Municipal Services Director/City Engineer Summary: Council to review and award bid for project as presented Administrative Report Council Communications and Reports Executive Session  Pursuant to RCW 42.30.110 Council may call an executive session during a regular or special meeting Adjournment MOSES LAKE CITY COUNCIL April 11 , 2017 The regular meeting of the Moses Lake City Council was called to order at 7 p.m. by Mayor Voth in the Council Chambers of the Civic Center, 401 S. Balsam, Moses Lake, Washington. Executive Secretary Sophia Guerrero called the roll. The following were: Present: Mayor Todd Voth, Deputy Mayor Karen Liebrecht, and Council members Don Myers, Bill Ecret, David Curnel, Ryann Leonard, and Mike Norman PLEDGE OF ALLEGIANCE: Shannon Hintz, Moses Lake Business Association, led the Council in the pledge of allegiance. MAYOR'S REPORTS -None ADDITIONAL BUSINESS -None CITY MANAGER'S REPORTS -None TREE REPLACEMENT John Williams City Manager, reminded the Council of the rejection of the bid for the 2017 tree replacement project and requested direction on how the staff should proceed with the addressing the dead and overgrown trees in the downtown paver area. Shawn O'Brien, Asst. Municipal Services Director/City Engineer, stated in the downtown business area there are 240 trees which includes 34 of the original honey locust. Of those 34 trees, 26 have overgrown the grate opening which is cutting into the trunks; 16 of those are causing damage or have died and been removed. There was some discussion and it was the consensus of the Council that the dead and problematic trees be removed and the City research alternatives to replacing the trees. Staff will provide information on the costs of doing the work with City crews vs an outside company. K-9 GRANT REQUEST John Williams, City Manager, stated that the Police Department has the opportunity to apply for a K-9 grant program and requested direction from the Council on whether or not to pursue the grant. Kevin Fuhr, Police Chief, stated that the first dog would be a tracking dog and current staff would be trained as a K-9 handler. There was some discussion and it was the consensus of the Council to proceed with applying for the grant. CITIZEN'S COMMUNICATIONS MOSES LAKE BUSINESS ASSOCIATION Shannon Hintz, Moses Lake Business Association, gave some background information on the association and stated that contrary to rumor, the Association is going strong and is currently looking for a new director. CONSENT AGENDA Minutes: The minutes of the March 28 meeting were presented for approval. Approval of Claims. Prepaid Claims, Checks, and Payroll: Vouchers audited and certified by the Finance Director as required by RCW 42.24.080, and those expense reimbursement claims, certified as required by RCW 42.24.090, have been recorded on a listing which has been made available to the Council for approval CITY COUNCIL MINUTES: 2 April 11 , 2017 and is retained for public inspection at the Civic Center. As of April 11, 201 7 the Council does approve for payment claims in the amount of $401 , 963. 06; prepaid claims in the amounts of $35,249.48 and $401, 963. 06; claim checks in the amount of $964,286.37; and payroll in the amounts of $331 ,889.33 and $3,965.94. Ordinance -Amend 13.12 -Water, Sewer. and Stromwater Rates: An ordinance was presented which removes the fees and references them to the approved fee schedule. Barrington Point 3A Preliminary Plat and Findings of Fact: The Barrington Point 3A Preliminary Major Plat and Findings of Fact were submitted for approval. This is a 28 lot plat on 6.52 acres located west of Paxson Drive, east of Crestview Drive, south of Park Orchard Elementary School, and about 2, 100' south of Valley Road. The site is zoned R-1 , Single Family Residential, which corresponds with the underlying Comprehensive Plan Land Use Designation of Residential. The Planning Commission recommended that the preliminary plat be approved with conditions. Action Taken: Council member Leonard moved that the Consent Agenda be approved, seconded by Council member Norman, and passed unanimously. OLD BUSINESS RESOLUTION -PURCHASES AND CONTRACTS A resolution was presented which establishes delegated authority for certain types of contracts, emergency purchases, grant applications, and establishes reporting requirements. The resolution of the City Council of the City of Moses Lake establishing delegated authority for certain types of contracts, emergency purchases, grant applications, and establishing reporting requirements was read by title only. John W illiams, City Manager, explained that this is a policy that establishes which documents can be signed under the City Manager's authority, those delegated to department heads, and those to be approved by Council. He pointed out that th is deals mainly with purchases. Action Taken: Council member Ecret moved that the resolution be adopted, seconded by Council member Curnel, and passed unanimously. NEW BUSINESS ORDINANCE -TERMINATE FRANCHISE An ordinance was presented which terminates the franchise granted to Ken Wiser for a private irrigation main under Truman Drive. With the development of the area by Hayden Homes, the irrigation main is no longer needed. Gilbert Alvarado, Community Development Director/Deputy City Manager, gave the background on the irrigation main and franchise. ORDINANCE -AMEND 10.12 -PARKING REGULATIONS An ordinance was presented which amends Chapter 10, 12, Parking Regulations, by restricting parking on both side of Lakeland Drive from East Oasis Circle to Nelson Road. Shawn O'Brien, Asst. Municipal Services Director/City Engineer, explained the reason for restricting parking on Lakeland Drive and converting it to th ree lanes. RESOLUTION -NUISANCE ABATEMENT COSTS -2118 SPRUCE A resolution was presented which affirms the Council's prior authorization to staff to collect the funds expended for the nuisance abatement at 2118 Spruce. CITY COUNCIL MINUTES: 3 April 11, 2017 The resolution establishing the billing to be imposed against Lorance Pence. as the owner of certain real property upon which the City caused abatement of a nuisance to be performed after a failure of the property owner to abate the same was read by title only. Action Taken: Council member Leonard moved that the resolution be adopted, seconded by Council member Norman, and passed unanimously. RESOLUTION -NOTICE OF INTENT TO ASSUME TRANSPORTATION BENEFIT DISTRICT A resolution was presented which sets a public hearing to adopt an ordinance to authorize the City to assume the rights, powers, functions, and obligations of the Transportation Benefit District. The resolution of the City Council of the City of Moses Lake, Washington, establishing a hearing date to consider an ordinance to authorize the City of assume the rights, powers, functions, and obligations of the City of Moses Lake Transportation Benefit District was read by title only. John Williams, City Manager, reminded the Council of the procedures necessary before the Council can conduct certain business of the Transportation Benefit District during the regular Council meetings. He explained that the Transportation Benefit District is still a separate entity with a specific accounting system but would be included in the City's regular audit instead of requiring a separate audit. Action Taken: Council member Liebrecht moved thatthe resolution be adopted, seconded by Council member Myers, and passed unanimously. STREET RECONSTRUCTION FUNDING John Williams, City Manager, stated that the Board of the Transportation Benefit District allocated funds to the Kittleson Road project and staff was requested to report to Council how to fund the remaining cost of the project. He explained how the funding would work and that it would not require an interfund loan or repayment to the Transportation Benefit District. Bob Taylor, Finance Director, explained where the funds could come from. There was some discussion by Council. Action Taken: Council member Leonard moved that funds be reallocated to improve Kittleson Road and accept the funding from the Transportation Benefit District, seconded by Council member Norman, and passed unanimously. SAND DUNES WASTEWATER TREATMENT PLANT -HEADWORKS IMPROVEMENTS The City received four bids for the Sand Dunes Wastewater Treatment Plant Headworks Improvements Project. This project will expand the capacity of the headworks, replace the deteriorated shelter and controls, provide a redundant channel and screen, improve flow control, and include improvements to address hydrogen sulfide and odor issues. There was some discussion by the Council since the bids came in higher than the engineer's estimate. Action Taken: Council member Leonard moved that the bid be awarded Culbert Construction in the amount of $1, 142,412.18, seconded by Council member Curnel, and passed unanimously. TEN PIN BREWERY -WASTE DISCHARGE PERMIT After monitoring the waste discharge from the Ten Pin Brewery for the past year, it has been determined that a waste discharge permit is necessary as several of the characteristics of their flow do not meet the City's discharge limits. Authorization was requested for the City Manager to sign the Waste Discharge Permit. There was some discussion. CITY COUNCIL MINUTES: 4 April 11 , 2017 Action Taken: Council member Norman moved that the City Manager be authorized to sign the Industrial Waste Discharge Permit No. 22 for the Ten Pin Brewery, seconded by Council member Curnel, and passed unanimously. THE GREENS -PLAT EXTENSION The new owners of The Greens have requested a one year extension of the preliminary plat approval for Phase 2 of the project. Council member Norman declared a conflict of interest and left the dias. Gilbert Alvarado, Community Development Director/Deputy City Manager, gave the background of the project. Craig Schultz, Northlake Capital Development, new owner of The Greens stated that they are attempting to develop the area with an eye to the existing market. The units will be rentals because that is what the market is looking for at the present time. There was some discussion by the Council on the development of the area. Action Taken: Council member Leonard moved that the request be granted, seconded by Council member Ecret, and passed unanimously. ADMINISTRATIVE REPORTS AWC LEGISLATIVE PRIORITIES COMMITTEE John Williams, City Manager, reported on his testimony before the legislature and his meetings with the legislators on bills affecting cities. POLICE DEPARTMENT Kevin Fuhr, Police Chief, stated that they have been testing different body cameras and have now decided which one will work best for the police officer and are in the process of purchasing the cameras with a grant that was previously awarded to the City. COUNCIL COMMUNICATIONS AND REPORTS-None EXECUTIVE SESSION The regular meeting was adjourned at 8:25 p.m. and the Council met in a 30 minute executive session with the City Attorney under RCW 42.30.11 O(C) to consider the sale of real estate and RCW 42.30.11 O(G) to review the performance of a public employees. No action to follow. At 8:55 the Council extended the executive session for an additional 10 minutes. The executive session was adjourned at 9:05 p.m. and the regular meeting was reconvened. Council must adopt a resolution that sets out its intent to conduct a public hearing concerning the assumption of the TBD. Background The Moses Lake City Council established a TBD on December 27, 2016 under Revised Code of Washington (RCW) 36.73 and 35.21.225. The TBD has the same boundaries as the City of Moses Lake and the City Council acts in an ex officio and independent capacity as the TBD governing board. On February 28, 2017, the TBD imposed a $20.00 vehicle license fee as authorized by the statute. These funds are to be collected beginning October 1, 2017. The Page 1of2 TBD also imposed a sales and use tax up to .02%, contingent to voters' approval. The State Legislature passed Second Engrossed Substitute Bill 5987, Chapter 44, Laws of 2015 ("Senate Bill 5987"), effective July 15, 2015, now codified as Chapter 36.74 RCW, which authorizes a city to assume the rights, powers, functions, and obligations of a transportation benefit district established by a city. In order to assume the rights, powers, functions, and obligations of a transportation benefit district established by a city, the city legislative authority must adopt an ordinance or resolution indicating its intention to conduct a hearing concerning the assumption of such rights, powers, functions, and obligations. City Council adopted Resolution No. 3670, Notice of Intent to assume the Transportation Benefit District on April 11, 2017. Fiscal and Policy Implications As a separate entity and taxing authority, the TBD would incur costs in creating financial reports and purchasing insurance. The city's assumption of the TBD will eliminate these costs. The rights, powers, immunities, functions, and obligations of the Moses Lake Transportation Benefit District are hereby assumed by the City of Moses Lake which is hereby vested with every right, power, immunity, function, and obligation currently granted to or possessed by the Moses Lake TBD. Section 3. No Existing Right Impaired. Pursuant to RCW 36.74.040, this assumption does not impair or alter any existing rights acquired by the Moses Lake TBD under Chapter 36. 73 RCW or any other provision of law relating to transportation benefit districts. Nor does this assumption impair or alter any actions, activities, or proceedings validated thereunder; any civil or criminal proceedings instituted thereunder; any rule, regulation, or order promulgated thereunder; any administrative action taken thereunder; or the validity of any act performed by the Moses Lake TBD or division thereof or any officer thereof prior to the assumption of such rights, powers, functions, and obligations by the City as authorized under the law. Section 4. Rules, Regulations, Pending Business, and Contracts. Pursuant to RCW 36.74.040, all rules and regulations and all pending business before the board of the Moses Lake TBD shall be continued and acted upon by the City Council. In addition, pursuant to RCW 36.74.050(2), all existing contracts and obligations of the Moses Lake TBD remain in full force and effect and must be performed by the City. The assumption does not affect the validity of any official act performed by any official or employee prior to the assumption authorized under the law. Section 5. Records of the Moses Lake TBD. Pursuant to RCW 36.74.060, all reports, documents, surveys, books, records, files, papers, or other writings relating to the administration of the powers, duties, and functions available to the Moses Lake TBD must be made available to the City. Section 7. Assumption of Indebtedness. Pursuant to RCW 36.75.070, the City assumes and agrees to provide for the payment of all of the indebtedness of the Moses Lake TBD, including the payment and retirement of outstanding general obligation and revenue bonds issued by the Moses Lake TBD. Section 8. TBD Governing Body Abolished. Immediately following the assumption of the TBD by the City, the Moses Lake Transportation Benefit District Board of Directors is abolished as required by RCW 36. 7 4.030(2). Section 9. Effective date. Municipal Services Director April 25, 2017 Motion Ordinance-Amend MLMC 10.12 Parking Regulations Legislative History: I April 11, 2017 April 25, 2017 Motion Attached is an ordinance that amends Moses Lake Municipal Code 10.12, entitled "Parking Regulations". This amendment would prohibit parking and unloading on both sides of Lakeland Drive from Nelson Road NE to East Oasis Circle. Background The prohibition of parking on this section of Lakeland Drive is the result of the Mitigated Determination of Non-Significance that was issued for the Crossroads North Phase II through VI Major Plats. In accordance with that determination, the Developer is required to install "No Parking" signs and restripe Lakeland Drive to provide one northbound lane, one southbound left turn lane, and one southbound right turn lane. This reconfiguration affects four property owners. This item was first presented to City Council at the April 11th meeting. Fiscal and Policy Implications The Developer will be able to restripe Lakeland Drive to include a left turn lane per their agreement with the City of Moses Lake. This will improve traffic flow at the Lakeland Drive and Nelson Road intersection. The irrigation main is no longer needed so the franchise is being terminated. Background During the development of Crossroads, irrigation water was needed for the northern part of the property while it was being farmed prior to development. As development has moved north, farming has been discontinued, so the irrigation is no longer needed and therefore the franchise that allowed the irrigation main is also no longer needed. Most of the irrigation system has already been removed. On April 11 , 2017 this ordinance was presented to the City Council for review. No action was taken at that time. Special events shall be allowed by a special events permit granted by the City Manager or designee. (Ord. 2817, 7/12/16) 5.12.020 Intent: It is the specific intent to place the obligation of complying with the requirements of this chapter upon the applicant or sponsor, and nothing contained in this chapter is intended to be construed to create or form the basis for liability on the part of the City, or its officers, employees or agents for any injury or damage resulting from the failure of the applicant or sponsor to comply with the provisions stated herein. (Ord. 2817, 7/12/16) 5.12.030 Definitions: For the purpose of this chapter, words and phrases used herein are as follows: A. "Applicant" shall mean any person or organization who seeks a special event permit to conduct or sponsor an event governed by this chapter. B. "Athletic event" shall mean an occasion in which a group of persons collect to engage in or watch a sport or form of exercise on private or public property and/or on a City street, sidewalk, alley, or other street right-of-way, which obstructs, delays or interferes with the normal flow of pedestrian or vehicular traffic, or does not comply with traffic laws or controls. Athletic events include, but are not limited to, bicycle and foot races. C. "Block party" shall mean a limited street closure within a residentially zoned area for the purposes of holding a gathering involving the immediately surrounding residents. D. "Expressive activity" means conduct, the sole or principal object of which is the expression, dissemination or communication by verbal, visual, literary or auditory means of opinion, views or ideas. Expressive Activity includes, but is not limited to, public oratory and the distribution of literature. E. "Funeral procession" means a single direct movement from a mortuary or church to the place of burial of a human body, under the direction of an authorized funeral director. 12-1 (7/16) CITY OF MOSES LAKE MUNICIPAL CODE CHAPTER 5.12 -SPECIAL EVENTS F. "Permit application fee" shall mean the fee to be paid by the special event permit applicant at the time the application is filed with the Finance Director. Such fee shall be set by the City Council. G. "Permittee" shall mean any person or organization who has been issued a special events permit by the City Manger or designee. The permittee shall have authority, subject to approval by the City, to determine participation in commercial activities during a special event. H. "Refundable deposit" shall mean the amount of money required of a permittee by the Municipal Services Department, Public Works Division, in order to assure adequate cleanup of the special event site. The deposit shall be returned to the permittee upon the completion of the event and approval of the Municipal Services Department, Public Works Division. I. "Special Event" means: 1. Any organized formation, parade, procession, demonstration or assembly which may include persons, animals, vehicles, or any combination thereof, which is to assemble or travel in unison on any street, sidewalk or other public right-of-way owned or controlled by the City which does not comply with applicable traffic regulations, laws or controls. 2. Any organized assemblage of seventy-five (75} or more persons at any public place, property, or facility which is to gather for a common purpose under the direction or control of a person. 3. Examples of special events include, but are not limited to, concerts, parades, circuses, fairs, festivals, block parties, street fairs, community events, on the water activities (such as boat races), mass participation sports (such as marathons and other running events}, athletic or sporting events, and community celebrations and observances conducted on public property or public rights of way. J. "Special events permit" shall mean the permit issued by the City Manager or designee after the applicant has met all applicable reviews and requirements set forth in this chapter. (Ord. 2817, 7/12/16) 5.12.040 Exemptions: The provisions of this chapter shall not apply to: A. Funeral processions B. Groups required by law to be so assembled C. Pedestrian processions along a route that is restricted to sidewalks and crossing streets only at pedestrian crosswalks in accordance with traffic regulations and controls. D. Expressive activities. If practicable, the organizers should give notice to the City at least four (4} hours prior to the event informing the City of the date and time of the event and provide an estimate of the approximate number of persons who will be participating. E. Activities of state and federal governmental agencies, including military units, which are performed within the scope of such agency's duties and functions. F. Events conducted by the City of Moses Lake (Ord. 2817, 7 /12/16) 5.12.050 Administration: The City Manager shall, after consultation with appropriate departments and agencies, have discretionary authority regarding special event permits. The City Manager may approve, modify, or condition an application for a special events permit in accordance with the principles of this chapter. (Ord. 2817, 7/12/16) 12-2 (7/16} 5.12.060 Permit Required: CITY OF MOSES LAKE MUNICIPAL CODE CHAPTER 5.12 -SPECIAL EVENTS A. Any person desiring to conduct or sponsor a special event on public property or which will necessitate the use of the public right-of-way shall first obtain a special events permit. B. Any event subject to the provisions of this chapter that is staged without complying with all conditions of this chapter shall be subject to closure by the City Police Department. (Ord. 2817, 7/12/16) 5.12.070 Permit Fee and Deposit -Exemptions: A. The fee for issuance of a special events permit shall be set by resolution of the City Council. A clean-up deposit is required for applicants or sponsoring organizations of special events involving the sale of food or beverages for immediate consumption, the erection of structures, the use of horses or other animals, other than dogs and cats, or the use of fireworks or other incendiary devices, in an amount reasonably anticipated to be incurred in removing debris or litter caused by such special event as determined by the City Council. The clean-up deposit may be returned after the special event if the applicant or sponsoring organization cleans and restores the area used for the permitted event to the same condition as existed prior to the event. If the property used for the event has not been properly cleaned or restored, the clean- up deposit shall be applied toward the City's costs in cleaning up the permitted area. There may be requirements for police officers to control traffic, provide security, and protect people and property at additional costs. The Public Works Division may have additional costs for placing barricades, roadway preparation, and clean-up. B. No fee shall apply to a block party (Ord. 2817, 7/12/16} 5.12.080 Prioritization of Permit Applications: When an event is proposed that would conflict with the time or location of another event, the following criteria shall guide the determination of priority for the special event: A. Whether a special event is being proposed for the same area or time as another event and, if so, whether multiple events can be reasonably accommodated given the location and resources, and if not, giving priority to the first event for which a permit application is submitted; provided, that either an event sponsored by the City of Moses Lake or a bona fide nonprofit organization that has previously occurred in the same general location or at the same approximate time of year shall have priority; provided further, that the nonprofit organization submits a timely and complete permit application for the special event. B. Whether timing or location of an event might conflict with other projects and activities, for example, road work or a construction project. C. History of the event or of other events held by a sponsoring party as related to safety, security, and compliance with permit conditions. (Ord. 2817, 7/12/16) 5.12.090 Permit Application and Issuance: A. A special event application as provided by the Administration Department and provided by the Parks and Recreation Department shall be completed and submitted to the parks and Recreation Department at least sixty (60) days prior to the event. Applications submitted less than sixty (60) days prior to the event may be accepted if the Administration Department finds that there is adequate time to properly process the request, that all requirements of the permit can be met without undue strain on City resources and the date and venue are available for use. B. If required by the City, the permittee shall provide the City with proof of commercial general liability insurance as required in section 5.12.140 below. 12-3 (7 /16) CITY OF MOSES LAKE MUNICIPAL CODE CHAPTER 5.12 -SPECIAL EVENTS C. The Parks and Recreation Director or designee shall issue the special event permit once the application has been approved after review of appropriate departments to include Police, Fire, Public Works, Parks, Community Development, and others as determined by the City Council, and the applicant has agreed in writing to comply with the terms and conditions of the permit. D. The Parks and Recreation Director or designated appointee shall approve, conditionally approve, or deny an application based on the recommendations of City departments involved in the review process. (Ord. 2817, 7/12/16) 5.12.100 Permit Requirements: A. Special event uses are to be temporary and approved for a particular zoning district by the Community Development Director. B. Temporary signage and temporary structures will be allowed subject to provisions of this code pursuant to the interpretive authority and discretion of the Community Development Director. C. Requests for temporary parking facilities for special events and street closures for special events shall be subject to provisions of this code pursuant to the interpretive authority and discretion of the Police Chief. Street closures for any portion of a state highway or right-of-way shall be subject to state requirements and approvals. D. Requests for fire and emergency medical services shall be subject to requirements and interpretive authority and discretion of the City's Fire Department. E. Requests for police services shall be subject to provisions of this code pursuant to the interpretive authority and discretion of the Police Chief. F. Expenses for fire, police, medical services, parks, and public works crews needed for coverage and cleanup at the special event shall be prepaid and the responsibility of the permittee, even if the permit fee has been waived. If the actual cost for City services and equipment on the date(s) of the event is greater than the estimated cost. the applicanUsponsor will be billed for the difference. G. Adequate sanitation and other required health facilities shall, as required by applicable statutes and the Grant County Health District, be provided or made available in or adjacent to any public assembly areas. H. Use of City water beyond incidental and typical consumptive uses, such as use of City water to run a water toy or water feature, shall require prepayment for such use in an amount to be determined by the City Manager. (Ord. 2817, 7/12/16) 5.12.110 Permit Conditions: The Parks and Recreation Director or designee may condition the issuance of a special event permit by imposing reasonable requirements concerning time, place, and manner of the event; and such requirements as are necessary to protect the safety and rights of persons and property and the control of traffic. (Ord. 2817, 7/12/16) 5.12.120 Denial of Application: A special event permit may be denied based upon a determination that: A. The event would endanger public safety or health B. The proposed event would seriously inconvenience or impair the general public's use of public property, services or facilities C. The event would unreasonably infringe upon the rights of abutting properties 12-4 (7/16) CITY OF MOSES LAKE MUNICIPAL CODE CHAPTER 5.12 -SPECIAL EVENTS D. The event would conflict with another proximate event or interfere with construction or maintenance work in the immediate vicinity E. There is not sufficient qualified safety personnel or other necessary City staff to accommodate the event F. The applicant failed to complete the application form after being notified of the additional information or documents required G. Information contained in the application of supplemental information requested from the applicant is found to be false in any material detail H. The applicant cannot meet, or is unwilling to meet, all of the requirements of this chapter or any special conditions imposed by any of the reviewing agencies I. Other issues in the public interest were identified by the City Manager, City Council, or City Official J. Failure to prepay expenses, fees, charges, deposits, insurance or bonds K. The proposed event is scheduled to occur at a route or location adjacent to a school or class during a time when such school or class is in session, and the noise created by the activities of the event would substantially disrupt the educational activities of the school or class L. The purpose of the proposed event is to incite crime or the overthrow of the government by force or the event would engage in or encourage participants to engage in illegal acts M. The primary purpose of the special event is for advertising products, goods, or events that are for private profit, and the special event is primarily for private profit. The prohibition against advertising any product, goods, or event shall not apply to signs identifying organizations or sponsors furnishing or sponsoring exhibits or structures used in the special event. (Ord. 2817, 7/12/16) 5.12.130 Indemnification: A. Prior to the issuance of the special event permit, the applicant must agree to reimburse the City for any costs incurred by the City in repairing damage to City property occurring in connection with the permitted event. B. In consideration of being permitted to produce this special event or activity or use of any City property or facilities in connection with this activity, the applicant ("indemnitor") agrees to the following: 1. The indemnitor hereby agrees to release, indemnify and hold harmless the City of Moses Lake from any and all liability, claims, demands, causes of action, charges, expenses, and attorney fees (including attorney fees to establish the City's right to indemnity or incurred on appeal) resulting from involvement in this event whether caused by any negligent act or omission of the City or otherwise. This agreement shall not apply to any liability resulting from the sole negligence of the City. 2. The indemnitor agrees to reimburse the City for any loss, theft of, or damage to City property, equipment and/or facilities. 3. The indemnitor agrees to comply with all applicable laws, statutes, ordinances, rules and requirements including, but not limited to, not admitting more attendees than designated by the Fire Department as safe for the particular event or facility. 12-5 (7/12/16) CITY OF MOSES LAKE MUNICIPAL CODE CHAPTER 5.12 -SPECIAL EVENTS 4. The indemnitor expressly agrees that this release and hold harmless agreement is intended to be as broad and inclusive as permitted by Washington law and that if any portion thereof is held invalid, notwithstanding, the balance shall continue in full legal force and effect. 5. Falsification and/or misrepresentation in completing this application may result in rate adjustment or event cancellation. Changes to the detailed program require immediate notification to City. (Ord. 2817, 7/12/16) 5.12.140 Insurance Required: A. As required by the City Manager, the permittee shall provide the City with proof of commercial general liability insurance generally in the amount of at least one million dollars ($1,000,000) (combined single limits per occurrence), two million dollars ($2,000,000) aggregate, and an endorsement naming the City of Moses Lake as an additional insured must be provided. If food or nonalcoholic beverages are sold or served at the event, the policy must also include an endorsement for product liability. If alcoholic beverages are sold or served at the event, the policy must also include an endorsement for host liquor liability. If the event involves athletic or other types of active participants, the policy must include participant coverage. If vehicles are used for other than nominal and standard commute purposes, a policy of business automobile liability, on an insurance industry standard form or equivalent including coverage for owned, non-owned, leased or hired vehicles, or equivalent coverage. The City Manager and the City's risk manager may require additional endorsements or higher limits depending upon the proposed activity. Such insurance shall be primary to, and non- contributory with, any insurance maintained by the City. B. Certificates of insurance shall be submitted to the City for approval directly from the insuring agency via postal mail, fax or email. The insurance policy shall be written on an occurrence basis, shall name the City as an additional insured, shall be written for a period not less than twenty-four (24) hours prior to the event and extending for a period not less than twenty-four (24) hours following the completion of the event, and shall contain a provision prohibiting cancellation of the policy except upon thirty (30) days' written notice to the City. Acceptability of insurance, including coverage types and limits, is subject to approval by the City's risk administrator. (Ord. 2817, 7/12/16) 5.12.150 Revocation or Suspension: A. A special events permit issued under this chapter shall be temporary, shall vest no permanent rights in the applicant, and may be immediately revoked or suspended by the City Manager or City Council if: 1. The applicant has made a misstatement of material fact in the information supplied; the applicant has failed to fulfill a term or condition of the permit in a timely manner; or the check submitted by the applicant in payment of the fee for a permit has been dishonored 2. The applicant requests the cancellation of the permit or cancels the event 3. The activity endangers or threatens persons or property, or otherwise jeopardizes the health, safety or welfare of persons or property 4 . The activity conducted is in violation of any of the terms or conditions of the special events permit 5. An emergency or supervening occurrence requires the cancellation or termination of the event in order to protect the public health or safety 12-6 (7/16) 6. The applicant fails to prepay expenses. CITY OF MOSES LAKE MUNICIPAL CODE CHAPTER 5.12 -SPECIAL EVENTS B. The City shall refund the permit fee in the event of a revocation caused by an emergency or supervening occurrence; the City shall refund the balance of the fee, less the actual costs incurred if the cancellation occurs at the request of an applicant who is in compliance with this chapter. C. If any event, use, or occupancy for which the permit has been revoked is not immediately discontinued, the City Manager or designee may remove any structure or obstruction, or cause to be made, without obligation to do so, such repairs upon the structure or obstruction as may be necessary to render the same secure and safe, or adjourn any special event. The cost and expense of such removal, repair or adjournment shall be assessed against the permittee, including all professional fees associated with enforcement of the collection of the same. (Ord. 2817, 7/12/16) 5.12.160 Appeal Procedure: Any party, including the applicant, may appeal the Parks and Recreation Director's or designee's decision to grant or deny a permit. A written appeal must be received by the Finance Director within ten ( 10) days after a written decision. The written notice of appeal shall set forth the specific grounds for the appeal and attach any relevant documents for consideration. A hearing shall be held by the City Manager not more than ten (10) business days after the receipt of the request for a hearing. The Finance Director shall give the appellant reasonable notice of the appeal hearing to the applicant and appellant (if not the applicant). The applicant shall have the right to attend said hearing and present evidence. Any hearing under this chapter shall be conducted during normal business hours, on an informal basis. A record of the hearing, including the date of hearing, who was present, and the findings made as to whether or not the decision was consistent with the approval criteria, shall be made in writing. The written finding shall be filed with the City Manager or designee. The decision of the City Manager shall be final. (Ord. 2817, 7/12/16) 5.12.170 Waiver of Application Deadline -Waiver of fees, insurance and performance requirements for special events protected under the First and Fourteenth Amendments to the U.S. Constitution: A. Upon a showing of good cause the City Manager shall consider an application that is filed after the filing deadline, if there is sufficient time to process and investigate the application and obtain police and other services for a special event protected under the First and Fourteenth Amendments to the U.S. Constitution primarily involving political or religious activities intended for the communication or expression of such ideas. Good cause can be demonstrated by the applicant showing that the circumstances that gave rise to the permit application did not reasonably allow the participants to file within the time period prescribed and that the event is for the purpose of exercising the right of free speech. 8. An application for a special event protected under the First and Fourteenth Amendments to the U.S. Constitution shall be processed promptly without charging a fee that impermissibly infringes on constitutionally protected rights and without imposing terms and conditions or performance requirements that impermissibly infringe on constitutionally protected rights. C. The City Manager may waive or reduce the insurance requirements under this chapter if the applicant or an officer of the sponsoring organization signs a verified statement that s/he believes the event's purpose is First Amendment expression, and that the cost of obtaining insurance is so financially burdensome that it would constitute an unreasonable burden on the right of First Amendment expression. The statement shall include the name and address of two insurance agents or other source of insurance coverage contacted to determine insurance premium rates for insurance coverage. The city allows for variance on overhead construction for Code 16.56.050 A2 : "That the costs of the underground installation, when compared to overhead installation, is disproportionate in comparison to the benefit to be gained by the property and/or public and is disproportionately high when compared to other properties or locations; or" The additional cost to underground these electrical and communication facilities along this portion of line is approximately $500,000. In addition there will be cost and hardship for the citizens located in the area to upgrade their side of the service. About 163 customers will be affected with the cost to upgrade electrical secondary system and the required excavation on all the sites in their yards. This permit is compatible with Permit No.ST-008121 issued by Washington State Department of Ecology (Ecology). This permit authorizes the Permittee to discharge Low Chloride Process Wastewater from their Moses Lake facility at 3322 Road N NE to the City's Dunes POTW in accordance with the conditions of this permit. The permit becomes effective as of the date signed. General Conditions l. All discharges and activities authorized by this permit shall be consistent with the terms and conditions of this permit. The discharge of any wastewater with discharge rates or characteristics that exceed this permit shall constitute a violation of the terms and conditions of this permit. Whenever the Permittee refuses to take corrective action or continues to violate terms and conditions of this permit, the City may impose civil penalties; terminate this permit, or both. Termination of this permit may require disposal of the process wastewater in some manner other than into the private sewer or side sewer tributary to the Dunes POTW, at the expense of the Permittee. 2. All facility changes that could result in a significant deviation in the permitted characteristic of pollutants discharged to the Dunes POTW shall be reported to the City. Significant adverse deviations in characteristics of pollutants shall be submitted to the City for review and approval before discharging to the Dunes POTW. No significant change shall be made until plans have been approved by the City, and a new or modified permit has been issued. This permit does not authorize new connections, increased flows, or significant changes. 3. The diversion or bypass of any discharge from any pre-treatment facility, utilized by the Permittee to maintain compliance with the terms of this permit, is prohibited, except where unavoidable to prevent loss of life, severe property damage, or as provided in the SPECIAL CONDITIONS of this permit. The procedures outlined in Paragraph 4 of the GENERAL CONDITIONS shall be followed in the event of such a diversion or bypass to the Dunes POTW. 4. In any event that causes a violation of the discharge rates or characteristics authorized by this permit, the Permittee shall take the following actions: a. Immediately stop, contain, and clean up the unauthorized discharge and correct the problem. b. Immediately notify the City so steps can be taken to prevent damage to the Dunes POTW. c. Submit a written report within fifteen (15) business days of the event, describing the breakdown, the actual quantity and quality of the resulting discharge, the corrective action taken, and the steps taken to prevent a recurrence. d. Pay reasonable costs incurred by the City that are associated with a breakdown, accident, or other cause that is attributable to such event. e. Pay a penalty for each occurrence of non-conformance with the conditions of this permit, as may be assessed in accordance with the Moses Lake Municipal Code. Compliance with the above requirements does not relieve the Permittee from responsibility to maintain continuous compliance with the conditions of this permit or the resulting liability for failure to comply. 6. The Permittee shall adequately maintain and efficiently operate all treatment and control facilities or systems installed or used by the Permittee to achieve compliance with the terms and conditions of this permit. 7. If any of the following findings have been discovered or reported to the City, the City will provide a written notice to the Permittee. The written notice by the City will describe the findings and any actions that will be taken by the City or required of the Permittee. In addition to actions previously described in Item 4, the permit may be amended, suspended, or revoked in whole or in part. Within ten (10) business days ofreceiving the written notice, the Permittee may request a hearing before the City Council, to dispute the findings or to request a revision to actions described. The City Council's determination will be final. a. Violation of any terms or conditions of this permit. b. Obtaining this permit by misrepresentation or failure to fully disclose all relevant facts. c. A change in permitted conditions that require a permanent reduction or elimination of wastewater discharge to the DunesPOTW. 8. The Permittee shall allow authorized representatives of the City to perform the following actions: a. Enter portions of the premises where effluent sources, disposal systems, or records are kept. If an escort for the premises is requested by either the City or the Permittee, the Permittee shall provide the escort. b. Inspect,monitoring equipment and monitoring methods required by this permit. c. Sample any effluent or pollutants that discharge to the Dunes POTW. d. Review test results and test methods. 9. The Permittee shall comply with all current federal, state, and local statutes, ordinances, and regulations. If the State's Waste Discharge Permit is revised to require more stringent limits on the Permittee's discharge to the Dunes POTW, the requirements of this permit may be revised by the City by providing written notice to the Permittee. 10. Within ten ( 10) business days of receiving the written notice ofrevisions by the City, the Permittee may request a hearing before the City Council, to dispute the revisions. Depending on the magnitude of the changes, the Pennittee, City, and Ecology may negotiate a compliance schedule that will allow the Permittee to implement the required revisions over a specified period. 11. This permit does not authorize discharge into public waters of Washington State. Any discharge to public waters of Washington State is subject to applicable regulations administered by Ecology. I 2. Costs incurred by the City in handling, treating, monitoring, and disposing of the Permittee's process wastewater shall be borne by the Permittee in the rate structure set forth by the City. The City may set forth the various fees in accordance with the Moses Lake Municipal Code. 13. The Permittee shall submit an application for permit renewal at least 180 days prior to the expiration date of the permit. In the event that the City does not respond within the allotted 180 day period, the existing permit shall remain in force until the revised permit is issued. 14. The Permittee shall pay fees associated with this permit as established by the Moses Lake Municipal Code. The City may revoke this permit ifthe permit fees are not paid. REC Solar Grade Silicon, LLC Discharge Permit No. 4 Page 2 Special Conditions In the event of noticeable corrosion attributable to the process wastewater discharge, the City may require the Permittee to develop a corrosion monitoring system. The system shall consist of metal samples or other material placed in pipes, wet wells of pump stations, and other appropriate locations affected by the process wastewater discharge. By comparing the rate of corrosion with the rate of control samples placed in wastewater not affected by the process wastewater discharge, any increases in the rate of corrosion may be monitored. Such analyses of samples shall be carried out periodically by a firm experienced in corrosion testing and evaluation. All analyses and tests shall be at the Permittee's expense. Such analyses and tests shall be performed in a manner and at locations that are acceptable to both the Permittee and the City. Based upon the analyses, the Permittee shall pay for damages to the Dunes POTW, and for additional protective measures to the Dunes POTW, including any or all of the following items: installation of cathodic protection systems; installation of protective linings for pipes, manholes, and tanks; replacement of equipment, pipes, and appurtenances; structural modifications; and other measures as directed by the City. The biological and physical operations at the City's wastewater treatment plant shall not be impaired by the Permittee's wastewater discharge. The City's wastewater treatment plant is an extended aeration activated sludge system. Processes at the plant include influent pH & conductivity monitoring, grit removal, aeration, clarification, solids removal, flow measurement, ultraviolet (UV) disinfection, and infiltration. If the City determines that any biological or physical processes in the wastewater treatment plant are negatively impacted by the Permittee's process wastewater discharge, the Permittee shall immediately take actions on the Permittee's operations to ensure proper operation of the wastewater treatment plant. Effluent Limits During the period of this permit, the Permittee is authorized to discharge Low Chloride Process Wastewater to the Dunes POTW, subject to the specified flow, concentration, and monitoring requirements. Process wastewater shall be monitored and discharged to the POTW and shall not exceed a maximum daily flow of300,000 gallons and a maximum monthly average of210,000 gallons per day. The effluent limits for the discharge to the Dunes POTW are shown in Table 1: Effluent Limits, Outfall No. 00 l. Outfall No. 00 I is the metering manhole sump prior to discharge to the City of Moses Lake Dunes POTW. Limits of effluent characteristics that are not specifically listed in this permit shall be as set forth in City of Moses Lake Municipal Code, Chapter 13.05, Sewer Regulations, as of the date of this permit. In order to meet the effluent limits, the Permittee shall provide facilities as specified herein. When required, pretreatment and storage facilities shall be designed and operated by the Permittee in a manner such that the wastewater is in compliance with the flow and concentration limits established herein. During emergency conditions, or when the effluent cannot meet the conditions of this permit, the Permittee shall divert the flow, collect the wastewater, and re-treat the effluent. If the effluent limits cannot be achieved by the onsite treatment system, the Permittee shall collect the effluent and send it off site for disposal in accordance with applicable regulations. REC Solar Grade Silicon, LLC Discharge Permit No. 4 Page 4 Sampling and Analvtical Procedures Samples and measurements taken to meet the requirements of this permit shall be representative of the volume and nature of the monitoring parameters, including representative samples of unusual discharges or discharge conditions such as bypasses, upsets, and maintenance-related conditions affecting effluent quality. Sampling and analytical methods used to meet the water and v.astewater monitoring requirements specified in this permit shall conform to the latest revision of the following rules and documents unless otherwise specified in this permit or approved in writing by Ecology. a. Guidelines Establishing Test Procedures for the Analysis of Pollutants Contained in 40 CFRpart 136 b. Standard Methods for the Examination of Water and Wastewater (APHA) Flow Measurement, Field Measurement, and Continuous Monitoring Devices The Permittee Shall: 1. Select and use appropriate flow measurement, field measurement. and continuous monitoring devices and methods that are consistent with accepted scientific practices. 2. Install, calibrate, and maintain these devices to ensure the accuracy of the measurements is consistent with the accepted industry standard, the manufacturer's recommendation, and approved O&M manual procedures for the device and the waste stream. 3. Calibrate continuous monitoring instruments weekly, unless a longer period is acceptable to the City, based on monitoring records. a. Must calibrate continuous pH measurement instruments using a grab sample analyzed in the lab with a pH meter calibrated v.'ith standard buffers and analyzed within 15 minutes of sampling. 4. Use field measurement devices as directed by the manufacturer. Reagents shall not be used beyond their expiration dates. 5. Establish a calibration frequency for each device or instrument in the O&M manual that conforms to the frequency recommended by the manufacturer. 6. Calibrate flow:monitoring de\·ices at least once per year, or as otherwise specified by the manufacturer. 7. Maintain calibration records for at least three years. Reporting and Record Requirements The Permittee shall monitor and report in accordance with the conditions set forth in this permit. Falsification of the information submitted to Ecology or to the City is a violation of the terms and conditions of this permit. Monitoring results required by this permit shall be submitted by paper form by the l 5'h day of the month following the sampling period. A copy of the DMR in Ecology "Paris" format will be accepted so long as it is accompanied by the electronic signature form and delivered to one of the addresses listed below in paper form. Such information shall include all calibration and maintenance records, all original recordings for continuous monitoring instrumentation, and copies of all reports required by this permit. Laboratory accreditation The Permittee shall ensure that all monitoring data is prepared by a laboratory registered or accredited under the provisions of Chapter 173-50 WAC, "Accreditation of Environmental Laboratories". However, flow, temperature, settleable solids, conductivity, pH, and internal process control parameters are exempt from the accreditation requirements of Chapter 173-50; but, the Permittee shall obtain accreditation for conductivity and pH if accreditation or registration is required for other parameters. Request for Reduction in Monitoring The Permittee may request a reduction of the sampling frequency after twelve ( 12) months of monitoring. The City will review each request, and if approved, the reduction will be either included when the permit is reissued, or by a permit modification. To request a reduction in the sampling frequency, the Permittee shall provide the following to the City: 1. Provide a ""Titten request. 2. Clearly state the parameters for which reduced monitoring is requested. 3. Clearly state the justification for the requested reduction. Waste Preventative Practices The following methods shall be used by the Pennittee to reduce or eliminate contaminant loading to the Dunes POTW: I. Chemicals shall be stored in a manner that will prevent entry of these solutions into the Dunes POTW or waters of the state. All chemicals shall be stored using best management practices. 2. Pretreatment and storage systems shall be maintained continuously by the Permittee, in satisfactory and effective operational condition, and shall be accessible to the City at all times. 3. The Pennittee shall designate a representative whose responsibilities shall include the operation and maintenance of pretreatment and storage facilities, monitoring requirements, permit compliance, and all other aspects of the process waste...,-ater discharge. The City may contact the designated representative, at any time, to discuss matters related to the process wastewater discharge to the Dunes POTW. 4. The Permittee is liable for all damages directly attributable to its wastewater discharge, exclusive of normal wear and tear. Permittee shall not be jointly and severally liable for the damage caused by any other party, but shall only be liable for its pro-rata share of damages that are directly attributable to the Permittee's wastewater discharge. Attributable damages include those that may be caused by the wastewater collection system, pump stations, wastewater treatment plant, receiving water degradation, or any combination of these items. 5. In the event that a hazardous petroleum or radioactive material spill reaches the Dunes POTW, the Permittee shall notify the City immediately. I Deputy City Manager April 25, 2017 Motion Comprehensive Plan Amendment -9951 NE Harris Road Legislative History: I April 25, 2017 I Motion Attached is an Application for Comprehensive Plan Amendment submitted by Ashwani Sharma, ADI Investment LLC, requesting to change the land use designation of parcel #17-0304-000 from Residential to Commercial. This parcel is outside City limits but within the Moses Lake Urban Growth Area (UGA) which requires both City and County approval. The BOCC requires preliminary review of all proposed amendments to the Moses Lake UGA by the City Council before Grant County will complete their review. The property owner is requesting the designation change from Residential to Commercial in order to construct a convenience store and bed and breakfast residence inn with occupancy for up to 150 people. Additional permits and approvals would be needed; the designation change would be only the first step. It is also important to note that nothing in the process binds the owner to the proposed use; if the designation is changed, the owner can proceed with any allowed uses that meet zoning requirements. Page 1of3 Background The Growth Management Act, RCW 36.70A, requires consistency between City and County within the UGA. However, Grant County has the ultimate authority with matters that pertain to the UGA. The current system in place for reviewing UGA amendments is that BOCC requests input from the City, in the form of a recommendation from the City Council on whether the request should be considered. Fiscal and Policy Implications Fiscal implications are too detailed to be determined at this time. The changing of land designated Residential to Commercial property would increase the amount of property taxes that could be collected in comparison. Also, the issue of public services, such as police and fire protection, would need to be considered. Commercial development would have more economic impact on the area and region, by providing jobs and creating the need for additional services. Policy implications are also complicated. There are other Commercial designations within Yi mile of the site, but not contiguous. Stratford Road farther south is a major commercial street, but north of Harris there is very little commercial development. Careful consideration should be given to expanding the Commercial designation to this site while taking into account traffic implications; public safety implications; water and sewer implications. When proposed to change a Comprehensive Plan Land Use Designation, the benefit to the public must be considered, rather than the benefit to the property owner. One additional policy and possibly fiscal implication is that Moses Lake's water service policy, recently adopted by the Council, would require connection to City water for a commercial use. So a water main would need to be extended before this project could be developed. Frontage Road E. within the City of Moses Lake, Washington. 2.2 Condition of Demand: The City of Moses Lake, Washington shall make demand upon the principals or either of them only upon a determination, in the sole discretion of the City of Moses Lake, that the principals have failed to perform the obligation imposed by the city. 2.3 Statutes and Ordinances: This obligation is undertaken and entered into by principals being mindful that the statutes of the State of Washington and the ordinances of the City of Moses Lake, Washington which are incorporated by reference as if set forth fully herein, are the law governing th is obligation. 2.4 Plat Obligation: Principals are required to perform the following obligations in connection with the development of the above referenced project: Work listed on the bid supplied by Central Washington Asphalt dated October 29, 2014, which includes hard surface area for 10 required 9' x 1 O' parking spaces, drive aisle, and striping. 3. Obligation of Principals 3.1 Principal: Principals agree to perform or cause to be performed all things necessary to satisfy the obligations listed in 2.4 in compliance with City of Moses Lake ordinances and/or community standards and administered by the City of Moses Lake, Washington within twenty-four (24) months from the date of the execution of this bond. Upon completion and acceptance of work satisfying the listed obligations or principals, or a portion thereof, the Moses Lake City Engineer may approve, in his sole discretion, a reduction in bond requirements or release of the bond. 3.2 Subsequent to Acceptance of Work: Principals agree that after the Moses Lake City Eng ineer accepts the work satisfying all obligations imposed upon the principals, as stated under 2.4 or as altered as provided by law, and after the expiration of all lien periods, and if there are no liens pending, then the penal sum of this bond shall be deemed to insure against defects appearing or developing in the material or workmanship provided or performed in satisfaction of the obligation of principal under this bond within a period of twelve (12) months after the acceptance by the City Engineer. Furthermore, notwithstanding the reduction of this bond, the principals agree to hold the City of Moses Lake harmless from all defects appearing or developing in the material or workmanship provided or performed under this agreement within a period of twenty-four (24) months after acceptance by the City Engineer. The obligation of the principals for defects stated above shall be at 10% of the penal sum of this bond notwithstanding any reduction in the bond amount authorized by the Moses Lake City Engineer pursuant to 3.1. 4. Alternative to Bond: As provided by law, the principals have deposited into a savings account with any bank or savings and loan association or credit union authorized to do business in the State of Washington in a branch located in Grant County, Washington the sum of twenty thousand nine hundred eighteen dollars ($20,918). The City of Moses Lake has been named as the only authorized drawer of that savings account with the principals appearing as successor-drawers. The City of Moses Lake is authorized by the principals to use all or so much of that savings account as is necessary to carry out the conditions of paragraph 3.1 if the conditions of paragraph 2.2 are met. The City of Moses Lake shall execute a release or releases of interest in the saving account once the principals have performed as provided for in this bond as determined solely by the city, or if the principals provide substitute security to the City of Moses Lake which is acceptable to the city and approved by the City Attorney. 5. General Provisions 6. 5.1 Extension: If principals apply to the Moses Lake City Council for and receive from them a one-time extension of the twelve ( 12) month time limit for completion of the performance this bond insures, both principals acknowledge they understand principals must provide new security covering the costs calculated pursuant to ordinance and for the duration specified by the Moses Lake City Council by additional deposits to this account or by providing additional security acceptable to the City Attorney. 5.2 Washington Law: It is hereby expressly agreed by principals that if any legal action is brought under the terms and conditions of this bond, that the decisions of the courts of the State of Washington shall be binding. 5.3 Attorney Fees: In the event of legal action to enforce rights under this bond, the prevailing party shall be entitled to receive its reasonable attorney fees. a h rine . The City's systems have the capacity to serve this lot. The property is located outside of the City limits, but inside the UGA and within one-half mile of the city limits. If approved, the property owner will be required to annex into the City or sign an extra territorial agreement before a permit is issued for connecting to City services. Background This appears to be the first time a new home is built on a lot inside of the City's UGA and Retail Water Service Area, but only request to connect to one of the two available services. The owners intend to serve the lot with a private onsite well even though the City's water system located in their street.
