1976 09 28l_ 2434 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING -REGULAR SESSION September 28, 1976 CITY HALL -COUNCIL ROOM 8:00 p.m. Members Present:Eric Skaug",Jim Barney,Kent Jones,Bill Moe,Bob Hill,and Norm Johnson.Absent:Don Swanson Mr. Johnson moved that Mr. Jones be nominated Mayor Pro Tern,seconded by Mr. Barney, and passed unanimously. Mr.Moe moved that the minues of the September 21,1976 meeting be approved as submitted,seconded by Mr.Barney,and passed unanimously. APPROVAL OF BILLS REGULAR BILLS AMOUNT PAID GENERAL $17,804.53 STREET 1,962.16 ARTERIAL STREET °2,953.94 FEDERAL REVENUE SHARING 545.91 WATER/SEWER 11,220.12 WATER/SEWER CONSTRUCTION 1972 4,867.97 EQUIPMENT RENTAL 2,093.60 FIREMEN PENSION AND RETIREMENT 5.00 Mr.Johnson moved that the bills be approved as submitted,seconded by Mr.Skaug, and passed unanimously with Mr.Hill abstaining from voting for that portion of the warrants to Pacific Northwest Bell.Warrants 572 to 665 were approved for payment. I.CITIZEN INPUT None II.CONSIDERATION OF BIDS L.I.D.NO.29 -BEAUMONT DRIVE Jerry Fay,Public Works Director,explained that problems had come up regarding /OcfS the bids on this L.I.D.He stated that the original engineering estimate was lower than it should have been and so the bids as presented are 36%over the figures presented to the people on the assessment roll.He stated that construction could not start until Spring anyway and he recommended that the bid not be awarded tonight. Mr.Fay also stated that if this L.I.D.could be combined with others to reduce the cost,the present assessment rolls might be used.If not,another Public Hearing will have to be held in the spring. Mr.Hill moved that L.I.D #29 be tabled,seconded by Mr.Johnson,and passed unanimously. III.PETITIONS,COMMUNICATIONS OR PUBLIC HEARINGS PUBLIC HEARING -COMMUNITY DEVELOPMENT BLOCK GRANT PROJECTS A letter from Stan Bech,City Planner,was read which stated that the public hearing was to garner citizen input concerning community development needs within the City of Moses Lake. The Public Hearing was opened. Mr.Ray Diaz aksed if this was going to be a union project and Mr.Jones stated that the interest was mainly in determining which projects could be done. There were no futher comments from the audience, so the discussion was closed for this meeting.The next Public Hearing on this item will be on October 12 and Mr. Jones asked the people present to notify other people of that meeting. 2435 CITY COKNCIL MINUTES:9/28/76:Page 2 IV.ORDINANCES AND RESOLUTIONS 1 ORDINANCE -SETTING 1977 TAX LEVY -FIRST READING A letter from Mr.Waggener,City Manager,was read which requested an ordinance fixing taxations on assessed valuations of property. Mr.Waggener stated that the tax levy must be set before October of each year. The ordinance fixing the amount to be received from municipal purposes from taxations on assessed valuations of property within the City of Moses Lake,Washington,for the year of 1977 was read by title only. Mr. Johnson moved chat the ordinance be adopted,seconded by Mr, Skaug, and passed unanimously. RESOLUTION -BENNETT ADDITION L.I.D. A letter from Jerry Fay, Public Works Director, was read which stated that petitions had been received for street improvements on Jefferson Avenue and for the installation of sewer facilities in Bennett Addition*. The resolution of the City Council of the City of Moses Lake declaring its intention to improve Fern Drive,Crouse Street,Bemis Street and Sybil Lane by constructing and installing a sanitary sewer system and connecting to existing sewer facilities at Fern Drive and Gibby Road and to create a local improvement district to assess the cost and expense of said improvement against the properties within the local improvement district specially benefited thereby, and notifying all persons who may desire to object to said improvement to appear and present their objections at a regular meeting of the City Council to be held on October 26, 1976, was read by title only. Mr. Hill moved that the resolution be adopted, seconded by Mr. Johnson, and passed unanimously. RESOLUTION -JEFFERSON AVENUE L.I.D. \G&* A resolution of the City Council of the City of Moses Lake declaring its intention to improve the area on Jefferson Avenue adjacent to lots 1, 2, and 4 of the Assembly of God Addition and adjacent to tract no. 7 through 16 of West View Tracts by grading, graveling,constructing and installing curbs, sidewalks, sewer side laterals, asphalt concrete pavement and storm drainage and to create a local improvement district to assess the cost and expense of said improvements against properties in such district specially benefited thereby, and notifying all persons who may object to said improve ment to appear and present their objections at a regular meeting of the City Council to be held on November 9, 1976, was read by title only. Mr.Skaug moved that the resolution be adopted,seconded by Mr.Barney,and -passed unanimously. V.REQUESTS TO CALL FOR BIDS None VI.REFERRALS FROM COMMISSIONS ORDINANCE -BUILDING PERMITS ON UNPLATTED PROPERTY A letter from Stan Bech,City Planner,was read which stated that the Planning Commission recommended that the ordinance granting building permits on unplatted property be approved. Mr. Hill wanted to know if Gull Industries and Mike's Rental would be allowed to build on unplatted property if this ordinance was passed,and Mr.Bech stated that the ordinance would be effective five days after publication and they would be allowed to build. The ordinance amending Section 3.4.08 of the Moses Lake City Code titled Building Permits - Unplatted Areas,was read by title only. Mr.Moe moved that the ordinance be adopted,seconded by Mr.Skaug,and passed unanimously. 2436 CITY COUNCIL MINUTES:9/28/76*Page 3 RESOLUTION -REQUEST TO BUILD O^TJNPLATTED PROPERTY -GULL INDUSTRIES This resolution was not considered because the adoption of the ordinance permitting /"** building on unplatted property made it unnecessary. RESOLUTION -REQUEST TO BUILD ON UNPLATTED PROPERTY -MIKE'S RENTAL This resolution was not considered because the adoption of the ordinance permitting //**'' building on unplatted property made it unnecessary. FINAL PLAT -COLUMBIA BASIN CENTER A letter from Stan Bech,City Planner,was read which stated that the Planning //** Commission recommended that the Columbia Basin Center Plat be approved as final. Mr. Hill moved that the final plat be approved with the stipulation that all appropriate city platting fees be paid and that the $100,000 letter of credit be released upon receipt of completed utility drawings,seconded by Mr.Johnson,and passed unanimously. PRELIMINARY PLATS -MOORE PLAT -CHAUSSEE ADDITION PLAT -EAST BROADWAY INDUSTRIAL PLAT -FRANZ PLAT — A letter from Stan Bech,City Planner,was read which stated that the Planning Commission recommended that the above preliminary plats be approved. Mr. Bech explained each of the plats to the Council. Mr. Hill moved that October 12 be set as the date to consider these preliminary plats,seconded by Mr.Barney,and passed unanimously. SPECIAL USE PERMIT -ROBERT STRAIT _A letter from Stan Bech,City Planner,was read which stated that the Planning Commission recommended that a Special Use Permit be granted Robert Strait to keep cattle on his property until such time as the cattle become a nuisance to the neighborhood. Mr. Bech stated that four protest letters had been received. Mr. Strait stated that at the present time he has two calves and one horse.He wants these cattle to help keep the weeds down and the grass at an acceptable level. Mr.Johnons moved that the Special Use Permit be granted until such time as the cattle become a nuisance to the neighborhood,seconded by Mr.Moe,and passed unanimously. VII.OTHER ITEMS FOR COUNCIL CONSIDERATION None VIII.COUNCIL QUESTIONS AND COMMENTS Mr.Skaug suggested that the service groups in town be contacted on the Community Development Block Grants so that they could present their ideas and suggestions at the next Public Hearing on this item. IX.CITY MANAGER REPORTS AND COMMENTS Mr. Waggener stated that the Public Works Department has scheduled Thursday, September 30, for a Public Hearing to be held at Knolls Vista School to discuss the possibility of L.I.D.'s in this area. The Regional Meeting of the Association of Washington Cities will be held in Quincy on October 4 at 6 p.m. at the Turf Cafe. There is a Study Session set with the Planning Commission on Thursday, October 7, to review the proposed zoning ordinance. Mr.Waggener stated that the staff was prepared to continue the tour of City facilities if the Council wishes. He suggested that tours might be taken of the City Hall,Community Development,Park and Recreation, Public Works, Fire, Police, and Sewage Treatment Plant. Mr. Hill suggested that the public be invited to tour the Police Facilities.It was decided to have a tour on Wednesday,October 6,at 8 a.m., starting at City Hall.
