The meeting was called to order at 8 p.m. by Mayor Don Swanson.
Mr.Moe moved that the minutes of the meeting of September 27,1977 be approved as
submitted,seconded by Mr. Johnson, and passed unanimously.Mr.Johnson moved that
the minutes of the special meeting of October 3,1977 be approved as submitted,
seconded by Mr.Jones,and passed unanimously.

facilities plan to date and future plans in regard to this system. .r—
PUBLIC HEARING -FINAL ASSESSMENT -MARINA DRIVE LID #30 I

The public hearing was opened.
Jerry Fay,Public Works Director,went over the LID process for the Council and
citizens.
He pointed out the location of this LID and stated that the preliminary estimate
was $112,242.42.The total final assessment was $97,400.94.
There were no comments from the audience, so the public response was closed.
Mr. Jones moved that the public hearing be closed,seconded by Mr. Johnson, and
passed unanimously.
Mr.Jones moved that the final assessment be approved and staff be directed to draw
up an ordinance,seconded by Mr. Johnson, and passed unanimously.
PUBLIC HEARING -FINAL ASSESSMENT -BENNETT STREET LID #33

Jerry Fay,Public Works Director,pointed out the location of this LID and stated
that the preliminary estimate was $51,711.74.The total final assessment was
$34,709.89.
There were no comments from the audience,so the public response was closed.
Mr.Jones moved that the public hearing be closed,seconded by Mr.Johnson,and
passed unanimously.
Mr. Skaug moved that the final assessment be approved and staff be directed to draw
up an ordinance, seconded by Mr. Jones, and passed unanimously.
PUBLIC HEARING -ORDINANCE -ZONE CHANGE -LOWER PENINSULA -SECOND READING^_
A letter from Stan Bech,City Planner,was read which stated that the City Council
had passed the first reading of this ordinance on September 20.This ordinance is
for a zone change on the lower Peninsula from Ag, Agriculture to R-1, Single Family
Residential and P,Public.
The public hearing was opened.
Dr.Rector stated that he was in favor of the R-1 zoning.
Barry Ziegler also stated that he was in favor of the R-1 zoning.
There were no further comments,so the public response was closed.
Mr.Johnson moved that the public hearing be closed,seconded by Mr. Jones, and
passed unanimously.
The ordinance amending Chapter 3.24 of the Moses Lake City Code by changing the
official zoning map on the following described parcel of land was read by title
only.

VI.ORDINANCES AND RESOLUTIONS
ORDINANCE -AMENDING WATER AND SEWER RATES -SECOND READING

A letter from Jerry Fay, Public Works Director,was read which presented an ordinance
revising the water/sewer rates for duplexes.
The ordinance amending Chapter 9.6 of the Moses Lake City Code entilted "Water and
Sewer Rates" (city system)by adjusting duplex rates and modifying procedures was
read by title only.
Mr. Jones moved that the second reading of the ordinance be adopted,seconded by
Mr.Johnson and passed uanimously.
ORDINANCE -AMENDING GAMBLING TAX REGULATIONS -SECOND READING

A letter from R.C.Bierma,Finance Director,was read which presented an ordinance
amending the ordinance on gambling tax.
The ordinance amending Chapter 3.18 of the Moses Lake City Code entitled "Gambling
Tax"by reducing tax rate on amusement games defining exemptions and renumbering
certain sections therein was read by title only.
Mr.Barney moved that the second reading of the ordinance be adopted,seconded by
Mr. Jones,and passed unanimously.
RESOLUTION -ACCEPTING FRANCHISE FOR UTILITY INSTALLATION -GRANT COUNTY //if
A letter from Jerry Fay,Public Works Director,was read which presented a resolution
accepting a franchise from Grant County for the installation of utilities in Gateway
Estates.
The resolution accepting a franchise from Grant County,Washington was read by title
only.
Mr. Moe moved that the resolution be adopted, seconded by Mr. Johnson, and passed
unanimously.

VII.REFERRALS FROM COMMISSIONS
ORDINANCE -ZONE CHANGE REQUEST -BEN BARIGAR
A letter from Stan Bech, City Planner, was read which stated that the Planning
Commission recommended that the zone change request of Mr. Ben Barigar be approved.
Mr.Barigar is requesting that lots 1, 2, and 3 of Curtiss Addition be changed from
the existing C-4, Tourist Commercial to R-3,Multi-family Residential for the
purpose of constructing apartments on this property.
The ordinance amending Chapter 3.24 of the Moses Lake City Code by changing the
official zoning map on the following described parcel of land was read by title
only.
Mr.Johnson moved that the first reading of the ordinance be adopted and a public
hearing be set for October 29,seconded by Mr. Jones, and passed unanimously.
PRELIMINARY PLAT -PROFESSIONAL CENTER
A letter from Stan Bech,City Planner,was read which stated that the Planning //£&
Commission recommended that the Professional Center Preliminary Plat be approved.
This proposed plat is located at 1100 Ivy Street and consists of dividing existing
buildings and developed property into individual lots.
Mr. Jones wanted to know where lot 4B was and it was pointed out that there is no
lot 4B. Mr. Bech stated that it was probably lot IF.

Reid Knauss stated that the 10 foot wide sidewalk required on Third Avenue on Lot
1J would probably be a driveway. Mr. Bech stated that the sidewalk would simply
be a part of the driveway.
Mr.Johnson moved that the Professional Center Preliminary Plat be approved with
the following variances:
1. A variance be granted on minimum size on Lots IB,IE,IF,1G,IK,and 1H.
2.A variance be granted on street frontage on Lots 1C,IB,1L,and IK.,r

3.A variance be granted on the required width for Lots IB and IF.I
4. A variance be granted on the required depth for Lots 1C,IB,ID,1L,IE,IK,
and 1H.
and the following minimum improvements:
1. A 10 foot wide sidewalk shall be constructed on Third Avenue on Lot 1J.
2.Each lot shall be served by individual water meters and sewer services
3.A bond in the amount of $10,000 may be presented to guarantee completion of
the required utilites.

VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION
COVERING PARKING METERS
A letter from Chester Waggener,City Manager,was read which stated that the
Council had requested information regarding loss of revenue should parking meters
be covered through the Thanksgiving and Christmas holidays.Revenue received
from parking meters last year for that period was approximately $1,100 and during
the same period in 1975 the revenue was approximately $1,800.The covered parking
meters can be expected to psychologically encourage additional shopping in the
Central Business District but there may be a decrease in parking availability if
merchants and their employees use the metered spaces for all day parking. He
suggested that the 2-hour parking limitation not be enforced if no revenue is
received.Information showing the number of parking spaces available during the
period September 14 to October 1 were attached to the letter.
Bob Heintz from Morgan Jewelers asked if there would be no enforcement of the
0 parking limitations.Mr.Waggener stated that when it was presented it was his
understanding that the merchants police it themselves and this would be his
recommendation.
Mr. Waggener stated that the merchants should also be responsible for keeping
the meters covered.There was some discussion by Council on what type of bags
should be used to cover the meters. Mr.Waggener suggested that this concern
be left up to the merchants and this was agreed to by the Council.
Mr.Barney moved that the Council approve the concept of covering the parking
meters from November 21 to January 2,1978,and the retail merchants be responsible
for covering the meters,seconded by Mr.Johnson,and passed unanimously.~
ANGLE PARKING ,.
\r Bob Heintz,Retail Merchants,stated that the merchants were requesting angle
parking downtown in the near future for a trial period to see if it will work.
He stated that they did not want to wait for the report from CH2M Hill.He
stated that they would like to see the downtown area a shopping area instead
of a thoroughfare.
Mr.Swanson pointed out that according to the survey there are over 100 empty
parking spaces each day.

Pat Acres,City Attorney,stated that there could be considerable trouble with
insurance coverage of the angle parking if a study were not conducted prior to
its inception.
Mr. Heintz stated that the last month was slow and he felt this survey did not
accurately show the need for parking during the holiday rushes.He also proposed
reducing the speed limit on Third Avenue to help reduce the possibility of accidents.
Mr.Swanson pointed out that when this was tabled before it was agreed to wait
for a report from the traffic consultant.
Mr.Heintz presented a petition to the Council in favor of angle parking.
IX.COUNCIL QUESTIONS AND COMMENTS
COMMENTS ON LETTER TO EDITOR
Pat Acres,City Attorney,stated that the letter to the editor written by Bill )\f"
DeGeorge on September 27 raised some issues that need to be answered.The main
problem pointed out by Mr.DeGeorge is the vandalism by youth.He stated that
there will be changes in juvenile law shortly and he has asked Clair Able of the
probation office to come before the Council to explain the changes.
X.CITY MANAGER REPORTS AND COMMENTS
AWC REGIONAL WORKSHOPS
Mr.Waggener reminded the Council of the AWC Regional Meeting in Ellensburg on JO
Thursday,October 20.The Councilmen will be called later in the week to find
out which ones will be attending.
REVENUE SHARING FUNDS
Mr.Waggener stated that under the Revenue Sharing Act each city is required to JJy/
hold a proposed use hearing on revenue sharing funds before the budget is submitted
to the Council.This hearing will be held on Tuesday,October 25 at 7 p.m.He
suggested that it would be a good idea if the Council attended this meeting to
hear the citizen input directly. The Council concurred.
The meeting was adjourned at 9:30 p.m.
