CITY COUNCIL MEETING -REGULAR SESSION November 17, 1976
CITY HALL -COUNCIL ROOM 8 P.M.
Members Present:Eric Skaug,Jim Barney,Kent Jones,Bill Moe, Norm Johnson,and
Don Swanson.Absent:Bob Hill.
The meeting was called to order at 8 p.m.by Mr.Swanson and approval of the minutes
of the meeting of November 9 was called for.Mr. Jones moved that the minutes be
approved as submitted,seconded by Mr.Johnson,and passed unanimously.

IV.ORDINANCES AND RESOLUTIONS
ORDINANCE -1976 UNIFORM BUILDING CODE -SECOND READING ;as6>
A letter from Mr.Waggener,City Manager,was read which requested the adoption
of the 1976 Uniform Building Code,the 1976 Uniform Plumbing Code,the 1975 National
Electrical Code, and the 1976 Fire Code.
The ordinance repealing existing Chapter 3.2 of the Moses Lake City Code entitled
"Uniform Building Code" and enacting a new Chapter 3.2 of the Moses Lake City Code
to be entitled "Uniform Building Code"by adopting the 1976 International Conference
of Building Officials Codes and their appendices was read by title only.
Robert Kimball,Building Inspector,stated that Section 106 of this code gives him
the authority to use his judgment in those areas that are not specifically spelled
out in the code.
Mr.Skaug moved that the ordinance be adopted,seconded by Mr.Jones,and passed
unanimously.
ORDINANCE -1976 UNIFORM PLUMBING CODE -SECOND READING
The ordinance repealing existing Chapter 3.14 of the Moses Lake City Code entitled
"Plumbing Code"and enacting a new Chapter 3.14 of the Moses Lake City Code to be
entitled "Plumbing Code"by adopting the 1976 edition of the International Association
of Plumbing and Mechanical Officials Uniform Plumbing Code was read by title only.
Robert Kimball, Building Inspector, stated that this code now has a section that
gives him the authority to use his judgment in areas that are not specified by the
code. He stated that the rate schedule has been changed and some clean out require
ments have also been changed.
Mr. Johnson moved that the ordinance be adopted, seconded by Mr. Barney, and passed
unanimously.
ORDINANCE -1975 NATIONAL ELECTRICAL CODE -SECOND READING
The ordinance repealing Chapter 3.16 of the Moses Lake Municipal Code,entitled /0^3dz>
"Electrical Code"by adopting the 1975 edition of the National Electrical Code was
read by title only.
Robert Kimball,Building Inspector,stated that requirements on depths on direct
burial and the installation of swimming pools have been changed.
Mr.Jones moved that the ordinance be adopted,seconded by Mr.Skaug,and passed
unanimously.

ORDINANCE -1976 FIRE CODE -SECOND READING
The ordinance repealing existing Chapter 3.32 (Ordinance No.715)of the City Code
and enacting a new Chapter 3.32 referred to as the "Fire Code"by adopting the 1976
edition of the Uniform Fire Code, except as deleted, modified, or amended by this
ordinance was read by title only.
Mr.Barney moved that the ordinance be adopted, seconded by Mr. Jones, and passed
unanimously.
ORDINANCE -JEFFERSON STREET L.I.D.#34
A letter from Jerry Fay,Public Works Director,was read which stated that an
ordinance had been created for L.I.D.#34 for the improvement of Jefferson,Brown,
and State Streets.
The ordinance ordering the improvement of Jefferson Avenue by grading, graveling,
construction and installing side lateral sewer connections,curbs,sidewalks,
asphaltic concrete pavement and storm drainage in accordance with Resolution No.
782 of the City Council of the City of Moses Lake,Washington;establishing Local
Improvement District No. 34 and providing the method of assessment in said district;
providing that payment for said improvement be made by special assessments upon
property in said district payable by the mode of "Payment by Bonds";and providing
for the issuance and sale of Local Improvement District warrants redeemable in cash
and Local Improvement District bonds was read by title only.
Mr. Skaug moved that the ordinance be adopted,seconded by Mr. Jones, and passed
unanimously.
ORDINANCE -ENVIRONMENTAL POLICY REGULATIONS -FIRST READING
A letter from Stan Bech, City Planner, was read which stated that the Department
of Ecology has prepared a model ordinance which will enable the City of Moses Lake
to adopt the State Environmental Policy Act Guidelines by reference and that the
Planning Commission recommended that the Environmental Policy Regulations Ordinance
be approved.
Mr. Waggener stated that Mr. Bech was out of town and suggested that any detail
questions could be answered by him at the second reading. He suggested that the
address of the City of Moses Lake's SEPA public information center,which is 316
South Chestnut, and the phone number be deleted so that if either should change,
the ordinance would not have to be amended.
The ordinance repealing Chapter 3.23 of the Moses Lake City Code by adopting by
reference certain sections of the State Environmental Policy Act Guidelines and
amending the City of Moses Lake's Environmental Policy Regulations accordingly
was read by title only.
Mr. Jones wanted to know how this varies from what is currently being done. Mr.
Waggener stated that in talking with Mr.Bech that it was his understanding that
it is basically what we are doing now.
Mr.Skaug wanted to know if the Planning Commission did not require an Environmental
Impact Statement if the City Council could require one.Mr.Waggener stated that
it was his understanding that either the Planning Commission or the City Council
could request one. This was confirmed by Mr. Acres.
Mr.Jones moved that the first reading of the ordinance be adopted with the change
as suggested by Mr.Waggener,seconded by Mr.Johnson,and passed unanimously.

VI.REFERRALS FROM COMMISSIONS
LLOYD'S FIRST ADDITION -PRELIMINARY PLAT
A letter from Stan Bech,City Planner,was read which stated that the Planning //**^
Commission recommended approval of the Lloyd's First Addition Preliminary Plat
with the following minimum utility requirements:
1.Installation of an eight inch water main from Lakeshore Drive to the southeast
limit of the plat, approximately 980 feet.
2.Installation of a six inch water main on Muriel Lane,approximately 600 feet.
3.Installation of two fire hydrants.
4.Minimum grading and graveling of a thirty foot road dedication on the southern
boundary of the plat and a sixty foot right-of-way for Muriel Lane.
Ron Baker,Engineer,stated that the 980 feet of eight inch water main should be
580 feet.
Mr.Skaug wanted to know if Mr.Lloyd planned to do any street construction since
he is only required to grade and gravel his streets.Mr.Lloyd stated that he would
meet the city requirements.
Mr.Jones moved that the preliminary plat be accepted with the miniumum utility
requirements as specified,seconded by Mr.Skaug,and passed unanimously.
VII.OTHER ITEMS FOR COUNCIL CONSIDERATION
1977 PRELIMINARY BUDGET
Mr.Swanson suggested that Mr.Waggener summarize his letter of transmittal for /O/O
the Council and then have the Council set two study sessions to go over the budget
instead of trying to go into it now.
Monday,November 22,at 7:30 p.m.,was set for the first study session on the budget.
Mr.Waggener summarized his letter to the City Council regarding the budget.He
stated that xone change to be made is that the total city budget for 1977 should be
$5,650,690.This-changes the net toal for 1977 to $4,483,030 and the difference
to 1%.-"
CIVIC CENTER COMPLEX -SELECTION OF ARCHITECT
A.4etter from Mr.Waggener,City Manger,was read which stated that since the bond //SO
issue for the Civic Center had failed that the City Council may now wish to proceed
with the Police facility only,utilizing the $600,000 in the cumulative reserve
fund. If so, it is necessary to select an architect to develop plans and specifica
tions for bids. He wished to know how the Council wanted to proceed on this.
There was considerable discussion by the Council.
Mr. Swanson moved that the City staff be directed to draw up an architect selection
procedure to be presented to architects for building and designing a Police and
Court facility,seconded by Mr. Moe, and passed with Mr. Johnson opposed.
ACCEPTANCE OF WORK -STREET RESURFACING
A letter from Jerry Fay,Public Works Director,was read which stated that McAtee '&'7
&Heathe has completed all work prescribed under Contract 76-12,Street Resurfacing
for a total cost of $26,233.55,and recommending that the work be accepted and the
thirty day lien period be entered into.
Mr.Fay stated that the actual figure for the project should be $29,148.21.
Mr.Skaug moved that the work be accepted and the thirty day lien period be entered
into,seconded by Mr.Jones,and passed unanimously.

VIII.COUNCIL QUESTIONS AND COMMENTS
Mr. Skaug wanted to know if anything had been done about the Clover Drive problem
brought up by Mrs.Chatterton.Mr. Fay stated that the State had indicated that
consideration would have to be given in their budget. Mr. Skaug recommended that
this be followed up with a letter.
A letter from Don Swanson,Mayor, was read which requested Council confirmation
of the appointment of Norma Gallagher as a member of the Community Action Council
and Pat Lightel as alternate.
Mr Jones moved that the appointments be confirmed, seconded by Mr. Johnson, and
passed unanimously.
Mr. Barney stated that he had received some calls on the zone change on Marina
Drive.This was changed from R-1 to R-3.He wanted to know if any written protests
had been recieved. Mr.Waggener stated that he had received word from two of the
property owners who were not happy with the present zoning and wanting to have it
changed back to R-1.
