1963 03 26782 COUNCIL MEETING MARCH 26,1963 REGULAR SESSION 8:00 P.M.CITY HALL The City Council met in regular session with the meeting called to order by Mayor John Dietzen.Other councilmen present were:Gordon Ebbert, Fred Krueger,William Hilderbrand,Otto Skaug,and Harold Stadshaug. Mr.Forrest Hardin was absent. Minutes of the last Council meeting of March 12th were approved by the City Council. Written protests received in amount of 66.8%,itemized as follows: Assessment No. 7-5 7-6 7-8 7-10 Owner John R.and Lapreille Bohne Robert and Donna L.Renner Carl and Betty Sheppard Donald R.and Viola J.Rundle Amount 184.24 184.24 192.33 220.42 Public Works Director,Garth Anderson,felt the above protests were an . accurate account of property owners'feelings,even though it was possible to have the sidewalk portion of the project deleted in Units #1 and #2.M Garth stated Unit #4 was approximately a $30,000 project and that it would be worthwhile to go ahead and call for bids on just this unit, although there would be less competition and possibly a little higher cost.'However,if the cost were above 10%of the estimate,the project would be forced to be dropped. Motion by Krueger,seconded by Ebbert,that an ordinance be drafted on proceeding with Unit #4 for reading at next Council meeting.Motion carried. The other units failed,although considered,because of the large percentage of protests that were received. SAFE AND SANE FIREWORKS Mr.Skaug moved that the item on Safe and Sane Fireworks be taken from the table and the the City abide by present ordinances as written.Seconded by Mr.Stadshaug.Motion carried. RETAIL TRADES -REQUEST TO GLOSE STREET A letter from Larry Jobin,Chairman,Special Promotions,Moses Lake Chamber of Commerce was read.He;:stated the Retail Trades Committee wished to conduct a "Moses Lake Side-Walk Sales Day"on July 19, 1963 between the hours of 9:30 A.M.and 8:30 P.M.The committee requested permission to block off Third Avenue from Alder Street to Ash street during these hours. Mr.Jobin appeared before the Council and explained the purpose for this request.It was felt it would promote additional business during the "Crazy Days"Sales.Fire Chief,Chet Roily,felt no fire hazard would be caused as access could be had through the alley.However,Mr. Jobin was to work with the Fire Department. n 786 MARCH 26,1963 (Continued) RETAIL TRADES -REQUEST TO CLOSE STREET (Continued) Motion by Krueger,seconded by Hilderbrand,that Retail Trades Com mittee be authorized to block off Third Avenue from Alder Street to Ash Street on July 19th as requested,providing they work out any possible problems with the Fire Department.Motion carried. SAVEKO DRUG -APPEAL RE:TEMPORARY BUILDING A letter was read from Jim Wright,Building and Planning Director,stating that on March 18,1963,a request was made by Saveko Drug to erect a sales tent on their property next to Jack's Bargain Barn.The construction of this type of facility in a Fire Zone #1 does not conform to the City Building Code.It was Jim's opinion that use of the tent for a period exceeding thirty days would normally not be considered a temporary structure and would not comply with the Building Code. Mr.Jack Newton appeared before the Council and explained that this tent was 100'from any building,had open sides,and would contain plants,etc. with running water at all times.He could see no fire hazard and wished to be allowed to have this tent in use for a 90-day period during the spring and early summer of each year. Fire Chief Roily explained the difference in the Building and Fire Codes and that the enforcement of fire regulations and standards would be done by the Fire Department,although the Uniform Building Code outlines these standards. Jim Wright stated that our allowing this temporary building for any period of time might cause a lower rating by the Rating Bureau. Motion by Hilderbrand,seconded by Skaug,that this request be tabled until next Council meeting and that Jim Wright write to the Rating Bureau in regard to their opinion on what this could do to any future ratings if we allowed this type of temporary building in this location.Motion carried. PARKING STUDIES -RECOMMENDATIONS FROM PLANNING COMMISSION Letter read from Jim Wright,Building and Planning Director,stating the Planning Commission had completed ;their study of the parking problems in residential zones and recommended the following: 1.Amend the Zoning Ordinance by permitting parking and storage of boats,camping trailers not exceeding 2 0 feet in length, camper trucks and other recreational equipment inrear yards and front yards.Parking in side yards may be permitted by agreement with the adjoining neighbor. 2 .Amend the Zoning Ordinance to permit one off-street parking space in front yards for single-family dwellings for automobiles and trucks not exceeding one-ton capacity.Large trucks exceeding one- ton,heavy commercial,industrial,and agricultural equipment and machinery would be prohibited from being parked or stored in R-l,R-2 ,and R-3 zones.It would be permitted in the Rl-S suburban zones. 787 MARCH 26,1963 Continued Councilman Ebbert questioned whether this was fiar to the small-equipment operators,not large enough to establish buildings outside the city and who have been in business for many years.City Manager,Chet Waggener, stated that we prohibited commercial buildings in residential zones and this was somewhat the same.Jim Wright stated that our residential zones would become testing grounds causing mixed uses. Motion by Hilderbrand,seconded by Skaug,that Planning Commission's recommendations,numbered 1 and 2,be drafted in ordinance form for read ing at next Council meeting.Mr.Ebbert added the amendment that six months'notice be allowed those having existing businesses.The motion carried. Motion by Hilderbrand,seconded by Stadshaug,that an ordinance be drafted for first reading at next Council meeting providing that on-street parking of heavy or industrial equipment,large'trucks exceeding one-ton capacity, trailers,recreational equipment,etc.,be prohibited in residential zones. Motion carried. LIBRARY BOARD -PRELIMINARY BUILDING PLANS 13 It was moved by the Library Board at their meeting on March 25,1963, that an auditorium be built in the basement creating a defense fallout shelter in the proposed library building,providing that the City Council were in favor of this.This action was stated by Mr.John Hayes, Vice-Chairman of the Library Board,who appeared before the Council. Architect,Harvey Vernier,stated that the cost of this would be a little greater and possibly less convenience for the library staff would also be involved.He said a small basement would be necessary anyway for the heating and air-conditioning equipment.The Council decided to meet with Mr.Vernier at a special study session for further discussion.n «* PARKS &RECREATION -POLICY RECOMMENDATIONS FOR PLANTINGS &GIFTS Letter from Clem Brigl,Parks and Recreation Director,outlining the recom mendations of the Moses Lake Parks Advisory Board at their March 21st meeting,In brief,they are as follows: Properties used in the parks should be given to the City on a permanent or semi-permanent basis at the time of erection or placement.If organ isation holds title,they shall be governed by rules and regulations of City and Parks Advisory Board.They shall also maintain the property. If City is given title,maintenance shall be done by the City. Planting areas are to be designated by the City for planting.Clubs wishing to plant in any of these areas shall present a plan to Parks Advisory Board for approval.Those who plant shall maintain their plantings in the designated areas,with the exception of watering, which will be done by the City.Those not complying with a standard type of care will be sent notice,*and if still not complying after • a reasonable period of time,the planting will be resodded by the City. This reasonable period of time will be determined by the Parks and Recreation Director. Motion by Krueger,seconded by Hilderbrand,that City accept recommendations of Parks Advisory Board regarding park plantings and gifts.Motion carried. - 788 MARCH 26,1963 Continued CORRESPONDENCE FROM HOUSEWIVES RECREATION COMMITTEE A letter was read from the Housewives Recreation Committee thanking the City Council and City Manager for the enjoyment they have received from the recreational program at the new City Park. ACCEPTANCE OF STREET RIGHT-OF-WAY ALONG PENINSULA DRIVE /0 9 Garth Anderson,Public Works Director,showed Council the location of this 10'strip of land in Lot 1,Block 2,of Replat of Battery Orchards Track #31. Resolution No.292 was read accepting the conveyance of this deed for right-of-way purposes along Peninsula Drive to the City of Moses Lake from Mr.and Mrs.Clarence Jones and Mr.and Mrs.Jose Garza. Motion by Krueger,seconded by Hilderbrand,that Resolution No. 292 be adopted.Motion carried. RESOLUTION no.291 -TRANSFER OF FUNDS /O/O Letter from Jim Wright,Building and Planning Director read,requesting that $15 0.00 be transferred from materials and supplies to capital outlay enabling the purchase of a mobile radio unit capable of operating in conjunction with the Public Works citizen-band unit.This purchase Jim explained,would be in lieu of testing equipment previously authorized and a less-than-originally-planned cost of a new permanent zoning map. Motion by Skaug,seconded by Stadshaug,that Resolution No.291 authorizing this budget transfer be adopted.Motion carried. ORDINANCE NO.486 - SALE OF BONDS,L.I.D.#13 Motion by Ebbert,seconded by Stadshaug,that Ordinance No.486, fixing the amount,form,date,interest rate,maturity and denominations of Local Improvement District No.13 bonds and directing the issuance and sale thereof to Grande and Company,Inc.,Seattle,Washington be adopted on its first reading.Motion carried.
