CITY COUNCIL MEETING -REGULAR SESSION JANUARY 17,1978 -8:00 P.M.

Members Present:Don Swanson,Stephen Shinn,Jim Barney,Kent Jones,Barry Ziegler,
and Eric Skaug.Bob Hill was absent
The meeting was called to order at 8 p.m.by Mayor Don Swanson.
Kent Jones moved that the minutes of the meeting of January 10, 1978, be approved
as submitted,second by Jim Barney,unanimously approved.

Stephen Shinn moved that the bills be approved as submitted,second by Kent Jones,
unanimously approved.Warrants 4115 through 4129 were approved for payment.
I.CITIZEN INPUT
Sandy Rapozo,employee of W.Ron Baker stated that she would answer any questions /Oa?^
in regard to the Conditional Use Permit for a mobile home park requested by Mr.
Near and Mr.Knott.
Marie Ahlers,1532 Dunn Street,asked the Council why she had to pay the $35.00
business license fee;the same amount as a bank would pay,if she has a very small
business.
Kent Jones asked what the policy was in regard to business licenses in other cities,
and Mr.Waggener replied that some cities require a graduated tax on business
licenses,and the fee structure was based on the size of business.The City of
Moses Lake has a flat rate of $35.00 per year,with businesses making under $1,000
being exempt. There was no consistent practice in charging business license fees.
Barry Ziegler asked what the gross revenue for business licenses was, and Mr.
Waggener replied that without looking it up in the budget, he would estimate that
it was about $16,000 to $17,000. He stated that perhaps the Council would like to
look into this for 1979.
Barry Ziegler asked Mr.Waggener how long the City had had this Ordinance. He
replied that we have had this same rate for about six years.
Mr.Ziegler asked what the procedure was when a citizen asked for a reduced rate.
Jean Burton, Assistant Finance Director, replied that there has only been two requests
for exemption that she could remember. She stated the business has to have purchased
a license the previous year,present evidence that it did less than $1,000 of
business during the preceding year to receive an exemption.
Kent Jones asked if the Department of Revenue would give us information that the
City could use to charge a graduated tax based on amount of income.Mr.Waggener
replied that technically the City could get this information,but they would not
want us to use it for this purpose.The Chamber of Commerce may be able to provide
this information.
Jim Barney stated that all businesses must pay a business tax now.If licenses were
increased there would be alot of complaints,as compared to the two complaints that
have been received.He thought that businesses were paying enough taxes already.
Mr.Shinn felt that perhaps the Council could lift the minimum to get an exemption
from $1,000 to a higher amount.
II.CONSENT AGENDA
Kent Jones moved,that the items on the Consent Agenda be approved,second by Eric
Skaug,and unanimously passed,with Stephen Shinn abstaining from voting on Item
#2 on the Consent Agenda.

2.COMPLETION OF WORK -PUMP MODIFICATION
Jerry Fay, Public Works Director,requested that Council accept the work and
enter into the 30-day lien period by Shinn Irrigation,Inc,under Contract
#77-06, for pump modifications.

V.ORDINANCES AND RESOLUTIONS
ORDINANCE -REVISION OF COMMUNITY STANDARDS -2ND READING
An Ordinance adopting the Standard Specifications for Municipal Public Works Con
struction and providing for control of installation of City water and sewer
utilities located outside the City limits was presented by Jerry Fay,Public
Works Director.The Ordinance was read by title only:An Ordinance repealing
Chapter 12.08 of the Moses Lake Municipal Code entitled "Uniform Community
Standards"and enacting a new Chapter 12.08 entitled "Community Street and
Utility Standards"by adopting by reference the Standard Specifications for
Municipal Public Works Construction of the Washington State Chapter of the
American Public Works Association published in 1977 and making amendments
thereto.
Eric Skaug moved that the second reading of the Ordinance be adopted,second
by Jim Barney,unanimously approved.
VI.REQUESTS TO CALL FOR BIDS -None
VII.REFERRALS FROM COMMISSIONS
Stanley Bech,City Planner,presented a request for a Conditional Use Permit
for a proposed mobile home park located at 1911 West Marina Drive that will
consist of 65 units.City sewer and water utilities will serve this develop
ment and all storm drainage will be kept on site.The request was granted by
the Planning Commission with two stipulations.
Eric Skaug asked Mr.Bech if there was a time limit on the permit,and Mr.
Bech replied that the permit was good for one year.
Kent Jones moved that the Council approve the Conditional Use Permit with the
stipulations recommended by the Planning Commission, namely: 1. That two entrances
to the park be required with one being a thirty (30)foot paved entrance off of
Broadway; and 2.That a sight obscuring fence six (6')feet high be placed on the
boundary facing Battery Orchard Tracts #74. The motion was seconded by Mr. Barney
and unanimously approved.

IX.COUNCIL QUESTIONS AND COMMENTS -None
X.CITY MANAGER REPORTS AND COMMENTS
Mr.Waggener stated that the information to hold a study session on solid waste
disposal would be ready for the next Council meeting on January 24, 1978.The
Council set a study session for that date.
Mr.Waggener gave a report on the status of union negotiations.He stated that
the Teamsters Union had accepted the contract last night.This is a two year
contract.Wages in 1978 increase 8.2%,medical increase,two additional holidays,
and vacation improvement,with the total package costing 9.85%. On January 1,
1979, wages will increase in accordance with the Seattle Consumer Price Index,
with a floor of 4% and a maximum of 10%,plus $120/year for uniform clothing.
