were developed and requested the Council authorize a method for selection of a tenant for the building and that the Council select those services that should be a requirement of the lease.This commerical lot and building is at the Moses Lake Municipal Airport. There were two ways discussed on how the bidding for this item should be let out. One was for a set of specifications to be set and the other was to state tthat the facility is available and ask people what services they would provide and evaluate it on the services offered.Mr.Moe moved that the rent of the airport be put out for bid with proposals of the services listed, giving the renters an option as to the services that they will be willing to provide, seconded by Mr. Barney, and passed unanimously. REQUEST FOR PUBLIC HEARING -SIX YEAR STREET PROGRAM A letter from the Public Works Director, Jerry Fay, requesting that the City Council hold a Public Hearing on June 22, 1976, was read. ;/77 Mr. Fay stated that some meetings were held with the State Highway Department and with the consultant that worked with the cities of Pasco and Kennewick on their project of a bridge over the Columbia River.At the meetings,which were held to discuss the Ring Road concept,the one thing that came out was the fact that we need a study made on this project,that the whole thing was rather vague and the possibility of funds from an outside source are remote,without a definite proposal in hand.He stated that a detailed*study of the Ring Road project would cost between $40,000 and $50,000. Mr.Hill moved that a Public Hearing be set for June 22,1976,seconded by Mr. Skaug,and passed unanimously. REQUEST TO SELL FIREWORKS -EAGLES LODGE A letter from the Fire Chief,Russell Beeman,stating that an application has been c submitted by the Eagles Lodge Number 2622 to sell "Safe and Sane"fireworks from a stand located at the northwest corner of Jack's Bargain Barn,was read. 2377 1° CITY COUNCIL MINUTES:6 June 8,1976 Mr.Hill moved that the request to sell "Safe and Sane"fireworks be granted with the exception that the Eagles Lodge include contractural liability of insurance coverage,seconded by Mr.Johnson,and passed unanimously. VIII.COUNCIL QUESTIONS AND COMMENTS $\Mr.Barney wanted to know when the next meeting on the Zoning Ordinance would take place.It was stated that a meeting is scheduled with Don Swartz for June 28 and 29,1976.It was decided that a study session on the Zoning Ordinance would be held after the regular Council meeting on June 15,1976. IX.CITY MANAGER REPORTS AND COMMENTS Mr.Fay gave a detailed report on the costs incurred in the building of Well #31 and stated that the work is completed.He stated that the cost was $200,982.00. A grant from the Department of Social and Health Services would cover $66,000.00 of the cost. Mr.Jones moved that the meeting be adjourned,seconded by Mr.Barney,and passed unanimously.
