Members Present:Don Swanson,Kent Jones,Robert Hill,Jim Barney,Norm Johnson,
Bill Moe,.and Eric Skaug.
The meeting was called to order by Mayor Don Swanson at 8 p.m.
Mr. Hill moved that the minutes of the meeting of April 12 be approved as submitted,
seconded by Mr.Jones,and passed unanimously.

PUBLIC HEARING -LOOP DRIVE L.I.D.
The Public Hearing was opened./Ov /
Jerry Fay,Public Works Director,went over the L.I.D.procedure for the Council and
citizens.
Faye Maslen,719 Loop, and Harold Thompson,725 Loop,stated that they were in favor
of this L.I.D.
There being no further comments,the public response was closed.
It was pointed out that there is only a 20%protest on this L.I.D.
Mr.Johnson moved that the Public Hearing be closed,seconded by Mr. Skaug, and
passed unanimously.
Mr. Hill moved that the staff be authorized to prepare an ordinance for the Loop
Drive L.I.D.,seconded by Mr. Jones, and passed unanimously.
PUBLIC HEARING -CRESTMONT DRIVE L.I.D.
Jerry Fay,Public Works Director,went over the L.I.D. for the Council and citizens.x
He stated that no protests have been received.
The Public Hearing was opened.
There being no comments,the public response was closed.
Mr.Barney moved that the Public Hearing be closed,seconded by Mr.Jones,and passed
unanimously.
Mr.Jones moved that the staff be authorized to prepare an ordinance for the Crestmont
Drive L.I.D.,seconded by Mr.Barney,and passed unanimously.
COMMUNICATION -CERTIFICATE OF APPRECIATION -PARK AND RECREATION DEPARTMENT

A letter from Velda Shallenberger of the National Water Safety Congress was read which
stated that the Park and Recreation Department has been presented an Appreciation
Award for its efforts to further water safety in Moses Lake.

background on the organization,and then presented the award to Cecil Lee,Park and
Recreation Director.

ORDINANCE -CONSTRUCTION AND INTERPRETATION OF ORDINANCES -SECOND READING
^The ordinance relating to construction and interpretation of ordinances of the City
of Moses Lake and the Moses Lake City Code was read by title only.

ORDINANCE -PENALTY PROVISIONS -SECOND READING

The ordinance repealing and/or amending existing penalty provisions of the Moses Lake
City Code and enacting a new general penalty provision applicable to the ordinances
of the City of Moses Lake and the Moses Lake City Code in its entirety,was read by
title only.
Mr. Hill moved that the second reading of the ordinance be adopted,seconded by Mr.
Johnson,and passed unanimously.
ORDINANCE -RETIREMENT SYSTEM -SECOND READING
The ordinance repealing Chapter 1.34 of the Moses Lake City Code entitled "Pension,
Relief, Disability, and Retirement" and enacting a new Chapter 1.34 entitled "Public
Employees Retirement System"was read by title only.
Mr.Jones moved that the second reading of the ordinance be adopted,seconded by Mr.
Skaug,and passed unanimously.
ORDINANCE -COMMUNITY STREET AND CONSTRUCTION STANDARDS -SECOND READING
The ordinance repealing Chapter 2.1 of the Moses Lake Municipal Code entitled,"Unifom
Community Standards"and enacting a new Chapter 2.1 entitled "Community Street and
Utility Standards",by adopting by reference the Standard Specifications for Municipal
Public Works Construction of the Washington State Chapter of the American Public Works
Association,published in 1977 and making amendments thereto was read by title only.
Mr.Barney moved that the second reading of the ordinance be adopted,seconded by Mr.
Jones,and passed unanimously.
ORDINANCE -REPEALING CHAPTERS 3.36 AND 3.38 (FIRE HAZARDS)-SECOND READING
An ordinance repealing Chapter 3.36 entitled "Fire Hazards - Nuisance" and Chapter
3.38 entitled "Transporting Flammable Liquids" was read by title only.
Mr.Skaug moved that the second reading of the ordinance be adopted,seconded by Mr.
Jones,and passed unanimously.
ORDINANCE -REPEALING CHAPTERS 3.6 AND AMENDING CHAPTER 3.15 (GRADES) -SECOND READING
The ordinance repealing Chapter 3.6 entitled "Grades",and amending Chapter 3.15 entitled
"Sewer -Construction and Use" by repealing those sections having the subchapter heading
"Private Use"was read by title only.
Mr.Hill moved that the second reading of the ordinance be adopted,seconded by Mr.
Johnson, and passed unanimously.
ORDINANCE -REPEALING CHAPTER 9.1 (GAS SERVICE) -SECOND READING

ORDINANCE -ROADS AND BRIDGES -SECOND READING -,.£S30
The ordinance relating to Title 4 of the Moses Lake City Code,entitled "Sidewalks
and Streets"repealing Chapter 4.4 "Roads and Bridges -Standard Specifications"and
amending Chapter 4.10 "Excavations and Obstructions"was read by title only.
Mr.Hill moved that the second reading of the ordinance be adopted,seconded by Mr.
Johnson,and passed unanimously.
ORDINANCE -AMBULANCES -SECOND READING
The ordinance repealing Chapter 6.6 of the Moses Lake City Code entitled "Ambulances"
was read by title only.

ORDINANCE -SECOND HAND DEALERS -SECOND READING
The ordinance repealing Section 6.28.08,6.28.16,6.28.32,and 6.28.36 of Chapter /u^

Section 6.28.16 and 6.28.32 and amending Section 6.28.12 was read by title only.
Mr. Skaug moved that the second reading of the ordinance be adopted,seconded by Mr.

The ordinance amending Section 6.32.08,6.32.12,and 6.32.88 and repealing Section

Mr.Hill moved that the first reading of the ordinance be adopted,seconded by Mr.
Jones,and passed unanimously.
ORDINANCE -SOLICITORS -FIRST READING
The ordinance amending Sections 6.30.20,6.30.28,and 6.30.36 of Chapter 6.30 of the °^
Moses Lake City Code entitled "Solicitors",updating the standards for issuance of
a permit was read by title only.
Mr.Johnson moved that the first reading of the ordinance be adopted,seconded by
Mr.Jones,and passed unanimously.
ORDINANCE -PRIVATE DETECTIVES -FIRST READING
The ordinance amending Section 6.20.20 of Chapter 6.20,entitled "Private Detectives",
to update the standards for issuance of a license was read by title only.
Mr. Hill moved that the first reading of the ordinance be adopted,seconded by
Mr.Jones,and passed unanimously.

\ORDINANCE -MARINA DRIVE/GIBBY ROAD L.I.D.-FIRST READING
\j>A letter from Jerry Fay, Public Works Director, was read which presented the ordinance

for the L.I.D.at Marina Drive and Gibby Road.
Mr.Fay went over the project for the Council.
There was some discussion by the Council about the various problems connected with
this L.I.D.
The ordinance ordering the improvement of Marina Drive by construction and installing
sewer mains connecting to existing facilities on Gibby Road and on Marina Drive, in >
accordance with Resolution 810 of the City Council of the City of Moses Lake,Washington,
establishing Local Improvement District No.37;providing the method of assessment in
said district;providing that payment for said improvement be made by special assess
ments upon property in said district payable by the mode of "Payment of Bonds";and
providing for the issuance and sale of Local Improvement District warrants redeemable
in cash and Local Improvement District bonds was read by title only.
Mr. Moe moved that the first reading of the ordinance be adopted,seconded by Mr.
Johnson,and passed unanimously.
RESOLUTION -RESERVOIR #4 SITE
A letter from Jerry Fay,Public Works Director, was read which requested the Council
accept real estate from the Moses Lake School District for the Reservoir #4 site.
Mr.Fay stated that the School District had come up with a cost of $1,900 which he
felt was reasonable for the site.
The resolution accepting the conveyance of real estate to the City of Moses Lake from
Moses Lake School District No. 161 was read by title only.
Mr. Jones moved that the resolution be adopted,seconded by Mr. Johnson, and passed
unanimously.(
RESOLUTION -SETTING DATE FOR PUBLIC HEARING -GAYLORD AND TAMARACK L.I.D.1
A letter from Jerry Fay, Public Works Director, was read which requested the passage
of a resolution setting a Public Hearing date for L.I.D.'s on Tamarack Lane and
Gaylord Place.
Mr.Moe wanted to know why sidewalks were not being required on these L.I.D.'s.
Mr.Fay stated that no sidewalks were desired on Gaylord Place or Tamarack Lane
because it was felt they would not be necessary for the movement of pedestrian
traffic.
The resolution of the City Council of the City of Moses Lake declaring its intention
to improve the lower Peninsula area on Tamarack Lane adjacent to Lots 1 through 13
of Penvista Addition and on Gaylord Place adjacent to Lots 1 through 6 of Gaylord
Manor Addition by grading,graveling,constructing and installing curbs, sewer side
laterals,asphalt concrete pavement and storm drainage and to create a Local Improvement
District to assess the cost and expense of said improvements against properties in such
district specially benefited thereby and notifying all persons who may object to
said improvement to appear and present their objections at a regular meeting of
the City Council to be held on May 17, 1977 was read by title only.
Mr.Hill moved that the resolution be adopted,seconded by Mr.Barney.
Mr.Moe felt that the Council should establish a continuity of sidewalk development
and felt that the arguments against sidewalks were not valid.
Mr.Skaug also felt that sidewalks should be required.
The motion passed with Mr.Moe and Mr.Skaug opposed.

VI.REQUESTS TO CALL FOR BIDS
PICKUPS
A letter from M.G.McLanahan,Assistant Public Works Director,was read which /O/7
requested permission to advertise for bids for three pickups.This request was
presented to the Council previously on April 12 for two pickups and the bids and
specifications were prepared for three pickups.The request is being modified
so it will be compatible with the specifications that have been prepared.
Mr. Moe moved that staff be directed to advertise for bids for three pickups,seconded
by Mr. Jones, and passed unanimously.
VII.REFERRALS FROM COMMISSIONS
CONDITIONAL USE PERMIT -DEAN FORD
A letter from Stan Bech,City Planner,was read which stated that the Planning
Commission recommended that the City Council grant Dean Ford a Conditional Use Permit
for the development of a 74-unit mobile home park on Battery Orchard Tracts #52,#55,
and a portion of #54.
Mr.Hill moved that the Conditional Use Permit be granted with the following conditions:
1.That 8"water and sewer mains be extended from Peninsula Drive to Wapato Drive.
2.That the road ways within the park be paved to a width of 28 feet,permitting
on-street parking on one side of the street only.
seconded by Mr. Johnson, and passed unanimously.
VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION
DIVISION STREET RESURFACING
A letter from Chester Waggener,City Manager,and an accompanying letter from Jerry
Fay,Public Works Director,indicated that the proposed resurfacing of Division
Street from Seventh Avenue to Nelson Road would cost about $109,000.City funds in
the amount of $49,000 are available as a Capital contingency under the Miscellaneous
Services portion of the General Fund, and an ordinance transferring funds to the
Street Fund would be necessary. The remaining $60,000 of the project cost is
proposed to come from FAM funds.
Mr. Fay explained the project to the Council.
There was some discussion by the Council.
Mr.Hill moved that staff proceed with the resurfacing,seconded by Mr.Jones,and
passed unanimously.
NATIONAL SAFETY COUNCIL TRAFFIC SAFETY GRANT
A letter from Jerry Fay,Public Works Director,was read which stated that Moses ///~7
Lake has been selected to receive a grant of $2,300 under the Highway Safety Program
Analysis.This program consists of an in-depth review of the traffic safety needs,
establishing goals and objectives,and outlining procedures for implementation.The
letter requested the City Council to authorize the City Manager to accept this grant.
Mr.Moe moved that Mr.Waggener accept the grant,seconded by Mr. Jones, and passed
unanimously.'

IX.COUNCIL QUESTIONS AND COMMENTS
/CBD PARKING - LYLE STEWART,CONSULTANT
April 19,1977
f Mr.Moe stated that he felt the Council should take a leadership role in this problem
and attempt to draw people to the downtown area. He felt that Mr.Stewart should be
encouraged to come back to explain further.
Mr. Swanson stated that the Council felt it should be referred back to the people
downtown before inviting Mr.Stewart back.
X.CITY MANAGER REPORTS AND COMMENTS

ENERGY CONSERVATION -STREET LIGHT REDUCTION
Jerry Fay,Public Works Director,presented a map showing the 80 some street lights
which would be turned off.This is approximately 9%of the street lights in the city.
WATER AND SEWER RATE ORDINANCE
Mr.Waggener,City Manager,stated that the Water and Sewer Rate Ordinance would be
presented to the Council at the next meeting but that he,Mr.Fay,and Mr.Acres
would be out of town.He suggested that a study session be set for May 3.
The meeting was adjourned at 9:30 p.m.
