1978 10 172769 CITY OF MOSES LAKE MOSES LAKE, WASHINGTON CITY COUNCIL MEETING - REGULAR SESSION October 17,1978 CITY HALL -COUNCIL ROOM 8 p.m. Members present:Barry Ziegler,Don Swanson,Jim Barney,Eric Skaug,Bob Hill,and Kent Jones.Absent:Steve Shinn The meeting was called to order at 8 p.m.by Mayor Don Swanson. Mr.Ziegler moved that the minutes of the meeting of October 10 be approved as sub mitted,seconded by Mr.Jones,and passed unanimously. APPROVAL OF BILLS REGULAR BILLS AMOUNT GENERAL $7,797.74 STREET 5,302.84 ARTERIAL STREET 13.09 WATER/SEWER 111,789.44 SANITATION 4,125.47 WATER/SEWER CONSTRUCTION 117,526.35 EQUIPMENT RENTAL 700.79 URBAN ARTERIAL 161.50 TOTAL $247,417.22 Mr.Ziegler moved that the bills be approved as submitted,seconded by Mr.Hill, and passed with Mr.Hill abstaining from voting for that portion of the bills to Pacific Northwest Bell.Warrants 6267 to 6331 were approved for payment. I.CITIZEN INPUT None II.CONSENT AGENDA None III.CONSIDERATION OF BIDS None IV.PETITIONS, COMMUNICATIONS, OR PUBLIC HEARINGS CONTINUED PUBLIC HEARING - LID #42 -LAKEWAY DRIVE M.G.McLanahan,Assistant Public Works Director,went over the LID procedure for the Council and citizens.He stated that 81%of the property owners had signed a petition in favor of the LID. The public hearing was continued. There was some discussion on the LID. Mr Skaug moved that the public hearing be closed,seconded by Mr.Barney,and passed unanimously. Mr.Hill moved that city staff be authorized to proceed with LID #42,seconded by Mr.Jones,and passed unanimously. /-?// 2770 CITY COUNCIL MINUTES:2 October 17,1978 V.ORDINANCES AND RESOLUTIONS ORDINANCE -AMENDING ZONING ORDINANCE - C-4 ZONE -SECOND READING A letter was read from Stan Bech,Community Development Director,which stated that the Planning Commission recommended that the ordinance amending the C-4 Zone be adopted.The City Council requested a legal opinion on allowing new car dealerships in this zone,and it was the opinion of the city attorney that it should be changed to say Automobile Sales. A letter was read from the Planning Commission which requested that the Council not allow automobile dealerships as a conditional use.By doing so the C-4 zone would become an extension of the C-2 zone. Louie Dendy stated that he would like to see the wording changed to motor vehicle instead of automobile dealership as he has a client interested in the land at the corner of Nelson and Pioneer Way for light recreational vehicles. Mr.Skaug stated that if car dealerships are allowed in this zone it would be \/ery difficult to deny other types of open sales lots,and he felt that the ordinance should remain as previously presented. Mr.Swanson stated that there is no place in the downtown area for open sales lots and so they would be going into the county which would open up another strip type development. Mr.Barney stated that he felt this area would be the proper one for C-4 and C-2 commercial development. Ken Earl stated that he was in favor of allowing automobile dealerships as a condi tional use in this zone. The ordinance amending Chapter 18.36 entitled C-4,Tourist Commercial Zone,of Title 18 of the Moses Lake City Code was read by title only. Mr.Hill moved that the second reading of the ordinance be adopted as amended, seconded by Mr.Jones,and passed with Mr.Skaug opposed. IV.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS CONDITIONAL USE PERMIT -SOUTHSIDE MOBILE VILLAGE A letter was read from Stan Bech,Community Development Director,which stated that the Planning Commission recommended that the conditional use request from the South- side Mobile Village be approved. Mr.Ziegler stated that this area is almost completely surrounded by R-l zoning, which requires a 25 foot setback,and this mobile home park would only be required to have a 15 foot setback.He stated that he would like to see a 25 foot setback required as part of the conditional use permit. There was considerable discussion on the differences between the 15 foot setback for mobile homes and the 25 foot setback for single family homes. Mr.Barney moved that the conditional use permit be granted with the following stipulations: 1.That there shall be no access onto Peninsula.Ingress and egress shall be from Wanapum through the existing park. A U 2771 CITY COUNCIL MINUTES:3 October 17, 1978 2.The city,at the discretion of the city staff,shall secure the needed right- of-way on Peninsula Drive. 3.Sidewalks and curbs shall be installed along Peninsula for the full length of the property. 4.A binding site plan shall be reviewed by the Planning Commission before the issuance of a building permit. 5.A six foot high sight-obscuring fence or hedge,4 feet in height at the initial planting shall be installed. seconded by Mr.Jones. Mr.Skaug moved that the previous motion be amended to require a 25 foot setback, seconded by Mr.Ziegler. The motion amending the motion failed with Mr.Skaug and Mr.Ziegler in favor and Mr.Swanson,Mr.Jones,Mr.Barney,and Mr.Hill opposed. The motion to grant the conditional use permit passed with Mr.Ziegler and Mr.Skaug opposed.
