The minutes of the last regular Council meeting of July 13,1965
were approved by the Council as written.... ,-'

PUBLIC HEARING,CONTINUED -STRATFORD ROAD LID
a.Ordinance establishing LID
A letter of protest from the Aero Mechanics,914 N.Strat
ford Road,was read.The following reasons for protest
were listed:
1. The property was not benefited by the proposed improve
ment and the LID was not made for the purpose of
benefiting the property..
2.That the purpose of the proposed LID was to keep a
prior agreement between the city and State-.and that
the city had already committed itself to construction.
3.That the city is establishing a main arterial into
the city rather than establishing an improvement
benefiting the property owners.
4.That the proposal of the city to include the LID
improvements in the construction contracts to be
let by the State is improper and illegal.
5.For the reason that the assessment against the
undersigned is improper in purpose,form and con
tent.
6.That the city had installed improvements on Strat
ford Road before and no assessment was made against
property owners and therefore,this assessment was
inequitable and unfair.
7.That the purpose of the improvement was a four-lane
connecting arterial to Highway 11-G and Larson AFB,
and since the base is being closed that it is use
less and unnecessary.

A letter of protest from the Order of Elks was read.
They felt the property would not benefit by the proposed
improvement,that the city was just keeping a prior
commitment with the State and had already committed
itself to the construction of the improvement,and that
the Elks Lodge had not been able to indicate by vote in
open meeting their position.
The written protests submitted were 38.2%of the total
r ,cost of the project.
{_A cover letter from Mr.Ralph Kenison which accompanied
the protests was read.He stated that the protest of
the property owners was virtually 100%of the amount
assessed against the land,and that for this reason
and the reasons stated in the protests he urged the city
reject the LID proposed for Stratford Road under Resol
ution No.363.
A letter from Pat Nevins,Public Works Director,giving
a preliminary estimate of costs was read.He listed
the total actual value of the land and improvements at
$43,275.00 and the estimatedLID costs at $20,800.00
Another letter also from Pat Nevins,Public Works Director,
was read.It indicated that Mr.John Lee is prepared to
dedicate a right-of-way sixty (60)feet in width for a
street adjacent to his property which is along the pro
posed Stratford Road project.Mr.Nevins felt it would
be advisable and advantageous for the city to accept
the dedication.Mr.Nevins said that the right-of-way
would run in a westerly direction rather than to the
east as indicated in his letter.
Mr.John Calbom,City Attorney,stated that in this case,
since the city is paying 60%of the assessment,that the
I city could go ahead with the improvements despite the
protests of the property owners.He stated that this was
a result of a 1962 ruling by the Attorney General.
Mr.Kenison stated that the Attorney General's decision
had not been upheld in three cases recently brought to
court in King and Snohomish Counties.He said that if
the city went ahead with the LID,that the property owners
would have to bring action.
The Council felt that there was no question as to the
improvement to the property.
Motion by Hardin,seconded by Eng,that the public hearing
be closed.Motion carried.
An ordinance ordering the improvement of Stratford Road
from the intersection of Stratford Road and Valley Road
to a point 1,371.68 feet north of such intersection by
grading,gravelling,constructing and installing storm
drainage,curbs,sidewalks and asphalt concrete pavement,
all in accordance with Resolution No.363 of the City of
Moses Lake, Washington;establishing Local Improvement
District No.21;providing that payment for said improve
ments be made in part by special assessments upon property
—in said District payable by the mode of "payment by bonds;"
and providing for the issuance and sale of local improve
ment district warrants redeemable in cash and local improve
ment district bonds,was read by title only.
Motion by Holm,seconded by Hardin,that the first reading
of the ordinance be approved.Motion carried.

Motion by Ebbert,seconded by Jones,that Mr.Lee's dedi
cation of a sixty (60)foot right-of-way along the Stratford
Road project be accepted.Motion carried.
PUBLIC HEARING -VACATION OF FIRST FREE METHODIST PLAT
\n Mr.Merle W.Hoeft,Building and Planning Director,pre
sented a map showing the location of the plat.He said
the Planning Commission had no objection to the vacation
with the exception that a ten (10)foot strip be retained
in order to have a full half width for Peninsula Drive.
Mrs.Louise Taylor,owner of the property in the plat
prior to purchase of the land by the Church,asked if
it was necessary to let the sewer bond go at this time.
She was told that this is the reason for vacating the
plat.
Rev.James Havens appeared for the First Free Methodist
Church.
Mr.Hoeft stated that he felt the vacating of this plat
now would make for more orderly development of this area
in the future.
Motion by Hardin,seconded by Skaug,that the public
hearing be closed.Motion carried.
An ordinance vacating the Free Methodist Plat,within
the City of Moses Lake,Washington,except the easterly
ten (10)feet dedication for street purposes,was read
by title only.
Motion by Ebbert,seconded by Holm, that the ten (10)
foot strip be retained and the first reading of the
ordinance be accepted.Motion carried.
ORDINANCE NO.533 -AMENDING ORDINANCE 532,WATER AND SEWER

REVENUE BONDS
An ordinance amending Section 14 of Ordinance No. 532
by establishing the proper fund for the deposit of
revenue bond sale proceeds,was read by title only.
Mayor Stadshaug explained that this was just a change
of terminology to designate the fund as a bond con
struction fund rather than a redemption fund.
Motion by Eng,seconded by Skaug,that the ordinance
be adopted and declared an emergency.Motion carried
AIRPORT LEASE WITH BIG BEND COMMUNITY COLLEGE
Mr.Waggener,City Manager,explained that the lease
has been gone over by both attornies.He said that
the city would have to provide $200.00 per month for a
man to run the gas pumps,but that the college would
stand the cost of utilities.
Motion by Hardin,seconded by Eng,that the City Manager
be authorized to execute the lease on behalf of the city.
Motion carried.
REFERRAL FROM PLANNING COMMISSION -BEAUTY SHOP AT 956 S.DIVISION
A letter from Merle W.Hoeft,Building and Planning Director,
stating that in accordance with the provisions of the
Zoning Ordinance that the Planning Commission recommends
approval of a beauty shop at 956 S.Division for a period
of five (5)years,was read.

Motion by Holm,seconded by Hardin,that the Council
accept the Planning Commission's recommendation.Motion
carried.
DAMAGE CLAIM -ED HULL
A letter from the City Manager requesting the Council JOP7
merely note receipt of the claim in the minutes was read.
The Council concurred with Mr.Waggener's request.The
receipt of the insurance claim from Mr.Ed Hull is so
noted.
CASCADE PARK -REQUEST TO CALL BIDS FOR WATER LINE AND TO PRO
CEED WITH GRADING //J>/
A letter from Pat Nevins,Public Works Director,was read,y//
He requested that he be allowed to advertise for bids on
the two water lines,one along Valley Road and the second
running from an existing main on Airway Drive into the
Cascade Valley Park. He also requested permission to
accept quotations for the grading of approximately four
acres in the southeast corner of Cascade Park and that
the award be given to the lowest bidder.
Mr.Skaug asked what the city's commitment in Cascade
Park involved.
Mr.Waggener explained that the city must spend $10,000
in improvements by June of 1967.He said that $5,000
had been budgeted for grading this year along with $7,000
for water.
It was asked if this would fulfill the city's obligation
for 1966. It was explained that it would,if the city
were given full credit for the grading.
Clemens Brigl,Park and Recreation Director,presented
a sketch of Cascade Park showing the area to be graded
and water line installed.
Motion by Hardin,seconded by Skaug,that the Public
Works Director be authorized to advertise for bids on
the two water lines and for quotations on the aradina.
Motion carried.

The Mayor extended his thanks to Mr.Brigl and the
Park and Recreation Commission through Mr.Mitchell
for their hard work.'
Motion by Jones,seconded by Hardin,that the plan be
accepted.Motion carried.
