Balsam, Moses Lake, Washington. ROLL CALL: Executive Secretary Sophia Guerrero called the roll. The following were: Present: Mayor (Acting) Karen Liebrecht, and Council members Don Myers, Ryann Leonard, Mike Norman and David Curnel. PLEDGE OF ALLEGIANCE: Council member Norman, led the Council in the pledge of allegiance. SUMMARY REPORTS: MAYOR'S REPORTS -None ADDITIONAL BUSINESS Grant County Sheriff's Department -Emergency Management Task Force Committee City Manager, John Williams informed Council since the Sheriff's Department took over the responsibility of Emergency Management for Grant County, they have decided to create a Board of representatives from the county to serve and develop by-laws for this committee. Council member Ryann Leonard was asked to serve and she has expressed her desire to do so. Action taken: Mayor Liebrecht moved to appoint Council member Leonard to the Grant County Sheriff's Department Emergency Management Task Force Committee as a representative of the Moses Lake City Council, seconded by Council member Norman, and passed unanimously. CITY MANAGER'S REPORTS New Employee Introduction -Moses Lake Police Department Police Chief Kevin Fuhr introduced Moses Lake Police Department new police officer, Chuck Paul to the Council. Moses Lake High School Civics Class -Presentation to Council Moses Lake High School Civics Class under the direction of Ms. Gaynor Edwards, presented to Council parking and pedestrian crosswalk issues at Moses Lake High School located on Sharon Avenue. Brandon Hansen, Drayke Mooney, Emilee Barker, Elijah Fenton, and Trevor Fuller each gave a short explanation of the problem and possible solutions to resolve the parking and pedestrian crosswalk issues at the high school. Council congratulated the civics' class on their presentation and requested City Staff to contact and meet with the class to help resolve the issue. Holiday Schedule -Council Meetings for 2017 & 2018 City Manager, John Williams asked Council if they would like to move December 26th council meeting to December 21, 2017 due to the holiday. Action taken: Council member Leonard moved to have December 26th council meeting rescheduled to Thursday, December 21st at 5:30 pm, seconded by Council member CITY COU CJL MINU f'l::S -Nov. 14, 20 17 Norman, and passed unanimously. Mr. Williams also mentioned in 2018, Christmas falls on the fourth Tuesday of the month, another Council meeting date. City staff published a 2018 calendar for Council's review and it was suggested that the last council meeting of the month should be rescheduled to Thursday, December 20, 2018. Action taken: Council member Leonard motion to have the last council meeting of 2018 on Thursday, December 20, 2018 as published, seconded by Council member Curnel, and passed unanimously. CITIZEN'S COMMUNICATIONS Public Input: Charlene Winzler-Winzler Licensing, 1312 W. Broadway, Moses Lake Ms. Charlene Winzler addressed the council with a concern of improper mapping of the City limits when one is paying for their vehicle license tab. Some county residents are being charged $20.00 vehicle license fee for the Moses Lake Transportation Benefit District (TBD) when this should only be applied to residents living within city limits. The Department of Licensing has their own mapping system of Moses Lake, one not collected by the City of Moses Lake. After considerable discussion, City Manager, John Williams informed Council that the Finance Director has been in contact with the Dept. of Licensing and the Dept. of Revenue in correcting the mapping situation and offering a reimbursement to those who were improperly charged. After a county resident has paid their tab fee and if they were charged incorrectly for the TBD, they can go to the Utilities Department in the Civic Center with their receipt and complete a reimbursement request form. The City in turn will notify the state of the improper coding. With the passing of the TBD Proposition, effective April 2018, the $20.00 vehicle license fee will cease. Public Input: Elisia Dalluge -Moses Lake, WA Ms. Dalluge thanked Council and the public for their support and contributions to the Road Brothers fundraiser held last November 111h. CONSENT AGENDA #1 a. Minutes: The minutes of the October 24, 2017 meeting were presented for approval. b. Approval of Claims. Prepaid Claims. Checks, and Payroll: Vouchers audited and certified by the Finance Director as required by RCW 42.24.080, and those expense reimbursement claims, certified as required by RCW 42.24.090, have been recorded on a listing which has been made available to the Council for approval and is retained for public inspection at the Civic Center. As of October 24, 2017 the Council does approve for payment claims in the amount of $1 , 175,327.64; prepaid claim checks in the amount of $68, 145.50, $335.19, $32,223.72, and $29.74; claim checks in the amountof$1,032,205.45; and payroll in the amount of $2,837.25 and $328,378.32. pg.2 CITY COU CIL MINUTES -1 ov. 14, 2017 -----· -------- c. Resolution -City Employee Authorized to Sign Checks A resolution was presented updating the list of employees who are authorized to sign checks on behalf of the City of Moses Lake. d. Resolution -Accept Street and Utility Improvements -Sonico MP A resolution was presented which accepts street and utility improvements constructed for the Sonico Major Plat with the condition that the subdivision maintenance bond is in place. e. Resolution -Accept Street and Utility Improvements -Leah MP A resolution was presented which accepts street and utility improvements constructed for the Leah Major Plat with the condition that the subdivision maintenance bond is in place. f. Resolution -Accept Street and Utility Improvements -Barrington Point 3A MP A resolution was presented which accepts street and utility improvements constructed for the Barrington Point 3 A Major Plat with the condition that the subdivision maintenance bond is in place_ Council member Curnel questioned the payment for long distance fees, utility bills, Consolidated Disposal, GC Solid Waste, and for the Redflex Cameras. City staff explained the long distance fees are from analog phones and fax machines still being used in city departments. City Manager John Williams will do some research to find out what lines have long distance calls. As for Consolidated Disposal, that fee is for the transfer station and transport to the land fill. The fee paid to GC Solid Waste is for the tipping fee at the land fill. Chief Fuhr explained with 5 Redflex Cameras in the city, viewing and processing violations and collecting payments, Redflex charges the city for those services. Action Taken: Council member Curnel moved to accept the consent agenda as presented, seconded by Council member Leonard, and passed unanimously. PUBLIC HEARING #2 Ordinance -2018 Budget and Fee Schedule An ordinance adopting the 2018 budget and proposed fee schedule was presented. There was considerable discussion regarding the budget and fee schedule. Mayor Liebrecht opened the public hearing to take testimony from the public in regards to this matter. No public input, hearing closed. 1st Presentation of the 2018 Budget and Fee Schedule. No action taken. #3 Resolution -2018 Property Tax Levy A resolution was presented to fix the estimated amount to be received by the City from property taxes and sets the tax levy rate. pg.3 CITY COUNCIL MINUTES -Nov. 14, 2017 The resolution fixing and levying the amount of ad valorem taxes to discharge the expected expenses and obligations for the 2018 Budget for the City of Moses Lake, Washington was read by title only. Mayor Liebrecht opened the public hearing to take testimony from the public in regards to this matter. No comment from the public, hearing closed. Action taken: Council member Curnel moved to adopt Resolution No. 3710 as presented, seconded by Council member Leonard, and passed unanimously. OLD BUSINESS #4 Ordinance -Vacate Right-of-Way -Fig & Commercial Street -Mann & Eilers An ordinance was presented which vacates (1 O') ten feet of right-of-way (ROW) on Fig Street and (1 O') ten feet on the northeasterly portion of Commercial Street, Lot 2 Penhallurick Addition, adjacent to parcel # 110780000, 630 E. Broadway Ave. Public utilities and municipal departments were notified and have provided comment as part of the record. An ordinance vacating a portion of right-of-way was read in its entirety. Action taken: Council member Norman moved to adopt Ordinance No. 2876 as presented, seconded by Council member Leonard , and passed unanimously. #5 Ordinances-Amend MLMC Title 5 Business License The City's Finance Department amended several chapters to the Moses Lake Municipal Code Title 5 Business License to provide clarification and simplification of the business license application process and related fees. Four (4) ordinances were presented to council to amend. An ordinance amending section 5.04 .100 of the Moses Lake Municipal Code titled "Payment of Fee - Time Limit" was read in its entirety. Action taken: Council member Leonard moved to adopt Ordinance No. 2877 as presented, seconded by Council member Norman, and passed unanimously. An ordinance amending section 5.07.020 of the Moses Lake Municipal Code titled "Definitions" and section 5.07.060 of the Moses Lake Municipal Code titled "Fees" was read in its entirety. Action taken: Council member Leonard moved to adopt Ordinance No. 2878 as presented, seconded by Council member Curnel, and passed unanimously. An ordinance amending section 5.22.020 of the Moses Lake Municipal Code titled "Application and Fee" was read in its entirety. Action taken: Mayor Liebrecht moved to adopt Ordinance No. 2879 as presented, seconded by Council member Leonard, and passed unanimously. An ordinance amending section 5.40.120 of the Moses Lake Municipal Code titled "Identification Costs of Screening" was read in its entirety. Action taken: Council member Curnel moved to adopt Ordinance No. 2880 as presented , seconded by Council member Leonard, and passed unanimously. pg.4 CITY COUNCIL MINU fES -Nov. 14, 2017 NEW BUSINESS #6 Request Deferral/Deviation -McKean Preliminary Short Plat Columbia NW Engineering on behalf of property owners, Jeromy and Rosario McKean, is requesting from council a deferral for street, utilities, and landscaping requirements on their property located at 1048 W . Virginia Street. The proposed preliminary plat is located at the end of the unimproved Luta and Virginia Streets. At this time, it would not be advantageous to improve just a portion of those roadway frontages, but to defer those improvements through a covenant for future participation, when the City deems feasible to construct the improvements. Public Input: Wayne Ostler, Columbia NW Engineering, 249 Elder St., Moses Lake, WA-Mr. Ostler on behalf of the owners, requested from council approval to grant the request so they can move forward with the final plat review and recordation. Considerable discussion among staff and Council. Action taken: Council member Curnel moved to approve the deferral with a covenant for future participation when the subject improvements are constructed, as recommended by the Planning Commission, seconded by Council member Norman, and passed unanimously. #7 Request to Connect to City Water/Sewer Service -3357 Westshore Dr NE Fred Snoderly, Municipal Services Director, stated that property owner, Carlston Burton has requested permission to connect his lot located at 3357 Westshore Dr NE to the City's sewer and water system without annexing the property to the City. The property is located outside of the City limits, but inside the UGA and more than one-half mile from city limits. If approved, an Extra Territorial Utility Agreement would be required. Action taken: Council member Leonard moved that the request to connect to City utilities be granted with the stipulation that an Extra Territorial Utility Agreement be required, seconded by Council member Norman, and passed unanimously. #8 Resolution -Nuisance Abatement Costs -1111 N. Evelyn Dr A resolution was presented which affirms the Council's prior authorization to staff to collect the funds expended for the nuisance abatement at 1111 N. Evelyn Dr. The resolution establishing the billing to be imposed against Diversified Holdings, LLC as the owner of certain real property upon which the City caused abatement of a nuisance to be performed after a failure of the property owner to abate the same was read by title only. Action Taken: Council member Norman moved that Resolution No. 3711 be adopted, seconded by Council member Curnel, and passed unanimously. #9 Resolution -Nuisance Abatement Costs -814 S. Fairbanks Dr A resolution was presented which affirms the Council's prior authorization to staff to collect the funds expended for the nuisance abatement at 814 S. Action Taken: Council member Curnel moved that Resolution No. 3712 be adopted, seconded by Council member Leonard, and passed unanimously. #10 Resolution -Nuisance Abatement Costs -9972 Sunny Dr NE A resolution was presented which affirms the Council's prior authorization to staff to collect the funds expended for the nuisance abatement at 9972 NE Sunny Dr. The resolution establishing the billing to be imposed against Roland and Anastacia Huff as the owners of certain real property upon which the City caused abatement of a nuisance to be performed after a failure of the property owner to abate the same was read by title only. Action Taken: Council member Leonard moved that Resolution No. 3713 be adopted, seconded by Council member Curnel, and passed unanimously. ADMINISTRATIVE REPORTS November 7th Election and Certification City Manager, John Williams reiterated the election results with the Council. Certifications of the election results will be done on November 28th by the Grant County Elections Department. Once the certifications have been completed, oaths can be taken and signed by the newly elected council members, in which those will be returned to the GC Elections department for recording. On December 12th the two newly elected officials for Position No. 1 & 4 can be sworn in and assume their seats for the last two meetings in December. In January 2018, Council will choose their Mayor and Deputy Mayor. This was a brief legislative agenda for Council as we are now coming to an end for 2017 and what will occur in the beginning of 2018. 2018 Budget City Manager, John Williams reminded council that he will be absent at the next council meeting on November 28th. Deputy City Manager, Gilbert Alvarado will be present to oversee the 2nd public hearing and possible adoption of the 2018 Budget. COUNCIL COMMUNICATIONS AND REPORTS -None EXECUTIVE SESSION The regular meeting was recessed at 8:28 p.m. and the Council met in a 15 minute executive session with the City Attorney under RCW 42.30.110 (i) -To discuss with legal counsel representing the agency potential litigation At 8:42 p.m. the Council requested an additional 10 minute Executive Session The executive session was adjourned at 8:43 p.m. and the regular meeting was reconvened. Ordinance -Repealing MLMC Chapter 16.56 Undergrounding of Utilities The City Council declared a public emergency adoption of this ordinance for the protection of public health, safety, property, or peace and has passed this ordinance on a single reading with a majority plus one of the whole membership of the Council voting in favor of passage with the ordinance taking effect immediately upon passage. An ordinance repealing chapter 16.56 in its entirety of the Moses Lake Municipal Code titled pg.6 CITY COUNCIL MINUTES-Nov. 14. 2017 "Undergrounding of Utilities" was read by title only. Action taken: Council member Leonard motioned to adopt this ordinance as presented, seconded by Council member Myers, and passed unanimously. Ordinance-Amending MLMC 12.16 Street and Utility Construction Permits The City Council declared a public emergency adoption of this ordinance for the protection of public health, safety, property, or peace and has passed this ordinance on a single reading with a majority plus one of the whole membership of the Council voting in favor of passage with the ordinance taking effect immediately upon passage. An ordinance amending section 12.16.040 of the Moses Lake Municipal Code title "Inspection Fees" was read by title only. Action taken: Council member Curnel moved to adopt this ordinance in a single reading as presented, seconded by Council member Norman, and passed unanimously. Yes I November 28, 2017 I Motion This is the presentation of the budget ordinance establishing the authorization and spending plan for the 2018 fiscal year for all City operations. It requires a hearing to accept public comments and input. A balanced budget needs to be adopted by December 31, 2017. The budget ordinance also adopts the 2018 Fee Schedule by reference. Background The Budget provides for the financial planning, control and evaluation of all funds. Prior to Council presentation the City Manager, Finance Director and Department Directors met in September to review all budget proposals. The City Manager then made recommendations to create the City Manager's budget that was presented to City Council in a study session on October 21, 2017. From there, appropriate changes were made so that the 2018 Preliminary Budget considers guidance and direction given by Council throughout the budget process. Page 1of3 For the Preliminary Budget, all funds were balanced within available resources (i.e. reserves and new revenues), with the exception of the Ambulance utility fund. Staff sought direction from Council at the regular business meeting on November 14. Changes to the final budget from that meeting include a modification to the commercial rates charge by the Ambulance utility, which results in an increase to the revenue estimate by $185,000 (and balancing the fund); and an increase in the assessment paid to the Public Health District from $1.00 per capita to $1.25 per capita ($5, 700). Since the presentation of the Preliminary Budget, we have also been notified of two grant awards-the State Transportation Improvement Board (TIB) awarded $1.13 million to complete Lakeshore Drive, and the U.S. Department of Justice awarded an Office of Community Oriented Policing Services (COPS) grant of $250,000 over 3 years or $83,300 in 2018. As a result, the Lakeshore Drive project ($1.13 million) and 2 Police Officers ($200,990) are being added to the final budget. Additionally, Moses Lake voters approved the Transportation Benefit District (TBD) sales tax proposition. The sales tax will start to be collected on April 1, and collection of license tab fees will be rescinded as of March 31. This change is resulting in additional revenue of $640,000, with $600,000 being transferred to the Street Capital Fund to accomplish more TBD projects in 2018. The attached budget ordinance incorporates Council's final directives. Council could pass the ordinance at the conclusion of the public hearing. Many of the fees in the fee schedule are unchanged from 2017. Parks and Recreation reviewed their fee structure and are proposing modest fee increases for some of their activities. In accordance with Council direction given in November of 2016, all utility fees that are used to calculate the basic utility bills are being adjusted to keep up with inflationary increases, by applying the year-over-year increase in September's All Urban Consumers (CPl-U) West-B/C index of 2.6%. The exception is the Solid Waste utility which implemented an increase in September in keeping with the timing of the increase in the carrier contract. Based on Council direction at the November 14 meeting, two lines were added for commercial ambulance rates. One is to charge an additional utility fee per 5,000 square feet or portion thereof to a maximum of 25 units (or $296 per month) for non-residential structures, and the second is to charge lodging facilities a per unit fee for 50% of total room count. The Plan may be amended no more than once per year. The City of Moses Lake adopted a GMA-compliant Comprehensive Plan in 2001 and has amended it periodically. Attached are the proposed amendments for 2017, consisting of two site-specific land use designation changes requested by property owners. Background The Planning Commission reviewed and considered the following proposed amendments : A. Re-designate approximately 4.13 acres from Medium Density to Commercial. The area west of the Municipal Airport is owned by the City. The Airport Commission is requesting to add an area 267' by 1733' adjacent to the existing Municipal Airport. This would extend from the south boundary of the City-owned property to the existing City of Moses Lake Operations Complex. This 10.5-acre area is proposed for expansion of airport-related uses, including additional hangars and airport-related industries that do not require direct frontage on the runway. Note that this is slightly larger than the 227' x 1733' area that was initially proposed. See the attached map that shows a potential layout of this area and the need for 40 more feet in width. 2. The Operations Complex, which includes Public Works Street Division, Building Maintenance, and Equipment Division; and Parks Maintenance Division, is currently zoned Public but the designation is Parks/Open Space. This 13-acre site should be redesignated to Public Facilities as well, so that the use and zoning match the Comprehensive Plan designation. 3. As of the last update of the Capital Facilities Element in 2014, the airport property was included as undeveloped regional park land. The 67 acres were used to meet the Level of Service of 10.5 acres of park land per 1000 population. The City was able to show no deficiency in total acres until 2032 in City limits, although there were substantial deficiencies if the whole UGA was included since there are no parks in the UGA. Without the 67 acres at the airport, the in-City deficiency occurs by 2027. Note that the airport property is not relevant to the "Core Park System" calculation, since that consists of mini, neighborhood, and community parks, not regional parks. Since 2014 when the Capital Facilities Element was updated, a new Parks, Recreation & Open Space Plan has been adopted. The Plan is available on the City's website at http://cityofml.com/parkplan. Chapter 4, page 9 states that Regional/Urban Parks provide outdoor recreation facilities with regional significance (e.g. camping, boating) and can serve several communities. The service area is estimated to be a one-hour driving time. The discussion in this section of the Park Plan emphasizes the future need for camping areas and mentions that Regional/Urban Parks should be contiguous to or encompassing natural resources and an area of natural or ornamental quality for outdoor recreation, such as picnicking, boating, fishing, swimming, camping, and trail use, and may include play areas. The area adjacent to the Municipal Airport does not seem conducive to the uses proposed for a regional park in the new Park Plan. On the other hand, large vacant parcels to build a park on are a valuable resource that should not be eliminated without careful thought. 4. The Parks Level of Service in the Land Use Comprehensive Plan was based on National Park and Recreation Association (NRPA) standards that are no longer Analysis -Municipal Airport/Operations Complex Land Use Designation Amendment Page 1 current. NRPA has moved away from prescribing a set number acres per 1000 population for any city to now saying that the standard should be set locally. The City of Moses Lake will need to reevaluate the level of service for parks of various types as part of the next update of the Parks section of the Capital Facilities Element. 5. In reviewing whether to amend land use designations, the Commission should refer to the designation criteria from the Land Use element, and the guidance from the Growth Management Act (RCW 36. 70A) and implementing rules (WAC 365-196). 6. The Land Use element includes the designation criteria for Public Facilities (p.3- 22): The Public Facilities category contains public and institutional uses including facilities operated by state, county, municipal, or other government agencies; public educational institutions; public libraries, hospitals, and a municipal airport. Public utilities, both privately and publicly owned, are included in this category. Designation Criteria: 1. Existing public owned/operated facility. 2. Permanent facilities operated or owned by state, county, municipal, or other government agencies. 3. Future sites essential to the provision of privately or publicly owned utilities. 7. The Land Use element also includes the designation criteria for Parks/Open Space (p.3-24): The Parks/Open Space category includes public and privately owned parklands or open spaces. This section may be implemented by the Public Zone. Designation Criteria: 1. Existing public and privately owned parks. 2. Future sites reserved for park development. 8. In some cases there is additional revenue to support the additional expenditures, either in program revenues or grants. In those cases that are not supported by additional revenue, the fund balance is adequate to absorb the increase. The attached ordinance increases the 2017 budget for 7 funds resulting in citywide total expenditures of $1,889,000 and adds $1,439,000 to estimated revenue, resulting in a net use of fund balance of $450,000 in 6 separate funds {one fund has equal expenditures and revenues). Background RCW 35.33.091 sets forth the requirements to amend the budget absent a true "emergency". Even though there are areas in General Fund that are going over their individual authorization, the budget is passed at a total fund level, and we do not anticipate General Fund exceeding its 2017 budget in total. Other fund amendments are primarily the result of things already approved by Council but just not completely incorporated in the current budget. Examples include the uses of Page 1of2 Hotel/Motel taxes, the repayment of an interfund loan made at the end of 2016, mid-year rate adjustment for the Solid Waste utility, grants received, and the COLA adjustment for Fire pensioners. Other appropriations are needed to address true unforeseen items, such as the snowy, icy winter affecting the Streets budget as well as computers and copy machines breaking down. The appropriation for Water and Wastewater fund is simply to authorize the transfer of additional revenue to the capital fund. The spreadsheet attached to the appropriation ordinance details all of the changes. Fiscal and Policy Implications It is a compliance issue to have actual results be within the authorized appropriation. Background The update to MLMC Chapter 2.30 section 170 updates the code section to enable collection of insurance co-payments that were previously not collected. Fiscal and Policy Implications Changes to this ordinance will allow the city to process and collect co-payments from insured patients who have been transported by ambulance. Current estimations are between $150,000.00 and $180,000.00 in additional revenue. The ETA with both parties were part of a request for municipal water and sewer services. Both properties were not adjacent to the corporate limits and ultimately signed an ETA in order to receive municipal water and sewer services. The matter of initiating annexation proceedings with the subject properties comes from a request for municipal water and sewer services from Mr. Jay Byers. See map. In accordance with the City Council's Policy regarding utility extensions, properties that are within one-half mile of the corporate limits and wish to connect to water/sewer services must annex unless otherwise granted an exception by the City Council. Given that we have two (2) signed and recorded ETA in the area, staff is bringing these before the Council to consider exercising their authority of initiating an annexation to include the ETA properties. The annexation area would also include two parcels without signed and recorded ETA. Page 1of3 Background In 2001 the City Council adopted a Comprehensive Plan that included an Urban Growth Area (UGA} that was negotiated between the Grant County Board of County Commissioners and the Moses Lake City Council in accordance with RCW 36.70A.110. The final adopted UGA was nearly ten (10} years in the making and was subject to much debate, discussion and Public Hearings. The Moses Lake UGA is a twenty (20) year vision that is intended to encourage growth that is urban in nature and whereby urban governmental services would be provided by the City. The Moses Lake Comprehensive Plan, Goal 3, Section3-8 Land Use Chapter, addresses when it is appropriate to annex areas within our Urban Growth area. "Goal 3: THE CITY SHALL ANNEX ONLY THOSE PROPERTIES WHERE URBAN SERVICES AREAPPROPRIATE AND CAN BE REASONABLY PROVIDED" Fiscal and Policy Implications Municipal Services, Police, Fire, Planning and Building would all be impacted in terms of providing services. The development of annexation area would yield property taxes and more, which would be utilized to offset staff and infrastructure costs associated with City services that would be provided to the area. The availability of the utility authorized by this Agreement is s.u:bJecl to the capacity of the City's water system. 3.5 The water delivered pursuant to this Agreement shall be the. same as other water delivered within the City's system. The City makes no warranty as to such water quantity or quality other than it shall be delivered in accordance with the regulations applicable to city water systems. 3.6 The water service provided by the City is for up tp one singfe family home. 3. 7 Developer agrees and covenants that all sewer and/or water utility system components to be built and attached to the City's utility system shall be built to City standards. The standards applied by the City may include requiring construction in excess of that minimally required to connect the premises to City utilities where such additional construction is consistent with a City plan of service within the area of th~ premises. 3.8 Developer agrees and covenants that the premises will not be used in any manner or for any purpose inconsistent with or con'trary to the land use controls in place as those controls now exist or as they may be from time to time altered, amended, or re-adopted. The Developer acknowledges the pr~mlse·s are subject to development pursuant to regulations administered by Grant County. T he D~veloper agrees the City may impose development conditions greater than those imposed by Grant County, but in no event greater than those imposed for similar development withiA tne City's limits, as a condition of receiving utility services under this Agreement. The premises currently are used in a manner consistent with the existing land use controls. 3.9 This Agreement is entered into by the City based on the utility uses identified above and the land uses identified by the Developer for the premises. No subsequent leasehold, joint venture, or other tenancy or use agreement shall relieve the Developer or the Developer's successor in interest from performing under this Agreement. This Power of Attorney is executed, as is this Agreement, by Developer with a full understanding that Developer may be waiving and transferring to the City a valuable right as a land owner as respects annexation by the City. Developer waives any objection to annexation by the City. Developer acknowledges Developer has relied solely upon Developer's own legal counsel and fully understands the legal rights Developer is or may be surrendering to the City by the execution of this Agreement and the subjoined Covenant and Power of Attorney. 3. 11 Developer understands the delivery of utility services to these premises so long as they remain outside the corporate limits of the city, is a discretionary act of the City and the execution of this Agreement and performance hereunder are not intended and shall not be considered as an indication by the City of the intention to become a general provider of utility service beyond the terms of this contract, to these premises or any other lands located outside the corporate limits of Moses Lake. 3.12 Developer acknowledges that so long as the premises remain outside the corporate limits of the City, any or all utility service provided under this Agreement by the City are, or may become subject to, surcharges and/or increased charges in addition to the charges to similar customers located within the corporate limits. 3.13 Developer agrees that payment of service charges, surch~rge assessments, and/or additional charges required by City ordinances to be paid for the utility services mentioned above will in no way relieve the premises from Developer's share of any future Local Improvement District or Utility Local Improvement District payments which may be assessed to pay all or a portion of the expenses of installing main or mains, together with necessary valves, fire hydrants, pipe fittings and all other appurtenances which may be installed to serve a district which includes the premises. 3.14 Developer agrees that in the event of a sale, gift, transfer, segregation, assignment, or device of Developer's fee interest in the premises it will disclose the existence of this Agreement. 3.15 In the event of a breach of this Agreement by the Developer or any successor in interest, this Agreement, and all delivefri~s of utilities hereunder, shall be subject to termination thirty (30) days after notice to the Developer of the breach if the breach has not been cured. 3. 16 in the event the premises is delivered City utilities pursuant to this Agreement and the premises become located outside the City's UGA, this Agreement shall be deemed to have been terminated .as pl"Gvided for in the provisions dealing with the term of this Agreement. Parties: The parties to this Agreement are the City of Moses Lake, Washington (herein City), a municipal corporation of the State of Washington, located entirely within Grant County, Washington, and Jose & Maria Luisa Gonzales,(herehDeveloper). 2. Recitals: 2.1 The City is the owner of a municipal water and sewer system which operates within the City's limits and adjacent to real prope'.rty near Moses Lake, Washington. 2,2 Developer desires to receive water and/or sewer utility service from the City for use upon Developer's real property located more than one half mile from the corporate limits of the City and located within the City's Urban Growth Area (UGA). ' 2.3 The City, pursuant to Resolution No. 3200, requires that a!I non-contiguous real property which receives water and/or sewer utility services from the City be subject to an agreement which affects the use of the real property served by the City utilities, restricts expansion of City utility services beyond those contracted for, and creates a covenant running with the land. 2.4 Developer is fully aware of the restrictions imposed upon Developer and Developer's ·successor{s), heir(s), and assign(s) by City Resolutions No. 3200 and enters into this Agreement freely and voluntarily. 3. Agreement: It is agreed by and between the parties as follows: 3.1 The City will provide the water utility service listed below to Developer at the premises stated, pursuant to the terms of this Agreement. 3.2 The real property to be serviced is located within the City's UGA and is described as: Tx# 10680 in NESW 1019 28Tx#10680that portion of the south 1/2 of the northeast quarter of the southwest quarter of Section 10, Township 19 North, Range 28 E.W.M., Grant County, Washington, described as follows: beginning at the northeast corner of the south 1 /2 of the northeast quarter of the southwest quarter of said Section 1 O; thence North 89°52'36" West along the north line thereof, a distance of 808.34 feet; thence South 00°23'23" West, a distance of 130 feet to the true point of beginning; thence continuing South 00°23'23" West, a distance of 138.54 feet; thence South 89°55'29" East, a distance of 68 feet; thence North 00°26'00" East, a distance of 138.41 feet; thence North 89°55'29" West, a distance of 68 feet to the true point of beginning as recorded with the Grant County Auditor and referred to herein as the premises. 3.3 This Agreement shall be filed for record in the Office of the Grant County Auditor and shall be in the nature of a covenant running with the premises. It ,is the intent of Developer to have this Agreement, so long as it is in force, to be considered, interpreted, and regarded as a covenant running with the land as· to ttie ,premises. 3.4 All connections to the City water system or to the City sewer system shall comply with the ordinances and rules of the City with respect to .the appropriate utility. Any connection to the City's water and/or sewer system is subject to payment for the utility service of a rate established by the City which shall be subject to adjustment from time to time by the Moses Lake City Council. The availabi~ty of the utility authorized by this Agreement is subject to the capacity of the City's water system. ) 3.5 The water delivered pursuant to this Agreement shall be the same as other water delivered within the City's system. The City makes no warranty as to such water quantity or quality other than it shall be delivered in accordance with the regulations applicable to city water systems. 3.6 The water service provided by the City is for up to one single family home. 3.7 Developer agrees and covenants that all sewer and/or water utility system components to be built and attached to the City's utility system shall be built to City standards. The standards appliea by the City may include requiring construction in excess of that minimally required to connect the premises to City utilities where such additional construction is consistent with a City plan of service within the area of the premises. 3.8 Developer agrees and covenants that the premises will not be used in any manner or for any purpose inconsistent with or contrary to the land use controls in place as those controls now exist or as they may be from time to time altered, amended, or re- ·adopted. The Developer acknowledges the premises are subject to development pursuant to regulations administered by Grant County. The Developer agrees the City may impose development conditions greaterthan those imposed by Grant County, but in no event greater than those imposed for similar development within the City's limits, as a condition of receiving utility services under this Agreement. Developer or the successor holder of the fee title to the premises shall be bound by this Agreement and be responsible to perform under this Agreement. No subsequent leasehold, joint venture, or other tenancy or use agreement shall relieve the Developer or the Developer's successor in interest from performing under this Agreement. To continue this Agreement in effect and to continue a delivery of the identified utilities, any successor in interest shall execute an acknowledgment of this Agreement, Covenant, and Power of Attorney in a form approved by the City. 3.10 Developer shall execute contemporaneously with this Agreement the subjoined Power of Attorney and subjoined Covenant respecting the annexation of the premises by the City. This Power of Attorney is executed, as is this Agreement, by Developer with a full understanding that Developer may be waiving and transferring to the City a valuable right as a land owner as respects annexation by the City. Developer waives any objection to annexation by the City. Developer acknowledges Developer has relied solely upon Developer's own legal counsel and fully understands the legal rights Developer is or may be surrendering to the City by the execution of this Agreement and the subjoined Covenant and Power of Attorney. 3.11 Developer understands the delivery of utility services to these premises so long as they remain outside the corporate limits of the city, is a discretionary act of the City and the execution of this Agreement and performance hereunder are not intended and shall not be considered as an indication by the City of t~ intention to become a general provider of utility service beyond the te,.rms of this contract, to these premises or any other lands located outside the corporate limits of Moses Lake. 3.12 Developer acknowledges that so long as the premises remain outside the corporate limits of the City, any or all utility service provided under this Agreement by the City are, or may become subject to, surcharges and/or increased charges in addition to the charges to similar customers located within the corporate limits. 3.13 Developer agree~ t~at payment of service charges, surcharge assessments, and/or additional charges required by City ordinances to be paid for the utility services mentioned above will· in no way relieve the premises from Developer's share of any future Local tmprovement District or Utility Local Improvement District payments which may be assessed to pay all or a portion of the expenses of installing main or mains, together witt necessary valves, fire hydrants, pipe fittings and all other appurtenances which·may be installed to serve a district which includes the premises. 3.14 Developer agrees that in the event of a sale, gift, transfer, segregation, assignment, ·or device of Developer's fee interest in the premises it will disclose the existence of this Agreement. 3.15 In the event of a breach of this Agreement by the Developer or any successor in interest, this Agreement, and all deliveries of utilities hereunder, shall be subject to termination thirty (30) days after notice to the Developer of the breach ifthe breach has not been cured. 1306697 10/11/2012 10 :01 AM EXT ,COV,POA Page 3 of 6 R 221.00 Grant Co, UA CITY OF MOSES LAKE 1 1111111111 1~1111111111111 m111111111111111 H 111111~1~1111111111111 m1111111111 ~11101 COVENANT RUNNING WITH THE LAND 1. Basis: The foregoing Extra Territorial Utility Extension Agreement shall be deemed to be a covenant running with the land affecting the entire premises described above. Such Covenant shall be recorded with the Grant County Auditor and become a covenant of record. Such Covenant shall remain in full force and effect tor the life of the Extra Territorial Utility Extension Agreement. Any attempt to cancel, restrict, or modify this Covenant independent of the Extra Territorial Utility Extension Agreement shall terminate said Agreement immediately unless such cancellation, modification, or restriction is agreed to by the Moses Lake City Council. This Covenant shall expire and be of no further force or effect upon the annexation of the entire premises described in the foregoing Extra Territorial Utility Extension Agreement into the City of Moses Lake. 2. Creation: Developer, as the owner in fee simple of the above described premises, hereby creates a covenant running with the land to affect and include the entire described premises That Cov.enant shall include all the terms, conditions, limitations, and obligations of the Extra Territorial Utility Extension Agreement above. The period of termination shall begin upon the date the premises become located outside the City's UGA unless the parties agree otherwise in writing. 3.17 The permission to obtain City utilities contained in this Agreement shall lapse and become null and void if the premises are not connected to the City's utility system within five (5) years of the execution of this Agreement. 4. Term: This Agreement shall be in effect so long as Developer abides, observes, and performs this Agreement and the premises remains outside the corporate limits of the City of Moses Lake. This Agreement may be terminated by either party giving at least eighteen (18) months written notice of termination to the other, unless a shorter notice is agre~d to in writing. Upon annexation of these entire premises into the City of Moses Lake, this Agreement and the subjoined Covenant and Power of Attorney shall terminate and be of no further force or effect. Appointment: Developer hereby makes, constitutes, and appoints the City of Moses Lake, Washington Developer's true and lawful attorney for Developer and in Developer's name, place, and stead for the purposes stated herein. 2. Independent Advice: Developer has executed this Power of Attorney for the purposes stated after having a full understanding of the implications of the execution of this instrument. This Power of Attorney is also executed after being fully advised by Developer's own counsel as to the power being conveyed to the City of Moses Lake and with a full appreciation and waiver of any rights being abrogated. 3. Purpose: Developer appoints the City of Moses Lake as Developer's attorney for the purpose of executing any and all documents, petitions, requests, letters, or the like necessary or desirable in the process of the annexation of the premises described in the foregoing Extra Territorial Utility Extension Agreement into the corporate limits of the City of Moses Lake. 4. Termination: This Power of Attorney may be revoked by Developer only upon the termination of the forgoing Extra Territorial Utility Extension Agreement, or upon the consent of the City of Moses Lake's City Council. The continued validity, viability, and existence of this Power of Attorney is a prerequisite of continued utility service delivery to the premises under the terms of .the E:>dra Territorial Utility Extension Agreement by the City of Moses Lake.
