CITY COUNCIL MEETING -REGULAR SESSION March 22,1977
CITY HALL -COUNCIL ROOM 8 P.M.
Members Present:Don Swanson,Kent Jones,Bill Moe,Jim Barney, and Norm Johnson.
Absent:Bob Hill and Eric Skaug
The meeting was called to order by Mayor Don Swanson at 8 p.m.
Mr. Moe moved that the minutes of the meeting of March 15 be approved as submitted,
seconded by Mr. Johnson, and passed unanimously.

Mr.Johnson moved that the bills be approved as submitted,seconded by Mr.Jones,and
passed unanimously.Warrants 1750 to 1873 were approved for payment.

COMMUNICATION -W.M.FAGER
A letter from Bill and Rome Fager was read which commended the police force for saluting
the flag during a funeral procession.
Mr.Swanson recommended that Police Chief Baker commend his force for this action.Mr.
Johnson suggested that the letter be submitted to the newspaper for publication.This
was agreeable to the Council.
ARCHITECT SCHEMATIC PRESENTATION -POLICE/COURT/COUNCIL FACILITY

Mr. Waggener, City Manager, presented the schematic design documents from the architect
which includes drawings,outline specifications,and estimates of probable construction
costs.The Council set Tuesday,March 29,at 2 p.m. at the Library Auditorium for the
Council, County Commissioners, and staff to study this proposal.

ORDINANCES -CODE REVISION -FIRST READINGS

A letter from Pat Acres,City Attorney,was read which stated that a series of ordinances
were being presented to reorganize Title I of the City Code.
n ORDINANCE -MAYOR/COUNCIL POWERS AND DUTIES AND COUNCIL MEETINGS(h ;
V*Mr. Waggener,City Manager, informed the Council that the Museum Committee, the Airport
Commission,and the Beautification Commission were being abandoned under this ordinance
as they are no longer functioning bodies. He stated that under this new ordinance
a mayor pro tern would be selected to act for the duration of the mayor's absence,
and that a new item to the agenda,the consent agenda,was for the purpose of grouping
routine items together and passing them with one motion.
The ordinance relating to the Mayor and Council powers,duties,and meetings,and repealing
Chapter 1.2 of the Moses Lake City Code was read by title only.
Mr.Jones moved that the first reading of the ordinance be adopted,seconded by Mr.
Johnson.
Mr. Jones wanted to know why the Mayor would not appoint the members of the Civil
Service Commission Board also. Mr.Acres stated that it was state statute that the
City Manager appoint all members to this Board.
Mr. Waggener stated that it was state statute that all advisory boards would be appointed
by the Council and administrative boards would be appointed by the City Manager.
The motion passed unanimously.
/ORDINANCE -CITY MANAGER AND CITY DEPARTMENTS; ;
Y The ordinance relating to the administration of the city,creating departments,offices,
and positions of employment, determining the powers and duties thereof and repealing
certain inconsistant chapters of Title 1 of the Moses Lake City Code was read by title
only.
Mr.Jones moved that the first reading of the ordinance be adopted,seconded by Mr.
Barney,and passed unanimously.
ORDINANCE -EMERGENCY SERVICES
The ordinance repealing Chapter 1.8 of the Moses Lake City Code entitled "Municipal
Defense Commission"and enacting a new Chapter 1.13 entitled "Moses Lake Division of
Emergency Services"was read by title only.
Mr.Moe moved that the first reading of the ordinance be adopted,seconded by Mr. Jones,
and passed unanimously.
ORDINANCE -POLICE RESERVES
The ordinance repealing Chapter 1.19 of the Moses Lake City Code entitled "Reserve
Police"and enacting a new Chapter 1.19 entitled "Police Reserves"was read by title
only.
There was some discussion about the Reserves by the Council.
Mr.Moe moved that the first reading of the ordinance be adopted,seconded by Mr.Johns
and passed unanimously.
ORDINANCE -EQUIPMENT RENTAL FUND
r\Y The ordinance repealing existing Chapter 1.21 of the Moses Lake City Code entitled "City
\Shop Department"and enacting a new Chapter 1.21 entitled "Equipment Rental Fund"was
read by title only.
Mr. Barney moved that the first reading of the ordinance be adopted,seconded by Mr.
Jones, and passed unanimously.

ORDINANCE -AMENDING CHAPTER 1.10 (PLANNING COMMISSION)-AND REPEALING CHAPTERS 1.5
AND 1.11 /Q<fA
The ordinance amending existing Chapter 1.10 entitled "Planning Commission" and repealing
Chapter 1.5 entitled "Museum Commission"and Chapter 1.11 entitled "Beautification
Advisory Commission"was read by title only.
There was some discussion by the Council.
\Mr. Jones moved that the first reading of the ordinance be adopted, seconded by Mr.
Johnson,and passed unanimously.
RESOLUTION AND ORDINANCE -SALE OF CITY OWNED PROPERTY -UNITED BUILDERS

A letter from Mr.Waggener,City Manager,was read which stated that a Real Estate
Purchase and Sale Agreement has been received from United Builders of Washington to
purchase Capistrano Park,Lot 12,Block 4.
Mr. Moe moved that the resolution authorizing the sale of real estate to United Builders
of Washington,Inc. be adopted,seconded by Mr. Jones,and passed unanimously.
The ordinance providing for the conveyance of certain land of the City of Moses Lake
pursuant to resolution heretofore entered was read by title only.
Mr.Moe moved that the ordinance be adopted,seconded by Mr.Johnson,and passed
unanimously.
RESOLUTION -LOOP DRIVE L.I.D.'-SIDEWALKS -SETTING PUBLIC HEARING

A letter from Jerry Fay,Public Works Director,was read which requested the resolution
establishing the Loop Drive L.I.D. and setting the Public Hearing for April 19 be adopted.
The resolution of the City Council of the City of Moses Lake declaring its intention
to improve the area in the Knolls Vista area adjacent to Lot 1 of Knolls Vista #7 Addition,
Lot 21 of Knolls Vista #13 Addition, and Lots 1 through 29 of Knolls Vista #12 Addition
by constructing concrete sidewalk and to create a Local Improvement District to assess
the cost and expense of said improvement against properties in such district specially
benefited thereby, and notifying all persons who may object to said improvement to appear
and present their objections at a regular meeting of the City Council to be held on
April 19,1977 was read by title only.
Mr.Johnson moved that the resolution be adopted,seconded by Mr. Moe, and passed with
Mr.Jones abstaining.
RESOLUTION -CRESTMONT DRIVE L.I.D.-STREET AND SIDEWALKS -SETTING PUBLIC HEARING Jr\Q>Q
A letter from Jerry Fay,Public Works Director,was read which requested the resolution
establishing the Crestmont Drive L.I.D.and setting a Public Hearing for April 19 be
adopted.
The resolution of the City Council of the City of Moses Lake declaring its intention
to improve the Montlake area on Crestmont Drive adjacent to Lots 22 through 31 of Montlake
Addition #2 and Lots 21 through 23 of Montlake Addition #3 by grading,graveling,con
structing and installing curbs,sidewalks,sewer side laterals,asphalt concrete pavement
and storm drainage and to create a Local Improvement District to assess the cost and
expense of said improvements against properties in such district specially benefited
thereby,and notifying all persons who may object to said improvement to appear and
present their objections at a regular meeting of the City Council to be held on April
19,1977 was read by title only.
Mr Johnson moved that the resolution be adopted,seconded by Mr.Jones,and passed
unanimously.

REQUEST FOR STUDY SESSION -WATER/SEWER RATES
\^y A letter from Jerry Fay,Public Works Director,was read which requested a study session
be set to review needed water and sewer projects due to the continued development of
Moses Lake.
The Council set Tuesday,March 29 at 8 p.m.for a study session.
