1969 07 22COUNCIL MEETING -Regular Session July 22,1969 Council Chambers 8 o'clock Present were:Gordon Ebbert,Monte Holm,Otto Skaug,Jack Eng, Ernest Lindell and Michael Boyle.Mayor John Jones was not present. Monte Holm made a motion to nominate Jack Eng as Mayor Pro Tern.Motion was seconded and carried unanimously. The meeting was called to order by Mayor Pro Tern Jack Eng.Minutes of the previous meeting were approved as written on a motion by Monte Holm, second by Dr.Lindell.Carried. SPECIAL BILLS PARK FUND Super Secur Comfort Stations 2,933.21 c/o Ashe &Jones,Inc. 22 5 Terry Avenue,North Seattle,Washington Larson Playfield comfort stations,Contract No.69-03 Motion by Gordon Ebbert to pay this special bill.Second by Monte Holm.Carried. Warrants No.2880 through 2938 in the amount of $12,823.49 were approved for payment CORRESPONDENCE FROM JAPANESE AMERICAN CITIZENS LEAGUE. A letter was read from John Bloom as secretary of the JapaneseAmerican Citizens League,Moses Lake Chapter,asking for the City Council's support by resolution of their efforts in behalf of the legislation introduced for repeal of Title II of the Internal Security Act of 1950.Further stating that Title II makes possible the internment of individuals and groups through suspicion only and without due process of law. The second letter was read fromEdward M.Yamamoto as Vice President of the Japanese AmericanCitizens League,Columbia Basin Chapter,asking the City Council for their support to achieve the repeal of Title II of the Internal Security Act of 1950 also known as the Emergency Dentention Act,and respect fully asks the Council to pass a resolutionAin support of this repeal,and submitted printed background material to assist in their deliberations. 1389 ay 22,1969 Edward Yamanmoto wa s present and Mayor pro tern Jack Eng asked if he wished to make any additional comments.He stated that this particular law is aimed at everyone and everybody and anyone "probably"suspected is subject to internment and detention and not on the basis of an actual act of violation of the law,and only a preliminary hearing is given before a departmental hearing officer,not before a court of law.According to this Act you are guilty before beingiproven guilty.This law was not in effect during World War II when Japanese people then were placed in internment camps without benefit of law.Title II of the Internal Security Act of 1950 is in effect and in a moment of hysteria it could be used.Technically this law is unconstitutional. Monte Holm suggested that the accompanying material submitted be studied by the Council and given consideration at the next meeting.City Manager, Chester L.Waggener,mentioned that a resolution would be drafted for the next meeting for the Council to vote on at that time.
