COUNCIL MEETING
REGULAR SESSION -8:00 P.M.-City Hall January 25,1966
The City Council met in regular session with the meeting called
to order by Mayor Stadshaug.Councilmen present were:Gordon
Ebbert,Monte Holm,Otto Skaug,and John Jones.Councilmen
Hardin and Eng were absent.
The minutes of the last regular Council meeting of January 11,
1966,were approved by the Council as written.
BILLS were audited by the Council.Motion by Holm,seconded by
Skaug,that the bills be approved and warrants written.
Motion carried.

65-04 Cascade Park Water Main $396.27
Mr.Nevins explained to the Council that there is a
small leak in the water main that cannot be corrected
until weather conditions improve.He further explained
that this is why he did not recommend retaining 10%
on a thirty-day lien as is customary.
Motion by Skaug,seconded by Holm,that the special bill
from the Water and Sewer Fund be paid.Motion carried.
Warrants No.10,372 through 10,443 have been approved for payment
this 25th day of January,1966.
ORDINANCE -PROVIDING TAX ON PETROLEUM HEATING FUELS -1ST READING
A letter from City Manager Chester L.Waggener was read.
Mr.Waggener pointed out that the ordinance proposed an
amendment to the utility tax ordinance to provide a 3%
utility tax on the total gross income of firms selling
retail fuel oil.
A letter from Mr.John C. T.Conte,Jr.,Secretary of
Cascade Natural Gas,was read.In his letter Mr.Conte
outlined the taxes presently being paid by Cascade,
approximately 7.5%, 5% of which is paid directly to the
City of Moses Lake.Mr.Conte further stated that fuel
oil dealers pay a total tax of 4.6% of which the city
receives a very small percentage. They propose that the
fuel oil dealers pay a tax of 3%thereby dissolving the
inequities of the present tax structure.
Mr.Doug Stansbery,Mr.Charles H.Peck and Mr.John C. T.
Conte,Jr.,were in the audience representing Cascade
Natural Gas to answer any questions the Council might have
on the proposal.

It was suggested that the first reading of the ordinance
be postponed so that others interested in the matter can
be made aware of the proposal.
Mr.Skaug felt that the first reading of the ordinance
should be postponed.He also noted the absence of two'
members of the Council and felt that they also should be
present before any decision i s made on the matter.
Motion by Jones,seconded by Skaug,that the first
reading of the ordinance be postponed until the next
regular meeting of the City Council on February 28th.
Motion carried.
ORDINANCE NO.544 -REPEALING ORDINANCE NO.5 34 ORDERING STRATFORD
ROAD IMPROVEMENTS "•
d7»Ordinance No. 544 repealing Ordinance Nq.534 which is
entitled "An ordinance ordering the improvement of Strat
ford Road from the intersection of Stratford Road and
Valley Road to a point 1,371.68 feet North of such inter
section by grading,gravelling, construction and installing
storm drainage, curbs, sidewalks, and asphalt concrete pave
ment, all in accordance with Resolution No.363 of the City
of Moses Lake,Washington;establishing Local Improvement
District No.21;providing that payment for said improvement
be made in part by special assessments upon property in
said district payable by the mode of "Payment by Bonds";
and providing for the issuance and sale of local improvement
district warrants redeemable in cash and local improvement
district bonds",was read.
It was asked if there had been any written confirmation
from the property owners as to their decision not to have
the law suit dismissed.
Mr.Waggener,City Manager,explained that it would not
be necessary to have any correspondence from them unless
they wished to drop their suit against the city.
Motion by Holm,seconded by Ebbert,that the second reading
of the ordinance be waived and the ordinance adopted.Motion
carried.
ORDINANCE NO.545 -ADOPTING 1963 EDITION OF FIRE PREVENTION -CODE -
2ND READING
Ordinance No.545 amending Ordinance No.208 which is
|0 entitled "An ordinance adopting a Fire Prevention Code
prescribing regulations governing conditions hazardous
to life and property from fire or explosion and establish
ing a Bureau of Fire Prevention and providing officers
therefor and defining their powers and duties,"By amending
Section 1 to update the Fire Prevention Code,repealing
Sections 4 and 5 thereof and Ordinance No.371 and No.418,
was read by title only.
Motion by Skaug,seconded by Jones,that the ordinance be
adopted.Motion carried.
RESOLUTION NO.387 -ORDERING ABATEMENT OF NUISANCE -TREE REMOVAL
Resolution No.387 authorizing the City Engineer to abate a
nuisance at 803 Michael Street was read.
Mr.Nevins stated that there has been no reply to his letters
to Mr.Boldt who is an absentee land owner.

Motion by Holm,seconded by Ebbert,that the resolution be
adopted changing the date by which the nuisance must be
removed before the city can abate it from January 15th,to
February 15,1966.Motion carried.
APPOINTMENT TO PLANNING COMMISSION S/OQ 2
A letter from Dr.Leon Bodie expressing his regret for having
to resign from both the Planning Commission and Board of
Adjustment due to the press of his personal business and other
public obligations,was read.
A letter from Mayor Stadshaug requesting the Council confirm
his appointment of Mr.Larry Peterson to fill the unexpired
term on the Planning Commission to expire on December 31,
1967,was read.
Motion by Ebbert,seconded by Skaug,that the Council confirm
the appointment of Larry Peterson to the Planning Commission.
Motion carried.
INVITATION TO ATTEND MEETING WITH GRANT COUNTY COMMISSIONERS REGARDING
POSSIBLE QUALIFICATION OF THE COUNTY UNDER PUBLIC WORKS AND ECONOMIC
DEVELOPMENT ACT ^

A letter from H. E.Snead,Chairman of the Grant County Board
of County Commissioners,inviting representatives of various
organizations to attend a meeting on Friday,January 28th,at
7:30 P.M.,to deal with the possible qualification of the
County under the Public Works and Economic Development Act
of 1965,was read.
Mayor Stadshaug suggested that as many as possible should
attend the meeting.
Meeting adjourned.
