1978 09 192754 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING -REGULAR SESSION September 19,1978 CITY HALL -COUNCIL ROOM 8 p.m. Members present:Bob Hill,Barry Ziegler,Steve Shinn,Kent Jones,Don Swanson, Jim Barney,and Eric Skaug The meeting was called to order at 8 p.m.by Mayor Don Swanson. Mr.Barney moved that the minutes of the meeting of September 12 be approved as submitted,seconded by Mr.Ziegler,and passed unanimously. APPROVAL OF BILLS REGULAR BILLS AMOUNT GENERAL $7,200.24 STREET 790.68 WATER/SEWER 3,886.15 SANITATION 4,592.90 WATER/SEWER CONSTRUCTION 1,510.00 EQUIPMENT RENTAL 630.09 TOTAL $18,610.06 Mr.Jones moved that the bills be approved as submitted,seconded by Mr.Shinn,and passed with Mr.Hill abstaining from voting for that portion of the bills to Pacific Northwest Bell.Warrants 6041 to 6096 were approved for payment. PROCLAMATION - SQUARE DANCE WEEK A proclamation was read designating the week of September 18 through 24,1978 as Square Dance Week. Mr.Jones moved that the proclamation be confirmed,seconded by Mr.Ziegler,and passed unanimously. I.CITIZEN INPUT None II.CONSENT AGENDA None III.CONSIDERATION OF BIDS None IV.PETITIONS, COMMUNICATIONS, OR PUBLIC HEARINGS PUBLIC HEARING -ORDINANCE -ZONE CHANGE REQUEST - KEN EARL - SECOND READING The public hearing was opened.//; A letter was read from Stan Bech,Community Development Director,which stated that the Planning Commission recommended that the zone change request by Ken Earl be approved.Mr.Earl is requesting that the property which lies south of Sharon Avenue between the high school property and Pioneer Way be rezoned from Agricul ture to C-4,Tourist Commercial.This land consists of approximately 26 acres. Mr.Bech pointed out that the C-4 zone is in the process of being revised and would allow for professional offices in this zone.The revised zone would be called High way Commercial. 2755 CITY COUNCIL MINUTES;2 September 19,1978 Mr.Barney moved that the public hearing be closed,seconded by Mr.Jones,and passed unanimously. The ordinance amending Section 18.09.020 of Chapter 18 of the Moses Lake City Code entitled Zoning was read by title only. Mr.Jones moved that the second reading of the ordinance be adopted,seconded by Mr.Barney,and passed unanimously. V.ORDINANCES AND RESOLUTIONS ORDINANCE - ALLEY VACATION - HARVEY ALLISON - SECOND READING }v A letter was read from Stan Bech,Community Development Director,which stated that the Planning Commission recommended that the alley vacation request by Harvey Allison be granted.Mr.Allison is requesting that the alley dedicated as a part of Burress Tract No.5,extending for a distance of 195 feet be vacated.This alley presently has no access from a dedicated right-of-way. The public hearing was opened.There were no comments,so the public response was closed. Mr.Hill moved that the public hearing be closed,seconded by Mr.Shinn,and passed unanimously. The ordinance vacating an alley in Burress Tract No.5 was read by title only. Mr.Hill moved that the second reading of the ordinance be adopted,seconded by Mr.Shinn,and passed unanimously. RESOLUTION - LID #42 - LAKEWAY DRIVE \9 A letter was read from Jerry Fay,Public Works Director,which presented an ordinance establishing a public hearing date of October 10 for an LID in Broadripple Addition #3. The resolution of the City Council of the City of Moses Lake declaring its intention to improve the Broadripple area on Nelson Road between Lakeway Drive and Eastlake Drive and approximately 1,200 feet of Lakeway Drive of Broadripple Addition No.3 by grading,graveling,constructing and installing storm drainage,side lateral sewer connections,curbs,sidewalks and asphalt concrete pavement and to create a local improvement district to assess the cost and expense of said improvements against properties in such district specially benefited thereby,and notifying all persons who may object to said improvement to appear and present their objections at a regular meeting of the City Council to be held on October 10,1978 was read by title only. Mr.Jones moved that the resolution be adopted,seconded by Mr.Hill,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS ORDINANCE -ZONE CHANGE REQUEST -ACRES AND WISER -FIRST READING y*A letter was read from Stan Bech,Community Development Director,which stated that the Planning Commission recommended that the zone change request from Pat Acres and Bud Wiser be approved.They are requesting the rezoning of approximately 86 acres of land fronting on Pioneer Way northwest of its intersection with Kettleson Road from its existing Agriculture zone to C-4,Tourist Commercial. The ordinance amending Section 18.09.020 of Chapter 18 of the Moses Lake City Code entitled Zoning was read by title only. Mr.Barney moved that the first reading of the ordinance be adopted,seconded by Mr.Hill,and passed unanimously. !I J 2756 CITY COUNCIL MINUTES:3 September 19,1978 VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION IITED WAY ///? A letter was read from Jerry Fay,President of United Way,which requested permission to place balloons on all of the parking meter posts in the downtown area on October 2, 1978. Mr.Ziegler moved that permission be granted,seconded by Mr.Shinn,and passed unanimously. IX.COUNCIL QUESTIONS AND COMMENTS RAILROAD Mr.Hill stated that the Milwaukee Railroad is planning on abandoning its lines west of Montana.They are trying to get the Union Pacific to come in and he wished the Council to be aware of the fact that there is no right-of-way easement on the Alder Fill for the railroad. X.CITY MANAGER REPORTS AND COMMENTS CITY ATTORNEY Doug Zenor,City Manager,stated that the City Attorney,Pat Acres,has submitted a letter of resignation to be effective October 31,1978.Mr.Zenor requested Council authorization to investigate two alternatives toward filling this vacancy: 1.Retain a local attorney or firm on a contractual part time basis 2.Hire a full time city attorney Mr.Hill moved that Mr.Zenor be authorized to proceed,seconded by Mr.Jones,and passed unanimously.
