1965 02 23966 COUNCIL MEETING REGULAR SESSION -8:00 P.M.-CITY HALL February 23,1965 The City Council met in regular session with the meeting called to order by Mayor Stadshaug.Other Councilmen present were:Gordon Ebbert,Monte Holm,Otto Skaug, Jack Eng,Forrest Hardin and K. H. McDonald. Minutes of the last regular Council meeting of February 9, 1965 were approved by the Council as written. BILLS were audited by the Council.Motion by Hardin,seconded by McDonald, that the bills be approved and warrants drawn. Motion carried. Fire Alarm System -Moses Lake Library Motion by Hardin,seconded by McDonald,that the special bills from GOB #9 Construction be paid.Motion carried. Water &Sewer Basin Electric -Release of Retainage -Contract $308.26 64-05.Wiring for Well #9 Also read was a letter from Assistant City Engineer,William Daugaard recommending release of the 15%retainage.The 30-day lien period has elapsed and no liens have been filed against Basin Electric for labor or materials. Leonard Plumbing -Release of Retainage -Contract $1,860.17 64-05.Water nain and Piping for Well No.9 Also read was a letter from Assistant City Engineer,William Daugaard recommending that Council authorize release of the 15%retainage.The 30 day lien period has elapsed and no liens have been filed against Leonard Plumbing for labor or materials, Clearances have been received from the Tax Commission and the Department of Labor and Industries. 967 February 23,1965 SPECIAL BILLS (Continued) Water &Sewer Mathews Steel Buildings -Final Payment -Contract $776.15 64-05.Pumphouse for Well No.9 Also read was a letter from Assistant City Engineer,William Daugaard,recommending acceptance of the work. Stevens &Thompson,Inc. -Professional Engineering $3,600.00 Services,Sewage Treatment Plant (20%of $18,000 estimated Engineering ^ost) Motion by Holm,seconded by Skaug,that the special bills from the Water and Sewer Fund be paid,,in accordance with the recommendations by Mr.Daugaard.Motion carried. CONSIDERATION OF BIDS -PICKUP TRUCKS Letter was read from City Manager,Chester L.Waggener, 0 'recommending acceptance of the low bid of C & V Auto Sales & Service,for 3 pickup trucks, in the amount of $4,361.46.Other bids received were: Boyle Chevrolet,Inc.$4,467.43 Thompson Equipment Co.4,948.17 Moses Lake Ford Sales 4,600.00 Mr.Waggener said there was concern over the 50 to 90 day delivery date,however,in the past the 30 day delivery date has not been met,and since there is no penalty,he did not feel he cuuld recommend going to the second bid.C & V Auto Sales expects to be able to make delivery in 50 days,but to ( protect themselves,ran it up to 90 days.Principal concern is the panel truck used by the Poundmaster. Mr.Skaug pointed out that the bid bond of C & V Auto Sales was $5.00 short. Motion by Holm,seconded by McDonald,that the low bid of C & V Auto Sales be accepted,with a waiver of eligibility because of the bid bond being $5.00 short.Motion carried. PUBLIC HEARING -PROPOSED VACATION OF McNELLY ADDITION \j}Mayor Stadshaug opened the Public Hearing. There were no comments from the audience regarding the proposed vacation of McNelly Addition. Motion by Skaug,seconded by Eng,that the Public Hearing be closed.Motion carried. Letter was read from Building and Planning Director,Merle W. Hoeft,submitting information to Council in support of the Planning Commission recommendation to vacate the plat,excepting the 10 foot width to retain title to the full half width of Stratford Road.In accordance with present plans the land will be entirely consumed by the Washington State Highway Department in constructing the interchange at Highway 17 and Stratford Road. Motion by McDonald,seconded by Hardin,that the city attorney be instructed to prepare an ordinance for consideration at the meeting of March 9,1965.Motion carried. February 23,1965 968 PROPOSAL -PROSPECTUS FOR WATER AND SEWER BONDS -MARSHALL &MEYER . Mayor Stadshaug recalled that at the last meeting the proposal was made by Mr.Rae,and action was deferred until this meeting. Mr.Waggener said that concern has been that people out of the area,now knowing conditions of local economy,might be concerned by the Larson closure,and as Pronto Foods has no background or history,we are concerned about marketability of the bonds,and about interest on the bonds. Mr.Hardin said that he had contacted Seattle First's investment council concerning the bonds.They said that Marshall and Meyer is a very reputable firm,and under the circumstances,it would be wise to accept this proposal.The better the presentation, the more chance we have of getting a reasonable rate,and also of selling the bonds themselves. Motion by Holm,seconded by McDonald,that the proposal of Marshall &Meyer to prepare the prospectus for the Water and Sewer bonds,be accepted.Motion carried. INSURANCE CLAIM -AL SMITH -PROPERTY DAMAGE / /osy Letter was read from Mr.Waggener,presenting an insurance claim for personal property damage by Mr.Al Smith.This claim has been forwarded to the Insurance Agency for processing. Motion by Hardin,seconded by Eng,that the minutes note the receipt of the claim by Al Smith.Motion carried. ORDINANCE -AMENDMENT TO ZONING ORDINANCE -STORAGE OF MERCHANDISE Letter was read from Building and Planning Director,Merle W. Hoeft,submitting the Planning Commission request that Council review the proposed ordinance identifying display and sale of commodities,and/or storage of merchandise,supplies or commodities,and approve its adoption. The Ordinance,amending Ordinance No.433 entitled "The Comprehensive Zoning Ordinance of the City of Moses Lake, Washington"by repealing chat part of Section 150.20 entitled "Conditions"and adding a new section to be known as Section 150.25 entitled "Conditions"pertaining to the sale,display or storage of merchandise or commodities,was read by title only. Motion by Skaug,seconded by Eng,that the first reading of the ordinance be accepted,and that a public hearing be set for the March 9 meeting.Motion carried. ORDINANCE NO.522 -AMENDMENT TO ZONING ORDINANCE -WEST BROADWAY jj SECOND READING SQ&? Ordinance No.522,amending Sections 150.60 and 155.60 of Ordinance No.433,entitled "The Comprehensive Zoning Ordinance of the City of Moses Lake,Washington",by amending the front yard setback requirements,was read. Mr.Ebbert suggested that the ordinance be changed to read "A minimum front yard building setback of twenty-five feet..." Mr.Hardin and Mr.McDonald cited examples of other cities that have setback requirements,and spoke in favor of the minimum setback.Mr.Holm siad that he has been against it from the beginning,and is still against it. Motion by Eng,seconded by Skaug, that the second leading be accepted with the addition of the word minimum, and that Ordinance No. 522 be adopted.Motion carried with Mr.Holm voting no. 969 February 23,1965 ORDINANCE NO.521 -AUTHORIZING ISSUANCE OF BONDS -FIRE TRUCK a Ordinance No.521,of the City of Moses Lake, Washington, 0 providing for the issuance and sale of $40,000 par value of "General Obligation Fire Truck Bonds, 1965" of the City for the purpose of providing the funds to acquire a 1500 gallon per minute triple combination pumper fire truck;specifying the maturities and fixing the form and maximum interest rate of the bonds; and establishing a "Fire Truck Acquisition fund" and a "General Obligation Fire Truck Bond Fund,1965"was read by title only. Mr.Waggener suggested that as Council has actually called for bids for this equipment and it is to be delivered in about 45 days, and since there has been considerable discussion,the second reading of the ordinance be waived.This will allow us to proceed with the call for bids. Motion by Holm,seconded by Eng, that the second reading of Ordinance be waived,and the Ordinance be adopted.Motion carried. Motion by McDonald,seconded by Hardin,authorizing the call for bids for the Fire Truck Bonds for March 23,1965.Motion carried. RESOLUTION NO.356 -AUTHORIZING GRANTING OF DEED TO STATE OF WASHINGTON, DEPARTMENT OF HIGHWAYS Resolution No. 356,authorizing the granting of a deed to the State of Washington,Department of Highways,in the matter of SSH No. 11-G (S.R.17)Jet.PSH No. 18 to Ephrata Wye, was read by title only. Mayor Stadshaug recalled that this is property that was secured last fall by the City of Moses Lake for improvement of inter section of Nelson Road and 11G.The State Highway Department has found it necessary to secure limited access rights. Motion by Ebbert,seconded by Hardin,that Resolution No.356 authorizing conveyance of property to the State of Washington Highway Department be adopted.Motion carried. RESOLUTION NO.357 ACCEPTING DEED Resolution No. 357,accepting a Statutory Warranty Deed, conveying property to the City of Moses Lake from Jessica L. Longston and C. V.Zaser,was reid. These lots were acquired for expansion of the sewage disposal plant at a cost of $10,500.00 Motion by Hardin,seconded by Eng,that Resolution No.357 be adopted.Motion carried. SWEDBERG POOL -APPROVAL OF PLAQUE r^Mr.Daugaard showed sketches of the proposed plaque,honoring Ted Swedberg,designed by the Engineering Department at the request of the Lions Club.The Lions Club would rather the plaque read "in memory of"instead of "in honor of" if Council agrees.If approved,the plaque will be sent to a foundry to be case in bronze. Motion by McDonald,seconded by Holm,approving the plaque in memory of Mr.Swedberg.Motion carried. 1 February 23,1965 970 REQUEST TO CALL BIDS -PROTECTIVE COATING OF WATER TANKS Letter was read from Assistant City Engineer,William Daugaar requesting permission to have Mr.Crom,of Stevens and Thompson, prepare specifications for applying a protective coating to the Lakeview Terrace tanks,using the hot coal tar coating.Mr. Daugaard also requested permission to issue a call for bids to be sent out as soon as specifications are ready,and bids to be opened at 2:00 P.M.Friday,March 19,1965. Mr.Crom inspected the Juniper Street tank on February 10, 1965, and gave estimates on several types of protective coatings.Mr. Crom is of the opinion that the hot coal tar protection is far superior to the other methods,and recommends that the hot coal tar coating be used. Mr.Daugaard said that it probably will take about 6 weeks to do the two tanks,and they would like to start with the Lakeview Terrace tank,which is the highest. Motion by Hardin,seconded by Holm,that Mr.Daugaard be authorized to have specifications prepared,and to call for bids to be opened on March 19 at 2:00 P.M.Motion carried. REQUEST TO CALL BIDS -GASOLINE Letter was read from City Manager,Chester L.Waggener,requesting authorization to join with the Moses Lake School District in a bid call for gasoline for 1965.This procedure was first effected one year ago and resulted in a savings of approximately .02 per gallon.rhe proposed date for opening bids is March 8 at 2 P.M.with bids to be considered by the City Council at their regular meeting of March 9,1965. Motion by McDonald,seconded by Hardin,that the City Manager be authorized to call for bids with the School District.Motion carried. Mr.Jerry Foy,representing the large group of J.C.'s in the audience, reminded Council that the move into the new library will be in about two weeks,and Council is to help with the move.
