1964 03 10872 COUNCIL MEETING REGULAR SESSION -8:00 P.M.-CITY HALL March 10,1964 The City Council met in regular session with the meeting called to order by Mayor Dietzen.Other Councilmen present were:Gordon Ebbert, Otto Skaug, Harold Stadshaug, William Hilderbrand, Forrest Hardin and Fred Krueger. CERTIFICATE OF GRATITUDE -ASSISTANCE TO POLICE DEPARTMENT /&& Mayor Dietzen read a letter from Chief Bjork,commending Airmen Robert W.Goin,Harry L.Esterline,Roy L.Viar III,Kenneth M„ Rackstad and Celestine B.Le Clair for"their assistance in apprehending a burglary suspect on February 22,1964. Mayor Dietzen presented a Certificate of Gratitude to each of the Airmen. 873 MARCH 10,1964 CONSIDERATION OF BIDS -PUBLIC WORKS BUILDING A Letter was read from City Manager,Chester L,Waggener,|CM°recommending that $786.15 be transferred from each of the two funds,Capital Outlay Not Specified in the Water and Sewer Fund, and Street Construction Not Specified in the Street Fund,should the Council choose to award the bid for construction of an addition to the Public Works Building.He explained that the low bid of L & S Construction Co.in the amount of $8,104.72 and architects fee of $467.58 is $1,572.30 in excess of the budgeted amount.The proposed building is a minimum building, and if the size of the building were reduced,the building j .-> would no longer serve its intended function.However,the building is needed now,and costs will probably not be less _ at any future date. Motion by Skaug,seconded by Stadshaug, that the consideration of bids on the Public Works Building be removed from the tabl'e.- Motion carried. Motion by Stadshaug, seconded by Hardin, that the low bid of- L & S Construction Company in the amount of $8,104.72 be accepted, and the architects fee of $467.58 be paid.Motion carried. LID NO.18 -FINAL HEARING ^Garth Anderson explained that upon completion of LID #18 the \ Engineering office prepared the final assessment roll based on the final costs.The LID has been completed and the expenses* are incurred.The Councils position is to sit:as a goard of Equalization to consider any protests that may have been received in the light of whether these pieces of property have been fairly assessed. It is not proper for a citizen to submit a general protest of the project because the project was approved early last year. Mr.Anderson showed a map of the area,and explained the basis on which the property was assessed. pv Letters of protest were read from Bruce &lone Hull,Mr./"&Mrs. T.K.Bailey and Ralph Kinkaid.None of the protesting property owners were present at the meeting. or Mr.Anderson stated that all of the letters have been checked. Side laterals in this part of town are expensive.They aire digging through 9 or 10 feet of caliche for every connection, but the property owners are paying only the actual costs. It was agreed that there may have been a misunderstanding tbetween the Hull's and the contractor,but Mr.Waggener pointed out'that the pertinent point is that even if it was misinterpreted by the Contractor,they have not had any additional costs.•". Motion by Hardin,seconded by Stadshaug,that the public hearing- be closed.Motion carried.'•' Motion by Hardin,seconded by Stadshaug,that the protests of Bruce and lone Hull, Mr, and Mrs. T. K.Bailey and Ralph Kinkaid be overruled.Motion carried. ORDINANCE NO.505 -CONFIRMING ASSESSMENT ROLL,LID NO.18 ,-J«7 Ordinance No. 505,approving and confirming the assessment and U assessment roll of Local Improvement District No.18,which has been created and established for the purpose of.paying a part of the cost of improving Margaret Street and Lakeside Drive by grading,graveling,constructing and installing storm drains, side lateral sewer connections,curbs,sidewalks and asphalt concrete pavement,in the city of Moses Lake,as provided by Ordinance No.493,and levying and assessing the amount -thereof against the several lots,tracts,parcels of land and 'other property shown on said roll,was read..v < J MARCH 10,1964 374 ORDINANCE MO.505 -CONFIRMING ASSESSMENT ROLL,LID NO.18 (Continued) Motion by Stadshaug,seconded by Hardin,that Ordinance No.505 be adopted on its first reading.Motion carried. AIRPORT -REQUEST TO LEASE BUILDING ., Letter was read from M. L.Bertram,President of Moses Lake Sky- diver Club,requesting authorization to rent the old office building at the Municipal Airport on a quarterly basis of $2 5.00 per quarter. Mr.Waggener said that the Skydiver Club had also agreed to pay for the electricity and to mow and water the lawn. Motion by Ebbert,seconded by Skaug,that the Moses Lake Skydivers be allowed to rent the building at the Airport for $25.00 a quarter,with provision that rental can be terminated upon notification.Motion carried. REQUEST TO ENCROACH UPON CITY PROPERTY -HARRY L.COULSON '/&ZZL Letter was read from Harry L.Cculson requesting permission to install a sunshade onto his building at the city Park,which would extend over the parking lot on the west end. Mr.Coulson was not present at the meeting,and no plans have been submitted by him. Motion by Stadshaug,seconded by Ebbert,that Mr.Coulson's request be tabled until further information can be submitted. Motion carried. CIVIL SERVICE COMMISSION -APPOINTMENT _/03 y Letter was read from Mayor John F.Dietzen requesting confirmation of his appointment of John Vreiling to the civil Service Commission filling the unexpired term of Leo Beck,such term to expire May 2,1965. Motion by Krueger,seconded by Hilderbrand,that the appointment of Mr.Vreiling to the ^ivil Service Commission be confirmed. Motion carried. FIRE DEPARTMENT -VACANT LOT WEED CONTROL //9/ Letter was read from Fire Chief Otto Jensen,requesting authori zation to proceed with a plan for control of lots overgrown with weeds.This plan gives the property owner three alternatives, after being notified that a hazardous condition exists.He can cause the vegetation to be cut and removed within 10 days from the date of notice,obtain an open burning permit and burn the vegetation within 10 days from the date of notice,or request that the Volunteer Firemen burn the vegetation on the lot for a predetermined fee. The Volunteer Fire Department will use the city fire equipment for control, and the monies collected will go into the Volunteer Fire Department fund. Motion by Hilderbrand,seconded by Hardin,giving Fire Chief Jensen authorization to proceed with the control of lots over grown with weeds.Motion carried. SIX YEAR STREET PLAN -SET PUBLIC HEARING '77 Mayor Dietzen explained that the six year street plan has to be submitted to the state to qualify for \<t gasoline tax. We are required to hold a public hearing so that everybody effected can be notified.He also requested that the next Council meeting be set back to March 23. 875 MARCH 10,1964 SIX YEAR STREET PLAN -SET PUBLIC HEARING (Continued) Motion by Hardin,seconded by Krueger,that the public hearing on the 6 year street plan be set for March 23, as well as the Council meeting which would regularly be held March 24,and that notices be sent out to that effect.Motion carried. SPECIAL USE PERMIT u Letter was read from Building and Planning Director, James W ''Wright,notifying the council that a special meeting of the Planning Commission was held March 9,1964 for the purpose of - holding a public hearing on a proposal made by Our Lady of Fatima Catholic Church requesting a special use permit for construction of a parochial school west of Earl and Dale roads in the Knolls Vista area.The Planning Commission recommended to the City Council that a special permit for a parochial school be issued, subject to approval of the plat and also subject to the provision of a 25'landscaped strip along the easterly boundary of school property. No recommendations as to paving of the parking"lot' were made. Mr.Vernier and Mr.Alex Law showed sketches of the proposed plan indicating a buffer of 4 residential lots between the present residences and the school,and also a 25!landscaped strip betwe"en the parking lot and the street. The Council felt that they should have a plan that is more detailed spelling out exactly what is going to be done,such as exact location of parking lot and whether the parking lot *is goin^ to be paved or graveled.They also felt that there had been insufficient time to study the minutes of the Planning Commission meeting. Motion by Hardin,seconded by Hilderbrand,that the question I be tabled until the 23rd of March,to give council time to study the minutes of the Planning Commission and to g Vernier time to complete a plat plan.Motion carried MOSQUITO CONTROL -RESIGNATION \\\y9 Letter was read from Mr.M.J.Pippins resigning from'the Mosquito Control Board,and recommending the names of Max Ott, Ned Thomas,Leon Brodie,William McKenzie and George Massart,Jr. for appointment. Mayor Dietzen said that he had received a call from Mr.Ned Thomas asking that his name be removed from the recommended list. Mr.Dietzen also asked that Council give some thought to the appointment. Motion by Skaug,seconded by Hardin,that the meeting be recessed until Friday at 4:30 P.M. for the purpose of canvassing ballots and certify ing the election returns.Motion carried.
