CITY HALL -COUNCIL ROOM 8 p.m.
Members Present:Don Swanson,Kent Jones,Robert Hill,Jim Barney,Norm Johnson,
Eric Skaug,and Bill Moe.
i The meeting was called to order at 8 p.m.by Mayor Don Swanson.
I.,J Mr.Hill stated that he would like his request for a written report on the Police
Investigation to be included in the minutes.This request was made at the time
additional payment was requested for Pat Acres for his internal investigation of
the Police Department.
Mr. Hill moved that the minutes of the meeting of April 26 be approved as changed,
seconded by Mr. Johnson, and passed unanimously.

Mr. Skaug moved that the bills be paid, seconded by Mr.Barney,and passed with
Mr. Hill abstaining from voting for that portion of the bills to Pacific Northwest
Bell.Warrants 2085 to 2288 were approved for payment.

PUBLIC HEARING -BEAUMONT DRIVE L.I.D.-FINAL ASSESSMENT ROLL

Jerry Fay, Public Works Director, stated that during his final review of the assessment
roll he found that the engineering costs had not been distributed correctly to the
various lots and he requested that Council declare the assessment roll void and
authorize a new resolution establishing June 14 as the date for another public hearing.

Mr.Johnson moved that the assessment roll sent out be declared void,seconded by
Mr.Skaug,and passed unanimously.
Mr.Hill moved that a resolution be brought back to Council setting June 14 as
the date for a public hearing to consider the final assessment roll,seconded by
Mr. Johnson, and passed unanimously.
/PUBLIC HEARING -ORDINANCE -WATER/SEWER RATES (CITY)-SECOND READING

Jerry Fay,Public Works Director,went over the water/sewer rate study for the |
Council and citizens.
Mr.Dan Haight,515 N.Mattson Drive,stated that he was against the rate increase.
Mr.Jim Whitney,Association of Retired People,stated that the increase would
be hard on the senior citizens because many of them have vegetable gardens.
Mr. Ken Moos wanted to know if the residential sewer rate was based on water
consumption and Mr.Fay stated that only the commerical rate was based on consumption.
Mr.Charles Waldo stated that in Seattle it was only $2.80 for 600 cubic feet,and
that he was against the rate increase.
Carl Waring,304 Daley,wanted to know why the base was paying double the rate for
sewer the City was paying.Mr.Fay stated that the treatment plant at the base had
been improved and that when the City system is improved,then the rates will increase
in order to pay for the cost of maintenance and operation of the system.
Richard L.Ross,401 Offutt,wanted to know why the base residents pay more when
the Environmental Protection Agency paid 90%of the project,and questioned whether
the base was subsidizing the City system.Mr.Fay stated that the EPA mandates that
the City maintain the system and this mandates an increase in rates.There is a
co-mingling of funds,but there is no subsidizing.j-"^
Steve Shinn,426 Crestview Drive,stated that the rate at the base is justifiable,'
but he wondered if the City water system is subsidizing the sewer system.He
asked if the City is trying to pay for these projects in a three year period,
referring to the Knolls Vista project,Reservoir #2 and Reservoir #4. He also
questioned the cost of billing when the billing is made out on the same statement.
Lloyd Schmidt questioned why there was a cost increase of 10$,yet the minimum water
use was decreased by 100 cubic feet.
Neil Lucke, 1017 Gem, stated that if the rates were going to increase 25% that there
will also be an increase of brown lawns in the residential areas of 25%.
George Hochstatter, 615 So. Division, stated he was an avid gardener and would be
greatly affected by the water rate increase, and that he had heard a radio program
in which they suggested trimming trees and shrubs to conserve water.
An unidentified citizen who stated that he was from out of town was glad to see that
the City was holding this public town meeting,but asked Mr.Fay to answer the
question,"where is the growth coming from?",to which Mr.Fay answered that they
were not concerned where the growth is coming from,just with the fact that the growth
is occurring,and in trying to meet and anticipate that growth.
Pat Lightel requested that the Council take into consideration the people on fixed
income who cannot afford an increase in the water and sewer rates.
There being no further comments,the discussion by the citizens was closed.

Mr.Jones wanted to know how much of an increase would be given to a person using
approximately 750 cubic feet of water. Mr.Fay stated that it would be a little
over 10%.
Mr.Johnson stated that by cutting the basic water consumption from 500 cubic feet
to 400 cubic feet residents would be paying more for less water.
There was considerable discussion by the Council on the reduction of the water
consumption and what effect this would have.
Mr. Skaug stated that he felt this rate increase was necessary to supply funds for
J maintenance and operation of the system as well as funds for additonal needed capital
improvements.He suggested raising the base minimum from 400 cubic feet to 500 cubic
feet at a cost of $3.60.
The question of paying for capital improvements over long or short periods of time
was discussed.Mr.Fay stated that the rate increase would not cover the entire cost
of the projects in any case and additional funds would have to be found.
Mr. Hill moved that the Public Hearing be closed,seconded by Mr. Jones, and passed
unanimously.
The ordinance amending certain sections of Chapter 9.6 of the Moses Lake Code entitled
"Water and Sewer Rates"(City System)by increasing rates and modifying procedures
was read by title only.
Mr.Moe moved that the second reading of the ordinance be adopted.
Mr.Skaug stated that he would second the motion if Mr. Moe would accept an amendment
raising the minimum water usage to 500 cubic feet. Mr. Moe stated that he felt the
ordinance as presented would best suit the needs of the city.
The motion died for lack of a second.
Mr.Hill stated that he did not like the 22%to 25%increase in the rates as he
felt it put a burden on low and fixed income people.
Mr.Skaug moved that the ordinance be changed to 500 cubic feet at $3.60 and the
second reading adopted,seconded by Mr.Swanson.
Mr.Jones wanted to know who would be included in the change.Mr.Fay stated that
he felt nearly all households in Moses Lake would use in excess of 400 cubic feet
during the summer months.
The motion passed with Mr.Jones,Mr.Swanson,Mr. Skaug, and Mr. Barney voting
for and Mr. Moe, Mr. Hill, and Mr.Johnson voting against.
Mr. Fay wanted to know if this amendment would apply to the commercial rates also.
It was the consensus of the Council that it would.
PUBLIC HEARING -ORDINANCE -WATER/SEWER RATES (BASE) -SECOND READING

There being no comments from the citizens,the public response was closed.
Mr.Jones moved that the public hearing be closed,seconded by Mr.Johnson,and
passed unanimously.
The ordinance amending Chapter 9.10 of the Moses Lake City Code entitled "Water
and Sewer Rates and Regulations for Larson Air Force Base Property"by increasing
the water and sewer rates and modifying procedures was read by title only.
Mr.Skaug moved that the ordinance increasing water and sewer rates and modifying
procedures be approved with an increase from 400 cubic feet to 500 cubic feet under
the amount used,in both the residential and commercial water rates, seconded by
Mr.Swanson.

Mr.Hill wanted to know if the City is making money on the present rate schedule.
Mr.Fay stated that the City was making enough to maintain the present system.
He also stated that there is a tendency for people to decrease water consumption
when they go on meters for the first time and see exactly how much water they
are using. In this case, the City will be losing money when the base is metered
individually,but the rate increase would hold revenue at its current level.
The motion passed with Mr. Swanson, Mr. Skaug, Mr. Barney, and Mr. Jones voting for
and Mr. Hill, Mr. Johnson, and Mr.Moe voting against.
IV.ORDINANCES AND RESOLUTIONS

establishing Loop Drive LID #38.
The ordinance ordering street improvements in the Knolls Vista area adjacent to
Lot 1 of Knolls Vista #7 Addition,Lot 12 of Knolls Vista #13 Addition and Lots 1
through 29 of Knolls Vista #12 Addition by constructing concrete sidewalk in accord
ance with Resolution No.811 of the City Council of the City of Moses Lake,Washington;
establishing Local Improvement District No. 38 and providing the method of assessment
in said district;providing that payment for said improvement be made by special
assessments upon property in said district payable by the mode of "Payment by Bonds";
and providing for the issuance and sale of Local Improvement District warrants
redeemable in cash and Local Improvement District Bonds was read by title only.
Mr. Johnson moved that the second reading of the ordinance be adopted,seconded
by Mr.Skaug,and passed unanimously.

ORDINANCE -CRESTMONT DRIVE LID -SECOND READING
A letter from Jerry Fay,Public Works Director,was read which presented an ordinance
establishing Crestmont LID #39.
The ordinance ordering street improvements in the Montlake area on Crestmont Drive
adjacent to Lots 22 through 31 of Montlake Addition #2 and Lots 21 through 23 of the
proposed Montlake Addition #3 by grading,graveling,constructing and installing
curbs,sidewalks,sewer side laterals,asphalt concrete pavement and storm drainage
in accordance with Resolution No.812 of the City Council of the City of Moses Lake,
Washington;establishing Local Improvement District No.39 and providing the method
of assessment in said district;providing that payment for said improvement be made
by special assessments upon property in said district payable by the mode of "Payment
by Bonds"; and providing for the issuance and sale of Local Improvement District
warrants redeemable in cash and Local Improvement District bonds was read by title
only.
Mr.Hill moved that the second reading of the ordinance be adopted,seconded by
Mr.Jones,and passed unanimously.

POLICE/COUNCIL/JUSTICE COURT FACILITIES
A letter to Mr.G.Jeffrey Larsen,of Walker McGough,Foltz,Lyerla,was read which
stated the conclusions arrived at after a review of the drawings and effects of
budget reduction on the original schematic design.
The Council discussed the proposed changes in the design.

Mr.Hill moved that the schematic design that was revised on April 29 be approved
with the conclusions arrived at and cited in the letter dated May 10 addressed to
Mr. G. Jeffrey Larsen from the City Manager, seconded by Mr. Jones.
Mr.Jones expresssed concern about how much this project is going to cost and Mr.
Barney shared his concern.
The motion passed with Mr. Jones and Mr. Barney opposed.
VIII.COUNCIL QUESTIONS AND COMMENTS
VOTING DELEGATES -1977 AWC ANNUAL CONVENTION
A letter from Kent E.Swisher,Executive Director,was read which requested that
the city delegate persons to represent the city at the annual AWC Convention.
Mr.Waggener indicated that he was planning on attending the Convention.It was
the consensus of the Council that delegates be chosen at a later date.
IX.CITY MANAGER REPORTS AND COMMENTS

A letter from R.C.Bierma,Finance Director,was read which stated that Seattle Yg?j/
First National Bank was the low bidder on a "line of credit"of $500,000,pending^^/completion of LID's 29,30,31,33,34, 36,37,38,39,and 40.This bid is forJ^q-q
interim financing using registered warrants at an interest rate of 4.75%until jJ^jC

SAFE DRINKING WATER ACT
A letter from Jerry Fay,Public Works Director,was read which stated that the sc*OS
Federal Safe Drinking Water Act will become effective on June 27,1977.This act
should not have any significant effect on the operation of the water system.
Mr.Fay gave a presentation on the Safe Drinking Water Act to the Council.
E.R.G.-COUNCIL GOALS -MAY 14
Mr.Waggener,City Manager,reminded the Council of the workshop to be held on
Saturday,May 14 at the Hallmark Inn,starting at 8:30 a.m.The purpose of this
workshop is to discuss long and short range goals for the city.
MARINA DRIVE ZONING
Pat Acres,City Attorney,stated that there was an order entered this last week
dismissing the Marina Drive with prejudice.He stated that the term "with prejudice"
means that this action cannot be brought up again at a later date.
POLICE DEPARTMENT INTERNAL INVESTIGATION
Mr. Hill wanted to know when a report on the internal investigation of the Police
Department would be ready.Pat Acres,City Attorney,stated that he would be making
a report at the Council meeting on May 24.
BEAUMONT LID
A letter from P.K.Paulson was read which stated that the construction work done SOr3
last year in the area was very poor and suggested that a better job be done in the
future.
STREET LIGHTS
Mr.Barney wanted to know if anything further had been done on turning off the
street lights.M. G.McLanahan,Assistant Public Works Director,stated that he
will be meeting with Boyd Grant,PUD Manager,_on May 11 concerning this.
The meeting was adjourned at 10:30 p.m.
