1962 04 10If APRIL 10,1962 COUNCIL MEETING REGULAR SESSION 8:00 P.M.CITY HALL The council met in regular session,the meeting was called to order by Mayor Dietzen.Councilmen present were:Otto Skaug,Harold Stadshaug,William Hilderbrand, Alex Law and John Dietzen. Fred Krueger and Gordon Ebbert absent. The minutes of the last meeting of March 27th,were approved by the council,also the minutes of the Special Meeting of April 2nd,1962. Motion by Law seconded by Stadshaug,proceed with the low bid of Floyd Swenson,$31,1482.Skaug,Stadshaug,Law,Dietzen for.Hilderbrand against.Motion carried. _J BEflSELMAN ADDITION - REQUEST FROM LEVI MACKIN Mayor Dietzen, explained a study session was held in regards to the drainage problem. Mr.Levi Mackin stated he had an agreement with the City Supervisor and City Engineer,to fill in ditch,which is five feet deep.Paid $5,000 for the lot,then gave an easement to the City,which he felt was doing the City a favor.Problem was never brought up before the council. Expected the city to have it filled in and leveled up.Mr.John Moberg attorney for Mr.Mackin,asked what would the city have done if Mr.Mackin had not let them have an easement,as there was a definite drainage problem. Recording by Mr.McCosh (who x*as Mayor at the time)and Mr.Chester Waggener City Manager,regarding Mr.Mackin purchase of property and granting of easement.Mr.McCosh stated there were no verbal agreements for City to install drainage tile,that Mr. Mackin was definitely advised that City would not do so. Mr.Mackin not in accord with Mr.McCosh,felt he had an agreement before he put up the $5,000 for the purchase of the property. City Attorney,John Calbom asked Mr.Mackin,at what time he discussed this matter,before the purchase of the property or after.He stated before. Noted nothing in the easement regarding city filling in this ditch,why did he sign easement.Said he did not read easement,just signed it. Motion by Hilderbrand seconded by Law,inasmuch as the signed easement specifically states that City would not install drain,that the request by Mr.Mackin for such installation be denied.Motion carried. SIDEWALK PETITION -EVERGREEN DRIVE Petition representing 69$of frontage and area on Evergreen Drive was presented,requesting sidewalks.Motion by Hilderbrand seconded by Stadshaug,Ordinance be drawn up for L.I.D, No. 17 Evergreen Drive.=Motion car.
