1964 11 10940 COUNCIL MEETING REGULAR SESSION -8:00 P.M.-CITY HALL November 10,1964 The City Council met in regular session with the meeting called to order by Mayor Stadshaug. Other Councilmen present were: Gordon Ebbert,Monte Holm,Otto Skaug,Jack Eng,Forrest Hardin and K. H. McDonald. Mayor Stadshcvi.g requested that Resolution No. 340,commending Garth Anderson,be included in the minutes of the October 27,1964 meeting. Minutes were approved as ammended. BILLS were audited by the Council.Motion by Hardin,seconded by Holm, that the bills be approved and warrants drawn.Motion carried. Street Arterial McAtee and Heathe,Inc. -Release of Retainage 2,216.49 Contract 64-04 Sealcoating Also read was a letter from Assistant City Engineer,William Daugaard recommending release of the retainage in the amount of $2,216.49.The 30 day lien period has elapsed and no liens have been filed against McAtee and Heathe,Inc. Motion by McDonald,seconded by Hardin,that the bill be approved and warrant drawn.Motion carried. Water &Sewer Leonard Plumbing Company -Progress Payment #1 6,673.07 Contract 64-05 Well No.9 Mathews Steel ^uildings -Progress Payment #1 2,652.00 Contract 64-05 Pumphouse for Well #9 Also read was a letter from Assistant City Engineer,William Daugaard recommending acceptance of the work and payment in the amount of $2,652.00.75% of the construction of the Pumphouse has been completed. Motion by Holm,seconded by Eng,that the bills be approved and warrants drawn.•Motion carried. 941 CITY COUNCIL MINUTES:NOVEMBER 10,1964 REFERRAL FROM PLANNING COMMISSION -PROPOSED ORDINANCE RE:SET-BACK ON CERTAIN ARTERIAL STREETS Letter was read from Building and Planning Director,Merle W. Hoeft,submitting the Planning Commission's recommendation to establish a minimum front yard building setback of 25 feet on the East side of Stratford Road from the fill area to Highway 17, The Planning Commission also requested Council to reconsider a previous denial and establish a minimum 25 foot front yard set back for the area along West Broadway from Marina Drive to the "HS"highway service zone. Mayor Stadshaug recalled that the 25 foot set-back on West Broadway had come before Council some time ago. At that time the zoning ordinance was amended, but the set-back provision was not included. Mr.Waggener said that timing on the Stratford Road set-back might be important,as there was a possibility of a request for a building permit. It was suggested that Council should meet with the Planning Commission in a study session. Motion by Ebbert,seconded by McDonald,that the City Manager be authorized to prepare a proposed Ordinance to present at the next Council meeting,regarding the set back on Stratford Road.Motion carried. Mr.Thompson reported that the Planning commission has scheduled a study session for Thursday morning,November 12, at 7:00 a.m. at the Pancake House. RESOLUTION -STATE HIGHWAY DEPARTMENT -REVISION OF ACCESS PLANS 5SH 11G jqIQ Mr. Waggener showed prints of the revised access plan on SSH 11G from Nelson Road to G ape Drive.The only changes in this revised plan are in the Nelson Road area.This plan will permit the school access driveway to remain,but the Highway Department wants a locked gate so people other than school buses will not use the access road. Mayor Stadshaug suggested that School Board concurrence be obtained prior to adopting the Resolution. Motion by McDonald,seconded by Eng,that the item be tabled for consideration by the School Board.Motion carried. AGREEMENT -STATE HIGHWAY DEPARTMENT -MAINTENANCE OF FRONTAGE ROAD 1'ty Mr.Waggener showed maps of the area,and explained that this goes back to an agreement between the City and the State Hiohway Department dated a little more than 5 years ago. At that time, when PSH No.18 was under construction,Miss Longston,and the people operating the transmitter station,were denied access by the fill.The City Council interceded in her behalf,and an agreement was reached which required relocating a fence,at a cost of $1036.00.This money has been deducted from state gas tax monies,and the ^ity has been reimbursed by Miss Longston. The Resolution adopted by the Council at that time,spells out the same provisions that are in this agreement,principally that the City accepts maintenance of the front ge road.The State Highway Department needs the signed agreement to complete their records.This agreement doesn't require the City to do any thing unless it becomes a public thoroughfare.Work has been done,but it has been done by KSEM. Motion by Holm,seconded by Eng, that the agreement be accepted. Motion carried. NOVEMBER 10, 1964 942 SEWAGE TREATMENT -RATE AGREEMENT WITH PRONTO FOODS,INC.;j(*c Mr.Waggener explained the provisions of the proposed agreement between the City of Moses Lake and Pronto Foods.He pointed out the possible need for an addendum to Paragraph 6,providing that should the costs be greater,they will also be passed on to the industry.Mr.Calbom suggested that rather than re-write the agreement,an addendum letter be written. Mr.Waggener said that Mr.Calbom has pointed out that there is a serious question as to whether this Council can commit a future Council to an agreement such as Paragraph 11 Motion by Hardin,seconded by McDonald,that the agreement be accepted,with the provision that the Addendum letter concerning paragraph 6,be attached.Motion carried. SEWAGE TREATMENT -REQUEST TO ENGAGE CONSULTING FIRM /O Mr.Waggener requested authorization to engage the firm of Stevens and Thompson for engineering services on modifications to Sewage y^j- Treatment Plant,Wheeler St.Pumping Station and Trunk sewers.'^ He explained that this is a very detailed contract which spells / out exactly what Stevens and Thompson is to do, and what the City is to do. Motion by Holm,seconded by Ebbert,authorizing the Cj_ty Manager to engage the firm of Stevens and Thompson for engineering services. Motion carried. CORRESPONDENCE -PACIFIC NORTHWEST POLLUTION CONTROL ASSOCIATION - OPERATION REPORT AWARDS /0/3 Letter was read from Mr.Jerry Bollen of the Pacific Northwest Pollution Control Association complimenting Mr.Wilbur Hoist for his annual report,which was ranked as one of the top three in his Class by the Awards Committee.Mr.Hoist was honored at the banquet by presentation of a Certificate of Recognition for his accomplishment. Mayor Stadshaug commended Mr.Hoist and said that this is another indication of the caliber of department heads that are working with the City of Moses Lake. Meeting adjourned at 9:30 P.M. ATTEST: V.
