COUNCIL MEETING -REGULAR SESSTION December 23,1969

Dr.Lindell and Michael Boyle.
Mayor Otto Skaug called the meeting to order.Minutes of the previous meeting
of December 9,1969 were approved as written upon a motion by Bob Hill,second
by Norman Johnson.Carried.

CONSIDERATION OF BIDS -AUTOMOTIVE VEHICLES
/0/7AletterwasreadfromtheCityManager,Chester L.Waggener,stating that
bids on five vehicles had been received on December 17,1969 and attached the
bid tabulation.He recommended awards be made to the low bidders as follows:
1.3/4 Ton Pick-up C & V Dodge $1978.00

*Due to a misunderstanding in drafting specifications,the basic bid is
for a vehicle without interior insulation and lining.Thi s is not suitable for a
vehicle to be used for ambulance purposes.The alternate bid does provide for
a finished interior and is what was intended when calling bids.A tie bid was
noted for Iteml.-3/4 Ton Pick-up.Representatives for both firms were present
at the meeting.Norman Johnson made a motion the bid on the 3/4 Ton Pick-up
which tied,be rejected and call for new bids on thi s item.The Councilmen asked
if it would affect all those that bid or only the two tie bidders.The City Manager
stated the proper procedure is to reject all bids on the item or accept a bid.Norm
Johnson withdrew his motion,which died for lack of a second.There was discussion
as to whether it would be proper.to have the two bidders re-bid especiallysince
a figure had been disclosed.The representatives of the two firms were asked if
they would accept a flip of a coin for the decision,and they agreed.The
Secretary was asked to flip the coin.Thompson Equipment chose tails and
C & V Auto accepted heads.The coin came up heads and C & VAuto was deter
mined the successful bidder for the pick-up in question.
A motion was made by Norman Johnson to accept the decision to award the bid to
C & VAuto and accept the recommendation of the City Manager regarding the remain
ing four vehicles that the awards be made to the low bidders.Second by Dr.Lindell.
Passed unanimously.

PUBLIC HEARING -PROPOSED L.I.D.FOR PAVING OF NORTHSHORE DRIVE -
300 &400 BLOCK
Mayor Skaug opened the public hearing and asked Ron Baker,Assistant City Engineer
for a short explanation of the work contemplated for the proposed project.He stated
that 80%of the property owners signed a petition in favor of improving the street.
Jim Ellinger offered a slope easement provided the shrubs would be replaced that would
have to be removed.The easement would help to eliminate some of the problems of
drainage.He further stated that included in the project is repairng some of the curbing
that has settled.The cost of the curbing presents a bit of a problem since some of
the owners feel the curb repair cost should be carried by the city and not made part of
the L.I.D.Along approximately three lots,300 feet of new curbing is required and
the cost would have to be billed to the individual property owners since they now
have none.Also sanitary sewer stub-outs would have to be assessed to these three
lots and included in the L.I.D.cost.
Mayor Skaug asked for comments from those attending the hearing concerning the
project.
Larry Peterson,representing the Catholic Church,asked what the curb repair estimate
would be concerning the church property.
Ron Baker stated -broken down per 100-foot section,would be about $25 or $30
per lot.
Emil Kluth - 415 No rthshore Drive -stated he objected to the LID and that he did not
sign the petition and cannot see that the street is worse than it was eight years ago,
the length of time he has lived on Northshore Drive.The drainage correction he does
not feel will do any good at all,because the slope is at least a foot lower on the
South side than on the North side of the street.
Jack Rausch -420 Northshore Drive -at the time the petition was presented they
were trying to find out what the cost would be and instead he received the billing.
He also objected to the curbing cost.He asked if the curbing does not need repair
ing does a property owner have to pay for curbing?
Ron Baker -stated where an overlay is requested,a good job cannot be done on the
overlay without the curbing along with it.He also mentioned that the assessment
notice received is a preliminary notice.The LID has not been granted yet -this '
public hearing tonight is necessary to hear from the people involved.
Bob Coyle -407 Northshore Drive -said he came to listen.
Richard Teats -828 W.Broadway -owner of Lot 1,Knolls Vista 19,also known as
423 Northshore Drive -thinks there is some misunderstanding about the petition
and would like to see the LID defeated since some of the property owners are not
sure exactly the intent of the petition.
Leon Bodie -335 Northshore Drive -stated he is for the LID as long as they leave
his curbing as is and the cost of any curbing should be carried by the City.
Ron Baker -stated that it is not the intent to re-establish grading along the street,
it is to remain as is,simply an overlay on the existing asphalt.
Mrs.Emil Kluth -will it help from keeping water running into the garages ?
Leon Bodie -asked how many people are bothered with this -the only one he knows
of is Jim Ellinger .
Ron Baker -the project will not eliminate all the drainage problem in the area and
therefore,it is going to continue to run on down to the Lake. Dry wells help to _^
a certain extent but would bog down in this area in approximately six months.|

Emil Kluth -asked about sidewalks -he understands they are required.
Mayor Skaug commented,it is true there are no sidewalks provided for in the pro
posed LID,but it is only a major improvement rather than a complete road job and
thus not including sidewalks .
Mayor Skaug closed the public hearing to those attending.One written protest was
read from Rodney and Margaret Gannon,owners of Lot 23,Knolls Vista 5A Addition.
Ron Baker stated the assessments range from $400 to $3000 for the Catholic Church
property;the average individual lot per 100 feet is approximately $600 - The Teats'
property is $1012,which in this case requires sanitary sewer stub-outs plus curbing.
The sewer stub-out provide sewer facilities from the house.

The City Manager explained that the street was originally put in with a light bi-
-tuminous anticipating other paving was coming at a fairly early date.Light
bituminous paving when it deteriorates to a point where it cannot be maintained
will return to a gravel street.If the property owners wish to have their street
improved it is best to get it now before it becomes basically a gravel street again.
The storm drainage is incidental to the basic paving job.
Bob Hill felt that the $700 regarding the curbing could possibly be assumed by the
City rather than be a part of the assessment.
—Dale Nelson - 317 Northshore Drive -about 15 years ago when his house was built
~j they did not allow adequate setback - if a sidewalk is put in it will be right up
against his front door and the sprinkler system installed would have to be removed
I I and replaced.
Mrs.Kluth -mentioned that when they put in their driveway they were told they had to
allow for sidewalks.If one property has.to allow for it others should too.
City Manager -commented that if the City were to maintain curbing perpetually it
could only maintain it on a paved street and not on a gravel street.If the City is
going to accept maintenance for assuming repairs of curbing there wil 1 be more
requests on gravel streets.
Mrs.Hill -the cost perhaps would be less than the estimate we received?
Mayor Skaug -it is hoped that it will be substantially less if the City can incorporate
it with other bids such as the upcoming Pioneer Way project.
Dr.Lindell -if 80%signed in favor of the project,what percent were not in favor?
Ron Baker - 3%protested the LID in writing.The LID procedure calls for all protests
to be filed in writing.
The City Manager explained that if the Ordinance is adopted,those not in favor can
still stop it within 30 days following passage of the ordinance.It takes technically
I 60%majority protesting to take the authority away from the Council,or it can stop
short of that at 50%if the Council wishes to relinquish to that percentage.
Moved by Dr.Lindell to close the public hearing.Second by Michael Boyle.Passed.
ORDINANCE NO.605 ESTABLISHING L.I.D.NO.25.
The ordinance was read by title only establishing L.I.D.No.25 affecting the 3 00 and
400 Block on Northshore Drive.Mayor Skaug noted that the second reading be waived,
and asked should the Council wish to hold to the second reading.It was brought out
that usually after a public hearing the ordinance is passed on the first reading.
Motion by Gordon Ebbert,second by Dr.Lindell that Ordinance No.605 be passed
on the first reading.
Bob Hill wished to have the cost of curbing cleared.
M.G.McLanahan,Street Superintendent,noted that if the city repaired the curbing
it would not be a professional job and recommended the curbing cost be included in
the LID and they would have a professional job -also mentioned the 1970 Budget did
not provide sufficient money for such work.
City Manager -explained that the proposal is to replace 200 feet of cufcjingwhich
has settled and causing ponding,and the cost is included in the entire LID.
Dale Nelson -once a curbing is installed,it belongs to the City to maintain and would
like to hear a ruling on it.
City Manager -there is a misunderstanding -once a street is put in according to code
and accepted for maintenance,it is possible the street will have to be redone in
30 years or less time,and in this instance propose another LID and assess the property
owners.

Bob Hill proposed to add an addendum to the motion made by Gordon Ebbert to
accept the Ordinance -to omit from the cost of the L.I.D.approximately 200 feet
for the repair of the curbing that is defective and have it done professionally,this
cost to be carried by the City.A voice vote was taken on the addendum and was
defeated.The motion passing the ordinance at it's first reading passed.
REFERRAL FROM PLANNING COMMISSION -USE IN HS ZONE -AUTOMOBILE TOWING
-7\QO I A letter was read from the Building Inspector,John Taylor,recommending acceptance
of towing in Highway Service Zone.The request was noted by the Planning Commission
on their regular meeting on December 19,1969 and/to tneXttty council that the High
way Service Zone include the Towing Service.
Dr.Lindell asked if this required amending the Zoning Ordinance?
John Calbom,City Attorney,was present and stated the ordinance provied that if
a use is not mentioned in a particular zone,the City Council may,after the Plann
ing Commission considers this particular use,permit in any Zone a use that may be
described in keeping with the intent and use similar to uses in the zone,the City
Council would have to right to authorize this use.A copy of the minutes should go
to the Planning Commission noting the authorization.
Gordon Ebbert made a motion to include automobile towing as a permissable
business in Highway Service Zone.Second by Norman Johnson.Passed unanimously.

RESOLUTION NO.502 -AMENDING THE BASIC COMPENSATION PLAN
City Manager,Chester L.Waggener,stated the Resolution establishes the salaries
and classifications for all city employees as approved by the City Council when
accepting the 1970 Budget.It spells out employee classification for use in determin
ing those people qualifying for overtime pay or compensatory time.It allows Police *
and Fire Personnel to receive one and one-half time,where in the past they received
compensatory time for extra hours worked.Compensatory time depletes the staff
when people take time off for compensatory time accumulated.It also gives the
formula for computing overtime pay and holiday pay.It also allows for education i
premium pay based on the monthly salary for those personnel other than Department
Heads or Clerical.Sick Leave is the same as in the past -one paragraph has been
added to Sick Leave -"When,because of the City's membership in any retirement
system the City is required to continue the salary of an employee,*the sick leave
accumulated hereunder shall run concurrently with the requirements of the retire
ment act."
Motion by Michael Boyle that Resolution No.502 be adopted and insert (*)on
Page 8,first paragraph,line 4 -"because of disability".Motion seconded by
Bob Hill.Passed.
LONGVIEW TRACTS -WATER SYSTEM
Several people in the Longview Tracts asked the City Manager to submit a more
detailed letter as has been previously.The proposal letter is being submitted to
the City Council for their concurrance.
Dr.Lindell stated that since this item was tabled at a previous meeting it will
have to be removed from the table before making a particular decision.Moved
by Dr.Lindell to remove the item from the table and place it on the Agenda as
a matter of business.Second by Johnson.Passed.
The proposal was read in it's entirety.
The request was made by one of the residents of the Longview Tracts and have
multiple copies available so they can be distributed by the requesting party.
Motion by Gordon Ebbert that permission be granted to submit the proposal for
distribution by an interested resident of Longview Tracts.Second by Norman
Johnson.Passed.

REQUEST TO SELL SURPLUS EQUIPMENT
/a/7AletterwasreadfromM.G.McLanahan,Public Works Superintendent,stating that
a local contractor has requested permission to purchase a "J"Tamper owned by the
City.This equipment has not been in use since the purchase of a vibrator-type
roller.With no foreseeable need for the equipment,he requests permission that
the City Clerk be authorized to sell it.
The City Manager commented that a definite price offer has been received from one
contractor,although if permission is granted,the City request quotations from
other contractors in the community and sell it at the highest price offered -almost
a bid-type procedure without the formality.
Bob Hill moved to dispose of the property as proposed by the City Manager.
Second by Bill Moe.Passed.

as follows:
Leonard Cook,to fill the unexpired term of Larry Peterson,terminating December 31,
1973 .Ted Walters,to fill the unexpired term of Dean Hagerty,terminating

Motion by Boyle to confirm the appointments.Second by Dr.Lindell.Passed.
Mayor Skaug submitted the appointment of Tom Nesby to the Inter-Racial Commission
with his term expiring July 1,1971,augmenting the Commission from eight members
to nine.Motion by Bill Moe to postpone this appointment until the next meeting.
Second by Hill.A voice vote was taken and the motion passed.
