Yonezawa City, Japan/City of Moses Lake, WA
Sister City Week-August 6-14, 2017
Yonezawa City, Japan and the City ofMoses Lake, Washington,
formally entered into a Sister City relationship with the signing of the
appropriate documents in both Yonezawa City and the City of Moses
Lake in May 1981.
Yonezawa City, the City ofMoses Lake, and their respective Sister
City and Friendship Committees have promoted the establishment of a
friendly relationship between the two cities and their residents during
the last thirty-six years.
Yonezawa City and the City ofMoses Lake have established student
exchanges to further the friendly relations between the cities' citizens.
An adult contingent from Y onezawa City has visited the City of
Moses Lake during every year of the Sister City relationship,
advancing the friendship between the cities.
NOW, THEREFORE, I, TODD VOTH, Mayor of the City of Moses Lake, hereby proclaims
the week of August 6 -14, 2017 as Yonezawa City/City of Moses Lake Sister City Week
and invite all citizens of the community to join me in this endeavor.

CALL TO ORDER:
The regular meeting of the Moses Lake City Council was called to order at 7 p. m. by Mayor Voth in the
Council Chambers of the Civic Center, 401 S. Balsam, Moses Lake, Washington.
ROLL CALL:
Executive Secretary Sophia Guerrero called the roll. The following were:
Present: Mayor Todd Voth, Deputy Mayor Karen Liebrecht, and Council members Don Myers,
David Curnel, Ryann Leonard, and Mike Norman and Position No. 1 is vacant.
PLEDGE OF ALLEGIANCE:
Deputy City Manager, Gilbert Alvarado, led the Council in the pledge of allegiance.

CITY MANAGER'S REPORTS
Grant County Economic Development Council Presentation -President, Leanne Parton
Ms. Parton informs the City Council that the GC EDC is currently recruiting for an
Executive Director for their agency. They have 5 candidates and interviews will begin
tomorrow, July 261h. Open house for the finalists will be on August 3rd at the Porterhouse
Restaurant. Ms. Parton gives a brief history of the Grant County EDC to the Council. a
Ms. Parton is asking the City Council to fill the vacant ML Council Representative position
with the EDC, since former Council member Bill Ecret has resigned.
Action Taken: Mayor Todd Voth makes a motion to step down from his position as Airport
Commissioner and nominate Council member Mike Norman as the new Council
Representative to the Airport Commission. Seconded by Councilmember Curnel. Motion
passed 5 to 1 with Councilmember Liebrecht as a nay.
Action taken: Council member Norman made a motion to nominate Mayor Todd Voth as
the new Council Representative to the GC EDC. Seconded by Councilmember Leonard.
Motion passed 4 to 2, Councilmember Liebrecht and Myers as a nay.
New Employee I Promotions -City Employees
Fire Chief, Brett Bastian of the Moses Lake Fire Department introduced 3 new hires to
the department, Garrett Fletcher, Mike Miner, and Scott Anderson.
Municipal Services Director, Fred Snoderly, introduced Richard Law as the new City
Engineer.
City Manager, John Williams introduced Jynnifer Tarver as the new Administrative
Secretary.
Service Awards
A Years of Service pin for 30 years of service with the City was given to Dean Gaddis.
Service pin for 25 years of service was given to Richard Bisnett, Gilbert Alvarado, Bob
Taylor, and Brett Bastian.
CITY COUNCIL MINUTES
Service pin for 15 years of service was given to Paul Guerin and Eric Shurtz. Service pin
for 10 years of service was given to Dustin Tyler, Greg Graffe, and Andrew Deering.
2018 Transportation Benefit District (TBD) Budget
City Manager, John Williams would like permission from the Council to submit a grant
request to the Transportation Improvement Board to complete the 2 miles of the paving
project on Lakeshore Dr. The city would use funds from the 2018 budget and the city's
dedicated portion would be a 20% match ($300,000). The state would cover 80% if we
are awarded the grant. Grant deadline is in August and awarded in November.
Considerable discussion by the Council.
The consensus from Council to City Staff was to move forward with the grant submittal.
Striping I Parking Restriction -Lakeland Dr -Update
City Staff worked with homeowners on Lakeland Dr. to resolve the parking issue.
Striping was shortened, no parking will still be restricted on the eastside of Lakeland Dr,
but parking is now available on the west side of Lakeland Dr. (along GC Fire District No.
5 property). City staff has been in communication with the property owners along
Lakeland Dr and are satisfied with the staff's solution to the parking problem.
Council Appointment Process
City Manager, John Williams presented to Council, 4 applications to the vacant Position
No. 1 council seat. Council is to review those applications and set a process of selection
in an open public session for interviewing the candidates.
The City Manager also mentioned, Grant County Auditor, Michele Jaderlund announced
that there will be a special 3 day filing period on August 1st through August 3rd, 2017. The
filing period will be only for Position No 4 and in person only.
Councilmember Norman expressed his concerns about filling vacant position No. 1 at this
time and would like Council to reconsider their intent to fill the position for the remaining
time of the year.
Considerable discussion by the Council.
Action taken: Councilmember Norman made a motion for Council to reconsider their prior
decision to move forward in filling the vacant Position No. 1 seat. Seconded by
Councilmember Leonard. Motion passed with a vote of 4 to 2, Deputy Mayor Liebrecht
and Councilmember Curnel as a nay.
Action taken: Councilmember Norman made a motion not to fill Position No. 1 at this
time and wait for the voters to make their choice. Seconded by Councilmember Leonard.
Motion passed with a vote of 4 to 2, Deputy Mayor Liebrecht and Councilmember Curnel
as a nay.

CONSENT AGENDA
#1 a. Minutes: The minutes of the July 11, 2017 meeting were presented for approval.
b. Approval of Claims. Prepaid Claims. Checks, and Payroll: Vouchers audited and
certified by the Finance Director as required by RCW 42.24.080, and those
expense reimbursement claims, certified as required by RCW 42.24.090, have
been recorded on a listing which has been made available to the Council for
approval and is retained for public inspection at the Civic Center. As of July 25,
2017 the Council does approve for payment claims in the amount of
$2 ,322,712.33; prepaid claims in the amounts of $30, 180.01 and $95,059.07;
claim checks in the amount of $1 ,446,915.05; and payroll in the amount of
$400,578.50.
c. Request to Accept Work -Cascade Seal Project -2017
Quality Paving , Inc. has completed work on the Crack Seal Project-2017 and it
is ready to be accepted.
d. Request to Accept Work -Seal Coat Project -2016
Central WA Asphalt, Inc., has completed work on the Seal Coat Project -2016
and it is ready to be accepted.
Action Taken: Council Member Curnel requested item No. 1 b.be removed from the Consent Agenda for
discussion. Council Member Curnel asked Finance Director, Robert Taylor about the lnterfund Loan
Payment of $646,785.31 . Mr. Taylor explained that this payment was from Building Maintenance to
Water/Sewer for the construction of the Civic Center. It was a repayment from funds taken from
Water/Sewer to Building Maintenance. Council member Leonard moved that the Consent Agenda be
approved, all items included, seconded by Council Member Norman, and passed unanimously.
PUBLIC HEARING
#2 Ordinance -Amend MLMC 3.18 Gambling Tax-Card Room
An ordinance was presented which amends the Moses Lake Municipal Code Chapter 3.18 Gambling Tax
-Card Room.
The public hearing was opened. There were no comments. Mayor Todd Voth closed the public hearing.
City Council requested staff bring back an amendment to MLMC 3.18.060(c) to adjust the tax rate
collected on card rooms. The tax rate would be reduced beginning January 1, 2018 and continuing to
reduce by 1 % each year until it reaches 5%.
Police Chief, Kevin Fuhr, provided data to the Council the number of calls the Police Department have
received in the year 2015 through 2017 from the Lake Bowl/Card Room/Papa's Casino
RestauranUAmeristay Inn establishments. 167 calls were made to those establishments and 52 of those
calls were reported by the businesses themselves, their own staff. Half of those calls were disturbance
calls and the other half were either assaults or accidents.
Considerable discussion by the Council.
Action taken : Councilmember Norman moved to adopt Ordinance No. 2866 as written, seconded by
Councilmember Myers, and passed with a vote of 4 to 2. Deputy Mayor Liebrecht and Councilmember
Leonard voted nay.

CITY COlJNCIL MINUTES
Mayor Voth and Council allowed Mr. BJ Garbe to make a statement to the Council in regards to the
passage of Ordinance 2866. Mr. Garbe, address 600 N. Bluff Dr., Moses Lake, WA, is the CEO of Lake
Bowl and he would like to thank the Council for this vote. Mr. Garbe said he will do his best to make sure
the community and the city comes out ahead for this ordinance change. He understands the difficulty of
this decision and he wants this known under public record that he is going to make this right by the city.
OLD BUSINESS
#3 Request to Accept Amended Parks & Facility Naming Policy
The current Parks & Facility Naming policy was adopted in 2002. The updated version provided by the Parks &
Recreation Commission would replace the existing policy with a more detailed approach to naming parks and
facilities.
Considerable discussion by the Council.
Action taken: Deputy Mayor Liebrecht moved to accept the amended Parks and Facility Naming Policy,
seconded by Councilmember Curnel, and passed unanimously.
NEW BUSINESS
#4 Ordinance -Request to Amend Ordinance No. 2405 -Parkview PURD
A request from Bryan Henninger, Smith-Martin LLC, to amend Ordinance No. 2405 of the Parkview
Planned Residential Unit Development (PURD). located at 922 S. Division. Wayne Morgan, representing
Smith-Martin, has requested minor changes to the PURD Ordinance which are technical in nature and
consistent with Ordinance No.2405 the Parkview PURD. The Moses Lake Municipal Code 18.67.21 O
provides for these types of amendments.
Under new ownership, the existing PURD did not allow for changes to the design of buildings, fencing, or
roofline. The owner is seeking to change the original proposed plan for lot 1 after the existing building
was demolished last spring. The Planning Commission recommended that the City Council approve the
proposed changes.
Considerable discussion by the City Council. First presentation of this agenda item. No action taken.
#5 Resolution -Request to Build on Unplatted Property -Cascade Land Holdings, LLC
Community Development received a building permit application from Cascade Land Holdings, LLC for
construction of a shop and two-story office building at 2624 Road N NE to house Cascade Agronomics.
The subject property does not currently meet the development standards and is unplatted.
Per Deputy City Manager, Gilbert Alvarado, Development Engineer, Dave Thompson requested that if
approved, the building permit review requirements are met.
As Gilbert Alvarado stated in the past, a building permit cannot be issue on unplatted property in
accordance with MLMC 16.02.040 unless the City Council finds the public interest will not be adversely
affected by the issuance of such permit.
Action taken: Deputy Mayor Liebrecht moved to grant request to Cascade Land Holdings, LLC., to build

on unplatted property with the condition the Development Engineer's building permit requirements are
met. Second ed by Councilmember Norman. Motion passed unan imously.
ADMINISTRATIVE REPORTS
Department of Transportation
John Williams, City Manager met with representatives from the Dept. of Transportation along with City
staff mem bers to discuss many agreements we have in place and identify who is responsible for which
rights-of-way. Frontage Road near Hansen Road was discussed, snow plowing, and basically getting
clarification on who was responsible for which tasks and updating agreements.
WA State Auditors
John Williams, City Manager provided to the Council a copy of the WA State Auditors Exit Conference
findings. The audit is now complete. According to the City Manager, we received a passing
recommendation.
K9 Program
Kevin Fuhr, Police Chief, updated the Council regarding the K9 program. As of today, they have collected
$19,500. Their goal is to reach $25,000 and they are 80% into their goal. Will continue to meet with
business and community leaders to gain that extra $5,000.
Colville Confederation Tribe
Gil Alvarado, Deputy City Manager, updated the Council regarding the Colville Tribe Municipal Services
Agreement. The tribe did reach out to speak to Gil and indicated there were 3 small minor changes to the
agreement. City Attorney, Katherine Kenison will review the agreement for approval when she returns to
her office. There have been some staff changes with the Fuel Station and the new staff members will
meet with Gil to discuss the service agreement and the rock placement on the city's right-of-way at the
fuel station.

Attached is a copy of the proposed Industrial Waste Discharge Permit No. 8 for TK Holdings, Inc.
Staff discussed the permit with representatives from TK Holdings, Inc. and then prepared the waste
discharge permit. Don Kersey, Plant Manager, has signed the proposed permit.
Background
TK Holdings, Inc. is a significant industrial user and is required to have an industrial waste discharge
permit from the City of Moses Lake. Ecology has determined that a state waste discharge permit
in not required for this industry. All discharge permits expire in five years and are required to be
renewed to continue discharging to the City's wastewater system. The only significant revision to
this renewal is an increase of allowable discharge, from 15,000 gpd to 23,000 gpd.
Fiscal and Policy Implications
If the permit is not renewed, TK Holdings, Inc. will need to find an alternate location to discharge
their wastewater, and the city's revenue to wastewater would be reduced.

The City of Moses Lake (City) issues this wastewater discharge pennit to TK Holdings, Inc. (Permittee). This permit authorizes the
Pennittee to discharge Sanitary Wastewater from their Moses Lake facility at 9138 Randolph Road N.E to the City's Larson POTW in
accordance with the conditions of this permit. The pennit becomes effective as of the date signed.
General Conditions
1. All discharges and activities authorized by this permit shall be consistent with the tenns and conditions of this permit. The
discharge of any wastewater with discharge rates or characteristics that exceed this permit shall constitute a violation of the
terms and conditions of this permit. Whenever the Permittee refuses to take corrective action or continues to violate terms
and conditions of this permit, the City may impose civil penalties; terminate this permit, or both. Termination of this permit
may require disposal of the process wastewater in some manner other than into the private sewer or side sewer tributary to
the City's POTW, at the expense of the Permittee.
2. All facility changes that could result in a significant deviation in the pennitted characteristic of pollutants discharged to the
City's POTW shall be reported to the City. Significant adverse deviations in characteristics of pollutants shall be submitted
to the City for review and approval before discharging to the City's POTW. No significant change shall be made until plans
have been approved by the City, and a new or modified permit has been issued. This permit does not authorize new
connections, increased flows, or significant changes.
3. The diversion or bypass of any discharge from any pre-treatment facility, utilized by the Permittee to maintain compliance
with the terms of this permit, is prohibited, except where unavoidable to prevent loss of life, severe property damage, or as
provided in the SPECIAL CONDITIONS of this permit. The procedures outlined in Paragraph 4 of the GENERAL
CONDITIONS shall be followed in the event of such a diversion or bypass to the City's POTW.
4. In any event that causes a violation of the discharge rates or characteristics authorized by this permit, the Permittee shall take
the following actions:
a. Immediately stop, contain, and clean up the unauthorized discharge and correct the problem.
b. Immediately notify the City so steps can be taken to prevent damage to the City's POTW.
c. Submit a written report within fifteen ( 15) business days of the event, describing the breakdown, the actual quantity
and quality of the resulting discharge, the corrective action taken, and the steps taken to prevent a recurrence.
d. Pay reasonable costs incurred by the City that are associated with a breakdown, accident, or other cause that is
attributable to such event.
e. Pay a penalty for each occurrence of non-conformance with the conditions of this permit, as may be assessed in
accordance with the Moses Lake Municipal Code.

5. Compliance with the above requirements does not relieve the Pennittee from responsibility to maintain continuous
compliance with the conditions of this pennit or the resulting liability for failure to comply.
6. The Pennittee shall adequately maintain and efficiently operate all treatment and control facilities or systems installed or used
by the Permittee to achieve compliance with the terms and conditions of this pennit.
7. If any of the following findings have been discovered or reported to the City, the City will provide a written notice to the
Pennittee. The written notice by the City will describe the findings and any actions that will be taken by the City or required
of the Pennittee. In addition to actions previously described in Hem 4, the permit may be amended, suspended, or revoked in
whole or in part. Within ten (I 0) business days of receiving the written notice, the Pennittee may request a hearing before
the City Council, to dispute the findings or to request a revision to actions described. The City Council's detennination will
be final.
a. Violation of any tenns or conditions of this permit.
b. Obtaining this permit by misrepresentation or failure to fully disclose all relevant facts.
c. A change in permitted conditions that require a pennanent reduction or elimination of wastewater discharge to the
City's POTW.
8. The Permittee shall allow authorized representatives of the City to perform the following actions:
a. Enter portions of the premises where effluent sources, disposal systems, or records are kept. If either the City or the
Permittee requests an escort for the premises, the Permittee shall provide the escort.
b. Inspect monitoring equipment and monitoring methods required by this permit.
c. Sample any effluent or pollutants that discharge to the City's POTW.
d. Review test results and test methods.
9. The Permittee shall comply with all current federal, state, and local statutes, ordinances, and regulations. The requirements
of this permit maybe revised by the City by providing written notice to the Pennittee.
10. Within ten (I 0) business days ofreceiving the written notice ofrevisions by the City, the Perrnittee may request a hearing
before the City Council, to dispute the revisions. Depending on the magnitude of the changes, the Permittee and the City
may negotiate a compliance schedule that will allow the Pennittee to implement the required revisions over a specified
period.
11. This permit does not authorize discharge into public waters of Washington State. Any discharge to public waters of
Washington State is subject to applicable regulations administered by Ecology.
12. Costs incurred by the City in handling, treating, monitoring, and disposing of the Pennittee's process wastewater shall be
borne by the Perrnittee in the rate structure set forth by the City. The City may set forth the various fees in accordance with
the Moses Lake Municipal Code.
13. The Perrnittee shall submit an application for permit renewal at least 180 days prior to the expiration date of the permit. In
the event that the City does not respond within the allotted 180-day period, the existing pennit shall remain in force until the
revised permit is issued.
14. The Pennittee shall pay fees associated with this permit as established by the Moses Lake Municipal Code. The City may
revoke this permit if the permit fees are not paid.

Special Conditions
The biological and physical operations at the City's wastewater treatment plant shall not be impaired by the Pennittee's wastewater
discharge. The City's wastewater treatment plant is an extended aeration activated sludge system. Processes at the plant include
influent pH & conductivity monitoring, grit removal, aeration, clarification, solids removal, flow measurement, ultraviolet (UV)
disinfection, and infiltration. If the City determines that any biological or physical processes in the wastewater treatment plant are
negatively impacted by the Permittee's process wastewater discharge, the Permittee shall immediately take actions on the Permittee 's
operations to ensure proper operation of the wastewater treatment plant.
Effluent Limits
During the period of this permit, the Permittee is authorized to discharge Sanitary Wastewater to the City's POTW, subject to the
specified flow, concentration, and monitoring requirements. Sanitary wastewater shall be monitored and discharged to the POTW and
shall not exceed a maximum daily flow of23,000 gallons and the maximum spontaneous discharge of effluent shall not exceed 250
gallons per minute. If the spontaneous discharge of the effluent exceeds 250 gallons per minute, the Permittee shall operate and
maintain a flow control system on the discharge. Effluent limits for the discharge to the City's POTW are shown in Table I: Effluent
Limits, Outfall No. 001. Outfall No. 001 is the Lift Station Wet Well prior to discharge to the City's POTW.
Limits of effluent characteristics that are not specifically listed in this permit shall be as set forth in City of Moses Lake Municipal
Code, Chapter 13.05, Sewer Regulations, as of the date of this permit.
In order to meet the effluent limits, the Permittee shall provide facilities as specified herein. When required, pretreatment and storage
facilities shall be designed and operated by the Permittee in a manner such that the wastewater is incompliance with the flow and
concentration limits established herein. During emergency conditions, or when the effluent cannot meet the conditions of this permit,
the Permittee shall divert the flow, collect the wastewater, and re-treat the effluent. If the effluent limits cannot be achieved by the
onsite treatment system, the Permittee shall collect the effluent and send it off site for disposal in accordance with applicable
regulations.
Beginning on the date of issuance and lasting thru the expiration date of this permit, the Permittee is authorized to discharge Sanitary
Wastewater to the City's POTW sewer system subject to the following limits:

a Continuous means the uninterrupted except for brief length of time for calibration, power failure, or unanticipated equipment repair or
maintenance. The time interval for the associated data logger must be no greater than 30 minutes. Sample shall be taken one time a day
when continuous monitoring is not oossible.

c 24-hour composite means a series of individual samples collected over a 24-hour period into a single container, and analyzed as one
sample.
Sampling and Analvtical Procedures
Samples and measurements taken to meet the requirements of this permit shall be representative of the volume and nature of the monitoring
parameters, including representative samples of unusual discharges or discharge conditions such as bypasses, upsets, and maintenance-related
conditions affecting effluent quality.
Sampling and analytical methods used to meet the water and wastewater-monitoring requirements specified in this permit shall conform to the latest
revision of the following rules and documents unless otherwise specified in this permit.
a. Guidelines Establishing Test Procedures for the Analysis of Pollutants Contained in 40 CFR part 136
b. Standard Methods for the Examination of Water and Wastewater (APHA)
Flow Measurement. Field Measurement, and Continuous Monitoring Devices
The Permittee Shall:
I. Select and use appropriate flow measurement, field measurement, and continuous monitoring devices and methods
that are consistent with accepted scientific practices.
2. Install, calibrate, and maintain these devices to ensure the accuracy of the measurements is consistent with the accepted
industry standard, the manufacturer's recommendation, and approved O&M manual procedures for the device and the waste stream.
3. Check continuous monitoring instruments weekly, and calibrate quarterly unless a longer period is acceptable to the City, based on
monitoring records.
a. Must calibrate continuous pH measurement instrument in the field using standard buffers or using an effluent grab sample that
must be analyzed on a calibrated lab instrument within 15 minutes of sampling.
4. Use field measurement devices as directed by the manufacturer. Reagents shall not be used beyond their expiration dates.
5. Establish a calibration frequency for each device or instrument in the O&M manual that conforms to the frequency recommended by the
manufacturer.
6. Calibrate flow-monitoring devices at least once per year, or as otherwise specified by the manufacturer.
7. Maintain calibration records for at least three years.
Reporting and Record Requirements
The Permittee shall monitor and report in accordance with the conditions set forth in this permit. Falsification of the information submitted to the
City is a violation of the terms and conditions of this permit.
Monitoring results required by this permit shall be submitted by paper form by the 15•h day of the month following the sampling period to the
addresses listed below.

Records Retention
Records of all monitoring information shall be retained by the Permittee for at least three (3) years, and longer as required by litigation or as
requested by the City. Such information shall include all calibration and maintenance records, all original recordings for continuous monitoring
instrumentation, and copies of all reports required by this permit.
Laboratory accreditation
The Pennittee shall ensure that all monitoring data is prepared by a laboratory registered or accredited under the provisions of Chapter 173-50 WAC,
uAccreditation of Environmental Laboratories". However, flow, temperature, settleable solids, conductivity, pH, and internal process control
parameters are exempt from the accreditation requirements of Chapter 173-50; the Permittee shall obtain accreditation for conductivity and pH if
accreditation or registration is required for other parameters.
Request for Reduction in Monitoring
The Permittee may request a reduction of the sampling frequency after twelve (12) months of monitoring. The City will review each request, and if
approved, the reduction will be either included when the permit is reissued, or by a permit modification.
To request a reduction in the sampling frequency, the Pennittee shall provide the following to the City:
I . Provide a written request.
2. Clearly, state the parameters for which reduced monitoring requested.
3. Clearly, state the justification for the requested reduction.
Waste Preventative Practices
The following methods shaJI be used by the Permittee to reduce or eliminate contaminant loading to the City's POTW:
I. Chemicals shall be stored in a manner that will prevent entry of these solutions into the City's POTW or waters
of the state. All chemicals shall be stored using best management practices.
2. Pretreatment and storage systems shall be maintained continuously by the Pennittee, in satisfactory and effective operational
condition, and shall be accessible to the City at all times.
3. The Permittee's designate representative is the EHS Manager, whose responsibilities shall include the operation and maintenance of
pretreatment and storage facilities, monitoring requirements, permit compliance, and all other aspects of the process wastewater
discharge. The City may contact the designated representative, at any time, to discuss matters related to the process wastewater
discharge to the City's POTW.
4. The Permittee is liable for all damages directly attributable to its wastewater discharge, exclusive of normal wear and tear. Permittee
shall not be jointly and severally liable for the damage caused by any other party, but shall only be liable for its pro-rata share of
damages that are directly attributable to the Permittee's wastewater discharge. Attributable damages include those that may be caused
by the wastewater collection system, pump stations, wastewater treatment plant, receiving water degradation, or any combination of
these items.
5. In the event that a hazardous petroleum or radioactive materiaJ spill reaches the City's POTW. the Pennittee shall notify the City
immediately.
Reporting Permit Violations
The Pennittee shall take the following actions when non-emergency permit violations are discovered:
I. Immediately stop, contain, and cleanup unauthorized discharges; or otherwise stop the non-compliance and
correct the problem.
2. Contact the City within 24-hours by phone or E-mail.

~ The City of Moses Lake, a municipal corporation of the State of Washington, or its duly authorized agents or representatives.
Composite Sample: A mixture of grab samples collected at the same sampling point at different times, formed either by continuous sampling or by
mixing discrete samples. May be time-composite (collected at constant time intervals) or flow-proportional (collected either as a constant volume at
time intervals proportional to stream flow or collected by increasing the volume of each aliquot as the tlow increased while maintaining a constant
time interval between the aliquots.
Constituent: Any of the pollutants or potential pollutants found in the process wastewater.
Effiuem Limits· Flow, concentration, pH and mass loading limits for wastewater discharged to the City's POTW by the Pennittee.
Environmental Protection Agency: Federal environmental regulatory agency.
Egualjzatjon Basin: The Permittee's final containment structure for process wastewater to be discharged to the City's POTW.

Single Reading -Motion
The attached ordinance modifies the existing no parking ordinance listed in Municipal Code
10.12.035 to allow parking on the west side of Lakeland Drive between Nelson Road and Oasis
Circle.
Background
Council directed staff to look at the existing no parking ordinance to see if there was a way to allow
some parking on that portion of roadway at the request of the adjacent homeowners.

Attached is a document, to abandon a portion of a water easement within Boeing Company
property. The existing water main has been realigned and the existing easement is no longer
needed.
Background
The Boeing Company requested to realign the existing water main that runs through their property
to a location near their south and east property lines. The project was designed and constructed
by Boeing. The work is near completion and the existing water line will be abandon. There is no
other need for the City to retain this portion of the existing water easement.

1. The City of Moses Lake has received a request from The Boeing Company to abandon the
following described easement:
That portion of an existing water easement located in a portion of Section 27 and 28, T20N,
R28E, W.M., granted per Quit Claim Deed, recorded in Volume 26 of Deeds on Pages 153
through 167, under AFN 525220, Records of Grant County, Washington, found within Grant
County Parcel Numbers 171010000, 171011000, 171018000, and 171019000, shown on the
sketch attached hereto and labeled "Exhibit A" and located within the boundaries of Parcel 4
and Parcel 5 as shown on the "Survey for General Services Admin. at Larson Air Force Base,
Moses Lake, Wash." completed by John D. Swift dated June 2, 1971, records of Washington
State Department of Natural Resources. Said easement extends north from the south
boundary of Grant County Parcel Number 171019000 and runs north to City of Moses Lake
Well 29 and extends from a point of the aforementioned easement and extends east to the

THE BOEING COMPANY-8998 TYNDALL ROAD NE-MUNICIPAL EASEMENT,
UTILITY ACCESS EASEMENT, AND ABANDONMENT OF WATER EASEMENT
The executed Municipal Easement (four pages), granted to the City of Moses Lake by Boeing for
the realignment of an existing water main, is attached. The Municipal Easement for municipal
purposes can be presented to Council for acceptance.
The executed Grant of Utility Access Easement (three pages) providing the City of Moses Lake
access to all City owned water meter(s) and their electronic reading devices and access to all
City owned sanitary sewer meter(s) and their electronic reading devices on the Boeing site is
attached. The Grant of Utility Access Easement can be presented to Council for acceptance.
The Abandonment of Water Easement (two pages), to abandon a portion of the water
easement serving the location of the existing water main that was relocated is attached. The
Abandonment of Water Easement can be presented to Council for acceptance.
Filing fees for the three documents total $228.00 and has not been received yet. Once the
easements are accepted by City Council, the recording of the documents should be withheld
until payment is made by Boeing. Boeing has been notified that a check in the amount of
$228.00 made out to the Grant County Auditor to pay the filing fees must be submitted before
the easements will be recorded.
For reference the existing easement for that portion of the water main that was abandon per
request of Boeing is being abandoned by the City.
The new water main improvements that were relocated and constructed in the Municipal
Easement can be accepted after final connections are made and a punch list is completed. The
sketch attached to the Municipal Easement show the location of the water main realignment.

are owned and maintained by the City, the City, therefore, the City requires an access easement before
the new water main can be accepted.

The executed Municipal Easement (four pages), granted to the City of Moses Lake by Boeing for
the realignment of an existing water main, is attached. The Municipal Easement for municipal
purposes can be presented to Council for acceptance.
The executed Grant of Utility Access Easement (three pages) providing the City of Moses Lake
access to all City owned water meter(s) and their electronic reading devices and access to all
City owned sanitary sewer meter(s) and their electronic reading devices on the Boeing site is
attached. The Grant of Utility Access Easement can be presented to Council for acceptance.
The Abandonment of Water Easement (two pages), to abandon a portion of the water
easement serving the location of the existing water main that was relocated is attached. The
Abandonment of Water Easement can be presented to Council for acceptance.
Filing fees for the three documents total $228.00 and has not been received yet. Once the
easements are accepted by City Council, the recording of the documents should be withheld
until payment is made by Boeing. Boeing has been notified that a check in the amount of

the easements will be recorded.
For reference the existing easement for that portion of the water main that was abandon per
request of Boeing is being abandoned by the City.

Easement can be accepted after final connections are made and a punch list is completed. The
sketch attached to the Municipal Easement show the location of the water main realignment.

Motion
Attached is a request from Bryan Henninger, Smith-Martin LLC to amend Ordinance 2405, of the
Parkview Planned Residential Unit Development (PURD), located at 922 S. Division. Wayne
Morgan, representing Smith-Martin, has requested minor changes to the PURD Ordinance which
are technical in nature and consistent with Ordinance 2405 the Parkview PURD. Moses Lake
Municipal Code 18.67.210 provides for these types of amendments.
The Planning Commission considered the proposed amendments in accordance with MLMC
18.67.210 at their regular scheduled meeting on July 13, 2017 and recommended to the City
Council that the proposed changed be approved.
Background
The City Council approved the final PURD on July 8, 2008, and the final plat was recorded on May
16, 2017. Under new ownership, the existing PURD did not allow for changes to the design of
buildings, fencing, or roofline.

Further, the owner is seeking to change the original proposed plan for lot 1 after the existing
building was demolished last spring. (See attached change request section 2.A.)
Fiscal and Policy Implications Options The project owner has identified cost savings with the
proposed changes and states that developing under the exiting Parkview PURD would result in
higher development and material costs.

Section 2. The following described property shall be permitted to develop as Planned
Development District No. 12, and shall be named Parkview Planned Unit

A. Attached single family residences (townhouses), with one dwelling unit per lot, on

C. Private street and utilities, parking areas, common open space, and wetlands and

Section 4. The Parkview PUD is an overlay zone. The requirements of the underlying R-3 Zone
are modified as follows:
A. Overall development standards
1. The development shall be constructed with an architectural theme, essentially as
presented to the Planning Commission and Council, including the appearance of
the buildings.
2. A homeowners' association shall be required before the planned unit
development major plat is recorded with Grant County. The Codes, Covenants,
and Restrictions for the development shall be submitted to the City for review and
shall be recorded concurrently with the plat. The homeowners' association shall
be responsible for the maintenance of the site, including but not limited to
landscaping, fencing , off-street parking areas, and sidewalks.
B. Streets, sidewalks, and utilities
1. Internal street, sidewalks, and utilities shall be private.
2. The constructed width of the street shall not be less than 20' from face of curb
to face of curb.
3. Streets and utilities shall be constructed or bonded for before submittal of the
final planned development application.
4. Street lighting shall be smaller scale lighting consistent with the craftsman style
of the residential structures and shall be designed to prevent overspill of lighting
into the wetland area and lake.
C. Bulk standards:
1. The minimum lot size shall be 800 square feet. The minimum lot width shall be
21 '. The minimum lot depth for residential lots shall be 39'. Minimum dimensions
for garage lots shall be 25'.
2. Minimum setback of any new building from the exterior boundaries of the
development shall be the same as the underlying R-3 Zone.
3. Minimum setback from the property line abutting the internal street shall be 5' for
all buildings.
4. Where the residential units are attached, there shall be no side yard setback,
otherwise the residential units shall have a minimum 5' side yard setback.
5. Garage units shall be required to meet only the setback from the internal street
and driveway and from the project boundary.
6. Building overhangs such as eaves, cornices, and awnings may project into
setbacks not more than 2'; however, no encroachment into easements is allowed,
either above or below ground.
7. Minimum roof pitch of the main roof of residential structures shall be 8: 12 (vertical
: horizontal).
D. Building design standards:
1. Buildings shall be craftsman style with articulated architectural features as
detailed on Sheet 3 of 4 of the preliminary plat submittal.
2. All external doors and windows shall have trim with a minimum width of 3 Yi ".
3. Eaves of at least 18" shall be provided on at least two sides of all buildings.
4. Exterior siding materials for all buildings shall be wood, engineered wood , fiber
cement, fiber cement lap siding, stone, or masonry. Vinyl and plywood shall not
be allowed.
5. Roofing for all buildings shall be architectural composition shingles. Three-tab
shingles shall not be allowed.
6. Metal fencing shall be designed and constructed in the same manner as a typical
residential fence, however, metal is allowed to substitute from the traditional
wood or chain link fencing .
E. Landscaping and site development:
1. No less landscaping shall be provided than what is shown on the landscape plan
received May 5, 2008.
2. The developer shall restore the planter strip along Division Street and install and
maintain a Type Ill street frontage buffer within the planter.
3. All required landscaping shall be installed or bonded for before issuance of a
Certificate of Occupancy for any new residence.
4. The trash receptacle(s) shall be screened by a decorative block enclosure or
equivalent.
F. Parking:
1. Parking for each townhouse unit shall be a minimum of one outside space and
one garage space.
2. Parking forthe existing professional office/apartment building shall be a minimum
of 16 spaces.
3. No storage of recreational vehicles, watercraft, or similar items shall be allowed
unless wholly within a garage.
Section 5. Smith Martin Parkview, LLC or their successor in interest shall be bound to the uses and
modifications specified in this ordinance.
Section 6. This ordinance shall take effect and be in force five (5) days after its passage and
publication as provided by law.

Smith Martin Parkview LLC managing member Bryan Henninger proposes to make the following
amendments to Ordinance 2405 of the Parkview PUD project.
Section 2.A.
This building has been torn down since the original ordinance was drafted. Requesting to change
Lot 1 from a mix of offices and apartments to attached single family residences. (townhomes)
They would have one dwelling per lot for a total of 6. These would be larger units with attached
garages consistent with the style and materials used for the adjoining 21 units of the PUD.

The original design by previous owners was just conceptual and not necessarily done for site
conditions. We believe that the stepped roofs are awkward for such narrow buildings and detract
from our coastal craftsman style. We have added additional gables and accents to break up the
roof line on the front and the back.

The majority of the roof will be architectural composition shingles as specified. We would like to
change the portion that says no steel allowed to metal accents on garage roofs, front porch roofs,
and fencing. We believe this will enhance the style and beauty of the project.

B. In the event that a time extension is granted, a new performance bond or other approved
security shall be submitted in an amount sufficient to cover one hundred and fifty percent
(150%) of the cost of completing utility and street improvements or landscaping improvements.
The bond will be updated with new estimates of cost on all uncompleted improvements and
all increased costs shall be passed onto the bond.
C. Departments issuing recommendations for new performance bonds or approved security shall
not modify the terms and requirements of the bond or security other than to pass on all
increased cost estimates as determined by the Municipal Services Director to the bond or
security to cover the cost of completing utility and street improvements and/or landscaping

18.67 .190 Maintenance Bond: Upon completion of the required public improvements and prior to acceptance
by the City Council, the subdivider/ developer must submit a maintenance bond or alternative
security approved by the City Attorney in an amount determined by the City Engineer and approved
by the Municipal Services Director. The maintenance bond amount shall be one hundred percent
(100%) of the actual cost of construction. An alternative security shall be in an amount not less
than ten percent (10%) nor more than one hundred percent (100%) of the actual cost of
construction. The amount shall be determined on a case by case basis based upon the City
Engineer's estimated cost of repair or maintenance should repair or maintenance be required. The
subdivider/developer shall submit documentation of the cost of construction to the City Engineer
for his review and approval and use in determining the required bond or alternative security

18.67 .200 Inspection of Improvements: The Engineering Division of the Municipal Services Department or
a licensed professional engineer or engineering firm hired by the city shall be responsible for the
inspection of all public or dedicated planned development district street and utility improvements
to insure conformance with the approved plans and specifications. The applicant shall deposit an
inspection fee in the amount of two and a half percent (2 1/2%) of the estimated cost of
construction. The inspection fee shall be based on the actual cost of labor, materials, and
equipment plus fifteen percent (15%) for overhead. If the cost is less than the amount deposited,

18.67.210 Changes and Modifications:
A. Major changes in the approved final planned development district shall be considered as a new
application for preliminary planned development district approval. Major changes include, but
are not limited to, the following:

3. Increase in density or relocation of density pattern.
4. Change in exterior boundaries except survey adjustments.
5. Increase in building height.
B. The Community Development Director may approve changes in the final planned development
district which are minor and of a technical nature and which are consistent with the approved

Council has an opportunity to approve 2017 increases to the Sanitation rates for both commercial
and residential accounts. This increase will keep pace with the increase in contractor charges and
keep the fund solvent as required by RCW 35.92.010.
Background
Annually the fee charged by our contractors increases every September 1. For the contractor that
rate for this year will be around 2%, which is based on the contracted July CPI. In 2015 the fund
could not keep up with the landfill costs and operating expenses to the point that a $500,000
interfund loan was needed to cover the shortfall. In 2016 another loan was approved for $300,000.
A large balloon payment is due in 2018 on the 2015 loans. The proposed rate increase is needed
to pay back the loans and to cover the increase in operating costs. The rate increase would raise
the majority of residential bills (68%) by less than $1. per month but would raise enough revenue
to pay the annual interfund loan payments of $217,000, cover small unanticipated increases (i.e.
yard waste hauled to the landfill instead of the composting site), purchase of additional carts and

to build up the Fund Balance. It is a requirement of RCW 35.92.010 that a city utility cannot charge
a rate "that is less than the cost of the utility and service to the class of customers served".
Fiscal and Policy Implications
Passing the ordinance will increase rates of the Sanitation fund to keep pace with the contractor's
fee increase, maintain the current level of service and maintain a fund balance as recommended
by Council.
