CITY COUNCIL MEETING -REGULAR SESSION June 21,1977
CITY HALL -COUNCIL ROOM 8 p.m.
Members present:Don Swanson,Kent Jones,Jim Barney,Norm Johnson, Bob Hill, and
Eric Skaug. Absent:Bill Moe
The meeting was called to order at 8 p.m. by Mayor Don Swanson.
Mr.Jones requested that the minutes of the meeting of June 14,1977,show that ///^
he abstained from voting on the request for easement from Robert Holloway allowing
the encroachment of the outside sunscreen of the Taco Shop on city property. Mr.
Jones moved that the minutes of the meeting of June 14, 1977 be approved as amended,
seconded by Mr. Skaug, and passed unanimously.

Mr. Barney moved that the following items under the Consent Agenda be approved:

Mr.Jeff Webber of CH2M presented a report on the traffic survey in regard to the (Ol^f
consideration of a second lake crossing.
V.ORDINANCES AND RESOLUTIONS
ORDINANCE -AMENDING SHORT PLAT PROCEDURES -SECOND READING
A letter from Stan Bech,City Planner,was read which stated that the Planning /&<?'
Commission recommended that the ordinance amending the short plat section of the
Subdivision Ordinance be adopted.
The ordinance amending the Subdivision and Platting Ordinance of the City of Moses
Lake by changing Section 3.20.20.16 was read by title only.
Mr. Jones moved that the second reading of the ordinance be adopted,seconded by
Mr.Skaug,and passed unanimously.V

ORDINANCE -AMENDING MOBILE HOME PARK STREETS WIDTHS -SECOND READING
A9 A letter from Stan Bech,City Planner,was read which stated that the Planning
Commission recommended that the City Council adopt the ordinance amending Mobile
Home Park street widths.
The ordinance amending Chapter 3.24 of the Moses Lake City Code entitled Zoning
Code by changing the street widths required in Mobile Home Parks was read by
title only.
Mr.Johnson moved that the second reading of the ordinance be adopted,seconded
by Mr.Barney,and passed unanimously.

BEAUMONT DRIVE L.I.D.#29 -FINAL ASSESSMENT ROLL
[)Discussion on the Beaumont Drive LID #29 Final Assessment Roll was continued from
the meeting of June 14.
Mr.Barney stated that after looking at the rolled curbing in the disputed area
that he felt there was a definite problem with it. He suggested that the city
take the responsibility of seeing that this curbing gets fixed.
Jerry Fay, Public Works Director,stated that if the city takes the responsibility
to make the repair he felt the repairs could be made by cutting back into the curb
and lowering it.He stated that it would cost about $200 per location to repair
this curb.He suggested that the final assessment roll be passed as is and the
city bear the cost of repairing the curb.
Mr.Skaug moved that the final assessment roll be accepted,seconded by Mr.Hill,
and passed unanimously.
Mr. Johnson moved that the city bear the cost of correcting the curbing in Beaumont
Drive LID #29, seconded by Mr. Barney, and passed unanimously.

&a ANNEXATION REQUEST -DR.PENHALLURICK
Y A letter from Stan Bech,City Planner,was read which stated that the Council,at
their meeting on June 14,recommended that Dr.Penhallurick's annexation request
be considered at this meeting.
Mr.Bech stated that the Planning Commission had recommended that the area to be
annexed be zoned C-2,Limited Commercial,above the high water mark and the rest
of the area would be annexed under the Conservation Reclamation zone.He stated
that the existing city indebtedness consists of three General Obligation Bonds.
Mr. Hill moved that the annexation be accepted with the land to be zoned C-2, Limited
Commercial, and the assumption of all existing city indebtedness, seconded by Mr.
Johnson,and passed unanimously.
Pat Acres, City Attorney, wanted to know why a portion of ground under the lake
was also requested in the annexation.Ron Baker,Consulting Engineer,stated that {
Dr. Penhallurick claims deed to it prior to the time it was covered with water.

RESOLUTION -SETTING PUBLIC HEARING DATE -MONTLAKE ADDITION #3 L.I.D.

A letter from Jerry Fay,Public Works Director,was read which presented a resolution
establishing July 26, 1977 as the date for a Public Hearing on the Montlake #3 LID.
Mr. Jones stated that he felt the city was financing the developer in this case.
Mr.Hill stated that he agreed with Mr.Jones.
Mr.Barney stated that he felt this was an individual wanting to improve his develop
ment and he felt he should be given consideration.
Mr.Skaug stated that he was not in favor of this proposal.
Mr. Hill pointed out that this LID consists of only 2 property owners and one of
them owns 95%of the land.
There was some discussion by the Council on the pros and cons of this LID.
The resolution of the City Council of the City of Moses Lake declaring its intention
to improve the Montlake area on Crestmont Drive, Belmont Avenue and Beaumont Drive
adjacent to lots 1 through 20 and Lots 23 and 24 of Montlake addition #3 by grading,
graveling,constructing and installing curbs,sidewalks,sewer side laterals,asphalt
concrete pavement and storm drainage and to create a local improvement district to
assess the cost and expense of said improvements against properties in such district
specially benefited thereby and notifying all persons who may object to said improve
ment to appear and present their objections at a regular meeting of the City Council
to be held on July 26, 1977 was read by title only.
Mr.Hill moved that the Council not adopt the resolution,seconded by Mr.Johnson,
and passed with Mr. Barney opposed, and Mr. Swanson abstaining.
The resolution was not adopted.

X.CITY MANAGER REPORTS AND COMMENTS
SIDEWALKS
Stan Bech,City Planner,stated that the Planning Commission recommended very /Ov^>
strongly to the City Council that sidewalks be placed on all new developments,
LID's,cul de sacs,etc.
The meeting was adjourned at 8:45 p.m. .
