COUNCIL MEETING
REGULAR SESSION -8:00 P.M. -CITY HALL June 22,1965
The City Council met in regular session with the meeting called
to order by Mayor Stadshaug.Councilmen present were:Monte
Holm,Gordon Ebbert,Otto Skaug,Jack Eng,Forrest Hardin, and
John Jones.
The minutes of the last regular Council meeting of June 8, 1965,
were approved by the Council as written.
Mayor Stadshaug welcomed Mr. W.C.Armstrong a former City Council
man to the meeting.
BILLS were audited by the Council.Motion by Hardin,seconded
by Eng,that the bills be approved and warrants written.
Motion carried.

The following special bill was read:

investigation at site of the proposed trickling filter

Motion by Skaug,seconded by Hardin,that the special bill
from the Water and Sewer Fund be paid.
Warrants No.9,257 through 9,340 have been approved for payment
this 22nd day of June,1965.
ACCEPTANCE OF BIDS -POLICE CARS
7 A letter from the Public Works Director,Pat Nevins,was
read recommending the low bid for three police cars from
Moses Lake Ford Sales in the amount of $4,746.00 be accepted.
The other bid was:
Boyle Chevrolet $4,915.98
Motion by Eng,seconded by Skaug,that the Council accept
the recommendation of the Public Works Director recommending
the low bid of Moses Lake Ford Sales.Motion carried.
ORDINANCE NO.526 -LITTER CONTROL
An ordinance declaring it a public nuisance to deposit
or leave rubbish,debris or litter upon public or
private property within the City of Moses Lake and
prescribing both civil and criminal penalties for a
violation thereof,was read for the second time by title
only.

Motion by Holm,seconded by Hardin,that the Council accept
the second reading of the ordinance and grant final approval.
Motion carried.
ORDINANCE NO. 52 7 -DOG CONTROL
An ordinance requiring the licensing of dogs;prohibiting
dogs to run at large or allowing vicious dogs to endanger
any person:Placing enforcement in the Police Department:
Providing for impounding and confining of dogs;making
violations thereof a misdemeanor;and repealing Ordinance
Nos.120 and 265,was read for the second time by title
only.
Mr.Skaug questioned the section of the ordinance permitting
the pound to hold dogs for forty-eight hours.It was explained
to Mr.Skaug that forty-eight hours was inserted in place of
seventy-two hours because of the cost involved in holding
the dogs for any period of time.This would represent a 50%
savings for the city.It was noted that every possible
effort would be made to contact the owners of licensed or
valuable dogs.
Motion by Hardin,seconded by Eng,that the second reading
be accepted and the ordinance passed.Motion carried.
ORDINANCE No.528 -PARK AND RECREATION COMMISSION
An ordinance creating a Parks and Recreation Advisory
Commission for the City of Moses Lake,Washington,defining
terms of office,duties,and powers and repealing Ordinance
No. 281,was read for the second time by title only.
Motion by Hardin,seconded by Eng,that the second reading
be accepted and the ordinance passed.Motion carried.

ORDINANCE NO.52 9 -PARK AND RECREATION DEPARTMENT
An ordinance creating and establishing a municipal Park
and Recreation Department for the City of Moses Lake,
Washington:Prescribing the powers and duties of such
department:Providing for appointment of a Director of
Parks and Recreation and repealing Ordinance No. 282 and
all other ordinances in conflict therewith,was read for
the second time by title only.
Motion by Eng,seconded by Hardin,that the second reading
of the ordinance be accepted and the ordinance passed.
Motion carried.
ORDINANCE NO.530 -REVISING ELECTRICAL CODE
An ordinance revising Ordinance No.476 relating to
electricity,and revising the schedule of fees,and
inspections,was read for the second time by title only.
It was noted that one change had been made in the ordin
ance since the first reading,setting the fee for each
additional $1,000.00 or major fraction thereof at $3.00.
Motion by Hardin,seconded by Jones,that the second read
ing of the ordinance be accepted and that the ordinance
be passed. Motion carried.

ORDINANCE NO.531 - 1964 EDITION UNIFORM BUILDING CODE
An ordinance adopting the 1964 Edition of the Uniform
Building Code and its appendix relating to and regulating
the erection,construction,enlargement,alteration,repair,
removal,demolition,conversion,occupancy,equipment use,
height,area and maintenance of all structures within the'
City of Moses Lake,providing for the issuance of permits
and collection of fees therefore,providing penalties for
the violation thereof,declaring and establishing fire
zones;and repealing Ordinance No.439 and all ordinances
or parts of ordinances in conflict therewith,was read for
the second time by title only.
The City Manager,Mr.Waggener,pointed out to the Council
a change made to Section 4 of the ordinance,authorizing
the Building Official to require plans and specifications
be prepared and designed by an architect,civil or structural
engineers licensed by the State,or he may require structural
plans and calculations to be designed by a licensed struct
ural engineer.
Motion by Jack Eng,seconded by Holm,to accept the second
reading of the ordinance,also that the ordinance be passed.
Motion carried.
FIRST FREE METHODIST CHURCH -PETITION TO VACATE PLAT
A letter from the Building and Planning Director, Merle
Hoeft,was read stating that the Planning Commission
had no objection to vacating the Free Methodist Plat
located on the west side of Peninsula Drive,north of
Pacific Avenue. This plat is a part of Battery Orchard
Tract #51. It was recommended by the Planning Commission
that ten feet be retained and dedicated for the full half
width of Peninsula Drive.
Rev.James Havens appeared in behalf of the church.He
explained to the Council that the church had intended to
erect a building on the property,but that they had obtained
a building elsewhere and had no plans to build on this
property in the near future or possibly ever.It was noted
that the vacation would allow the city to eliminate the water
and sewer bond requirements now in effect on the property.
Mayor Stadshaug pointed out to the Council that it would
be necessary to set a public hearing for vacation of the
plat not less than twenty days after the request and not
more than sixty days from this time. He suggested that
a public hearing be set for the 27th day of July,which would
be the earliest possible date.
Motion by Holm,seconded by Eng,that a public hearing for
vacation of the Free Methodist Plat be set for July 27th.

MOSQUITO CONTROL DISTRICT -REQUEST RE:CITY FOGGING EQUIPMENT
Mr.Waggner,City Manager,explained to the Council that
the Tiffa fogging machine had been purchased by the City
in 1957 or 1958 at a cost of $2,400 or $2,500.It was
also stated that this piece of equipment had not been used
by the city since the time it was purchased. The Mosquito
Control District has been using it on a fairly regular
basis since that time.It was asked what the approximate
worth of the fogger was at this time. An estimate of
$1,000 was given.
Mr.Russ Hansen appeared for the Mosquito Control District.
He stated that the main problem with the piece of equipment
was the question of insurance,whether or not the Mosquito
Control District could insure a piece of equipment belonging
to the city.There is considerable danger of fire and it is
a difficult piece of equipment to work with and operate.
It was asked if the city could donate the fogger to the
Mosquito Control District.The City Attorney was asked
for his opinion. He stated that he would like to have
time to consider the matter.
Motion by Hardin,seconded by Skaug,that the equipment be
disposed of as discussed, if possible, after the City Attorney
had rendered a decision on the matter.Motion carried.
STATE EXAMINER'S REPORT -1964 AUDIT
A letter from the State Auditor's office regarding questions /J3L?
concerning the audit was read.
Mr.Waggener commented that this was the first year that
the city has received its report of the audit several weeks
prior to any information being released to the press.He
noted appreciation of this fact.
Two items were noted in particular,one was the filing of
purchase orders in numerical sequence of the purchase order
instead of numerical sequence by fund as provided by the
Division of Municipal Corporations.The second item men
tioned was the cash balance in GOB #4 Fund being in excess
of the amount permitted by statute.It was explained to the
Council that additional bonds were called in 1964 to reduce
the balance of the fund.
Mayor Stadshaug noted the difference in the report of the audit
for this year and previous years and complimented the City
Manager and staff for the fine work and improvement shown.
APPROVAL OF MOBILE HOMES BUSINESS IN HIGHWAY SERVICE ZONE
A letter from the Building and Planning Director,Merle Hoeft,
recommending approval of the business in accordance with
the provisions of Section 310.20 with the following restrictions
was read.
1.A dedication of land for street purposes to permit
permanent access from the Peninsula Motel to Broadway.

2.Improvements for water and sewer be provided to the
building.
3.Improvements to the land to complement the business
be accomplished.
4.The building be aesthetically compatible with the
development of Broadway Avenue.
Mr.Hoeft also presented a plot plan for the building
location and a sketch of the general area of construction.
He commented that the building would be used for trailer
sales and repair.
Motion by Holm,seconded by Hardin,that the recommendation
of the Planning Commission be accepted with the exceptions
as listed in Mr.Hoeft's letter.Motion carried.
HOUSING AND HOME FINANCE AGENCY
Mr.Barry Tate of the Housing and Home Finance Agency
was to appear before the Council. He was not present.
The presence of Mr.Ray Norman of Rogers and Norman was noted.
