Dir. / Deputy City Manager Summary: Council to review and adopt resolution as presented Administrative Report Council Communications and Reports Executive Session Adjournment MOSES LAKE CITY COUNCIL July 11 , 2017 CALL TO ORDER: The regular meeting of the Moses Lake City Council was called to order at 7 p.m . by Mayor Voth in the Council Chambers of the Civic Center, 401 S. Balsam, Moses Lake, Washington. ROLL CALL: Executive Secretary Sophia Guerrero called the roll. The following were: Present: Mayor Todd Voth, Deputy Mayor Karen Liebrecht, and Council members Don Myers, David Curnel, Ryann Leonard, and Mike Norman and Position No. 1 is now vacant. PLEDGE OF ALLEGIANCE: Park and Recreation Department Director, Spencer Grigg, led the Council in the pledge of allegiance. SUMMARY REPORTS: MAYOR'S REPORTS -None ADDITIONAL BUSINESS Action Taken: Mayor Voth moved to amend MLMC 3.18 Chapter Gambling Tax, enter it into the record as a first reading, and bring it back to the next council meeting as a public hearing and a vote, seconded by Council member Mike Norman, and passed with a 4 to 2 vote . Aye -Council Members Myers, Curnel, Norman, and Mayor Voth. Nay -Deputy Mayor Liebrecht and Council Member Leonard CITY MANAGER'S REPORTS Cit~ Manager John Williams confirmed with Council a public hearing has been set for July 251 to amend MLMC Chapter 3.18 Gambling Tax ordinance and advertise the public hearing accordingly. Council Position No. 1 seat is now open and City Manager John Williams would like to discuss options in filling this position with the council. Phase #1 -Municipal Research and Services Center (MRSC) has information regarding on how to fill a vacant seat on the City Council and who has authority to do so. Council has the ability to make an appointment to the vacant seat and must choose a candidate within 90 days. If Council fails to fill the vacant seat within 90 day, the Grant County Commissioners may choose a candidate within 180 days to take the vacant seat. Council may choose to keep the Council Position No. 1 seat vacant till December 31, 2017, but they must inform the Grant County Commissioners of their intent. There is an upcoming election for that particular seat and Council may let the election process be the deciding factor. Considerable discussion among Staff and Council. Phase #2 -Council Position No. 4 has no one running for this position now that Bill Ecret has withdrawn his candidacy. City Staff are in discussion with the Grant County's Legal Department and they in turn are in discussion with the Secretary of State on how to start the 3 day filing period . Considerable discussion among Staff and Council. CITY COUNCIL MLNUTES Action taken: Deputy Mayor Karen Liebrecht moved to advertise the vacant council position, accept resumes, and letters of intent from citizens who are interested in filling the vacant Council Position No. 1, with the understanding that there will be an interview for each interested candidate at the next council meeting and finally the closing date will be July 19, 2017 at 5 pm. Seconded by Council Member Curnel and passed with a 4 to 2 vote. Nay -Council Members Myers and Leonard. CITIZEN'S COMMUNICATIONS Considerable discussion by the Council. No action taken. CONSENT AGENDA #1 a. Minutes: The minutes of the Ju ne 27, 2017 meeting were presented for approval. b. Approval of Claims, Prepaid Claims. Checks, and Payroll: Vouchers audited and certified by the Finance Director as required by RCW 42.24.080, and those expense reimbursement claims, certified as required by RCW 42 .24.090, have been recorded on a listing which has been made available to the Council for approval and is retained for public inspection at the Civic Center. As of July 11, 2017 the Council does approve for payment claims in the amount of $829,911 .98; prepaid claims in the amounts of $42,878.64 and $13,732.76; claim checks in the amount of $1,045,686.52; and payroll in the amount of $411,258.66 and $3,658.48. c. Acknowledgment of Receipt -Resignation Council member Bill Ecret submitted his resignation from the Moses Lake City Council Position No. 1 effective July 3, 2017. Action Taken: Council Member Curnel requested item No. 1A be removed from the Consent Agenda for discussion. The lot size numbers for the Harley B. Short Plat were transposed at the last council meeting and were not changed in the June 27, 2017 minutes. Council Member Curnel requested the numbers be corrected. City Manager John Williams assured council the error will be corrected. Council member Curnel moved that the Consent Agenda be approved with the corrections made in the June 27'h minutes, seconded by Council Member Leonard, and passed unanimously. OLD BUSINESS -None NEW BUSINESS #2 STREET GANG ACTIVITY -CRIME FREE RENTAL HOUSING LEGISLATION Council requested information on potential legislative tools to address gang activity in rental housing following a citizen request. The City currently has the ability to address nuisance gang activity under its abatement process contained in MLMC Chapter 8.14. The State also provided legislation contained in Chapter 35.106 RCW regarding "Crime-Free Rental Housing". Several jurisdictions have implemented programs under this statute; a copy of Sunnyside's ordinance and Walla Walla Crime Free Rental Housing Program has been provided as an example. Considerable discussion between City Staff and Council. The Council would like to know if Sunnyside and Walla Walla have been successful with their programs. Staff is directed to bring back their findings. No other action taken. pg.2 CITY COU CJ L MI UTES ------· ------------------------- #3 REQUEST TO ACCEPT AMENDED PARKS & FACILITY NAMING POLICY The current Parks & Facility Naming policy was adopted in 2002. The updated version provided by the Parks & Recreation Commission would replace the existing policy with a more detailed approach to naming parks and facilities. City Staff has reviewed and made modifications to the policy also. Considerable discussion. City Manager reminded Council that they can recommend public participation to the Parks and Recreation Commission when the Parks & Facility Naming Policy is involved with a particular project. No action taken. ADMINISTRATIVE REPORTS TRANSPORTATION BENEFIT DISTRICT A Transportation Benefit District (TBD) Fact Sheet for Proposition No. 1 has been provided to the Council. This fact sheet highlights issues regarding this proposition ballot. This will be placed on our City website for the public's review. Our City Attorney's office will be delivering the proposition ballot to the Grant County Auditor to be placed on the 2017 November ballot. WATER RATIONING UPDATE Municipal Services Director, Fred Snoderly, informed the Council of his decision to implement a city wide water rationing recommendation on July 10. High water usage has caused reservoirs to have low level alarms and the wells available in the residential zones cannot keep up with the high demand. Well #33 was working extra hard to keep up with the demand and was pumping air. On July 101h the Water Division measured the water usage at 16.8 million gallons of water. After implementing the water rationing, the usage dropped to 14.9 million gallons of water in 24 hours. With continued support from the public, the Municipal Services Director hopes to lift the water rationing recommendation soon. Spencer Grigg, Parks and Recreation Director also informed Council that his department has cut their irrigation schedule down 70%. Considerable discussion. Council member Don Myers would like to revisit the water rates for conservation purposes. LODGING TAX ADVISORY COMMITTEE With Council Member Bill Ecret's resignation in place, there is now a vacant chair position with the Lodging Tax Advisory Committee that needs to be filled by a council member. Action taken: Council member Norman moved that Mayor Todd Voth be assigned as Chair to the Lodging Tax Advisory Committee, until the current vacant position has been filled, seconded by Council member Curnel, passed unanimously. COUNCIL COMMUNICATIONS AND REPORTS-None EXECUTIVE SESSION The regular meeting was adjourned at 8:03 pm and the Council met in a 20 minute executive session with the City Manager and City Attorney under RCW 42.30.11 O(c) and (i) to consider the minimum price at which real estate will be offered for sale or lease and discuss with legal counsel representing the agency potential litigation. No action to follow. At 8:23 pm the Council extended the executive session for an additional 1 O minutes. pg. 3 CITY COUNCJL ML 1UTES At 8: 33 pm the Council extended the executive session for an additional 10 minutes. Background The project consisted of placing 60,200 square yards of 5/8" -No. 4 wheel path repair, completing 193,200 square yards of 3/8" -No. 10 seal coat, and fog sealing 231,100 square yards of roadway on Division Street, Wheeler Road, Pioneer Way and Riviera Avenue. The work was awarded in the amount of $745,055.00 and the final contract amount is $624,906.22. The reduction in cost was due to a reduction in the calculated amount of oil and rock needed to complete the project. No streets were removed from the project. The state maximum rate that may be collected on card rooms is 20% and the City currently collects 10% per the current MLMC. Background This tax was originally established by state RCW as funding source for public safety (police and fire) and has the restriction that in can only be spent for those services caused by the impact of having such facilities in the City. The City has receipted the funds directly into the Police Budget Account. Page 1 o/2 Fiscal and Policy Implications If the current draft of the ordinance were adopted, the Police budget would see a reduction of revenue in excess of $116,000 annually at full implementation. The reduction would be exponential compounding of $23,000 each year until the full amount is realized. The renaming of parks and facilities is strongly discouraged. Policy The naming of city parks and facilities shall be the function of the Ci ty Council with assistanct.: from the Parks and Recreation Commission and the Parks and Recreation Department. Diversity, balance and creativity will be sought during adoption of names. The name selected for a site wi ll be recommended to the City Council for approval or amendment. City Council has final authority to approve or amend any recommendation. Objectives A. Provide name identification for indi vidual parks, park areas or city owned facilities. B. Provide criteria for the process of naming parks, park areas or city owned facilities. C. Provide opportunities for public input. D. Division. Wayne Morgan, representing Smith-Martin, has requested minor changes to the PURD Ordinance which are technical in nature and consistent with Ordinance 2405 the Parkview PURD. Moses Lake Municipal Code 18.67.210 provides for these types of amendments. The Planning Commission considered the proposed amendments in accordance with MLMC 18.67.210 at their regular scheduled meeting on July 13, 2017 and recommended to the City Council that the proposed changed be approved. Background The City Council approved the final PURD on July 8, 2008, and the final plat was recorded on May 16, 2017. The following described property shall be permitted to develop as Planned Development District No. 12, and shall be named Parkview Planned Unit Development as recorded with the Grant County Auditor. Parkview PUD Major Plat Section 2 Parkview is a mixed .use development. The land uses that are permitted are: A. Professional offices on the first floor and apartments on the second floor of the existing building on Lot 1. B. Attached single family residences (townhouses), with one dwelling unit per lot, on Lots 2, 3, 6 through 10, 12 through 19, and 22 through 27. C. Garage buildings for the townhouses on Lots 4, 5, 11, 20, and 21 D. Private street and utilities, parking areas, common open space, and wetlands and buffer on Lot 28. Section 3. The Parkview PUD is an overlay zone. The requirements of the underlying R-3 Zone are modified as follows: A. Overall development standards 1. The development shall be constructed with an architectural theme, essentially as presented to the Planning Commission and Council, including the appearance of the buildings. 2. A homeowners' association shalJ be required before the planned unit development major plat is recorded with Grant County. The Codes, Covenants, and Restrictions for the development shall be submitted to the City for review and shall be recorded concurrently with the plat. The homeowners' association shall be responsible for the maintenance of the site, including but not limited to landscaping, fencing, off-street parking areas, and sidewalks. B. Streets, sidewalks, and utilities 1. Internal street, sidewalks, and utilities shall be private. 2. The constructed width of the street shall not be less than 20' from face of curb to face of curb. Street lighting shall be smaller scale lighting consistent with the craftsman style of the residential structures and shall be designed to prevent overspill of lighting into the wetland area and lake. C. Bulk standards: 1. The minimum lot size shall be 800 square feet. The minimum lot width shall be 21 '. The minimum lot depth for residential lots shall be 39'. Minimum dimensions for garage lots shall be 25'. 2. Minimum setback of any new building from the exterior boundaries of the development shall be the same as the underlying R-3 Zone. 3. Minimum setback from the property line abutting the internal street shall be 5' for all buildings. · 4. Where the residential units are attached, there shall be no side yard setback, otherwise the residential units shall have a minimum 5' side yard setback. 5. Garage units shall be required to meet only the setback from the internal street and driveway and from the project boundary. 6. Building overhangs such as eaves, cornices, and awnings may project into setbacks not more than 2'; however, no encroachment into easements is allowed, either above or below ground. 7. Minimum roof pitch of the main roof of residential structures shall be 8: 12 (vertical : horizontal). D. Building design standards: 1. Buildings shall be craftsman style with articulated architectural features including stepped roofs, as detailed on Sheet 3 of 4 of the preliminary plat submittal. 2. AH external doors and windows shall have trim with a minimum width of 3 ~ ". 3. Eaves of at least 18" shall be provided on at least two sides of all buildings. 4. Exterior siding materials for all buildings shall be wood, engineered wood, fiber cement, fiber cement lap siding, stone, or masonry. Vinyl, aluminum, plywood, and steel shall not be allowed. 5. Roofing for all buildings shall be architectural composition shingles. Three~tab shingles shall not be allowed. E. Landscaping and site development: .... The developer shall restore the planter strip along Division Street and install and maintain a Type Ill street frontage buffer within the planter. 3. All required landscaping shall be installed or bonded for before issuance of a Certificate of Occupcmcy for any new residence. 4. The trash receptacle(s} shall be screened by a decorative block enclosure or equivalent. F. Parking: 1. Parking for each townhouse unit shall be a minimum of one outside space and one garage space. 2. Parking for the existing professional office/apartment building shall be a minimum of 16 spaces. 3. No storage of recreational vehicles, watercraft, or similar items shall be allowed unless wholly within a garage. Section 4. Section 2.A. This building has been torn down since the original ordinance was drafted. Requesting to change Lot 1 from a mix of offices and apartments to attached single family residences. (town homes) They would have one dwelling per lot for a total of 6. These would be larger units with attached garages consistent with the style and materials used for the adjoining 21 units of the PUD. Section 3. D 1,4,5 3.-01 The original design by previous owners was just conceptual and not necessarily done for site conditions. We believe that the stepped roofs are awkward for such narrow buildings and detract from our coastal craftsman style. We have added additional gables and accents to break up the roof line on the front and the back. 3.-04,05 The majority of the roof will be architectural composition shingles as specified. We would like to change the portion that says no steel allowed to metal accents on garage roofs, front porch roofs, and fencing. We believe this will enhance the style and beauty of the project. The maintenance bond amount shall be one hundred percent (100%) of the actual cost of construction. An alternative security shall be in an amount not less than ten percent ( 10%) nor more than one hundred percent ( 100%) of the actual cost of construction. The amount shall be determined on a case by case basis based upon the City Engineer's estimated cost of repair or maintenance should repair or maintenance be required. The subdivider/developer shall submit documentation of the cost of construction to the City Engineer for his review and approval and use in determining the required bond or alternative security amount. The applicant shall deposit an inspection fee in the amount of two and a half percent (2 1/2%) of the estimated cost of construction. The inspection fee shall be based on the actual cost of labor, materials, and equipment plus fifteen percent (15%) for overhead. Dave Thompson, Development Engineer, requested that if approved, the building permit review comments requirements, be stipulated as part of the approval. Thomps~ RE: CASCADE AGRONOMICS-2624 ROAD N NE BUILDING PERMIT REVIEW The following are some general comments in regard to the proposed building that may be passed on to the proponent. The street and service address assigned to the existing business is 710 E. Broadway Avenue. Upon recording of the CBSP and application for a building permit, the remaining parcels within the CBSP will be addressed. 1. Onsite extension of water mains, fire hydrants, fire suppression systems, and water services require engineered plans to be submitted for review by Development Engineering. Three sets of the plans need to be submitted and a review fee ($300.00 min. or $75.00 per sheet) paid. 2. The proposed sewer connection within the right of way of Road N shall be shown on the plans. The location of the sewer connection may need to be moved to avoid exposing the 90 degree fitting on the sewer force main that is nearby. 3. Current meter and system development charges for a 1" meter are $4,034.00. Fees are subject to increases at the end of the year. 4. Proponent should consider hard surfacing the entrance off of Road N to limit migration of gravel from the onsite road onto Road N. 5. Approved plans by the City Engineer and a Street and Utility Construction Permit are required prior to construction of any water, fire suppression, or sewer infrastructure.
