1977 06 28u 2563 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING -REGULAR SESSION June 28,1977 CITY HALL -COUNCIL ROOM 8 p.m. Members present:Don Swanson,Kent Jones,Norm Johnson,Bob Hill,Bill Moe,and Eric Skaug Absent:Jim Barney The meeting was called to order at 8 p.m. by Mayor Don Swanson. Mr. Hill moved that the minutes of the meeting of June 21 be approved as submitted, seconded by Mr.Jones,and passed unanimously. Warrants 2534 to 2642 were approved for payment. I.CITIZEN INPUT -i —-j Nancy Boyd requested permission from the Council to have two ice cream wagons at //J^ McCosh Park on the night of July 4 to sell ice cream.Mr.Waggener,City Manager,,)J/ stated that he and Cecil Lee, Park and Recreation Director, felt it would be an asset for that event. Mr.Johnson moved that permission be granted,seconded by Mr.Moe,and passed unanimously. Nancy Boyd also requested permission to run the wagons through Cascade Park on the weekends. Mr.Hill moved that permission be granted for this summer for the ice cream wagons to sell ice cream in Cascade Park on the weekends with the stipulation that this permission can be rescinded upon recommendation from the Park and Recreation Director, seconded by Mr.Johnson,and passed unanimously. II.CONSENT AGENDA Mr.Waggener,City Manager,stated that the Request to Call for Bids on the Meter Installation Program is being withdrawn from the agenda because a new law (HB 335) passed by the legislature prohibits the city from doing a job of over $5,000 with day labor.He stated that metering the base would cost approximately $200,000. 2564 ciTY COUNCIL MINUTES:2 June 28,1977 \\A letter from M.G.McLanahan,Assistant Public Works Director,was read which requested (^permission to advertise for bids for the replacement of a dump truck for the Public Works Department. Mr. Jones moved that permission be granted to advertise for bids for the dump truck, seconded by Mr.Johnson,and passed unanimously. III.CONSIDERATION OF BIDS None IV.PETITIONS,COMMUNICATIONS,AND PUBLIC HEARINGS PUBLIC HEARING -RESOLUTION -SIX YEAR STREET PROGRAM The public hearing was opened. A letter from Jerry Fay,Public Works Director, was read which presented the six year street program. Mr. Fay pointed out that the Division Street Overlay would not be done until next spring due to the paperwork required by the state because of the FAM funds being used for this project. There were no commments, so the public response was closed. Mr. Jones moved that the public hearing be closed,seconded by Mr. Johnson, and passed unanimously. The resolution adopting the Six Year Street Construction Program (1978 -1983) was read by title only. Mr. Jones moved that the resolution be adopted,seconded by Mr. Moe, and passed unanimously. PUBLIC HEARING -ORDINANCE -AMENDING 1977 BUDGET -SECOND READING A letter from R. C.Bierma,Finance Director, was read which explained the proposed amendment to the 1977 budget. The public hearing was opened. There were no comments,so the public response was closed. Mr. Moe moved that the public hearing be closed,seconded by Mr. Jones, and passed unanimously. The ordinance amending the original 1977 budget ordinance no. 795 to appropriate unanticipated revenues collected for contingency needs,and to revise fund for bike paths was read by title only. Mr. Jones moved that the second reading of the ordinance be adopted,seconded by Mr. Moe, and passed unanimously. COMMUNICATION -RETAIL TRADES DIVISION -CHAMBER OF COMMERCE y A letter from the Retail Trades Division was read which requested that Third Avenue from Alder to Ash Street and Division from Fourth Street to the alley behind Penneys be closed from 6 a.m.Friday July 22 until 7 p.m.Saturday,July 23 for the Annual Sidewalk Sale. Mr.Waggener,City Manager,stated that arrangements have been made for fire lanes so that fire protection is available. Mr.Hill moved that this request be granted,seconded by Mr.Johnson,and passed unanimously. 0/0 2565 CITY COUNCIL MINUTES:3 June 28,1977 COMMUNICATION -S.T.R. Mr.George Nordby of Stevens,Thompson,and Runyan gave a report on the progress that is being made in studying the possible alternatives for the sewerage facilities plan. V.ORDINANCES AND RESOLUTIONS No others VI.REQUESTS TO CALL FOR BIDS No others VII.REFERRALS FROM COMMISSIONS COCHRAN ADDITION PRELIMINARY PLAT A letter from Stan Bech,City Planner,was read which stated that the Planning //£LP Commission recommended that the plat be approved. Mr.Jones wanted to know how the sewer would be brought to the property.Mr. Bech stated that negotiations were being conducted with Eastern Washington Bank, Dr.Penhallurick,Mrs.Kvamme,and Mr.Cochran to coordinate the project at one time. He stated that there would be no problem of bonding for a sewer and letting him go to a septic tank if negotiations cannot be worked out at this time. There was considerable discussion by the Council on the possible extension of a sewer line to this property. Mr.Johnson moved that the Cochran Addition Preliminary Plat be approved with the following stipulations: 1.The lots shown need numbers 2.Note hatch marked area on Valley Road as street dedication 3.Show bearing on east boundary of Kvamme Addition as per legal description 4.Show distances on north boundary and east boundary of Kvamme Addition as per legal description 5.Submit utility drawings for proposed sewer facilities 6. 8"sewer main required on north property line seconded by Mr.Jones. Mr. Hill felt that Mr.Cochran should be required to construct a sewer line to his property. There was some discussion by the Council on the cost of the sewer line and the possibility that the various other owners may not be ready to develop their property at this time. Mr.Hill stated that the motion made no mention of a bond.Mr.Bech stated that the bond is an automatic requirement. Mr. Jones, Mr. Skaug, and Mr. Hill voted against the motion and Mr.Moe,Mr. Swanson,and Mr.Johnson voted for.The motion failed. Mr.Bech pointed out that since the Planning Commission's recommendation was not approved, a public hearing on this plat will have to be held. Mr.Johnson moved that a public hearing be set for July 12,1977,seconded by Mr.Jones,and passed with Mr.Skaug opposed as he will not be at that meeting. 2566 CITY COUNCIL MINUTES: 4 June 28, 1977 VON MARBOD PRELIMINARY PLAT *»A letter from Stan Bech, City Planner, was read which stated that the Planning Commission recommended that the Von Marbod Preliminary Plat be approved. Mr. Skaug wanted to know why Madison Avenue and State Street are required to be graded and graveled only.Mr.Bech stated that the existing dedicated right-of- way is only graded and graveled and this is in conformance with Block Conformity. Mr.Johnson moved that the Von Marbod Preliminary Plat be approved with the following f stipulations: 1.Letter from the developers of Swanson Addition to verify the reimbursement for utilities on State Street 2.Letter from School District #161 to verify the reimbursement for sewer on Nelson Road 3.Plan and profile of Madison Avenue 4.Dedication of Madison Avenue and State Street 5.Grade and gravel of Madison Avenue and State Street seconded by Mr. Jones, and passed unanimously. Mr. Skaug requested that the grading and graveling of streets within the city limits be brought up with the Planning Commission to consider the requirement that all streets within the city limits be paved. VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION None IX.COUNCIL QUESTIONS AND COMMENTS (', None I (•' X.CITY MANAGER REPORTS AND COMMENTS CITY PARTICIPATION IN SUBDIVIDER -INSTALLED UTILITIES -PUBLIC WORKS Jerry Fay,Public Works Director, gave a report to the Council on city participation in subdivider installed utilities when those utilities are larger than is necessary for the subdividers development. .O ANNEXATION OF THE BASE W Mr.Waggener,City Manager, stated that the base housing,Port of Moses Lake, and Big Bend Community College is being considered for annexation to the city. He stated that they have formed an ad hoc committee and have requested city represen tation. It was the consensus of the Council that Mr.Waggener and Mr.Jones represent the city on this committee. LONG TERM RECREATIONAL FACILITIES Mr.Waggener,City Manager,stated that the Council had requested a study session .— to discuss possibilites for long term recreational facilities.He stated that a date had never been set and he wanted to know if the Council wanted to consider that. It was the consensus of the Council that this be brought up again at the last meeting in July. U LJ 2567 CITY COUNCIL MINUTES:5 June 28,1977 INSURANCE Mr.Waggener,City Manager,stated that he had attended several different meetings /O*1 dealing with insurance problems of cities.He stated that insurance companies no longer consider cities good insurance risks and they are reluctant to insure cities. He stated that it was recommended at the AWC convention he attended in Ocean Shores that if a city has a good workable insurance program at the present time that the city do nothing to upset that program. /' GARBAGE PROBLEM Mr.Harold 0.Sandberg,518 Alder,stated that the garbage in the alley between Fifth and Sixth is deplorable.He stated that it was his understanding that the owner has been contacted and he has agreed to put a container in there.He stated that Mr.Deason said there would be a container in there by last week and the garbage is still scattered about.He felt some action should be taken.
