1977 08 09J i 2581 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING -REGULAR SESSION August 9,1977 CITY HALL -COUNCIL ROOM 8 p.m. Members present: Don Swanson, Kent Jones, Bill Moe, Norm Johnson, Bob Hill, Eric Skaug, and Jim Barney The meeting was called to order at 8 p.m. by Mayor Don Swanson. Mr.Jones moved that the minutes of the meeting of July 26,1977 be approved as submitted,seconded by Mr.Johnson,and passed unanimsouly. APPROVAL OF BILLS REGULAR BILLS AMOUNT GENERAL $8,568.60 STREET 1,836.03 ARTERIAL STREET 29.98 FEDERAL SHARED REVENUE 305.66 WATER/SEWER 7,635.30 SANITATION 20,707.28 WATER/SEWER CONSTRUCTION 28,896.84 EQUIPMENT RENTAL 751.53 LID #29 50.54 LID #31 12,423.30 LID #34 18,011.72 LID #36 26,410.10 LID #38 10,648.25 TOTAL $136,275.13 Mr.Moe moved that the bills be paid as submitted,seconded by Mr.Jones,and passed with Mr. Hill abstaining from voting for that portion of the bills for Pacific Northwest Bell.Warrants 2843 to 2929 were approved for payment. Mr.Swanson introduced the following candidates for Council:Andrew Thayer, Chuck Edwards,Stephen Shinn,Dick Siegert,Genaro Yzaguirre,Robert Lopez, and Barry Ziegler. I.CITIZENS INPUT None II.CONSENT AGENDA Ron Baker,Consulting Engineer,stated that one item of approximately $300 had //&>/? been omitted from the bid of DeBlasio which would increase the total to $77,936.91. Mr. Hill moved that the following items on the Consent Agenda be approved with the exception that on the Gateway Estates Waterlines,the bid be changed from $77,569.66 to $77,936.91: .drd/Tamarack and Crestmont LID's;Pick-up Le1. Consideration of Bids -Gayldrd/Tamarack and Crestmont LID's; Pick-up Lease; and Waterline Oversizing -Gateway Estates seconded by Mr. Skaug,and passed unanimously. III.CONSIDERATION OF BIDS No others 2582 CITY COUNCIL MINUTES:2 August 9,1977 IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS PRESENTATION -CERTIFICATION OF APPRECIATION -PARK AND RECREATION ADVISORY COMMISSION A letter from the Mayor was read which requested that the Council recognize the outstanding service to the community by Bill Brotherton,Robert Heikell,Ken Moos, and Beth Stevens for serving on the Park and Recreation Advisory Commission. The Mayor presented Certificates of Appreciation to Bill Brotherton and Robert Heikell.Ken Moos and Beth Stevens were not present at the meeting. PUBLIC HEARING -ORDINANCE -ALLEY VACATION -JESSICA LONGSTON -FIRST READING A letter from Stan Bech,City Planner,was read which stated that the City Council had set August 9 for a public hearing on the alley vacation request by Ms.Jessica Longston.This alley is located on the north side of Lot #27 in Broadripple Addition #1.The city will retain the vacated alley as an easement with the right to exercise and grant easements for the construction,repair,and maintenance of public utilities and services;and shall be reimbursed by the abutting property owners with one-half the appraised value of the vacated alley. The public hearing was opened. There were no comments from the audience,so the public response was closed. Mr.Hill moved the public hearing be closed,seconded by Mr.Jones,and passed unanimously. The ordinance vacating the alley lying north of Lot #27 in Broadripple Addition #1 was read by title only. Mr.Jones moved that the first reading of the ordinance be adopted,seconded by Mr. Hill, and passed unanimously. V.ORDINANCES AND RESOLUTIONS ORDINANCE -AMENDING 1977 BUDGET -DROUGHT RELIEF FUNDS -SECOND READING A letter from Ron Bierma,Finance Director,was read which presented an ordinance revising the original 1977 budget. Steve Shinn,426 Crestview Drive,stated that he did not believe the citizens of Moses Lake were aware that the Grant County Housing Authority is in fact paying for the metering of the base and he felt this fact should be brought to their attention. The ordinance revising the original 1977 Budget Ordinance No. 795 to appropriate funds to purchase equipment and materials and provide for expenditure of emergency drought relief funds and participation of water main oversizing was read by title only. Mr.Barney moved that the second reading of the ordinance be adopted,seconded by Mr.Johnson,and passed unanimously. ORDINANCE -GAMBLING TAX -SECOND READING i A letter from Chet Waggener,City Manager, was read which stated that the Council had requested tavern owners to submit copies of quarterly reports submitted to the Washington State Gambling Commission.These reports show a net income from gambling of 25% of gross.Mr.Bjork,Director of the Washington State Gambling Commission, called to say that the average net income throughout the state is 18% of gross after payment of all federal, state, and local taxes. He also stated that only two cities in the state are charging a local tax less than the statutory 5% maximum. # ^ 00 2583 CITY COUNCIL MINUTES:3 August 9,1977 Mr.Hill wanted to know approximately how much money the city would receive from this tax. Ron Bierma,Finance Director,stated that if the tax had been enforced the city would have collected approximately $14,000. Mr. Jones wanted to know if the ordinance states that the keeping of records for three years involves the keeping of all the punch boards and pull tabs. Mr. Swanson stated that it had been determined that the city was asking the same in record keeping as is already required by the state. Mr.Barney stated that he had thought the tax was to be reduced to 2*2%from 5%. Mr. Swanson stated that the tax could be changed. Mr.Jones wanted to know what the funds received from this tax would be used for. Mr.Bierma stated that they would primarily be used for enforcement. Mr. Moe moved to table this ordinance until August 16,seconded by Mr. Johnson, and passed with Mr.Jones opposed. The Council wished the following questions answered for the next meeting: 1.Where will the excess money go and what can it be used for? 2. 5%gross tax? 3.What are other cities using the money for? 4. Which records are required? (Are the punchboards and pull tabs considered records?) VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS ORDINANCE -AMENDING SUBDIVISION ORDINANCE -BLOCK CONFORMITY -FIRST READING A letter from Stan Bech, City Planner, was read which presented an ordinance amending the Subdivision and Platting Ordinance to require paved streets,curbs, and sidewalks on all dedicated street right-of-ways in all new subdivisions and all LID's. Mr. Skaug stated that paragraph B addresses itself only to paving and he felt any reference to paving should also include curbs and sidewalks. There was considerable discussion by the Council on whether or not sidewalks would be required under all circumstances or if the Council could grant a variance. It was the consensus of the Council that the phrase "and all LID's" be deleted from paragraph A. The ordinance amending Chapter 3.20 of the Moses Lake City Code entitled subdivision and platting ordinance by changing Section 3.20.50.36 was read by title only. Mr.Skaug moved that the first reading of the ordinance be adopted,but deleting references to LID's, seconded by Mr.Barney. Mr. Moe stated that he felt the LID was the problem when this was sent to the Planning Commission for a recommendation.He stated that the Planning Commission had recommended that LID's conform to block conformity by having to put in curbs and sidewalks and he felt it should be left in. Mr.Jones felt that there were too many questions unresolved to act on the ordinance at this time. Motion passed with Mr.Jones and Mr.Moe opposed. /as/ 2584 CITY COUNCIL MINUTES:4 August 9,1977 VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION fV ANNEXATION REQUEST -DR.RICHARD PENHALLURICK yJ A letter from Stan Bech,City Planner,was read which stated that the City Council had instructed city staff to draw up a petition for annexation upon the request of Dr.Richard Penhallurick. Mr. Hill moved that August 23 be set as a date for a Public Hearing,seconded by Mr.Johnson,and passed unanimously. IX.COUNCIL QUESTIONS AND COMMENTS None X.CITY MANAGER REPORTS AND COMMENTS P o ft CANDIDATES FOR SEPTEMBER 20 PRIMARY ELECTION A letter from Ron Bierma,City Clerk,was read which stated that Council candidates for positions 1, 2, and 4 would be on the primary election. All candidates recieved a packet of sample forms, instructional pahmphlets, and related informa tion at the time of picking up papers for filing.
