1966 05 101095 COUNCIL MEETING REGULAR SESSION -8:00 P.M.-City Hall May 10,1966 The City Council met in regular session with the meeting called to order by Mayor Stadshaug.Councilmen present:Gordon Ebbert,Monte Holm,Otto Skaug,Jack Eng,Forrest Hardin,and John Jones. Mayor Stadshaug welcomed the members of the audience to the meeting. The minutes of the last regular Council meeting of April 26, 1966, were approved by the Council as written. BILLS were audited by the Council.Motion by Hardin, seconded by Skaug,that the bills be approved and warrants written.Motion carried. Professional engineering services in con nection with resident engineering services for the Sewage Treatment Plant extension in accordance with agreement between Stevens & Thompson,Inc.and the City of Moses Lake, dated May 26,1965.$1,359.91 Floyd 0.Swenson Final payment -Contract 65-05 -Expansion of Sewage Treatment Plant $1,079.47 A letter from Public Works Director Pat Nevins was read.He stated that in a telephone conversation with Mr.Harold Murray of Stevens and Thompson on May 9th, he was told that all the work has been satisfactorily completed with the exception of Change Order #8,installation of the boiler.Mr.Nevins recommended acceptance of the work done under the basic bid and Change Orders 1 through 10,excluding Change Order #8, and that payment be made as shown on the purchase order. Motion by Holm,seconded by Eng,that the special bills from the 1965 Water and Sewer Bond Construction Fund be paid. ORDINANCE NO.54 6 -AMENDING ORDINANCE NO.513 -WATER AND SEWER RATES SECOND READING . Ordinance No. 546 amending Ordinance No. 513 which is entitled "An ordinance relating to the municipal water system of the City of Moses Lake,Washington regulating the use of the water therefrom,providing for the sale of the same,fixing the price thereof,providing a method of collection charges therefor,and •—fixing the method of collecting for the use of facilities and furnishing of services by the sewer system and sewerage disposal plant of the City of Moses Lake,and providing penalties for the violation thereof and repealing Ordinances 32, 179, 402 and all other ordinances or parts of ordinances in conflict herewith", was read by title only. Motion by Skaug,seconded by Jones,that the ordinance be adopted. Motion carried. SUN BASIN GROWERS,REVISED SITE PLAN A letter from City Manager Chester L.Waggener was read. He noted that the Planning Commission reviewed a revised site plan for an all steel building with a baked enamel finish and stone ornamentation rather than the concrete block building originally proposed for Sun Basin Growers.The City Council in its first authorization approved the plan with the contingency that the proposed exit to Balsam Street be eliminated.Sun Basin Growers now feels that this exit is important to proper design of the parking area and requested that the special permit be revised to authorize access to Balsam Street.Mr.Waggener stated that the Planning Commission has reviewed the proposed site plan and recommends to the Council that approval be given for the use of the steel building and the access to Balsam Street. A letter from Bob Lewis,a resident of the area in which Sun Basin Growers proposes to construct their new office building, was read.He wished to object to the request as he feels a metal building would not be in keeping with the harmony of the present structures in the area,that the access on Balsam Street would create undue traffic on a residential street which already has an excess of traffic,and that the original request to the Planning Commission was objected to in writing by 80% of the property owners in the area on a petition. Due to a misunderstanding the materials,pictures,and slides for a presentation on the building were not available to the Council tonight. Mr.Conger of Sun Basin Growers informed the Council that both the financiers and architect for the build ing felt that the access on Balsam was necessary for proper fire protection and general convenience. He stated that the traffic load to the building would not amount to much more than two or three cars a day other than employee travel. He also noted that no freight would be delivered to the building as it would be strictly a business office.He pointed out that the additional parking that would be put in with the construction of the building would be available for use to anyone after the regular office hours,thereby providing additional parking on Wednesday evenings and on Sundays when there is congestion in the area because of church meetings.There would be 19 parking spaces to accommodate both the employees and customers.Mr. Conger presented a copy of the new plat plan to the Council. Mayor Stadshaug opened the meeting to comments from the audience. He asked that any comments or questions be directed to the Mayor and members of the Council. 1097 May 10,1966 Mr.Jim Mitchell of 414 E.Brown pointed out to the Council that the original plan was approved without access on Balsam Street. He felt no concession should be made on this item.He felt that without the materials for the presentation on the appearance of the building that there could be little reason for a decision on the matter at this time. Mr.Bob Jeske of 4 20 E.Brown felt he would not like to see the additional parking for 19 cars in this residential area.He did not feel that the building would look like a home or compli ment the homes in the area now. Mr.Roger Stanford of 406 E.Brown said that he agrees with Mr. Jeske and Mr.Mitchell. Phillip Thorn of 1010 Skyline Drive felt that the Council should look to the future as they would establish a precedent by allow ing access on Balsam Street to anyone. He objects to the Balsam Street access. Mr.Skaug felt that plans and materials to show the appearance of the building should be presented before a decision is made. Mayor Stadshaug suggested that due to the misunderstanding that the slides and presentation should be made at the next Council meeting on May 24th. Mr.Hardin wanted to know if the access on Balsam Street was really necessary with the one on Pioneer Way. Mr.Conger stated that it was their opinion that the Balsam Street access would make for better utilization of the parking area. Motion by Holm,seconded by Skaug,to deny approval of the plan for access on Balsam Street.Motion failed with Hardin,Stad shaug,Ebbert,and Eng voting "No". City Manager Chester L.Waggener suggested to the Council that property should be entitled to access on any street abutting it and that if the Council feels that access to the street is detrimental to adjoining properties,then perhaps,they should review the entire request for the special permit as to its being applicable for that particular area. Mr.Mitchell pointed out to the Council that the Pioneer Way access would be hazardous.He also mentioned that the residents of the area had not had an opportunity to see the revised plan and that they would like to see it before making any final objections. Motion by Eng,seconded by Hardin,that any further discussion on the item be postponed until Sun Basin Growers presents the rest of the material on the appearance of the building at the next meeting.Motion carried. RETAIL TRADES COMMITTEE -SALES PROMOTION A letter from Logan 0.Beam,Manager of the Chamber of Commerce, was read.Mr.Beam requested that Mr.Larry Jobin be placed on the agenda to ask for permission to cover the parking meters in the downtown area for "Crazy Days"sales promotion on Friday, May 13th,and to barricade Third Avenue,between Ash and Alder, for their sidewalk sales promotion scheduled for Friday,July 29th. May 10,1966 1098 Mr.Jobin was in the audience representing the Retail Trades Committee of the Chamber of Commerce.He pointed out that on the request to barricade the streets for the sidewalk sale this had been allowed in 1964,but in 1965 it was denied because of fire hazard.Mr.Jobin suggested that a fire lane could be left on both sides of the street next to the curb to allow for the movement of fire protection equipment if necessary.He said that the display on the street would consist mainly of cars, trailers,farm equipment,and things of that nature. Fire Chief Jensen felt that the fire lane would be sufficient to solve his one objection about the movement of fire equipment, however, with the type of material allowed between the buildings on the two sides of the street,that this would allow fire to jump from one side of the street to the other on the unprotected glass fronts of the buildings.He did mention that the prob ability of a fire occurring on this particular day was slight. Motion by Holm,seconded by Hardin,that the request to cover the parking meters for the "Crazy Days" sale on May 13th be approved.Motion carried. Motion by Eng,seconded by Holm, that the Council approve the request to hold a sidewalk sale on July 29th,barricading Third Avenue between Ash and Alder.Motion carried. MR.AUGIE BREITMEIER -APPEAL TO COUNCIL /off A letter from City Manager Chester L.Waggener to Mr. A. J. Breitmeier of 927 N.Paxson Drive was read.In his letter Mr. Waggener pointed out to Mr.Breitmeier that he had been placed on the agenda for May 10th. He requested that Mr.Breitmeier provide him with advance information to be presented to the Council for their consideration in accordance with the policy set up by the Council itself. He pointed out to Mr.Breitmeier that failure to provide any background information on a request to be heard,often results in a delay in action until the Council has had an opportunity to study all possible background infor mation . Mr.Breitmeier asked the members of the Council if they were aware of the things going on in City Hall.Mayor Stadshaug indicated to Mr.Breitmeier that information in the files is available to the Councilmen at any time. Mr.Breitmeier presented a letter he had written on July 15,1964, and asked if the members of the Council had seen a copy of that particular letter.Mayor Stadshaug and the members of the Council indicated after seeing the letter that it had been presented to Council at a previous meeting when Mr.Breitmeier appeared before the Council. Mr.Breitmeier was asked what request or complaint he had to bring .before the Council,as the Councilmen and Mayor were not aware as to just what the problem was.Mr.Breitmeier did not at this time list or state his grievances. After some discussion Mr.Breitmeier was requested to write a letter, including any materials that he might wish, to present his grievances to the City Council at the next meeting on the 24th of May. He was requested to submit this information to the City Manager in sufficient time to allow the information to be distributed to the Council members for study prior to the actual meeting date. CERTIFICATE OF COMPETENCY FROM POLLUTION CONTROL COMMISSION -AMOS DODGEN -~" 1099 May 10,1966 A letter from James C.Pluntze,Secretary of the Board of Cert ification of the State of Washington Department of Health,was read. He indicated his pleasure in announcing that a Certificate of Competency is being issued to Mr. Amos R.Dodgen as a Group IV Water Pollution Control Plant Operator.He stated that Mr. Dodgen successfully passed the examination and that along with his experience qualified him for this rating. Mayor Stadshaug presented Mr.Amos R.Dodgen with his certificate and complimented him on his fine efforts to improve himself and on his interest in preparing himself to do a better job as a city employee. SANITATION -USE OF FILL SITE DURING CLEAN-UP WEEKEND F\° A report from C. D.Fuller of the Moses Lake Garbage Service giving an analysis of the sanitary fill use during "Operation Clean Sweep"April 30th through May 1st,was presented.It was pointed out that the revenue from having the fill open for use during this weekend certainly did not begin to cover the operation cost,however,for a worthwhile project like this, it certainly is desirable. Mayor Stadshaug complimented the Chamber of Commerce and Project Chairman Dewayne Dennis for the fine efforts toward improving the appearance of the community in operation "Clean Sweep". CIVIL SERVICE COMMISSION -APPOINTMENT \0bA Motion by Stadshaug,seconded by Skaug,that the Council approve the appointment of John Dietzen to fill the vacancy left by John Vreiling on the Civil Service Commission.Mayor Stadshaug felt it was commendable for a man who has already served as a Councilman and Mayor to still be interested enough in city government to take a position on one of its commissions.
