1966 05 24j 1100 COUNCIL MEETING REGULAR SESSION -8:00 P.M.-City Hall May 24,1966 The City Council met in regular session with the meeting called to order by the City Clerk.Councilmen present:Gordon Ebbert,Monte Holm,Otto Skaug,Jack Eng,Forrest Hardin,and John Jones.The first order of business was the election of a Mayor pro-tem due to the absence of Mayor Stadshaug. Motion by Ebbert,seconded by Holm,that Councilman Hardin be appointed Mayor pro-tem.Motion carried. The minutes of the last regular Council meeting of May 10, 1966, were approved by the Council as written. BILLS were audited by the Council.Motion by Eng,seconded by Holm, that the bills be approved and warrants written.Motion carried. CURRENT EXPENSE -Total Amount Paid $2,622.22 EQUIPMENT RENTAL -Total Amount Paid 2,479.82 PARK AND RECREATION -Total Amount Paid 409.29 STREET -Total Amount Paid 8 0.86 WATER AND SEWER -Total Amount Paid 8,141.75 SANITATION -Total Amount Paid 196 .31 TOTAL $13,930.25 SPECIAL BILLS There were no special bills. Warrants No.10,939 through 11,014 for $13,930.25 have been approved for payment this 24th day of May, 1966. SUN BASIN GROWERS -•REVISED SITE PLAN -REQUEST WITHDRAWN—j/yy The Mayor pro-tem explained to the members of the audience and to the Council that the request from Sun Basin Growers to construct an office building on Balsam and Hill has been withdrawn,therefore,no further action or discussion would be necessary. A. J.BREITMEIER -APPEAL RE-GARBAGE ORDINANCE A letter from Mr. A. J.Breitmeier was read. In his letter Mr.Breitmeier pointed out several areas in which he felt the City should make allowances from policies and ordinances to give residents fair and just treatment.He felt that the circumstances and conditions of the particular area in which he lives are limited.Mr.Breitmeier does not feel this is just,because he pays the same amount of taxes as any other resident in the city. He stated that property within the City Limits is entitled to water service,mains with fire hydrants reasonably spaced, sewer trunk lines,garbage pickup,etc.All of these things are not available according to Mr.Breitmeier.In his sum mation Mr.Breitmeier stated that the major conveniences available to him are practically nil,but that he is taxed equal to others more fortunate.It was his contention that because of the lack of major conveniences available to him, that he should be allowed to dispose of his own garbage in the same manner as he has taken care of it in the past 15 years. 1101 May 24,1966 In a letter accompanying Mr.Breitmeier's letter,Mr.Waggener pointed out that all the items listed had been discussed with Mr.Breitmeier and the residents of his area before.They were told that as long as the streets are not dedicated for public use the City cannot do any maintenance work on them even if requested.They were also told that water and sewer mains are normally constructed at the property owners expense as part of a normal platting procedure.Mr.Waggener stated a willingness to cooperate with Mr.Breitmeier and the residents of the area,but that they would have to dedicate the streets for public use before the City can even begin to assist them. Mr.Breitmeier appeared before the Council with a letter from Mr.Donn Kaynor,City Finance Director,stating that the garbage charge would be $ .25 per can per pickup of $10.50 per month. He did not feel that his bill was correct,if these billing rates are correct. It was asked how long Mr.Breitmeier has been billed for garbage.It was pointed out that he had been billed for two years.Because of non-payment Mr.Breitmeier's bill has been turned over to the Credit Bureau for collection.The Superior Court ruled that Mr.Breitmeier would have to pay the garbage bill in accordance with the City's universal garbage ordinance. Mr.Kaynor indicated that he and Mr.Breitmeier had discussed the bill and adjustments for vacancies had been made.Add itional units were adjusted off by Mr.Kaynor because of the scant amount of garbage in each can. Mayor pro-tem Hardin pointed out to Mr.Breitmeier that if the complaint is about charges on the garbage bill that this is strictly an administrative matter and should be taken up with Mr.Waggener and Mr.Kaynor.He did not feel that if this was the problem,that it should be brought before the Council. Mr.Waggener offered to meet with Mr.Breitmeier at his con venience after normal working hours at the City Hall in the evening or even on a Saturday. Mr.Jones felt that the City would be setting a poor precedent to waive the garbage charges for Mr.Breitmeier,therefore he made a motion that Mr.Breitmeier's request for a waiver of the charges be denied.Seconded by Holm.Motion carried. TRAFFIC CONTROL -PROPOSED REVISIONS )l 1 Pat Nevins,Public Works Director,presented a traffic study on the arterial streets.Mr.Nevins stated that traffic counts had been taken on all these streets and indicated on the map as presented to the Council.He indicated that this program is in conjunction and accordance with the Comprehensive Street Plan presented to the Council earlier this year.He explained that the traffic counts as listed are for a 24-hour period.These figures were derived from a seven day counting period divided by 7 from traffic moving in both directions. Mr.Nevins proposed the installation of stop signs and replac ing of yield signs and other signs which are not as legible as they should be.Between two and three thousand dollars has been provided in the budget this year for this purpose. He indicated that the 77 signs would be installed in accord ance with the Uniform Traffic Control Devices Manual as pub- listed by the Bureau of Public Roads. May 24,1966 1102 Several of the signs to be installed are a direct result of requests by the citizens for stop signs in particular areas. Two of the areas in this category are at Hill and Balsam and Dogwood and "A"Streets.Mr.Nevins indicated that as these are traffic control devices for arterial streets that it would be possible to use the 1/2C gas tax money remitted to the City for the purchase of the signs. Motion by Holm,seconded by Jones,that Mr.Nevins be auth orized to commence installation of the 77 traffic control devices with the amount budgeted in the current year's budget.Motion carried. .KNOLLS'VISTA WATER TANK -PROGRESS REPORT /OOP Mr.Nevins presented a program of slides showing the Crestview Water Tank,Cascade Park development,and the proposed Wheeler Road project. Mr.Nevins indicated possible completion of the interior paint ing of the water tank for the end of this week barring unforseen circumstances.Water pressure in the Knolls Vista area would be back to normal by about Monday with this completion date in mind.It was pointed out that the painting of the exterior of the tank would take until sometime in June to complete because of difficulty in obtaining the paint. WHEELER ROAD -PRELIMINARY REPORT JO J /During the presentation Mr.Nevins showed various slides on the proposed Wheeler Road project.He explained to the Council that the pavement width would be 57'permitting a 6'medium strip at the intersection of Pioneer Way and Wheeler Road for a left turn lane.The pavement would then narrow to 51'for the remainder of the distance. There are still two areas where right-of-ways for an additional 10'will be needed.The 51'width would permit four lanes of traffic with no parking.It was indicated that there would be sidewalks on both sides of the street the entire length of the project.At the same time a drain age line would be run to Beeline Frame and Axle at their expense to help eliminate a drainage problem which they are now experiencing. The State Highway Department has already started plans for the installation of a traffic control system for the intersection of Wheeler Road and Highway 17.This intersection in the past has been a dangerous one with several accidents. The project would be done on the 60-40%basis with the City sharing in the cost of the project.An approximate total cost of the project would be $185,000 for the 3,500 foot length of roadway. Mr.Nevins presented the report from the State Highway Department Soil Engineer on the base material and a roadway section for the project.He proposed a meeting with the property owners be set for June 7th to see what their reaction to the project and its cost will be.
