Summary: To discuss and review suggested designs, color schemes and themes for commercial buildings within
city limits.
The purpose of the study session is to allow the city council to discuss matters informally and in greater detail than permitted at
formal council meetings. While all meetings of the council are open to the public, study sessions discussions are generally limited to
the council, city staff and consultants.

The regular meeting of the Moses Lake City Council was called to order at 7 p.m. by Mayor Voth in the Council
Chambers of the Civic Center, 401 S. Balsam, Moses Lake, Washington.
Executive Secretary Sophia Guerrero called the roll. The following were:
Present: Mayor Todd Voth, Deputy Mayor Karen Liebrecht, and Council members Bill Ecret, Don Myers, Mike
Norman, David Curnel, and Ryann Leonard
PLEDGE OF ALLEGIANCE: Tanner Yilmaz, Knowledge Bowl participant, led the Council in the flag salute.
COUNCIL MEMBER REPORTS -None
MAYOR'S REPORTS
CERTIFICATION OF ACHIEVEMENT -KNOWLEDGE BOWL
A Certificate of Achievement was presented to the members of the Moses Lake High School Knowledge Bowl
in recognition as the Washington State Knowledge Bowl Champions.
PARKS AND RECREATION COMMISSION
Mayor Voth requested Council confirmation of the re-appointment of Charlene Rios to the Parks and
Recreation Commission.
Action Taken: Mrs. Liebrecht moved that the re-appointment of Charlene Rios be confirmed, seconded by
Mrs. Leonard, and passed unanimously.
ADDITIONAL BUSINESS -None
CITY MANAGER REPORTS
RESOLUTION -GRANT APPLICATION -LARSON PLAYFIELD
A resolution was presented which authorizes the City staff to apply for a grant from the Recreation and
Conservation Office, Youth Athletic Facilities, for lighting renovation at Larson Playfield.
The resolution of the City of Moses Lake, Washington authorizing the submittal of an application for grant
funds from the Recreation and Conservation Office, Youth Athletic Facilities (YAF) was read by title only.
Action Taken: Mr. Curnel moved that the resolution be adopted, seconded by Mr. Norman, and passed
unanimously.
POLICE DEPARTMENT
Reserve Officers Justine Materne, Jeremy Coleman, and Rudy Valdez were presented to the Council and
sworn in as new Reserve Officers. ·
POLICE RESERVE OFFICER -VOLUNTEER OF THE YEAR
Matt Davis, Reserve Officer, was recognized as Volunteer of the Year.
COMMUNITY DEVELOPMENT DIRECTOR
Lee Creiglow, Building Inspector, was introduced to the Council.

CITIZEN'S COMMUNICATIONS
VETERAN'S PARl DE
April 26, 2016
Joann Hozzu, 318 Dale Road, stated that there will be a parade on June 11 to honor all·veterans and the
Mayor and Council were invited to walk in the parade.
CONSENT AGENDA
Minutes: The minutes of the April 12 meeting were presented for approval.
Approval of Claims, Prepaid Claims, Checks, and Payroll: Vouchers audited and certified by the Finance
Director as required by RCW 42.24.080, and those expense reimbursement claims, certified as required by
RCW 42.24.090, have been recorded on a listing which has been made available to the Council for approval
and is retained for public inspection at the Civic Center. As of April 26, 2016 the Council does approve for
payment claims in the amount of $345,539.27; prepaid claims in the amounts of $109,456.67 and $2,630.53;
claim checks in the amount of $1, 579,407.44; and payroll in the amount of $324, 369.21 .
Resolution -Abandon Easement -Catholic Church: A resolution was presented which abandons the 5'
easement located along the northwesterly property line of Lot 1, Knolls Vista 18th Addition.
Water/Sewer Service -Medel: Jose Nicolas Leon Medel requested permission to connect the west 217.80'
of Tax #3564 located at 4741 Grape Drive, to the City's sewer system without annexing the property to the
City. The property is within one half mile of the City's limits but it would be impractical to annex since there
are additional parcels and right-of-way between the lot and the City's limits. If approved, an Extra Territorial
Utility Agreement would be required.
Action Taken: Mrs. Leonard moved that the Consent Agenda be approved, seconded by Mr. Norman, and
passed unanimously.

OLD BUSINESS
RESOLUTION -GOVERNANCE COORDINATION MANUAL -PARK AND RECREATION COMMISSION
AND LODGING TAX ADVISORY COMMITTEE
A resolution was presented which adopts revisions to the Governance Coordination Manual by setting forth
guidelines and rules of conduct for the Parks and Recreation Commision, Lodging Tax Advisory Committee,
and a change to the order of business for Council meetings.
The resolution of the City of Moses Lake, Washington, amending Resolution No. 3597 creating the rules of
procedures for City Council meetings, public hearings, legislative process and general government polices
was read by title only.
John Williams, City Manager, explained the changes.
Action Taken: Mrs. Liebrecht moved that the Governance Coordination Manual be amended as proposed and
the resolution be adopted, seconded by Mrs. Leonard, and passed unanimously.
NEW BUSINESS
ORDINANCE -CREATE 2.39 -LODGING TAX ADVISORY COMMITTEE -1sr PRESENTATION
An ordinance was presented which creates the Lodging Tax Advisory Committee and repeals Resolution 2065
which originally established the Committee.
John Williams, City Manager, pointed out that there have been some legislative changes and the ordinance
will bring this Committee into compliance with state law.

Legislative History:
May 10, 2016 Set Date for Public Hearing
The City Council should consider a request from Gregory and Marla Huff to vacate a portion of
Right-of-Way (ROW}, described as Blanchet Ave adjacent to Lot 1, Block 1, HLH Plat. The Council
should set a public hearing to consider the merits of the vacation and Ordinance vacating
described ROW.
Background
Gregory and Marla Huff are requesting the vacation of a portion of unimproved ROW that abuts
their property. The Huff's have voiced their concerns in the past over the maintenance of the
unimproved ROW and are requesting to vacate in order to maintain the ownership.

A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT-OF-WAY
DEDICATED FOR THE DEVELOPMENT OF BLANCHET AVENUE ADJACENT TO
LOT 1, BLOCK 1, HLH PLAT
RECITALS:
1. There exists right-of-way dedicated for Blanchet Avenue adjacent to Lot 1, Block 1, HLH Plat.
2. RCW 35. 79 provides that a public street may be vacated upon resolution initiated and passed by the
legislative authority of the jurisdiction where the street is situated and that such resolution shall fix a time
when the petition will be heard and determined and which shall not be more than sixty days nor less than
twenty days after the passage of such resolution.
RESOLVED:
1. The vacation of the following described public right-of-way shall be initiated:
That portion of Blanchet Avenue, formerly known as Sixth Avenue, dedicated on the Plat of Park Orchard
Tracts, Per Grant County Plat records Book 1, Page 36, located in the SW 1 /4, Section 15, Township 19
North, Range 28 East. W.M., City of Moses Lake, Grant County, Washington, described as follows:
A 43. 00 foot wide portion of Blanchet Avenue adjacent to Lot 1, Block 1, H. L.H. Plat, recorded in book 11
of Major Plats, pages 56 and 57, records of Grant County, Washington, more particularly described as
follows:
BEGINNING at the easterly most corner of said Lot 1; Thence S62°12'45"W along the southerly line of
said lot 1 a distance of, 180.60 feet; Thence S00°10'05"W along an extension of the west line of said Lot
1, a distance of 48.65 feet; Thence N62°12'45"E along a 43 feet distant from and parallel to the
southeasterly line of said Lot 1, a distance of 183.17 feet to a 40.00 foot radius non-tangent curve
concave to the east; Thence along the arc of said curve to the right, through a central angle of 45°50'21 ",

Dear Sirs:
We own property located at 410 White Street.
As long as we have owned this property, Blanchet Dr. (which sits between our
property and the Catholic Church, and at the end of a cul-de-sac) has sat there
vacant. The new elementary school Park Orchard sits adjacent.
This Blanchet Dr. property has become a dumping ground for nll the neighbors
unused items, grass clippings and etc.
We would like Blanchet Dr. vacated and would like to purchase this unbuildable Yi
lot. We would move our fence to incorporate this vacated street into our property
on White Street. We would move the fence to 5 feet of the existing sidewalk used for
access to the elementary school.
We have discussed this with a representative with the Catholic Church as they have
the same concerns and agree with our purchasing ands cleaning up this property.
We have also paid the $200 fee to start the process for the right-of-way vacation.

Cutting Edge Earthworks, Inc. has completed work on the Storm Drainage Project -2015 and it is
ready to be accepted.
Background
The project consisted of installing storm drainage improvements to address existing problems,
increase capacity, and reduce the amount of flow discharging to the lake. The work was awarded in
the amount of $158,766.11 and the final contract amount is $159,164.26.
Fiscal and Policy Implications
Upon acceptance, the City will enter into the 60 day lien period as required by Washington State
Law.

Background

Central Washington Asphalt (CWA) requests permission to perform work on the Seal Coat Project -
2016 between the hours of 10:00 pm and 7:00 am. The sections of roadway will include Pioneer
Way, Wheeler Road, and Division Street
Background
Moses Lake Municipal Code 8.28.050.B.3 requires City Council approval for construction work
between the hours of 10 p.m. and 7 a.m. in residential zones.
When streets are chip sealed, there are excess chips on the road that must be must be swept up.
This work is typically performed at night due to lower temperatures and traffic volumes. Sweeping
during high daytime temperatures can lead to chips being pulled out of the soft oil. Daytime traffic
volumes are also higher and lead to more conflicts with the slow moving sweepers.

There are no fiscal implications.

Attached is an Ordinance that establishes a Planned Action for the Grant County International
Airport Employment Center pursuant to the Washington State Environmental Policy Act (SEPA).
The Planned Action Ordinance is part of the $400,000 grant awarded by the Washington State
Department of Commerce (Commerce) Advanced Planning Grant Program. The Ordinance must
be adopted in order to complete the deliverable portion of the Grant Program funds.
Background
In 2015, Commerce implemented a temporary grant program for State Fiscal Year 2015 with $1.2
million dollars available to fund Advanced Planning projects through a SEPA Planned Action. By late
2014, approximately $900,000 dollars were still available. The Port of Moses Lake approached the
City of Moses Lake and Grant County to submit a joint grant application to develop a Planned
Action study area of Port property and private property. The intent of the Planned Action was to
develop the up-front environmental impact analysis for future development in the study area.

AN ORDINANCE ESTABLISHING A PLANNED ACTION FOR THE GRANT COUNTY
INTERNATIONAL Al RPO RT (GCIA) EMPLOYMENT CENTER, PURSUANT TO THE
STATE ENVIRONMENTAL POLICY ACT.
1. The State Environmental Police Act (SEPA) and implementing rules provide for the integration of
environmental review with land use planning and project review through designation of"Planned Actions"
by jurisdictions planning under the Growth Management Act (GMA).
2. The City has adopted a Comprehensive Plan complying with the GMA.
3. The City has adopted development regulations permitting designation of Planned Actions.
4. The GCIA Employment Center has received an Advanced Planning grant from the Washington State
Department of Commerce to prepare a Planned Action EIS.
5. The City has established development regulations for properties within the GCIA Employment Center
site.
6. The City desires to designate a Planned Action for the GCIA Employment Center area.
7. Designation of a Planned Action expedites the permitting process for subsequent, implementing projects
whose impacts have been previously addressed in a Planned Action environmental impact statement
(EIS), and thereby encourages desired growth and economic development.
8. The GCIA Employment Center Planned Action EIS identifies impacts and mitigation measures
associated with planned development in the GCIA Employment Center Area.
9. The City has adopted development regulations which will help protect the environment and will guide the
amount, location, form, and quality of desired development.
10. The GCIA Employment Center area is deemed to be appropriate for designation of a Planned Action.
11 . The Grant County (County), as a SEPA lead agency, provided public comment opportunities through an
EIS scoping period in February and March 2015, and for the GCIA Employment Center Draft EIS during
June and July 2015.
12. The City provided notice and an opportunity for the public to comment on the GCIA Employment Center
Planned Action EIS during a public meeting before the City Council on April 12, 2016.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Recitals: The recitals set forth above are incorporated herein by reference.
Section 2. Purpose: The City Council declares that the purpose of this ordinance is to :
A. Combine environmental analysis, land use plans, development regulations, City codes and ordinances
together with the mitigation measures in the GCIA Employment Center EIS to mitigate environmental
impacts and process planned action development application in the GCIA Employment Center area.
8. Designate the GCIA Employment Center as a Planned Action for purposes of environmental review and
permitting of subsequent, implementing projects pursuant to the SEPA, RCW43.21 C.031 .
C. Establish criteria and procedures, consistent with state law that will determine whether subsequent,
implementing projects qualify as Planned Actions.

D. Provide the public with information about Planned Actions and how the City and County will process
applications for implementing projects within the Planned Action area.
E. Streamline and expedite the land use review and approval process for qualifying projects by relying on
the EIS completed for the Planned Action
F. Apply the City's development regulations together with the mitigation measures described in the Planned
Action EIS and this ordinance to address the impacts of future development contemplated by the
Planned Action.
Section 3. Findings: The City Council finds as follows:
A The City is subject to the requirements of the Growth Management Act RCW 36. 70A, and portions of
the GCIA Employment Center site located in the City and County are within an Urban Growth Area.
B. The City has adopted a Comprehensive Plan complying with the GMA which addresses a portion of the
GCIA Employment Center site.
C. A portion of the approximately 1,258-acre Planned Action area is location within Grant County, and
encompasses an area smaller than the Grant County limits.
D. An EIS has been prepared for the Planned Action area, and the City Council finds that the EIS
adequately identifies and addresses the probable significant environmental impacts associated with the
types of land uses and amount of development planned to occur in the designated Planned Action area.
E. The mitigation measures identified in the Planned Action EIS and attached to this ordinance as Exhibit
B, incorporated herein by reference, together with adopted City and County development regulations,
will adequately mitigate significant impacts from development within the Planned Action area.
F. The Planned Action EIS identifies the location, type and amount of development that is contemplated
by the Planned Action.
G . Essential public facilities defined in RCW47.06.140 are excluded from the Planned Action and are not
eligible for review or permitting as Planned Actions.
H. Future projects that are implemented consistent with the Planned Action will protect the environment,
benefit the public and enhance economic development.
I. The County has provided several opportunities for meaningful public involvement in the proposed
Planned Action, has considered all comments received, and, as appropriate, has modified the proposal
or mitigation measures in response to comments.
J. Public services and facilities are adequate to serve the proposed Planned Action, with implementation
of mitigation measures identified in the EIS.
Section 4. Procedures and Criteria for Evaluating and Determining Projects as Planned Actions:
A Planned Action Area: The Planned Action designation shall apply to the area shown in Exhibit A,
incorporated herein by reference.
B. Environmental Document: A Planned Action determination for a site-specific project application shall
be based on the environmental analysis contained in the Draft EIS issued on June 26,2015, and the Final
EIS issued December 2015. The Draft and Final EISs shall comprise the Planned Action EIS for the
Planned Action area. The mitigation measures contained in Exhibit Bare based upon the findings of the
Planned Action EIS and shall, along with City and County regulations, provide the framework that the City
and County will use to impose appropriate conditions on qualifying Planned Action projects.
C. Planned Action Designated: Land uses and activities described in the Planned Action EIS, subject to
the thresholds described in subsection 4.D and the mitigation measures contained in Exhibit B, are
designated Planned Actions or Planned Action Projects pursuant to RCW 43.21 C.031. A development

application for a site-specific Planned Action project located within the Planned Action area shall be
designated as a Planned Action if it completed the modified SEPA Checklist in Exhibit C, and meets the
criteria set forth in subsection 4. D of this ordinance and applicable laws, codes, development regulations
and standards of the City and County.
D. Planned Action Th resholds: The following thresholds shall be used to determine if a site-specific
development proposed within the GCIA Employment Center site is contemplated by the Planned Action
and has had its environmental impacts adequately evaluated in the Planned Action EIS:
1. Qualifying Land Use: The following general categories/types of land uses which are permitted in
zoning classifications applicable to the GCIA Employment Center site, and subject to any
limitations in size contained in the applicable zoning districts, are considered Planned Actions;
anticipated land uses are further identified below:
a. Heavy industrial and manufacturing uses
b. Light industrial and technology uses
c. Aviation development, revenue support uses and airfield operations
d. Public
e. Infrastructure and utilities, such as roadways, water, wastewater and stormwater, which are
also Planned Actions.
Individual land uses considered to be Planned Actions shall include those uses specifically listed
in development regulations applicable to the zoning classifications applied to properties within the
Planned Action Area.
2. Development/Employee Thresholds
a. The following total amounts of various new land uses and employees are contemplated by the
Planned Action at build-out:

Development and Revenue Support classifications described in the GCIA Master
Plan.
b. If future development proposals at the GCIA Employment Center Planned Action Area exceed
the development thresholds specified in this ordinance, further environmental review may be
required pursuant to WAC 197-11-172. Furthermore, if proposed development would alter the
assumptions and analysis in the Planned Action EIS, further environmental review may be
required.

3. Transportation:

a. Trip Ranges & Thresholds: The total number of new trips anticipated in the Planned Action
area and reviewed in the EIS is as follows:

Uses or activities that would exceed these maximum trip levels will require additional SEPA
review.
b. Concurrency: The determination of transportation impacts shall be based on the Moses Lake
Municipal Code and the County's concurrency management program contained in the Grant
County Code (GCC 25.20).
c. Traffic Im pact Mitigation: In order to mitigate transportation-related impacts, all P Ian ned Action
projects shall be responsible for a proportional share of off-site improvements for local streets
and roads listed in Exhibit B unless a separate mitigation funding agreement has been
executed by the affected agencies. A proposed project's proportional share shall be
determined based on a traffic generation study, included with the Planned Action checklist
required by Section G 1 of this ordinance. The study shall consider the type, intensity and
location of the proposal, and its proportional demand for identified local traffic improvements.
d. Director Discretion: The City of Moses Lake Community Development Director and Grant
County Planning Director shall have discretion to determine incremental and total trip
generation, consistent with the Institute of Traffic Engineers (ITE) Trip Generation Manual
(latest edition) or an alternative manual accepted by the County Engineer at his or her sole
discretion, for each project permit application proposed under this Planned Action.
5. Elements of the Environment and Degree of Impacts: A proposed project that would result in a
significant change in the type or degree of impacts to any of the elements of the environment
analyzed in the Planned Action EIS shall not qualify as a Planned Action.
6. Changed Conditions: Should environmental conditions change significantly from those analyzed
in the Planned Action EIS, the City's and County's SEPA Responsible Official may determine that
the Planned Action designation is no longer applicable until supplemental environmental review
is conducted.
E. Planned Action Review Criteria:
1. The City's and County's SEPA Responsible Official may designate as "Planned Actions", pursuant
to RCW 43.21C.030, applications that meet all of the following conditions:
a. The proposal is located within the Planned Action area identified in Exhibit A of this ordinance.
b. The proposed uses and activities are consistent with those described in the Planned Action
EIS and Section 4.D of this ordinance.
c. The proposal is within the Planned Action thresholds and other criteria of Section 4.D of this
ordinance.
d. The proposal is consistent with the City of Moses Lake Comprehensive Plan and Grant County
Comprehensive Plan.
e. The proposal's significant adverse environmental impacts have been identified in the Planned
Action EIS.
f. The proposal's significant impacts have been mitigated by application of the measures
identified in Exhibit B, this ordinance, and other applicable City and County regulations,
together with any modifications or variances or special permits that may be required.

g. The proposal complies with all applicable local, state and/or federal laws and regulatio ns, and
the Responsible Official determines that these constitute adequate mitigation.
h. The proposal is not an essential public facility as defined by RCW 36.?0A.200(1), unless the
essential public facility is accessory to or part of a development that is designated as a
Planned Action under this ordinance.
2. The City and/or County shall base its decision on review of a SEPA checklist, or an alternative
form authorized by state law, and review of the application and supporting documentation.
3. A proposal that meets the criteria of this section shall be considered to qualify and be designated
as a Planned Action, consistent with the requirements of RCW 43.21 C.030, WAC 197-11-164 et
seq, and this ordinance.
F. Effect of Planned Action:
1. Designation as a Planned Action project means that a qualifying proposal has been reviewed in
accordance with this ordinance and found to be consistent with its development parameters and
thresholds, and with the environmental analysis contained in the Planned Action EIS.
2. Upon determination by the City's and County's SEPA Responsible Official that the proposal meets
the criteria of Section 4.D and qualifies as a Planned Action, the proposal shall not requ ire a SEPA
threshold determination, preparation of an EIS, or be subject to further review pursuant to SEPA.
G. Planned Action Permit Process: Applications for Planned Actions shall be reviewed pursuant to the
following process:
1. Development applications shall meet all applicable requirements of the Moses Lake Municipal
Code and Grant County Unified Development Code (GCC). Applications for Planned Actions shall
be made on forms provided by the City and County and shall include a SEPA checklist, or an
approved Planned Action checklist.
2. The City of Moses Lake Community Development Director and County's Planning Director or
designee shall determine whether the application is complete as provided in GCC25.04.130 -
25.04.160.
3. If the application is for a project within the Planned Action Area defined in Exhibit A, the application
will be reviewed to determine if it is consistent with the criteria of this ordinance and thereby
qualifies as a Planned Action project.
a. The SEPA Responsible Official shall notify the applicant of his/her decision. Notice of this
determination shall also be mailed or otherwise verifiably delivered to federally recognized
tribal governments and to agencies with jurisdiction over the Planned Action project pursuant
to Chapter 1, Laws of 2012 (Engrossed Substitute Senate Bill [ESSB] 6406).
b. If the project is determined to qualify as a Planned Action, it shall proceed in accordance with
the applicable permit review procedures specified in GCC 25 .04, except that no SEPA
threshold determination, EIS or add itional SEPA review shall be required.
c. Notice of the application for a Planned Action project shall be pursuant to GCC 25.04.190-
25.04.240.
4. If notice is required for the underlying permit, the notice shall state that the project has qualified
as a Planned Action. If notice is not otherwise required for the underlying permit, no special notice
is required by this ordinance.
5. Development Agreement: To provide additional certainty about applicable requirements, the City
or County or an applicant may request consideration and execution of a development agreement
for a Planned Action project. The development agreement may address review procedures
applicable to a Planned Action project, permitted uses, mitigation measures, payment of impact

fees or provision of improvements through other methods, design standards, phasing, vesting of
development rights or any other topic that may properly be considered in a development
agreement consistent with RCW 36. 708.170 et seq.
6. If a project is determined to not qualify as a Planned Action, the SEPA Responsible Official shall
so notify the applicant and prescribe a SEPA review procedure consistent with the City's or
County's SEPA regulations and the requirements of state law. The notice shall describe the
elements of the application that result in failure to qualify as a Planned Action.
7. Projects that fail to qualify as Planned Actions may incorporate or otherwise use relevant elements
of the Planned Action EIS, as well as other relevant SEPA documents, to meet their SEPA
requirements. The SEPA Responsible Official may limit the scope of SEPA review for the non-
qualifying project to those issues and environmental impacts not previously addressed in the
Planned Action EIS.
Section 5. Monitoring and Review:
A. The City and County should monitor the progress of development in the designated Planned Action area
as deemed appropriate to ensure that it is consistent with the assumptions of this ordinance and the
Planned Action EIS regarding the type and amount of development and associated impacts, and with
the mitigation measures and improvements planned for the GCIA Employment Center Planned Action
Area.
B. This Planned Action Ordinance should be reviewed by the SEPA Responsible Official no later than five
(5) years from its effective date. The review shall determine the continuing relevance of the Planned
Action assumptions and findings with respect to environmental conditions in the Planned Action area,
the impacts of development, and required mitigation measures. Based upon this review, the City and
County may propose amendments to this ordinance or may supplement or revise the Planned Action
EIS, as appropriate.
C. When Planned Action monitoring indicates that development proposals that generate a cumulative of
about 12,000 daily trips have been submitted, the City and County will begin work towards developing
a memorandum of understanding (MOU) in cooperation with the Washington State Department of
Transportation to address identified impacts to state transportation facilities. The MOU may address
timing, design and funding of state facilities, and/or such other topics as the parties may determine.
Section 6. Conflict: In the event of a conflict between this ordinance or any mitigation measure imposed
thereto, and any ordinance or regulation of the City and County, the provisions of this ordinance shall control
EXCEPT that the provision of any International Code shall supersede.
Section 7. Severability: If one or more sections, subsections or sentences of this ordinance are held to be
unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this ordinance
and shall remain in full force and effect.
Section 8. This ordinance shall take effect and be in force five (5) days after its passage and publication of
its summary as provided by law.

There is an opportunity to obtain State funding for a planned action analysis of the Port's
aviation and industrial area. This analysis would support aircraft and aviation-related
manufacturing development.
These funds are available through the end of the State's biennium. This advanced planning
action will provide an environmental analysis during this study rather than at a project permit
review stage, streamlining and expediting the land use permit process. The Port believes that
completing this analysis would benefit the community by facilitating private investment in the
study area. The community would be better positioned to attract new businesses in the aerospace
industry.
Based on the benefits associated with a planned action analysis, the Port of Moses Lake would
like to request the City's support for a grant application to complete this analysis.

I Motion
The attached Ordinance amends Municipal Code 13.05 entitled "Wastewater Regulations". The
main changes include increasing the color limit for industrial process water from 15 to 100 color
units and adding an appeal process to coincide with RCW 35A.390.
The City Council may either request staff to bring this ordinance back before them for further
discussion, or make a motion at this meeting to approve the ordinance.
Background
The City set a limitation for process water of 15 color units upon recommendation from our
consultant. This was done because an industry was discharging process water with a very dark
color that was affecting the treatment plant. After further research and consideration staff
recommends increasing the limitation to 100 color units since it will not affect the treatment
plant.
RCW 35A.21.390 was enacted May, 2015 that defines an appeal process for owners of single
family residents when the city requires them to connect to the City's sewer system.

AN ORDINANCE AMENDING CHAPTER 13.05 OF THE MOSES LAKE MUNICIPAL
CODE ENTITLED "WASTEWATER REGULATIONS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Chapter 13. 05 of the Moses Lake Municipal Code entitled "Wastewater Regulations" is amended
as follows:
13.05.030 Definitions: Unless the context specifically indicates otherwise, the meaning of terms used in the
chapter shall be as provided in this section:
A "BOD" means the quantity of oxygen utilized in the biochemical oxidation of organic matter
under standard laboratory procedures during five (5) days at 20° Celsius, usually expressed
as a concentration of mg/L.
8. "Building Sewer" means the sewer service line beginning two feet from the edge of the building
and ending at the POTW's sewer main.
C. "Dangerous Waste" is defined in WAC 173-303-040.
D. "Domestic Wastewater" means water that carries human wastes, including toilet, kitchen, bath,
and laundry wastes.
E. "FOG" means polar and non-polar fats, oil, and grease that originate from animals, vegetables,
petroleum, nonbiodegradable cutting oil, and mineral oil.
F. "Force main" means a sanitary sewer main that is pressurized by a POTW lift station, or a
sanitary sewer main that is pressurized by commercial or industrial users.
G. "Garbage" means solid wastes from the preparation, cooking, and dispensing of food, and
from the handling, storage, and sale of produce.
H. "Industrial User" means a person that discharges industrial wastewater to the POTW.
I. "Industrial Wastewater" means water or liquid that carries waste from industrial or commercial
businesses. Apartment buildings containing three or more dwellings are considered a
commercial business.
J. "Interference" means a discharge alone or in conjunction with discharges by other sources that
inhibits or disrupts the POTW, or the POTW's treatment operation, or biosolids processes,
or that causes a violation of any requirement of the City's state waste discharge permit.
K. "Low Pressure Main" means a sanitary sewer main that is not pressurized by a POTW lift
station. and receives wastewater from low volume pumping systems.
1K "May" means permissive as allowed by the City Manager, City Council, Municipal Services
Director, or the Department of Ecology.
Mt:. "Medical Waste" means isolation wastes, infectious agents, blood, blood products,
pathological wastes, sharps, body parts, contaminated bedding, surgical wastes, potentially
contaminated laboratory wastes, and dialysis wastes.
,NM. "Municipal Services Director" is the director who is responsible to the City Manager for
management of the Public Works and Engineering Divisions, the supervision of departmental
employees, and for the effective administration, construction, and development of public
works, engineering, and related public facilities. The Municipal Services Director may
designate representatives to assist in the performance of these duties.
ON. "Natural Outlet" means any outlet into a watercourse, pond, ditch, lake, or other body of
surface water or groundwater .
.E.9. "Owner" means property owner, 8ftY part owner, joint owner, tenant in common, joint tenant,
tenant by the entirety, of the whole, or a part of such building or land.
QP. "Pass Through" means a discharge that exits the POTW into waters of the United States in
quantities or concentrations, alone or in conjunction with a discharge or discharges from other
sources that create a violation of any requirement of the City's state waste discharge permit.
B.G. "Person" means any individual, firm, company, association, society, corporation, or group.
§R "pH" means a measurement of the acidity or alkalinity of a solution, expressed in standard
units.
IS. "POTW" means the City owned system of gravity mains, force mains, pump stations, and
wastewater treatment plants that convey and treat wastewater.
!,ff. "Pretreatment Standards" means general discharge prohibitions, City's specific limitations on
discharge, State standards, or the National Categorical Pretreatment Standards for any
specific pollutant, whichever standard is most stringent.
:{8. "Pretreatment" means the reduction of the amount of pollutants, the elimination of pollutants,
or the alteration of the nature of pollutant properties in industrial wastewater prior to or in lieu
of introducing such pollutants into the POTW. This reduction, elimination, or alteration can
be obtained by physical, chemical, or biological processes; by process changes; or by other
means. Diluting the concentration of the pollutants is only allowed by an applicable
pretreatment standard.
WV. "Stormwater" means precipitation, groundwater, surface water, roof runoff, or subsurface
drainage.
~W. "Shall" means a mandatory requirement.
~*-"Significant Industrial User" means an industrial or commercial user that meets one or more
of the following criteria:
1. Subject to Categorical Pretreatment Standards under 40 CFR 403.6 and 40 CFR chapter
I, subchapter N.
2. Discharges an average of 25,000 gallons per day or more of industrial wastewater to the
POTW.
3. Discharges industrial wastewater that exceeds 5 percent of the average dry weather
hydraulic or organic capacity of the POTW treatment plant.
4. The Department of Ecology determines that the industrial user has a reasonable potential
for adversely affecting the POTW's operation or for violating pretreatment standards or
requirements in accordance with 40 CFR.8(f)(6).
~¥. "Slug Discharge" means any discharge at a flow rate or concentration that could cause a
violation of this chapter, and any discharge not of a routine, regular, or episodic nature.
AAl:.. "Total Dissolved Solids" means the portion of total solid in water or wastewater that
passes through a specific filter.
BBAA. "Total Suspended Solids" means the portion of total solids that are floating or suspended
in water, or wastewater; and that are removable by laboratory filtering.
CCBB. "User" means a person that is responsible for discharging wastewater to the POTW.
DDGB. "Wastewater" means domestic wastewater or industrial wastewater.
EEOO. "Waste Discharge Permit" means a permit required for every significant industrial user
granting the privilege of discharging their industrial wastewater into the POTW.
13.05.060 Private Wastewater Systems:
A. Septic tanks and alternative onsite disposal systems are prohibited for new subdivisions, except
in heavy industrial zones where sewer treatment systems and onsite disposal systems may be
allowed by City Council.
B. Wastewater systems including mains, manholes, lift stations and their appurtenances located
in private streets, binding site plans and on private property shall be privately owned.
C. The construction plans for the installation of privately owned wastewater systems that discharge
to the POTW shall be in compliance with the requirements of the Community Street and Utility
ConstFuetien Standards, and shall be approved by the Municipal Services Director prior to
construction. Furthermore, the Municipal Services Director will observe the installation of the
wastewater system. The engineer of record shall inspect and direct the contractor to assure that
the installation complies with the approved plans and specifications.
D. Before privately owned metered sewer mains and service lines connect to the POTW, a
perpetual access easement, access easement dedication on a plat, or other legal device
approved by the City Attorney is required to be accepted by the City Council to allow City staff
to access the meters and electronic reading devices.
13.05.070 Prohibited Wastes: Except as provided in this chapter, no person shall discharge wastewater to the
POTW that contains the following characteristics:
A. A Temperature greater than 104°F.
B. A FOG concentration greater than 100 mg/L.
C. Substances that can solidify or become discernibly viscous at temperatures greater than 32 °F.
D. Pollutants that could create a fire or explosive hazard in the POTW, alone or by interaction,
including waste streams with a closed-cup flashpoint of less than 140°F using the test methods
specified in 40 CFR 261 .21, 40 CFR 403.5(b)(1 ), or are capable of creating a public nuisance
per WAC 173-216-060(2)(b)(ii).
E. Solids or viscous substances that could cause an obstruction, pass th rough, or any other
interference with the operation of the POTW.
F. A pH less than 6.0 or greater than 11.0.
G. Corrosive properties capable of causing damage or that are hazardous to POTW structures,
equipment, or maintenance personnel.
H. Dangerous wastes.
I. Toxic or poisonous substances in sufficient quantity to interfere with any POTW processes, or
constitute a hazard to humans, animals, or the receiving waters of the POTW.
J. Noxious or malodorous gases or substances capable of creating a public nu isance.
K. A five (5) day BOD concentration greater than three hundred (300) mg/L.
L. A TSS concentration greater than three hundred and fifty (350) mg/L.
M. Unacceptable amounts ofTDS that could cause an interference with the normal operation of the
POTW. Limitations for TDS will be set after the Department of Ecology and the City review the
engineering reports from the prospective discharger, and investigate alternatives to reduce TDS
in the wastewater.
N. Industrial process water with a color greater than T5 100 color units.
0 . Stormwater.
P. High volumes of wastewater with a low BOD per volume ratio that could adversely affect the
treatment plants' process capabilities.
Q . Swimming pool water.
13.05.150 Requirement to Connect to the POTW:
A New Buildings: Newly constructed buildings having human occupancy, as defined in the
International Building Code, shall be connected to the POTW.
8 . Existing Buildings: The owner of an existing building having human occupancy, as defined the
International Building Code. that is all houses, buildiMgs, or properties used for humal'1
occupaMcy, employmeMt, recreatio1'1, or other purpose, situated within two hundred feet (200') of
the POTW, is required at the owner's expense to connect such facilities building directly to the
POTW within six (6) months after the date of official notice to do so. Provided that, the
connection shall not be required if the cost of making the connection, including system
development charges, exceeds ten thousand dollars ($10,000). The owner shall submit a
detailed cost estimate to the Municipal Services Director for review. The determination of the
cost of making the connection shall be made by the Municipal Services Director. The owMer caM

Services Director. The decisiol'1 of the City CouMcil shall be fiMal. Furthermore, if the owner is
not required to make a connection because of cost, at such time as the septic system fails, either
the tank or the drain field, the connection to the City's sewer system shall be required and made.
1. In accordance with RCW 35A.21.390. the owner of a single-family residence can appeal the
requirement to connect to the POTW to the City Council within ten ( 10) days after notice of
the Municipal Services Director's decision is mailed via certified mail to the owner. The
appeal shall be in writing and shall be signed by the owner by declaration under penalty of
perjury as to the truth of the matters stated in the appeal. pursuant to RCW 9A.72.085. The
written appeal notice shall contain or be accompanied by the following information:
a. Specific basis on which the owner contests the Municipal Services Director's decision .
.12.,, All documentation or other evidence supporting the owner's appeal, including any expert
testimony.
c. The current address of the owner.
st_ A brief statement of the relief sought and the reasons why the Municipal Services
Director's decision should be reversed, modified or otherwise set aside.
2. The appeal hearing before the City Council shall be scheduled for the next available City
Council meeting. and notice of the appeal hearing date shall be mailed via certified mail to
the owner at the address listed in the notice of appeal. Failure of the owner to appear and
prosecute the appeal shall constitute a waiver of the right to appeal granted under this
section. The decision of the City Council shall be final.
13.05.1 80 Discharge to the POTW: The following items are required to be completed, when applicable, prior
to discharging to the POTW:
A Application forms are submitted as follows:
1. Utility Service Request to Engineering Division.
2. Request for Utility Service to Finance Department.
B. Fees are paid as follows:
1. Utility service ehatge fee to Finance Department.
2. System development charges listed in MLMC 3.62 to Engineering Division.
3. Private reimbursement fees to Engineering Division.
4. Reimbursement fees listed in MLMC 13.08 to Engineering Division.
5. Waste discharge permit fees listed in MLMC 3.54 to Operations Division.
C. The wastewater improvements that are being dedicated to the City have been completed and
accepted by the City. The private wastewater improvements that are not being dedicated to the
City have been satisfactorily pressure tested and videoed.
D. An extraterritorial agreement is recorded at the Grant County Auditor's Office.
E. The waste discharge permits are approved executed by the City and the Department of Ecology.
F. A wastewater industrial user survey has been submitted to the Wastewater Division Supervisor
that is deemed to be complete.
13.05.210 Connection to Force Mains:
A The Municipal Service Director may allow owners to connect to a POTW force main. A valve
shall be installed on the owner's service line at the tee on the City-owned main. Furthermore,
all wastewater that contains solids must pass though a septic tank prior to being pumped into
the POTW's force main.
B. The City shall not be responsible for any backflow from the POTW into the owners service line
nor shall the City be responsible for any damages, claims. or losses resulting therefrom.
13. 05.240 Ownership: The limits of ownership for mains and building sewers that are located within the City's
right-of-way and municipal easements are defined below.
A. City-Owned Mains: The City shall have ownership of the sewer mains and appurtenances,
provided that they have been accepted by the City Council.
B. Privately Owned Mains: Owners shall retain ownership for sewer mains and appurtenances that
only serve their property, The owner's sewer main shall include all its pipe and appurtenances
up to the point of connection to a City-owned sewer main, including the wye, tee, or other
connecting device to a City-owned sewer main, but does not include the manhole that is installed
on a City-owned sewer main; and where a valve is installed to a tee on a City-owned pressure
8ewef force main, the City shall own the tee and valve, and the owner shall retain ownership of
all pipe and appurtenances upstream of the City-owned valve.
C. Gravity Bu ilding Sewers: Owners shall retain ownership for gravity building sewers, up to and

D. Pressurized Building Sewers: Owners shall retain ownership for pressurized building sewers up
to and including the wye, tee, or other connecting device to a City-owned sewer main; except that,
if a valve is installed to a tee on a City-owned sewer main, the City shall own the tee and valve and
the owner shall retain ownership of all pipe and appurtenances upstream of the City-owned valve.

Motion
Attached is an Ordinance creating Chapter 2.39, Lodging Tax Advisory Committee of the
Moses Lake Municipal Code. The Ordinance repeals Resolution 2065. The Committee is
entrusted with the responsibilities of advising and making recommendation concerning the
collection and use of lodging taxes under Chapter 67.28 RCW. The Committee shall report to
the City Council on the extent to which any proposal will accommodate activities for tourists or
increase tourism, and the extent to which any proposal will affect the long-range stability of the
special fund created for the lodging tax revenues.
Background
The provisions of Resolution 2065, A Resolution Establishing a Lodging Tax Advisory
Committee and Appointment Members Thereto, is no longer consistent with current practice
under Chapter 67.28 RCW. The proposed Ordinance brings the City of Moses Lake into current
practice and creates consistency with the Governance Coordination Manual

Fiscal and Policy Implications
The City Council must meet the requirements under RCW 67.25 in order to collect lodging
taxes. To do so, the Council should consider adopting new policies that are consistent with
current law. The fiscal implications are significant given the lodging taxes collected on an
annual basis

THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Chapter 2.39 of the Moses Lake Municipal Code entitled "Lodging Tax Advisory Committee" is
created as follows:
2.39.010 Board Created -Eligibility: There is created a Lodging Tax Advisory Committee, consisting of five
(5) members, who shall be appointed by the City Council. One (1) member shall be an elected
official of the City who shall serve as chair, two (2) members shall be representatives of
businesses required to collect the lodging tax, and two (2) members shall be persons involved in
activities authorized to be funded by revenue received from the lodging tax.
2.39.020 Membership-Appointment: Members shall be appointed for a one (1) year term. The City Council
will review the membership on an annual basis and make changes as appropriate. Upon vacancy
by death, resignation, or other cause, the Mayor, with confirmation by the City Council , shall fill the
vacancy by appointing a member to the unexpired portion of the term.
2.39.030 Removal: A member may be removed during his or her term upon a recommendation from the
Mayor and the affirmative majority vote of the City Council sitting in quorum. If a member is
unexcused from two (2) meetings per year, excuses being permitted for personal or family illness
and vacations, cause exists for removal. The member wishing to be excused from a meeting must
notify the secretary to the Lodging Tax Advisory Committee prior to the meeting. The absence
shall be announced and the reasons therefor at the time roll call is taken at the meeting and shall
be recorded as excused or unexcused in the minutes of the meeting , if minutes are taken.
2.39.040 Quorum: A majority of the Committee shall constitute a quorum for the transaction of business.
Any action taken by the majority of those present at any regular or special meeting of the
Committee is deemed and taken as the action of the Committee.
2.39.050 Meetings: The Lodging Tax Advisory Committee shall devote such time as may be necessary to
properly discharge all duties devolving upon them. The Commission members shall serve without
compensation. The Committee shall meet as often as is necessary to conduct business but shall
hold a meeting at least once a year.
2.39.060 Duties of Council to Committee: The Committee is entrusted with the responsibilities of advising
and making recommendations concerning the collection and use of lodging taxes. The City shall
submit any proposal that will impose a tax under Chapter 67.28, RCW. The City Council shall
submit to the Lodging Tax Advisory Committee, for its review and comment, proposals on:
A. The imposition of a tax under SSB 5867.
B. Any increase in the rate of such a tax.
C. Repeal of an exemption from such a tax.
D. A change in the use of the revenue received from such a tax.

4. Setting goals for short-term and long-term future of the City park system

Attached is an Ordinance that amends the City Council's current practice under MLMC 16.02.040,
Unplatted Areas, which entails requests from property owners seeking building permits on
unplatted properties. The intent of Ordinance is to reduce the frequency of the number of times
a request could come back before the Council by simply extending the duration of the approval.
The Ordinance as drafted would allow a six (6) month window of approval rather than the
current one (1) month approval.
Background
The Community Development Department receives multiple requests every year from property
owners seeking a building permit for property that is deemed unplatted in accordance to our
development regulations. Under the current Ordinance, a request that is approved by the City
Council is only valid for thirty (30) days and a building permit must be submitted within that
timeframe. Often, it is not uncommon that a party that has been given approval by the Council
has come back to the Council under the same circumstances because the thirty (30) day period
has expired.

CODE ENTITLED "BUILDING PERMITS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Chapter 16.02 of the Moses Lake Municipal Code entitled "Building Permits'; is amended as
follows:
16.02.040 Un platted Areas: No building permit or other development permit shall be issued for any lot, tract
or parcel of land divided in violation of Chapter 58.17 RCW or the platting ordinances and
regulations of the city. No building permit or other development permit shall be issued fo r any
unplatted property not otherwise permitted to be issued a building permit unless the City Council
finds that the public interest will not be adversely affected by the issuance of such a permit. The
standards to determine if the public interest will be adversely affected includes but is not limited
to consideration of the installation or existence of adequate sewer and water, conformance to lot
size requirements, existence of street, sidewalk and curb improvements, access to the site, all as
respects the proposed building site and the surrounding area. The City Council may condition the
issuance of a building permit on unplatted land on the installation or completion of such utility,
street and sidewalk improvements or other conditions as the City Council upon recommendation
of staff shall deem appropriate. The City Council shall make the grant of the privilege to build on
unplatted land specific as to the proposed building activity and personal to the applicant. The~
grant of such privilege shall expire if a building permit is not obtained within tMifty(30) days six (6)
months of the adoption of the resolution provided for herein unless the applicant requests and
obtains an additional thirty {30) day extension from the Community Development Director. Any
request for the thirty (30) day additional extension must be submitted in writing to the Community
Development Director prior to the expiration of the six (6) month limitation period. The Community
Development Director has the discretion to grant the additional extension only when no significant
development code changes have occurred or will occur during the extension period, there is
demonstrable proof of substantial progress made by the applicant, and the request serves the
public health, safety and welfare. No more than one (1) thirty (30) day additional extension may
be granted to any applicant. The City Council shall only direct the issuance of such a permit by
a resolution of the City Council. The following construction is exempt from City Council resolution:
A. Remodeling of an existing, conforming building.
B. Construction o fa temporary structure.
C. Fences
D. Signs
Section 2. This ordinance shall take effect and be in force five (5) days after its passage and publication of

Attached is an ordinance that amends Moses Lake Municipal Code 3.62, entitled "Utility System
Development Charges". This would update the system development charges to reflect the 2015
consumer price index (CPI), which is 1.8%, in accordance with MLMC 3.62.021.
Background
Utility System Development Charges are only charged when a property owner requests a new connection
to City's water or sewer system. System development charges were established in 1995 to help finance
water and sewer improvements. The rate indexing per the CPI started in 2009.
Fiscal and Policy Implications
The CPI increase will keep up with inflation and maintain the same purchasing value for future
improvements to the City's water and sewer systems.

The Smoothery, a real fruit smoothie concessionaire, has requested authorization to vend at the
"Rattler Roundup" Girls Fastpitch Softball Tournament on May 21 & 22. The group was invited to
participate by the tournament organizers.
Background
Up until 2014, the Parks and Recreation Department provided on-site concessions at both
baseball/softball complexes. As a result of budget circumstances, funding was not available to
continue operating our "in-house" concession outlets at these fields. Currently, we are advising
tournament organizers that we are unable to provide those services and they would be best
served by utilizing outside vendors for food and beverage sales. Current city municipal code
requires City Council approval of all "for-profit" operators.
