COUNCIL MEETING -Regular Session September 9,1969
Council Chambers -8:o'clock P.M.
Present were:Gordon Ebbert,Otto Skaug,Jack Eng,Ernest Lindell and
Michael Boyle.
Not Present:Mayor John Jones and Councilman Holm.
Due to the absence of Mayor Jones,Gordon Ebbert made a motion to appoint
Otto Skaug as Mayor Pro Tern.Seconded and carried unanimously.
Mayor Pro Tern Otto Skaug opened the meeting.Minutes of the previous meeting
of August 26,1969,were approved as written upon a motion made by Michael
Boyle.Second by Jack Eng.Carried.

RESOLUTION NO.495 ACCEPTING EASEMENT FROM CHICAGO.MILWAUKEE.ST.PAUL
AND PACIFIC RAILROAD.
IOf 3 a letter was read from the City Manager stating that the resolution proposes
acceptance of an amended easement from the Chicago,Milwaukee,St.Paul and
Pacific Railroad granting an additional 10-foot easement to the rear of the proper
ties along Broadway from Alder Street to Ash Street and recommended acceptance
of the easement by the City Council.This amended easement constitutes a change
from a 30-foot right of way to a 40-foot right of way for alley purposes.The
extra width was request at the local improvement district hearing.Moved by
Dr.Lindell to adopt this resolution accepting the easement from the Railroad
Company.Second by Michael Boyle.Carried.

WASHINGTON STATE HIGHWAY DEPARTMENT -PRELIMINARY ENGINEERING AGREE
MENT FOR BROADWAY -PIONEER WAY.
A letter was read from Chester L.Waggener,City Manager,Stating that this agree
ment between the State of Washington acting through the Washington State Highway
Commission and the Department of Highways and the City of Moses Lake,proposes
that the City will conduct all preliminary design work for improvements along Broad
way Avenue as it merges into Pioneer Way.This is in conjunction with our Urban
Arterial Project for Pioneer Way -Phase II,and requested authorization from tthe
City Council to sign this agreement on behalf of the City of Moses Lake.The
amount involved is $7,450.00 which covers a lump sum statement from Lewis &
Redfor,Engineers and the city's costs.Motion by Gordon Ebbert,second by
Jack Eng to author!ze the City Manager to sign this agreement.Carried.
REQUEST BY TAPANESE AMERICAN CITIZEN LEAGUE OF THE COLUMBIA BASIN FOR
RESOLUTION REPEALING TITLE II OF THE INTERNAL SECURITY ACT OF 1950.
Mayor pro tern;Otto Skaug stated that after some deliberation by the Council,
each councilman attested as an individual that they felt this request fe 11 some
what outside the realm of their particular sphere of operation and asked to be
relieved of the request for repeal by resolution as a group.They would,however,
write theirrespective representatives or congressmen as individuals if the organiza
tion wished them to.Also would appreciate if the organization would provide some
kind of format of what they would like to have included in their particular letters.
COLUMBIA BASIN GOOD NEIGHBOR COUNCIL REPORT CONCERNING LEASE OF
DAY CARE CENTER SITE.
A letter was submitted by the City Manager stating that the Good Neighbor Council
had requested the opportunity to appear before the City Council concerning their
permit for operation of the Day Care Center,and further stated that the City Council
on their regular meeting of November 22,1966 approved a special permit for loca
tion of mobile units behind Central School.That permit waa issued for a 3-year
period with the stipulation that the Day Care Center make progress reports to the
City Council regarding obtaining a permanent building location following the
second year of operation in the mobile units.The special permit was granted only
on this condition since the units did not meet the building code nor the zoning
ordinance.At the time the permit was requested,representatives of the Day Care
Center emphasized that the mobile units were avialable for their use for a maximum
of three years,after which time those units would be transferred to another location
for temporary use,thus requiring the Day Care Center to find more permanent
facilities at the expiration of the three-year permit.

Jim Pritchard,Chairman of the Good Neighbor Council was present and stated that
the actual situation is a little different than presented to the Council at that time,
and asked for extension of the "non-conforming"permit so these units could stay
since considerable labor and expenses were put into the units when they located
there,and hoped that the council could give some consideration at the end of the
three-year period.He also stated that the present acting leadership of the group
was not aware of this special permit until it was called to their attention a few
weeks ago.Gordon Ebbert asked if any effort has been made at this time to obtain
a different location.Jim Pritchard stated that the Day Care Center had suffered
several cuts in funds,and that some church property had been considered but deter
mined,after a study,that it did not seem feasible without additional funds.The
plan now is to decentralize under the Department of Health,Education and Welfare and
hoped that other funds will become available for Day Care Centers for low income
families through other federal sources.
Michael Boyle commented that at the time the permit was issued it was emphasized
that the mobile units were available for a maximum of three years,are they planning
to utilize these on a permanent basis?Jim Pritchard stated that he was not sure
where that thinking came from;hie does not underhand that portion of the maximum
time available and personally understands that the intention was that the units in
Moses Lake would stay in Moses Lake.
Dr.Lindell moved to delay any action that would be binding upon the Council until
the next meeting.Second by Jack Eng.Carried.
PRESENTATION OF CERTIFICATE -WATER POLLUTION CONTROL PLANT OPERATOR.
A letter of recommendation was read from the State Department of Health announcing
that a certificate of competency is being issued to Mr.Amos Dodgen by the Board
of Certification for the State of Washington of the Pacific Northwest Pollution Control
Association.The certificate indicates an increase in qualifications and advances
him to Group III.
Mayor Pro Tern Otto Skaug personally presented the Certificate to Amos Dodgen
and commended him for receiving this worthy certification.
FIRE DEPARTMENT -PRESENTATION OF DEFENSIVE DRIVING CERTIFICATES.
Members of the Fire Department enrolled in a course of defensive driving sponsored
by the Washington State Patrol.This was a six-hour program.Those receiving
certificates were as follows:

Otto Skaug presented the certificates to each fireman and congratulated them
and stated it is always gratifying to know that men are striving to improve their
quality of work.
LEGISLATIVE COUNCIL COMMITTEE ON REVENUE AND REGULATORY AGENCIES -
NOTICE OF PUBLIC MEETING.
A letter was read from theCity Manager informing the Council that the public
meeting will be held on Friday,September 19,1969 in the Group Conference
Center at Central Washington College at Ellensburg from 8:00 PM to 10:00 PM.
The subject of this meeting will be the financing of local governments,and
requested that those individuals testifying discuss fiscal problems which may be

peculiar to their particular region with emphasis on possible solutions.In
view of the serious financial position of municipal governments,and our specific
request for assistance from the State Legislature,he feels it is important that
we have good representation at the public meeting by having someone of the
Moses Lake City Council there to participate in that meeting,and also have
someone from Moses Lake appear as a witness,possibly the Mayor and one
or more councilmen,and also department heads.Lack of number of people
appearing for a certain area indicates to the Legislatures there m:ust not be
serii'QUS problems in the area,and we certainly want to dispell this thought.
He recommended that as many as can go do so and confirm their attendance by
telephoning City Hall this coming week.
COMMUNITY RECONNAISSANCE REPORT AND INITIAL HOUSING ELEMENT.
Copies of these reports were delivered earlier to the Councilmen for their
information.The reports were required by the Planning &Community Affairs
Agency along with our application for "701"Planning grants.
CLAIM -MOSES LAKE SCHOOL DISTRICT NO.161.
q9 Aclaim had been submitted against-the City of Moses Lake for water damage at
I Larson Elementary School when water was turned on after it had presumably been
winterized.This was presented for Council notation and referred to the City's
Insurance Agent.
