1977 08 16Jj 2585 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING -REGULAR SESSION August 16,1977 CITY HALL -COUNCIL ROOM 8 p.m. Members present:Don Swanson,Kent Jones,Bill Moe,Bob Hill,Jim Barney,and Eric Skaug.Absent:Norm Johnson The meeting was called to order at 8 p.m. by Mayor Don Swanson. Mr. Hill moved that the minutes of the meeting of August 9 be approved as submitted, seconded by Mr. Jones, and passed unanimously. I.CITIZEN INPUT None II.CONSENT AGENDA None III.CONSIDERATION OF BIDS PUMP MODIFICATIONS A letter from M. G.McLanahan,Assistant Public Works Director,was read which recom mended that Shinn Irrigation Equipment be awarded the bid for lowering the pumps in '//- Wells 3,5,7,21,and 22.Shinn Irrigation was the low bidder with $16,448.15.S/7o~~ Mr.Moe moved that Shinn Irrigation be awarded the bid, seconded by Mr.Hill,and •——^ passed unanimously.'^ IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS COMMUNICATION -APPOINTMENTS TO PLANNING COMMISSION A letter from Don Swanson,Mayor,was read which requested Council confirmation of the appointments of Jerry Law and Sid Winzler to the Planning Commission. Mr.Moe moved that the appointments be confirmed,seconded by Mr. Jones,and passed unanimously. PRESENTATIONS -CERTIFICATES OF COMPLETION A letter from Myron A. Palmer,Acting Police Chief was read which stated that Willard Self,Cornelius D.Van Beek,Frederick Haynes,and Dale Baltzell have completed 4,000 hours of training through the State of Washington and Department of Labor and Industries, and requesting the Mayor present the certificates of completion. The mayor presented the certificates. V.ORDINANCES AND RESOLUTIONS ORDINANCE -GAMBLING TAX -SECOND READING /JV& Mr. Moe moved that this item be,brought back on the table,seconded by Mr. Hill, and passed unanimously. A letter from Chet Waggener, City Manager,was read which stated that only two cities in the state are charging a local tax less than the statutory five percent maximum allowed;that the funds received from this tax would be included in the Police budget in a nonspecific basis;that records additional to those required by the state and federal governments will be required only for purposes of transmitting receipts to the City of Moses Lake;and that a Declaration of Intent to conduct a taxable activity is required. The ordinance creating Chapter 3.18 of the Moses Lake City Code,entitled "Gambling Tax",by providing for,and levying a tax upon the income derived from certain activi ties;providing for the collection and enforcement of such taxes;and providing penal ties for failure to timely pay such taxes was read by title only. -'J 2586 CITY COUNCIL MINUTES:2 August 16,1977 Mr.Moe moved that the second reading of the ordinance be adopted,seconded by Mr. Jones. Mr.Hill stated that he would like to see the 5%tax on gross receipts changed to 3%. Mr.Barney stated that he was in agreement with this. The motion passed with Mr.Barney and Mr.Hill opposed. „ORDINANCE -ALLEY VACATION -JESSICA LONGSTON -SECOND READING J1 :]"A letter from Stan Bech,City Planner,was read which stated that Ms.Jessica Longston is requesting a vacation on the alley on the north side of Lot #27 of Broadripple f \ Addition #1. The ordinance vacating the alley lying north of Lot #27 in Broadripple Addition #1 was read by title only. Mr.Barney moved that the second reading of the ordinance be adopted,seconded by Mr.Skaug,and passed unanimously. ORDINANCE -AMENDING SUBDIVISION ORDINANCE -BLOCK CONFORMITY -SECOND READING A letter from Stan Bech,City Planner,was read which presented an ordinance which would amend the Subdivision and Platting Ordinance to require paved streets,curbs, and sidewalks on all dedicated street right-of-ways in all new subdivisons. Mr. Bech stated that the current ordinance makes exceptions on paving for h width streets and for streets adjacent to existing street dedications which are not paved. This ordinance would require the paving of the street and the installation of side walks and curbs. The ordinance amending Chapter 3.20 of the Moses Lake City Code entitled Subdivision and Platting Ordinance by changing Section 3.20.50.36 was read by title only. Mr. Hill moved that the second reading of the ordinance be adopted,seconded by Mr. Skaug, and passed unanimously. VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS ORDINANCE -AMENDING ZONING ORDINANCE -PUBLIC NUISANCE -FIRST READING \cp 'A letter from Stan Bech,City Planner,was read which stated that the Planning \Commission recommended that the accompanying ordinance dealing with Public Nuisances be approved. This ordinance would clarify the definition of outside storage in a residential area. The ordinance amending Chapter 3.24 entitled Zoning Code of the Moses Lake City Code in order to clearly define a public nuisance was read by title only. Mr.Jones moved that the first reading of the ordinance be adopted,seconded by Mr. Barney,and passed unanimously. \05 ORDINANCE -AMENDING ZONING ORDINANCE -CONDITIONAL USE PERMITS -FIRST READING A letter from Stan Bech,City Planner, was read which stated that the Planning Commission recommended that the accompanying ordinance setting one year time limits on conditional use permits be approved. The ordinance amending Section 3.24.180 of Chapter 3.24 of the Moses Lake City Code entitled Zoning Code was read by title only. Mr. Hill moved that the first reading of the ordinance be adopted, seconded by Mr. Jones,and passed unanimously. FT 2587 CITY COUNCIL MINUTES:3 August 16,1977' VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION MUNICIPAL INSURANCE Mr. Moe moved that August 30 be set as a study session to consider the municipal insurance,seconded by Mr. Barney, and passed unanimously. IX.COUNCIL QUESTIONS AND COMMENTS None X.CITY MANAGERS REPORTS AND COMMENTS PUBLIC WORKS SECOND QUARTER REPORT Jerry Fay, Public Works Director, presented the Second Quarter Public Works Report This report is effective to June 30, 1977. WATER CONSUMPTION ON BASE M.G.McLanahan,Assistant Public Works Director,reported to the Council on the /'**(-? problems encountered on the base due to the drought and the high water usage.He stated that another well is needed on the base and one is in the plans for the future. He also stated that water consumption on the base this year is higher than it was last year. MUNICIPAL CODE Chet Waggener,City Manager,stated that Book Publishing Company would have the Moses Lake City Code published and delivered by mid-September. /o*v /C/6> BROCHURE Chet Waggener,City Manager,distributed the Brochure to the Council and stated that delivery would be made on a house to house basis in the last weekend of August.
