Motion
The Grant County Economic Development Council Board of Directors is requesting the Mayor
with a confirmation from Council to appoint a City Council Member to serve on the Grant County
EDC Board of Directors.
Background
Council Member Mike Norman was appointed January 26, 2016 to serve on the board as a
representative of the Moses Lake City Council and at this time, he has formally requested to step
down from this position. His very busy schedule will not allow him to fulfil his three (3) year term.
Mayor Todd Voth has selected Deputy Mayor Karen Liebrecht to fill this vacant position with the
Grant County Economic Development Council Board of Directors for the remaining time of this
term.

The regular meeting of the Moses Lake City Council was called to order at 7 p.m. by Mayor Voth in the Council
Chambers of the Civic Center, 401 S. Balsam, Moses Lake, Washington.
Executive Secretary Sophia Guerrero called the roll. The following were:

PLEDGE OF ALLEGIANCE: Ava Voss and Joelee Green-Cerrillo, Endeavour Soccer Academy, led the
Council in the flag salute.
SUMMARY REPORTS
CERTIFICATION OF ACHIEVEMENT -ENDEAVOUR SOCCER ACADEMY
A Certificate of Achievement was presented to members of the Endeavour Soccer Academy for their bronze
finish in the 2016 Washington Cup Spring/Puget Sound Premier League.
PARKS AND RECREATION COMMISSION
Mayor Voth requested Council confirmation of the re-appointment of Tiffany Quilter to the Parks and
Recreation Commission.
Action Taken: Mrs. Liebrecht moved thatthe re-appointmentofTiffany Quilter be confirmed, seconded by Mrs.
Leonard, and passed unanimously.
WELL CITY
John Williams, City Manager, stated that the City has met the AWC Trust's WellCity standards and earned
a 2% discount on medical premiums for 2016. The following City employees who work on the Wellness
Committee and work on the Wellness events were recognized -Billie Jo Munoz, Freya Liggett, Rick
Rodriguez, Tasiya Oliver, Levi Bisnett, Olivia Martinez, Richard Bisnett, and Tanyaa Haines.
CONSENT AGENDA
Minutes: The minutes of the May 24 meeting were presented for approval.
Approval of Claims. Prepaid Claims, Checks, and Payroll: Vouchers audited and certified by the Finance
Director as required by RCW 42.24.080, and those expense reimbursement claims, certified as required by
RCW 42.24.090, have been recorded on a listing which has been made available to the Council for approval
and is retained for public inspection at the Civic Center. As of June 14, 2016 the Council does approve for
payment claims in the amount of $1,347,354.10; prepaid claims in the amounts of $115,611 .79 and
$56,316.22; claim checks in the amount of $1,569,516.46; and payroll in the amount of $352,482.58.
Cascade Park Preliminary Major Plat and Findings of Fact: The City of Moses Lake submitted an application
for a preliminary plat to subdivide 38.32 acres into 3 lots. The site is located in Cascade Valley. The site is
zoned Public, which corresponds with the underlying Comprehensive Plan Land Use Designation of public.
The Planning Commission recommended that the preliminary plat be approved with conditions.
Resolution -Accept Deed -Bernhardt: A resolution was presented which accepts a deed from William and
Deena Bernhardt and Scott Bernhardt for an activity trail located adjacent to the Bernhard Major Plat.
Resolution -Accept Improvements -Barrington Point 3 Major Plat: A resolution was presented which accepts
the street and utility improvements constructed as part of the Barrington Point 3 Major Plat.
Action Taken: Mr. Norman moved that the Consent Agenda be approved, seconded by Mr. Curnel, and
passed unanimously.

PUBLIC HEARINGS
ORDINANCE -VACATE RIGHT-OF-WAY -BLANCHET AVENUE
An ordinance was presented which vacates a portion of Blanchet Avenue adjacent to Lot 1, Block 1, HLH Plat.
The ordinance vacating a portion of right-of-way was read by title only.
Gilbert Alvarado, Community Development Director, gave some history of the vacation of Blanchet Avenue
and explained the process and the fact that the City has requested one half the appraised value of the vacated
property.
The public hearing was opened. There were no comments, so the public hearing was closed.
OLD BUSINESS
ORDNANCE -AMEND 10.12 -PARKING REGULATIONS -2N° PRESENTATION
An ordinance was presented which amends the parking regulations by prohibiting parking and unloading on
both sides of Knolls Vista Drive from Stratford Road to Northshore Drive, the north side of Nelson Road from
Division Street to Baker Street, the south side of Nelson Road from Division Street to Skyline Drive, and in
the roundabouts.
The ordinance amending Chapter 10.12 of the Moses Lake Municipal Code entitled "Parking Regulations" was
read by title only.
Action Taken: Mr. Norman moved that the ordinance be adopted, seconded by Mrs. Leonard, and passed
unanimously.
NEW BUSINESS
ORDINANCE -CREATE 5.12 -SPECIAL EVENTS
An ordinance was presented which creates an administrative process for approving or denying special events
held within the City.
John Williams City Manager, and Gilbert Alvarado, Community Development Director, provided some
background on the existing process and the proposals to streamline that process.
There was considerable discussion by the Council.
RESOLUTION -ACCEPT GRANT -PAUL LAUZIER FOUNDATION
A resolution was presented which accepts a $30,000 grant from the Paul Lauzier Charitable Foundation. The
funds are to be used to repair and improve the fire training facility at Fire Station 1.
The resolution accepting a grant of $30,000 from the Paul Lauzier Charitable Foundation was read by title
only.
Brett Bastian, Acting Fire Chief, explained that the burn facility was in such disrepair that it was demolished.
The funds will be used to purchase sea-going connex boxes that will be retrofitted as a burn facility at the
existing training tower. Repairs will also be made to some of the training props in the training tower and the
car fire prop.
Action Taken: Mr. Ecret moved that the resolution be adopted, seconded by Mr. Curnel, and passed
unanimously.
RESOLUTION -ACCEPT DONATION -MOSES LAKE ADULT HOCKEY ASSOCIATION
A resolution was presented which accepts a $1,000 donation from the Moses Lake Adult Hockey Association.
The funds are to be used towards the purchase of additional storage sheds for the ice rink.

by title only.
Action Taken: Mrs. Leonard moved that the resolution be adopted, seconded by Mr. Curnel, and passed
unanimously.
DISCHARGE TO SEWER -FARWEST STEEL CORPORATION
Tom Seevers, Operations Manager, Farwest Steel Corporation, requested permission to discharge water from
their tank that is used for their steel cutting operations through a hose and into a privately owned manhole that
discharges to the City's sewer system. The discharge will be up to 10,000 gallons per occurrence that will
happen up to three times per year. The initial water test results showed no adverse impacts on the City's
system.
Mr. Seevers stated that they have been in business since 2000 and explained the use of water in their
process.
There was some discussion by the Council.
Action Taken; Mr. Ecret moved that the request be granted, seconded by Mrs. Leonard, and passed
unanimously.
ADMINISTRATIVE REPORTS
RETAIL CONFERENCE
Gilbert Alvarado, Community Development Director, reported on the Retail Conference that was attended by
City staff and various agencies. He mentioned that there were meetings with 50 companies and at least 19
potential business interested in Moses Lake.

Motion
Attached are the Crossroads North Phase 2 Final Plat, Findings of Fact as recommended by the
Planning Commission. The Planning Commission considered the Final Plat at their June 16, 2016
regular meeting and approved the final plat as presented with conditions. See attached
Background
The proposed plat is a 33-lot residential plat. The property is being subdivided so that houses can
be built and lots can be sold. The development is a continuation of the Crossroads and
Crossroads North developments.

FINDINGS OF FACT, CONCLUSIONS, AND
DECISION
1. HEARING BEFORE THE PLANNING COMMISSION.
1.1 Date. A public meeting was held upon proper notice before the Commission on June 16,
2016.
1 .2 Proponent. Hayden Homes is the proponent of this plat.
1.3 Purpose. The proponent has submitted a 33-lot final plat for property which is legally
described upon the plat. City staff has confirmed the property described on the plat is the
property submitted for platting.
1.4 Evidence. The Commission considered the following materials in reaching its decision:
A. The final plat submitted May 13, 2016.
B. Staff report and attachments.
2. FINDINGS OF FACT BY THE PLANNING COMMISSION.
Based upon the evidence presented to them, the Commission makes the following findings of fact:
2.1 The proponent is the owner of the property.
2.2 The property is currently zoned R-1, Single Family Residential.
2.3 The layout of the final plat conforms to the approval conditions of the preliminary plat.
2.4 There are some issues that the proponent needs to resolve with the East Columbia Basin
Irrigation District and Bureau of Reclamation.
2.5 Corrections are needed, as noted in the comments of the Development Engineer.
3. CONCLUSIONS BY THE PLANNING COMMISSION.
From the foregoing findings of fact the Commission makes the following conclusions:
3.1 The Planning Commission of the City of Moses Lake is vested with the authority to determine
approval of plats.
3.2 It is in the best interests and welfare of the city's citizens to plat the property as proposed.
3.3 Conditions are required to ensure that the final plat conforms to the approval conditions of
the preliminary plat.
3.4 Conditions ensure that the required fees and reimbursements will be collected prior to the
City recording the plat with the Grant County Auditor.
3.5 Conditions ensure that the required street frontage landscaping will be installed prior to a
Certificate of Occupancy being issued for each lot.
4. DECISION OF THE PLANNING COMMISSION.
On the basis of the foregoing findings of fact and conclusions, it is the recommendation of the
Planning Commission that the plat be approved with the following conditions:
4.1 The comments of the Development Engineer, USSR, and ECBID shall be add ressed.
4.2 The plat shall not be recorded until the city fees and reimbursements are paid to the City of
Moses Lake.
4.3 The required covenant for cul-de-sac improvements shall be recorded with the plat.

1. HEARING BEFORE THE PLANNING COMMISSION.
1.1 Date. A public meeting was held upon proper notice before the Commission on May 12,
2016.
1.2 Proponent. Busby International Inc. is the proponent of this plat.
1.3 Purpose. The proponent has submitted a final plat application to create one platted lot of
47.94 acres for property which is legally described upon the plat. City staff has confirmed the
property described on the plat is the property submitted for platting.
1.4 Evidence. The Commission considered the following materials in reaching its decision:
A. The final plat submitted March 31, 2016.
B. Staff report and attachments.
2. FINDINGS OF FACT BY THE PLANNING COMMISSION.
Based upon the evidence presented to them, the Commission makes the following findings of fact:
2.1 The proponent is the owner of the property.
2.2 The property is zoned Heavy Industrial.
2.3 There were no significant changes between the preliminary plat and final plat.
2.4 Corrections to the drawing are needed, as noted in the comments from the Development
Engineer and East Columbia Basin Irrigation District.
2.5 A deferral of street improvements was granted with the preliminary plat, with the stipulation
that a covenant for the improvements in the future be recorded with the plat.
3. CONCLUSIONS BY THE PLANNING COMMISSION.
From the foregoing findings of fact the Commission makes the following conclusions:
3.1 The Planning Commission of the City of Moses Lake is vested with the authority to determine
approval of plats.
3.2 It is in the best interests and welfare of the city's citizens to plat the property as proposed.
3.3 Conditions are needed to ensure the plat is accurate.
3.4 With conditions, the final plat is consistent with the preliminary plat approval.
4. DECISION OF THE PLANNING COMMISSION.
On the basis of the foregoing findings of fact and conclusions, it is the recommendation of the
Planning Commission that the plat be approved with the following cond itions:
4.1 The comments of the Development Engineer shall be addressed before the plat is recorded.
4.2 The comments of the East Columbia Basin Irrigation District shall be addressed before the
plat is recorded.
4.3 The required covenant for street improvements shall be recorded with the plat.

Motion
The attached Resolution abandons the easement that City accepted for the on-site watermain and fire
hydrants, as shown on the attached map. Mike Mansfield, President of Busby International Inc. and staff
agree that that the easement should be abandoned and the ownership of the watermain and fire hydrants
should be transferred back to Busby International. This would change the ownership of the on-site water
main to private, which complies with MLMC 17.18.020.A.8.
Background
In 1991, The City accepted an easement, and the onsite watermain and fire hydrants, as shown on the
attached drawing. This was the policy at that time. Now, Moses Lake Municipal Code 17.18 .020.A.8
requires all improvements in a binding site plat to be privately held. The property is in the process of being
platted with a binding site plan.
Fiscal and Policy Implications
The City would not be required to maintain the watermain and fire hydrants.

A RESOLUTION AUTHORIZING ABANDONMENT OF AN EASEMENT
RECITALS:
1. The City of Moses Lake has received a request from Busby International, Inc. to abandon the
following described easement:
A portion of Farm Unit 76, Irrigation Block 41 in the south half of Section 18, Township 19 North,
Range 29 East Willamette Meridian, Grant County, Washington.
Said easement is 20 feet wide; 10 feet of said width lying either side of the following described line:
Beginning at the Southeast corner of said Section 18; thence North 89°44'10" West along the
Southerly line of said Section 18 and the center line of Wheeler Road a distance of 2,313.46 feet;
thence North 00°15'50" East a distance of 40.00 feet to the Northerly right of way of Wheeler Road
and the true point of beginning; thence continuing North 00°15'50" East a distance of 660 feet to the
terminus of said line.
Containing 0.30 acres more or less.

RESOLVED:
1. The City Council of the City of Moses Lake does resolve that the easement described above will be
abandoned, the existing water line is transferred to Busby International, Inc., and that the City
Manager is authorized to execute the necessary documents in order to accomplish the abandonment.

This is to notify you that Busby International Inc. agrees to accept and understand
ownership and future maintenance of the waterline pipe and appurtenances
extending from Wheeler Road into Busby International Inc. will be transferred
from the City to Busby International Inc. This is done to be in compliance with
current City policy. Upon receipt of this letter, the City will proceed to release the
easement under AFN 850414 and provide a resolution that transfers ownership of
the water line to Busby International Inc.

Motion
Attached is a copy of the proposed Industrial Waste Discharge Permit No. 10 for the Moses Lake Industries,
Inc. facility. Staff discussed the permit with representatives from Moses Lakes Industries and then
prepared the waste discharge permit, which closely resembles the permit that has been issued by the
Department of Ecology. Patrick J Blau, EHSS Manager representing Moses Lake Industries, has signed the
proposed permit.
Background
Moses Lake Industries is a significant Industrial User and is required to have an Industrial waste discharge
permit from the Department of Ecology and the City of Moses Lake. All discharge permits expire in five
years and are required to be renewed to continue discharging to the City's wastewater system.

EFFECTIVE DATE: October 1, 2015
EXPIRATION DATE: September 30, 2020
This wastewater discharge permit is issued by the City of Moses Lake (City) to Moses Lake Industries, INC (Permittee). This permit
is compatible with Permit No.ST-0005375 issued by Washington State Department of Ecology (Ecology). This permit authorizes the
Permittee to discharge process and sanitary wastewater from their Moses Lake facility at 8248 Randolph Road NE to the City's
POTW in accordance with the conditions of this permit. The permit becomes effective as of the date signed.
GENERAL CONDITIONS
1. All discharges and activities authorized by this permit shall be consistent with the terms and conditions of this permit. The
discharge of any wastewater with discharge rates or characteristics that exceed this permit shall constitute a violation of the
terms and conditions of this permit. Whenever the Permittee refuses to take corrective action or continues to violate terms
and conditions of this permit, the City may impose civil penalties; terminate this permit, or both. Termination of this permit
may require disposal of the process wastewater in some manner other than into the private sewer or side sewer tributary to
the POTW, at the expense of the Permittee.
2. All facility changes that could result in a significant deviation in the permitted characteristic of pollutants discharged to the
POTW shall be reported to the City. Significant adverse deviations in characteristics of pollutants shall be submitted to the
City for review and approval before discharging to the POTW. No significant change shall be made until plans have been
approved by the City, and a new or modified permit has been issued. This permit does not authorize new connections,
increased flows.
3. The diversion or bypass of any discharge from any pre-treatment facility, utilized by the Permittee to maintain compliance
with the terms of this permit, is prohibited, except where unavoidable to prevent loss of life, severe property damage, or as
provided in the SPECIAL CONDITIONS of this permit. The procedures outlined in Paragraph 4 of the GENERAL
CONDITIONS shall be followed in the event of such a diversion or bypass to the POTW.
4. In any event that causes a violation of the discharge rates or characteristics authorized by this permit, the Permittee shall take
the following actions:
a. Immediately stop, contain, and clean up the unauthorized discharge and correct the problem.
b. Immediately notify the City so steps can be taken to prevent damage to the POTW.
c. Submit a written report within fifteen (15) business days of the event, describing the breakdown, the actual quantity
and quality of the resulting discharge, the corrective action taken, and the steps taken to prevent a recurrence.
d. Pay reasonable costs incurred by the City that are associated with a breakdown, accident, or other cause that is
attributable to such event.
e. Pay a penalty for each occurrence of non-conformance with the conditions of this permit, as may be assessed in
accordance with the Moses Lake Municipal Code.

5. Compliance with the above requirements does not relieve the Permittee from responsibility to maintain continuous
compliance with the conditions of this permit or the resulting liability for failure to comply.
6. The Permittee shall adequately maintain and efficiently operate all treatment and control facilities or systems installed or used
by the Permittee to achieve compliance with the terms and conditions of this permit.
7. If any of the following findings have been discovered or reported to the City, the City will provide a written notice to the
Permittee. The written notice by the City will describe the findings and any actions that will be taken by the City or required
of the Permittee. In addition to actions previously described in ]tern 4, the permit may be amended, suspended, or revoked in
whole or in part. Within ten (10) business days of receiving the written notice, the Permittee may request a hearing before
the City Council, to dispute the findings or to request a revision to actions described. The City Council's determination will
be final.
a. Violation of any terms or conditions of this permit.
b. Obtaining this permit by misrepresentation or failure to fully disclose all relevant facts.
c. A change in any condition that requires a permanent reduction or elimination of wastewater discharge to the POTW.
8. The Permittee shall allow authorized representatives of the City to perform the following actions:
a. Enter portions of the premises where effluent sources, disposal systems, or records are kept. If an escort for the
premises is requested by either the City or the Permittee, the Permittee shall provide the escort.
b. Inspect monitoring equipment and monitoring methods required by this permit.
c. Sample any effluent or pollutants that discharge to the POTW.
d. Review test results and test methods.
9. The Permittee shall comply with all current federal, state, and local statutes, ordinances, and regulations. If the State's Waste
Discharge Permit is revised to require more stringent limits on the Permittee's discharge to the POTW, the requirements of
this permit may be revised by the City by providing written notice to the Permittee.
10. Within ten (10) business days ofreceiving the written notice ofrevisions by the City, the Permittee may request a hearing
before the City Council, to dispute the revisions. Depending on the magnitude of the changes, the Permittee, City, and
Ecology may negotiate a compliance schedule that will allow the Permittee to implement the required revisions over a
specified period.
11. This permit does not authorize discharge into public waters of Washington State. Any discharge to public waters of
Washington State is subject to applicable regulations administered by Ecology.
12. Costs incurred by the City in handling, treating, monitoring, and disposing of the Permittee's process wastewater shall be
borne by the Permittee in the rate structure set forth by the City. The City may set forth the various fees in accordance with
the Moses Lake Municipal Code.
13. The Permittee shall submit an application to the City for permit renewal at least 180 days prior to the expiration date of the
permit. In the event that the City does not respond within the allotted 180 day period, the existing permit shall remain in
force until the revised permit is issued. The copy of an application from the permittee to Ecology for permit renewal with the
same expiration and renewal dates will suffice as an application for renewal of the Municipal Industrial Waste Discharge
Permit.
13. The Permittee shall pay fees associated with this permit as established by the Moses Lake Municipal Code. The City may
revoke this permit ifthe permit fees are not paid.

Special Conditions
To determine the level of corrosion attributable to the process wastewater discharge, the City may require the Permittee to develop a
corrosion monitoring system. The system shall consist of metal samples or other material placed in pipes, wet wells of pump stations,
and other appropriate locations affected by the process wastewater discharge. By comparing the rate of corrosion with the rate of
control samples placed in wastewater not affected by the process wastewater discharge, any increases in the rate of corrosion may be
monitored. Such analyses of samples shall be carried out periodically by a firm experienced in corrosion testing and evaluation. All
analyses and tests shall be at the Permittee's expense. Such analyses and tests shall be performed in a manner and at locations that are
acceptable to both the Permittee and the City. Based upon the analyses, the Permittee shall pay for damages to the POTW and for
additional protective measures to the POTW, including any or all of the following items: installation of cathodic protection systems;
installation of protective linings for pipes, manholes, and tanks; replacement of equipment, pipes, and appurtenances; structural
modifications; and other measures as directed by the City.
The biological and physical operations at the City's wastewater treatment plant shall not be impaired by the Permittee's wastewater
discharge. The City's wastewater treatment plant is an extended aeration activated sludge system. Processes at the plant include
influent pH & conductivity monitoring, grit removal, aeration, clarification, solids removal, flow measurement, ultraviolet (UV)
disinfection, and infiltration. If the City determines that any biological or physical processes in the wastewater treatment plant are
negatively impacted by the Permittee's process wastewater discharge, the Permittee shall immediately take actions on the Permittee's
operations to ensure proper operation of the wastewater treatment plant.
Effluent Limits
During the period of this permit, the Permittee is authorized to discharge process and sanitary wastewater to the POTW, subject to the
specified flow, concentration, and monitoring requirements. Process and sanitary wastewater shall be monitored and discharged to the
POTW and shall not exceed a maximum daily flow of27,000 gallons per day and a maximum monthly average of 18,000 gallons per
day. Effluent limits for industrial discharge are listed in Table 1: Effluent Limits. Outfall 00 I. Outfall 001 is the first manhole
upstream of the private onsite lift station, receiving no domestic wastes. Limits shown in Table 001 correspond with State discharge
permit No. ST-005375. Effluent limits for the discharge to the POTW, which include the additional domestic wastes from the facility,
are shown in Table 2: Effluent Limits, Outfall 002. Outfall 002 is the first manhole upstream from the POTW, after which no
additional effluent is added from the Permittee.
Limits of effluent characteristics that are not specifically listed in this permit shall be as set forth in City of Moses Lake Municipal
Code, Chapter 13.05, Sewer Regulations, as of the date of this permit.
In order to meet the effluent limits, the Permittee shall provide facilities as specified herein. When required, pretreatment and storage
facilities shall be designed and operated by the Perrnittee in a manner such that the wastewater is in compliance with the flow and
concentration limits established herein. During emergency conditions, or when the effluent cannot meet the conditions of this permit,
the Permittee shall divert the flow, collect the wastewater, and re-treat the effluent. If the effluent limits cannot be achieved by the
onsite treatment system, the Permittee shall collect the effluent and send it off site for disposal in accordance with applicable
regulations.
Beginning on the date of issuance and lasting thru the expiration date of this permit, the Permittee is authorized to discharge process
and sanitary wastewater to the POTW subject to the following limits:

Continuous means the uninterrupted except for brief length oftime for calibration, power failure, or unanticipated equipment

Conductivity measurements, the Permittee shall sample twice per day when continuous monitoring is not possible.

Sampling and Analytical Procedures
Samples and measurements taken to meet the requirements of this permit shall be representative of the volume and nature of the
monitoring parameters, including representative samples of unusual discharges or discharge conditions such as bypasses, upsets, and
maintenance-related conditions affecting effluent quality.
Sampling and analytical methods used to meet the water and wastewater monitoring requirements specified in this permit shall
conform to the latest revision of the following rules and documents unless otherwise specified in this permit or approved in writing by
Ecology.
1. Guidelines Establishing Test Procedures for the Analysis of Pollutants Contained in 40 CFR part J 36
2. Standard Methods for the Examination of Water and Wastewater (APHA)
Flow Measurement, Field Measurement and Continuous Monitoring Devices
The Permittee shall:
1. Select and use appropriate flow measurement, field measurement, and continuous monitoring devices and methods
that are consistent with accepted scientific practices.
2. Install, calibrate, and maintain these devices to ensure the accuracy of the measurements is consistent with the accepted
industry standard, the manufacturer's recommendation, and approved O&M manual procedures for the device and the
waste stream.
3. Calibrate continuous monitoring instruments monthly, unless a longer period is acceptable to the City, based on
monitoring records.
4. Use field measurement devices as directed by the manufacturer. Reagents shall not be used beyond their expiration dates.
5. Establish a calibration frequency for each device or instrument in the O&M manual that conforms to the frequency
recommended by the manufacturer.
6. Verify flow-monitoring devices at least once per year, or as otherwise specified by the manufacturer.
7. Maintain calibration records for at least three years.
Reporting and Record Requirements
The Permittee shall monitor and report in accordance with the conditions set forth in this permit. Falsification of the information
submitted to Ecology or to the City is a violation of the terms and conditions of this permit.
Monitoring results required by this permit shall be either submitted by E-mail or by paper form by the 15th day of the month following
the sampling period. A copy of the DMR in Ecology "Paris" format will be accepted so Jong as it is accompanied by the electronic
signature form.

Records Retention
Records of all monitoring information shall be retained by the Permittee for at least three (3) years, and longer as required by litigation
or as request by the City. Such information shall include all calibration and maintenance records, all original recordings for
continuous monitoring instrumentation, and copies of all reports required by this permit.
Laboratory accreditation
The Permittee shall ensure that all monitoring data is prepared by a laboratory registered or accredited under the provisions of Chapter
173-50 WAC, "Accreditation of Environmental Laboratories". However, flow, temperature, settleable solids, conductivity, pH, and
internal process control parameters are exempt from the accreditation requirements of Chapter 173-50; but, the Permittee shall obtain
accreditation for conductivity and pH if accreditation or registration is required for other parameters.
Request for Reduction in Monitoring
The Permittee may request a reduction of the sampling frequency after twelve (12) months of monitoring. The City will review each
request, and if approved, the reduction will be either included when the permit is reissued, or by a permit modification.
To request a reduction in the sampling frequency, the Permittee shall provide the following to the City:
1 . Provide a written request.
2. Clearly state the parameters for which reduced monitoring is requested.
3. Clearly state the justification for the requested reduction.
Waste Preventative Practices
The following methods shall be used by the Permittee to reduce or eliminate contaminant loading to the POTW:
I. Chemicals shall be stored in a manner that will prevent entry of these solutions into the POTW or waters
of the state. All chemicals shall be stored using best management practices.
2. Pretreatment and storage systems shall be maintained continuously by the Permittee, in satisfactory and effective
operational condition , and shall be accessible to the City at all times.
3. The Permittee shall designate a representative whose responsibilities shall include the operation and maintenance of
pretreatment and storage facilities, monitoring requirements, permit compliance, and all other aspects of the process
wastewater discharge. The City may contact the designated representative, at any time, to discuss matters related to the
process wastewater discharge to the POTW.
4. The Permittee is liable for all damages directly attributable to its wastewater discharge, exclusive of normal wear and
tear. Permittee shall not be jointly and severally liable for the damage caused by any other party, but shall only be
liable for its pro-rata share of damages that are directly attributable to the Permittee's wastewater discharge.
Attributable damages include those that may be caused by the wastewater collection system, pump stations, wastewater
treatment plant, receiving water degradation, or any combination of these items.
5. Jn the event that a hazardous petroleum or radioactive material spill reaches the POTW, the Permittee shall notify the
City immediately.

GLOSSARY
City: The City of Moses Lake, a municipal corporation of the State of Washington, or its duly authorized agents or representatives.
Composite Sample: A mixture of grab samples collected at the same sampling point at different times, formed either by continuous
sampling or by mixing discrete samples. May be time-composite (collected at constant time intervals) or flow-proportional (collected
either as a constant volume at time intervals proportional to stream flow or collected by increasing the volume of each aliquot as the
flow increased while maintaining a constant time interval between the aliquots.
Constituent: Any of the pollutants or potential pollutants found in the process wastewater.
Effluent Limits: Flow, concentration, pH and mass loading limits for wastewater discharged to the POT W by the Permittee.
Environmental Protection Agency: Federal environmental regulatory agency.
Equalization Basin: The Permittee's final containment structure for process wastewater to be discharged to the POTW.
Hazardous Material: Any of the dangerous or extremely dangerous wastes identified in the Washington Administrative Code Chapter
173-303.
Monitoring: The program of flow and constituent determination outlined to insure compliance with the effluent limits and to define
the flow and constituent levels in an expanded scope for the wastewater discharged to the POTW.
Permittee: Moses Lake Industries, INC
POTW: The system of gravity sewers, force mains, pumps stations, and wastewater treatment plant owned by the City.
Pre-treatment and Storage: The facilities designed, constructed, and operated by the Permittee to alter process wastewater, prior to
discharging to the POTW, to comply with the effluent limits.
Process Wastewater: Water discharged as a by-product of any of the various industrial processes.
Radioactive Waste: Any materials defined as radioactive in the Washington Administrative Code, Title 246 or appropriate Federal
regulations.
Sanitary Wastewater: Wastewater generated by non-industrial activities, typically, domestic wastewater.

Set Date for Public Hearing
Six-Year Transportation Improvement Program
Legislative History:

Motion
The City Council should consider setting the date for a public hearing for the July 12 City Council meeting
to discuss the City's Six-Year Transportation Improvement Program (TIP). The public hearing was originally
set for the June 28 City Council meeting. However, the notice for the public hearing was not submitted to
the Columbia Basin Herald in time for the June 28th meeting.
Background
Annually the City is required to present the TIP to the public and allow comments to be heard and
incorporated into the program. The TIP is then submitted to Regional, State, and Federal planning
organizations to form lists of transportation needs.
Fiscal and Policy Implications
Only projects listed on the City TIP are el igible for Federal Funding. If a TIP is not approved, the City will not
be eligible to receive any Federal transportation grants.
