1961 04 25654 April 25,1961 The Council met in regular session,the meeting was called to order by Mayor Law, councilmen present were:Frank Holmes,Russell Stark,Harold Stadshaug,William Hilderbrand,John Dietzen and Fred Krueger. The minutes of the last regular meeting of April 11th,were approved by the council. BILLS:were audited by the council.The motion by Stark seconded by Holmes,bills be paid and warrants drawn.Motion carried. P \g BIDS ON AIRPORT:were reported on by Acting City Engineer,J.Garth Anderson,stated jthat two bids received,that of Basin Paving Co,in the amount of $20,310.16 and McAtee &Heathe for $23,882.56.Bids higher than anticipated.The motion by Hilderbrand seconded by Stadshaug,bids be turned over to the City Manager,City Engineer and Airport Advisory committee for further study.Motion carried. \0PILGRIM CONGREGATIONAL CHURCH FINAL PLAT:Minutes of the Planning Commission of April 20th,1961,approving the preliminary and final plat of the Pilgrim Congregational Church was read.The motion by Dietzen seconded by Holmes,final plat of the Pilgrim Congregational Church be accepted.Motion carried. \<)MSLgA ADDITION:Minutes of the Planning Commission of April 20th,196l whereby the City Engineer reported that the plat is ready for final approval,except for the payment of advance taxes,and recommending to the City Council that they set a time limit of 30 days for filing this plat,or have cash bond that is posted to guarantee platting,forfeited to the City.The motion by Stark seconded by Dietzen to accept the recommendation of the Planning Commission,and cash bond be utilized to satisfy all taxes and complete filing if not completed by owner in 30 days.Motion carried. JREQUEST BUILDING PERMIT PRIOR TO PLATTING:Minutes of the Planning Commission of »\*J ..pril 20th,1961,recommending to the City Council that a building permit be issued \upon posting of a satisfactory cash bond to guarantee completion of the plat within specified time was read.Discussion.The motion by Stadshaug,permit be granted subject to a posting of a $2,000.00 bond for completion and filing of plat,subject to approval of engineer,or bond be forfeited after sixty days,if Plat is not filed. Holmes,Stadshaug,Dietzen and Krueger,for,Stark and Hilderbrand against.Motion carried. PUBLIC HEARING TRAILER COURT EXPANSION:Minutes of the Planning Commission of April 20th,1961,recommending that the City Council set a date for a public hearing at the regular meeting of the Planning Commission on May lith,196l was read.The motion by Holmes seconded by Dietzen that a public hearing be set for May lath,1961 regular meeting of the Planning Commission,for a special permit for expansion of ikes Trailer Park.Motion carried. / ,REQUEST FOR WAIVER OF COMMUNITY STANDARDS;Letter from City Manager,Chester n^Waggener,stating that Mr.Frank Mertz,has requested a permit to install sidewalk \\in front of his building on East Broadway.Community Standards which were adopted by ordinance do not permit sectional or partial development of public rights-of- way, and that we do not have the authority to violate the provisions of this ordinance. Mr.Martz has requested to appeal this decision to the City Council.Discussion. The motion by Stark seconded by Krueger authorization be given to extend sidewalk ninety feet in front of Econ-0-Wash building on East Broadway,^otion carried. April 25th,Cont'd STATS PARTICIPATION OF L.I.D.ON EAST BROADWAY:Letter from City Manager,Chester Waggener,stating that there is possibilities of a L.I.D.street development along East Broadway,known as secondary State Hi-Way 7-2 now under state Control,and feels that investigation with the State Hi-Way Dept requesting state participation in this proposed improvement should be made.The motion by Stark seconded by Hilderbrand that the City Manager be instructed to request financial assistance in this project from the State Hi-Way Dept.Motion carried. CALL FOR BIDS FIRE ALARM SYSTEM:City Manager,Chester Waggener,explained that the /OZ7 specification for the Fire Alarm System had to be rewritten,due to joint use provisions ofcertain power poles etc,and requesting authorization to call for bids to be opened and read at the next regular council meeting.The motion by Holmes seconded by Stadshaug,to call for bids on the Fire Alarm System at the next regular council meeting on May 9th,1961.Motion carried. REPORT ON CONSTRUCTION PROJECTS:was given by Acting City Engineer,J.Garth Anderson, Dog Poung complete,few small items to be changed,and stated that workmanship is generally poor.Mayor stated that he felt the work on the dog pound was very poor, sloppy job on the concrete,wooodwork,and in general very poor construction.Mrs. Engholm appeared before the council,in regards to the leash law,and wanted to know how we plan to take care of the dog problem.Was told that fifteen dogs had been disposed of that day. Pump House:Piping installed and tested,completion date is Monday May 1st.Pump is in. -Swimming Pool:Back wall tunnel nearly complete,lights to be installed on Wednesday Bath house wall poured and also wall in filter room.Progress satisfactory. LIBRARY CONTRACT:Agreement explained by City Manager,Chester Waggener.M0ses Lake//^~V Library Board has approved proposal contract and will be considered for standard contract at next meeting of N0rth Central Regional Library Board.No objections to proposal contract were expessed by the Council. LETTER FROM MR.BERTRAM:in regards "W"'specifications for construction of possible /00& violation of conflict of interest statutes.Acting City Engineer,read letter from John McInerny,Consulting Engineer,providing an interpretation of the specifications and stating that all work has conformed to specifications.City Attorney,John Calbom stated that,in his opinion,no violation of statues exists inasmuch as materials supplied the contractor are in no manner a contract with the City and that payment for same is not contingent upon any payment from the City.
