The meeting was called to order at 7 p.m. by Mayor Deane.
PLEDGE OF ALLEGIANCE: Mr. Ecret led the Council in the flag salute.
PRESENTATION AND AWARDS
POLICE DEPARTMENT
Jack Dodson, Randy Moore, Edgar Salazar, and Omar Ramirez were introduced to the Council and given the
oath of office as a Police Officer.
CONSENT AGENDA
Minutes: The minutes of the August 11 meeting were presented for approval.
Approval of Claims, Prepaid Claims. Checks, and Payroll: Vouchers audited and certified by the Finance
Director as required by RCW 42.24.080, and those expense reimbursement claims, certified as required by
RCW 42.24.090, have been recorded on a listing which has been made available to the Council for approval
and is retained for public inspection at the Civic Center. As of August 25, 2015 the Council does approve for
payment claims in the amount of $1,481,356.41 ; prepaid claims in the amounts of $85,816.83, $190,298.98,
and $100, 796.11 ; claim checks in the amount of $1 ,629,305.55; and payroll in the amount of $338, 103.58.
Moses Lake Industries Final Major Plat and Findings of Fact: Moses Lake Industries has submitted a final
plat application for a one-lot plat of 86.946 acres at 8242 Randolph Road, the location of the existing plant.
The site is zoned Heavy Industrial, which corresponds with the Comprehensive Plan Land Use Designation
of Industrial. There have been no significant changes from the preliminary plat. The Planning Commission
recommended that the final plat be approved with conditions.
Resolution -Accept Easement -Russell Major Plat: A resolution was presented which accepts an access
easement for the Russell Major Plat, Lot 2, Block 1, Commercial Bindings Site Plan 2nd Amendment.
Action Taken: Mr. Ecret moved that the Consent Agenda be approved, seconded by Mr. Avila, and passed
unanimously.

ORDINANCES AND RESOLUTIONS
ORDINANCE -AMEND ZONING MAP -1sr READING
An ordinance was presented which changes the zoning of 190 parcels in the downtown area from C-2,
General Commercial and Business, to C-1A, Transitional Commercial Zone.
The ordinance changing the official zoning map was read by title only.
Gilbert Alvarado, Interim City Manager, gave the background on the proposed new zone and the reasons for
the changes.
Action Taken: Mr. Lane moved that the first reading of the ordinance be adopted, seconded by Mrs. Liebrecht,
and passed unanimously.
City Council Minutes: 2 August25, 2015
ORDINANCE AMEND 18.30 -COMMERCIAL ZONES - 1sr READING
An ordinance was presented which amends the Commercial Zones by including a new C-1A, Transitional
Commercial, Zone.
The ordinance amending Chapter 18.30 of the Moses Lake Municipal Code entitled "Commercial Zones" was
read by title only.
Gilbert Alvarado, Interim City Manager, explained that the changes deal with the newly created C-1A Zone.
Action Taken: Mr. Ecret moved that the first reading of the ordinance be adopted, seconded by Mr. Voth, and
passed unanimously.
ORDINANCE -GARBAGE RATES -SINGLE READING
An ordinance was presented which establishes new garbage collection rates. The rates take effect
September 9 and reflect the increases in the contractor fee set forth by contract.
Bob Taylor, Finance Director, stated that the proposed increase in the garbage rates coincides with the
increase in the rates charged by the garbage contractor. He pointed out that the rates charged by the garbage
collectors to the City are automatically increased by the increase in the CPI and by adopting the new rates for
the City's customers at this time, changes to the rates will only have to be made once.
Ryann Leonard, 905 Sand Dune, felt that the citizens should be notified and was concerned that the rates
would be passed on a single reading.
Gilbert Alvarado, Interim City Manager, pointed out that historically the public has not been notified of changes
in the garbage rates.
Dr. Curnel was concerned that a financial situation is not an emergency with regard to the public health,
safety, property, or peace.
Katherine Kenison, City Attorney, explained that there is no state law that requires the City to have two
readings of an ordinance. The requirement for two readings of an ordinance was self imposed by the Council
many years ago. The Council can determine if an emergency exists and adopt an ordinance on a single
reading.
Action Taken: Mr. Ecret moved that an emergency be declared and the ordinance be adopted on a single
reading, seconded by Mrs. Liebrecht, and passed with Dr. Curnel opposed.
Mr. Ecret directed staff to provide notification to the citizens of the increase on the utility bills and also direct
them to the website where the increase can be explained.
RESOLUTION -NUISANCE ABATEMENT -2603 TEXAS
A resolution was presented which provides for the abatement of nuisances at 2603 Texas, owned by Dorothy
Hester.
Gilbert Alvarado, Interim City Manager, stated that the lot is in the process of being cleaned up and
recommended that the hearing be continued to the next Council meeting to give the property owner an
opportunity to complete the clean up.
Action Taken: Mrs. Liebrecht moved that the hearing be continued to the next Council meeting, seconded by
Dr. Curnel, and passed unanimously.
REQUEST TO CALL FOR BIDS
MAE VALLEY SEWER IMPROVEMENT PROJECT-REBID
Staff requested authorization to call for bids for the 2015 Mae Valley Sewer Improvement Project-Rebid. The
project includes installing 1,850' of 12" force main through Blue Heron Park and 1,800' of 18" gravity sewer

main in Westshore Drive, decommissioning the existing Montana Sewer Lift Station, and constructing the new
Blue Heron Lift Station.
Action Taken: Mrs. Liebrecht moved that staff be authorized to call for bids, seconded by Mr. Lane, and
passed unanimously.

OTHER ITEMS FOR COUNCIL CONSIDERATION
DEVIATION REQUEST -PUD -UNDERGROUND UTILITIES
The Grant County PUD requested a deviation of the requirement to place new electrical distribution and
transmission lines underground for fiber optic cable to connect the Rocky Ford substation with the Dover
Substation Project and their Wheeler Tap to the Warden Substation Project. The PUD estimates the cost for
the Rocky Ford line at $570,000 to place the line overhead and $2,780,000 to place the lines underground.
The estimate for the Wheeler Tap is $1 ,800,000 to place the lines overhead and $8,000,000 to install the lines
underground. The Council may approve a deviation if it is determined that the cost of the underground
installation, when compared to overhead installation, is disproportionate in comparison to the benefit to be
gained by the property and/or public.
Randy Kono, PUD Electrical Engineer, explained the difference in costs between placing the transmission
lines overhead as opposed to underground.
Jeff Shupe, PUD Engineering Manager, explained that these projects are only partially in the City and
explained that the high voltage transmission lines are very expensive to install underground as opposed to
placing them overhead.
Anita Gruchalla, PUD Lands Specialist, explained that the PUD had public workshops on these projects and
have talked to all the jurisdictions that would be impacted.
Action Taken: Dr. Curnel moved that the deviation request be granted, seconded by Mr. Lane, and passed
unanimously.
Mr. Ecret requested that the ordinance requiring the undergrounding of utilities be reviewed by the Council
in the near future.
REQUEST FOR SEWER -LOWLAND WASTEWATER COMPANY
Jill Goodrich, owner of Lowland Wastewater Company, requested to change the boundary of the area that
she can serve with her private sewer system, which the City allows to be discharged into the City's force main
under a contract signed in 2009. The property is located in the Pelican Pointe area adjacent to the lake.
Gary Harer, Municipal Services Director, gave the background on the contract with Lowland Wastewater
Company and explained that a new contract would be drafted if the Council approves the request.
There was some discussion by the Council.
Action Taken: Mr. Voth moved that the request to expand the boundaries of the property to be served be
granted, seconded by Mr. Avila, and passed unanimously.
NON-AGENDA ITEMS AND PUBLIC QUESTIONS AND COMMENTS
GRANT COUNTY EDC -RECON SHOW
Emily Braunwart, Grant County EDC, reported on the contacts made at the Recon Show in Las Vegas that
is attended by the EDC and the City.
Debbie Doran-Martinez, Chamber of Commerce, explained that attendance by the EDC and City at this show
helps to build relationships with retailers.

Gilbert Alvarado, Interim City Manager, explained the work that goes into attending this show and the contacts
that can be made.
AMBULANCE SERVICE
Bill Foxley, 1026 S. Garden Drive, mentioned that the City is borrowing money between funds in order to keep
the ambulance service solvent and suggested that perhaps the City should eliminate the public ambulance
service and have a private ambulance service in the City. He felt that if the City is in need of funds, the funds
saved from the ambulance service could be used in other departments of the City. He mentioned that Walla
Walla and Portland have both gone to a private ambulance service as they could not afford a public one.
Mr. Ecret pointed out that the City is studying the ambulance service, what the Fire Department would look
like if the City did not operate the ambulance service, and how the ambulance service report is being
compiled.
COUNCIL QUESTIONS AND COMMENTS
CODE ENFORCEMENT
Mr. Ecret requested that the nuisance ordinance be reviewed to consider some changes such as eliminating
the 1 O' buffer for sidewalk areas vs non-sidewalk areas, vegetation on vacant lots being a certain height, and
a shorter period of time between the reporting of the violation and the conclusion of the case.
CHICKENS
Mr. Ecret requested that an ordinance be drafted that would allow chickens within the City limits to include a
limit of 8 hens and no roosters and be similar to regulations in other cities and towns in Grant County.
Mr. Voth volunteered to coordinate a demonstration of how chickens are raised when the ordinance is before
the Council.
CITY MANAGER REPORTS AND COMMENTS
FIRE DEPARTMENT
Gilbert Alvarado, Interim City Manager, stated that a contract has been drafted with American Medical
Response (AMR) to cover non-emergent out-of-town transports and should be signed within the next couple
of days. He mentioned that a meeting was held with Samaritan Hospital, AMR , and Protection-1 from Quincy
in order to explain the ramifications of the contract between the City and AMR. He pointed out that staff is
investigating the operation of the Fire Department without the ambulance service. A meeting was held with
Mr. Ecret, the Interim City Manager, and the Finance Director to discuss the monthly ambulance report and
determined that the coding of the time sheets needs to be refined to provide an accurate report.
Mr. Lane felt that the cost-of-service should include the Fire Department as well as the ambulance service.
Brett Bastian, Acting Fire Chief, stated that the out-of-town transports have been done by AMR since
Wednesday, August 19. Not doing the out-of-town transports allowed the Fire Department to respond to a
structure fire with a full crew and to respond to a cardiac arrest call with a full complement.
BUDGET
Gilbert Alvarado, Interim City Manager, stated that the Grant County Assessor is working on the new
construction that was not included in the City's assessed value. Three of the major projects were at least $5 .6
million that was not included and that shorted the City $332,640. The Assessor is investigating ways to
possibly recoup some of those funds
ICE RINK
Gilbert Alvarado, Interim City Manager, stated that the Parks and Recreation staff worked out a cost
breakdown for the use of the ice rink this coming season.
City Council Minutes: 5 August25, 2015
Spencer Grigg, Parks and Recreation Director, distributed a breakdown of the proposed fees for the use of
the ice rink. He explained that the fees were based on the fees used at the Surf n' Slide Water Park.
There was some discussion by the Council.
Mr. Ecret felt that the admission and season passes should be the same for adult and youth.
Action Taken: Mr. Ecret moved that the admission fees for the ice rink be set as follows:
1. Daily admission withou.t skate rental -$3
under 5 free
2. Skate Rental -$5
3. Combined daily admission -with skate rental -$6
4. 1 O admission punch card -$25
5. 10 admission punch card with skate rental -$65
6. Individual season pass -$45
7. Individual season pass with skate rental -$75
8. Hockey ice rental
Youth -$100 per hour
Adult -$125 per hour
Out of area teams -$275 per hour
9. Private rink rental
local organizations -$125 per hour
non-local organizations -$200 per hour
seconded by Mr. Voth and failed with Mr. Ecret, Mr. Voth, and Mr. Avila, in favor and Mrs. Liebrecht, Mr. Lane,
Dr. Curnel, and Mr. Deane opposed.
Action Taken: Mr. Deane moved that the rental rates as submitted be approved, seconded by Dr. Curnel, and
passed with Mr. Deane, Mrs. Liebrecht, Mr. Lane, and Dr. Curnel in favor and Mr. Ecret, Mr. Voth, and Mr.
Avila opposed.
PROJECTS UPDATE
Gilbert Alvarado, Interim City Manager, provided a list of the on-going projects in the City.
INVESTMENT REPORT
The City received $18,816.83 in investment income for July 2015.
EXECUTIVE SESSION
The regular meeting was recessed at 9:05 p.m. and the Council met in a 10 minute executive session with
the City Attorney to discuss labor relations and potential litigation. The executive session was adjourned at
9:15 p.m. and the regular meeting was reconvened.
CITY MANAGER RECRUITMENT
Gilbert Alvarado, Interim City Manager, stated that the Council is to meet with Greg Prothman, who was hired
to recruit a new City Manager, on September 10 to review the applications. It was the consensus of the
Council that 9 a.m. be set to meet with Mr. Prothman. He mentioned that Mr. Prothman also wishes to
discuss with the Council how the potential elections would impact the review of the applications. Specifically,
should the candidates be included in the process to select a new City Manager.
The regular meeting was adjourned at 9:20 p.m.

MOSES LAKE
Carlile Development LLC submitted a final plat application for a one-lot plat of 26 .1 7 acres
at the southwest corner of Randolph Road and Tyndall Road . The site is zoned Heavy
Industrial, which corresponds with the Comprehensive Plan Land Use Designation of
Industrial. The final plat has been modified from the preliminary plat, which had one small
lot and the remainder as a large lot. The final plat absorbs the smaller lot, which does not
affect the exterior boundaries of the plat. The Planning Commission recommended that
the final plat be approved with conditions.
Attached are the Findings, Conclusions and Decision of the Planning Commission. As no
appeal was taken from this decision of the Planning Commission, the Council's approval
of this decision incorporates and adopts the Findings, Conclusion and Decision of the
Planning Commission.

IN THE MATTER OF THE CARLILE
DEVELOPMENT FINAL PLAT
FINDINGS OF FACT, CONCLUSIONS, AND
DECISION
1. HEARING BEFORE THE PLANNING COMMISSION.
1.1 Date. A public meeting was held upon proper notice before the Commission on August 27,
2015.
1.2 Proponent. Carlile Development LLC is the proponent of this plat.
1.3 Purpose. The proponent has submitted a final plat application to create one platted lot of
26.17 acres for property which is legally described upon the plat. City staff has confirmed the
property described on the plat is the property submitted for platting.
1.4 Evidence. The Commission considered the following materials in reaching its decision:
A. The final plat submitted July 1, 2015.
B. Staff report and attachments.
2. FINDINGS OF FACT BY THE PLANNING COMMISSION.
Based upon the evidence presented to them, the Commission makes the following findings offact:
2.1 The proponent is the owner of the property.
2.2 The property is zoned Heavy Industrial.
2.3 There were no significant changes between the preliminary plat and final plat. The change
from two lots to one lot is insignificant.
2.4 Corrections to the drawing are needed, as noted in the Development Engineer's comments.
2.5 A deferral of street and utility improvements was granted with the preliminary plat, with the
stipulation that a covenant for the improvements in the future be recorded with the plat.
3. CONCLUSIONS BY THE PLANNING COMMISSION.
From the foregoing findings of fact the Commission makes the following conclusions:
3.1 The Planning Commission of the City of Moses Lake is vested with the authority to determine
approval of plats.
3.2 It is in the best interests and welfare of the city's citizens to plat the property as proposed.
3.3 Conditions are needed to ensure the plat is accurate.
3.4 With conditions, the final plat is consistent with the preliminary plat approval.
4. DECISION OF THE PLANNING COMMISSION.
On the basis of the foregoing findings of fact and conclusions, it is the recommendation of the
Planning Commission that the plat be approved with the following conditions:

Deeds on Pages 172 through 186, under AFN 525222, Records of Grant County, Washington, found

Reservoir #7 Raising Project Rebid -2014
T Bailey, Incorporated has completed the work for the Reservoir #7 Project Rebid-2014. This
project in conjunction with Reservoir #9 has increased the operating pressure in the Larson area by
approximately nine pounds per square inch, and increased the useable storage of Reservoir #7 from
950,000 gallons to 1.3 million gallons.
The contract was awarded in the amount of $1,035,370 and the final contract amount is $1,107,538.
The extra cost included painting the entire exterior of the tank instead of the just the area that was
added to the tank, and installing a ladder and hand rial on the interior foundation.
The contract work is physically complete and ready for acceptance by City Council. Upon
acceptance of the contract, we will enter into the 60-day lien period as required by Washington State
Law prior to releasing the contractor's retainage.

RESERVOIR #7 RAISING PROJECT REBID -2014
ACCEPT WORK
T Bailey, Inc. (TBI) has completed work for the Reservoir #7 Raising Project Rebid -2014. This
project consisted of increasing the overflow elevation of Reservoir #7 by 20.67 feet. This
project, in conjunction with the Reservoir #9 project in 2012, has increase the operating pressures
in the Larson area by approximately 9 pounds of pressure. The useable storage of Reservoir #7
was increased from 950,000 gallons to 1.3 million gallons.
The contract was awarded to TBI in the amount of $1,035,370.64 and the final contract amount
for the work is $1,107,538.52. The extra costs were the result of the Contractor proposing to
paint the entire exterior of the reservoir instead of just the new construction and installing a
ladder and handrail on the interior foundation. This project was rejected in 2011 when all three
of the submitted bids were over $1.4 million. City staff worked with TBI to consider cost saving,
alternative designs that would still meet our project objectives. TBI will be submitting this
project to the Steel Tank Institute in hopes of receiving national recognition for its uniqueness
and cost saving design.
The contract work is physically complete and ready for acceptance by City Council. Upon
acceptance of the contract. we will enter into the 60 day lien period as required by Washington

AN ORDINANCE AMENDING CHAPTER 18.30 OF THE MOSES LAKE MUNICIPAL
CODE ENTITLED "COMMERCIAL ZONES"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Chapter 18.30 of the Moses Lake Municipal Code entitled "Commercial Zones" is amended as
follows:
18.30.010 Purpose:
The purpose of this chapter is to provide for:
A. A well-distributed system of community-based retail, service, neighborhood convenience, and
regional-based retail uses;
B. Land uses that meet the needs of local residents and attract regional populations;
C. Land areas within the city to meet the needs of commercial development.
The C-1 , Central Business District, Zone is intended to provide for a variety of retail business uses
and services and to preserve land for such uses. It is a unique pedestrian-oriented commercial
district that is the major retail, office, entertainment, and arts center for the community.
Complementary residential uses are encouraged.
The C-1A, Transitional Commercial, Z~one is intended to be a transition zone between the C-1 and
C-2 zones and to provide an area for future expansion of the C-1 zone.
The C-2, General Commercial and Business, Zone is intended to provide for the general
commercial and business activity of the city and to preserve land for such uses. It is intended to
complement the downtown and help meet the other community needs, as well as provide an area
for large scale shopping centers and other uses oriented to vehicle traffic.
The NC, Neighborhood Commercial, z~one provides for small-scale shopping areas that offer
convenience goods and personal services for the daily needs of nearby neighborhoods. This
zoning district is designed to reduce trips by providing convenient shopping. The allowed uses
serve the neighborhood. Uses that tend to draw traffic into the neighborhood are not allowed.
18.30.030 Allowed Uses:
A. The Commercial Land Uses table indicates where categories of land uses may be permitted
and whether those uses are allowed outright or by conditional use permit. Only commercial
zones are included in this table. Land uses not listed are prohibited unless allowed through
the process specified in MLMC 18.30.030.D. Further interpretation of these zones may be
obtained as specified in MLMC 20.03.020.B. Land uses are also subject to any footnotes
contained within this chapter.
B. The symbols used in the table represent the following:
1. An "A" in a table cell indicates that the use is allowed subject to the applicable standards
in this code in the zone listed at the top of the table.
2. A "C" in a table cell indicates that the use is allowed by conditional use permit, subject to
the conditional use provisions in MLMC 18.51 and any additional standards specified.
3. An "X" in a table cell indicates the use is not allowed in the zone listed at the top of the
table.
C. Procedural requirements for permits are described in MLMC Title 20.
D. Uses similar to those listed may be established as allowed or conditionally allowed through the
interpretation procedures in MLMC 20.03.020.8. In determining whether a use should be
permitted, the Community Development Director shall refer to the purpose statements found
in 18.30.01 O and the 1987 version of the Standard Industrial Classification Manual.

6. Daily open merchandise display is permitted on private property when conducted in
conjunction with the principal operation which is in an enclosed adjoining building provided that
such merchandise is taken in and stored in an enclosed building at the close of each business
day and that the display shall not interfere with parking, traffic, or pedestrian movement.
7. The listed outdoor temporary/seasonal uses are permitted outright not to exceed thirty (30)
days in duration. Temporary structures associated with the listed uses are permitted and shall
be exempt from the requirement for compliance with the State Building Code. The siting of
temporary structures shall be approved by the Building Official.
8. All areas where vehicles are stored must be improved with hard surface paving. A street
frontage buffer as specified in MLMC 18.57.040.A is required, even if landscaping is not
otherwise required. Loudspeakers are prohibited.

thousand ( 10,000) square feet and office uses are limited to two thousand (2,000) square feet.
12. Limited to two thousand (2 ,000) square feet. Engineering, accounting, research, management,
and related services (SIC 87) is not allowed.
13. In the C-1 and C-1A Zones, repair and maintenance, where allowed, shall take place entirely
within an enclosed building.
14. No outdoor boarding allowed.
15. A bus garage or similar facility is allowed only in the C-2 Zone.
16. In compliance with the performance standards of the State of Washington siting criteria for on-
site hazardous waste treatment and storage facilities and the requirements of this chapter;
provided that, on-site hazardous waste treatment and storage facilities are accessory to and
subordinate to a primary use which is a generator of hazardous waste.
17. Construction storage facilities may be located ten (10) days prior to start of construction and
shall be removed within ten (10) days of finish of construction. Start of construction shall be
defined as ten (10) days prior to the physical presence of construction activity on the site for
which a building permit has been issued. Finish of construction shall be defined as the date
of issuance of a Certificate of Occupancy.
18. Allowed only as a subordinate use.
19. Existing residential uses may remain. For new residential uses, at least 50% of the ground
floor area must be designated for retail, service, public, or commercial uses except that
properties that front on Third Avenue may not use any of the ground floor area for residential
uses. Off-street parking for residential tenants must be provided, in compliance with MLMC
18.54.
20. When located adjacent to a residential zone, the allowed residential density is the same as the
adjoining residential zone. See MLMC 18.31.050.
21 . In the C-1 and C-1A Zones,~ multi-family use is not allowed for properties that front on
3'd Avenue.
22. Adult family homes shall be licensed by the Department of Social and Health Services, and a
city business license shall be required.
23. Family day care homes shall be licensed by the State of Washington Department of Social and
Health Services and shall operate in compliance with the licensed capacity requirements for
family day care homes. Certification by the office of child care policy licensor as providing a
safe passenger loading area, and a city business license shall be required. The building and
lot shall comply with all building, fire, safety, and health code requirements, and shall conform
to the lot size, building size, setbacks, and lot coverage standards of the zone, except for legal
nonconforming structures.
24. Excavation for the purpose of on-site construction or landscaping is permitted.
18.30.040 Prohibited: The following are prohibited in commercial zones:

unsightly material, litter, or debris except as may be contained in an approved garbage

18.30.050 Development Standards for Commercial Zones:
A. Purpose. This section establishes the development standards and site requirements for uses
in the commercial zones. The standards and rules are established to provide flexibility in
project design, prevent fire danger, provide adequate access and circulation, reduce
incompatibilities, and prevent overloading of infrastructure due to the impacts of development.
8. Explanation of Table. Development standards are listed down the left column of the table and
the commercial zones are identified across the top row. The matrix cells contain the
requirements of each zone. The footnotes identify particular requirements applicable to a
specific use, standard, or zone. Additional requirements for the NC zone are found in MLMC
chapter 18. 31 .

A RESOLUTION DETERMINING THAT MARKOVA LIVING TRUST IS THE OWNER OF CERTAIN
REAL PROPERTY WITHIN THE CITY; THAT A NUISANCE REQUIRING ABATEMENT BY CITY
FORCES OR FORCES CONTRACTED BY THE CITY EXISTS ON SUCH PROPERTY; AND
DIRECTING THE USE OF SUCH FORCES TO ABATE THE NUISANCE FOUND
Recitals:
1. Real Property Location and Ownership. It is alleged by a Code Enforcement Officer of the City, a person
authorized to enforce the ordinances and municipal code of the City, that the real property located at 2003
S. Beaumont, Lot 73, Montlake Add. #1 , Parcel #101624000, Moses Lake, Washington, is the site of
public nuisance violations of Moses Lake Municipal Code (MLMC) 8.14.030 M. 5. The records of Grant
County show the owner of the subject property to be Markova Living Trust, 9815 65111 Road, Apt. 1 E, Rego
Park, NY 1137 4-3505.
2. Notice. On June 30 , 2015, the Code Enforcement Officer caused to be delivered by regular mail and
certified mail to the owner of record of the subject property a Notice of Violation and Order to Correct or
Cease Activity. No appeal was filed to challenge that order. The time to comply under that order has
passed. The nuisance described in that order has not been abated by correction of the condition of the
property and a nuisance continues to exist on the subject property. On August 27, 2015, the Code
Enforcement Officer caused to be delivered to Markova Living Trust a notice of the intent of the City
Council to consider adoption of a resolution such as this at its meeting of September 8, 2015. Such notice
was in writing, in the English language and was delivered by return receipt mail and regular mail to the
record owner of the subject property.
3. Violations. It has been established by the Notice of Violation and Order to Correct or Cease Activity that
the following violations exist on the subject property and have not been corrected:
3.1. A violation of MLMC 8.14.030.M.5.: Nuisance Defined. Each of the following conditions, unless
otherwise permitted by law, is declared to constitute a public nuisance, and whenever the Code
Enforcement Officer determines that any of these conditions exist upon any premises or in any
stream, drainage way or wetlands, the officer may require or provide for the abatement thereof
pursuant to this chapter.
M. The erecting, maintaining, using, placing , depositing, leaving or permitting to be or remain in
or upon any private lot, building, structure or premises, or in or upon any street, alley,
sidewalk, park, parkway or other public or private place in the city, any one or more of the
following disorderly, disturbing, unsanitary, fly-producing, rat-harboring, disease-causing
places, conditions or things:
5. Any poison oak or poison ivy, Russian thistle or other noxious weeds, as defined by
Chapter 8.22 of the Moses Lake Municipal Code entitled "Noxious Weed Control"
whether growing or otherwise; but nothing herein shall prevent the temporary retention
of such weeds in approved covered receptacles.
4. Hearing. On September 8, 2015 the Moses Lake City Council conducted a hearing to consider the
allegations of the Code Enforcement Officer that the subject property contains a public nuisance ordered
corrected which remains uncorrected and that the record owner is responsible for the costs of correcting
and abating such violations if such corrections and abatement is accomplished by City forces or forces
contracted by the City for such purpose. All interested persons were permitted to provide written or oral
evidence relevant to the issue.

3505 is the record contract owner of the subject property per the records of Grant County.

3. The maintenance of these public nuisance violations on the subject property by the record owner is
detrimental to the health, safety, welfare, peace and tranquility of the residents of the City impacting
the quality of life and diminishing property values.
4. Markova Living Trust, the record contract owner, has fifteen (15) days from the date of the adoption
of this resolution to cause the nuisance violations listed herein to be removed to the satisfaction of
the Code Enforcement Officer. Those improvements include the following:
4.1 Kochia must be sprayed and then removed from the property
4.2 The weeds must be removed from the sidewalk and cut back 1 O' from the sidewalk on the
property itself
5. City staff shall provide a status report to City Council on the progress of the record contract owners
and occupant to make the clean up required on the subject property. If the improvements, as listed
above, are not to the satisfaction of the Code Enforcement Officer, the City is authorized to use City
forces or contract forces to cause the identified public nuisances to be removed from the subject
property to the satisfaction of the City Manager. All costs of any removal of the identified public
nuisances done at City expense shall be recovered by the City Manager by all reasonable means
including immediate assignment of the costs so incurred for collection.
6. A copy of this resolution shall be provided to the record contract owner by return receipt and regular
mail after its approval by the City Council.

stabilization plan, which will minimize blowing dust and maintain soil stability and which
shall be approved by the city prior to any plowing, discing, or scraping, is implemented
immediately.
4. Hearing. On September 8, 2015 the Moses Lake City Council conducted a hearing to consider the
allegations of the Code Enforcement Officer that the subject property contains a public nuisance ordered
corrected which remains uncorrected and that the record owner is responsible for the costs of correcting
and abating such violations if such corrections and abatement is accomplished by City forces or forces
contracted by the City for such purpose. All interested persons were permitted to provide written or oral
evidence relevant to the issue.

to the satisfaction of the City Manager. All costs of any removal of the identified public nuisances done
at City expense shall be recovered by the City Manager by all reasonable means including immediate
assignment of the costs so incurred for collection.
6. A copy of this resolution shall be provided to the record contract owner by return receipt and regular
mail after its approval by the City Council.

A RESOLUTION DETERMINING THAT BRYAN STARRETT IS THE OWNER OF CERTAIN REAL
PROPERTY WITHIN THE CITY; THAT A NUISANCE REQUIRING ABATEMENT BY CITY FORCES
OR FORCES CONTRACTED BY THE CITY EXISTS ON SUCH PROPERTY; AND DIRECTING THE
USE OF SUCH FORCES TO ABATE THE NUISANCE FOUND
Recitals:
1. Real Property Location and Ownership. It is alleged by a Code Enforcement Officer of the City, a person
authorized to enforce the ordinances and municipal code of the City, that the real property located at 826
S. Grand Drive (Lot 7, Block 9, Lakeview Terrace #1) Parcel #100919000, Moses Lake, Washington, is
the site of public nuisance violations of Moses Lake Municipal Code (MLMC) 8.14.030 M. 5. The records
of Grant County show the owner of the subject property to be Bryan Starrett, 826 S. Grand Drive, Moses
Lake, WA 98837.
2. Notice. On July 9, 2015, the Code Enforcement Officer caused to be delivered by regular mail and
certified mail to the owner of record of the subject property a Notice of Violation and Order to Correct or
Cease Activity. No appeal was filed to challenge that order. The time to comply under that order has
passed. The nuisance described in that order has not been abated by correction of the condition of the
property and a nuisance continues to exist on the subject property. On August 27, 2015, the Code
Enforcement Officer caused to be delivered to Bryan Starrett a notice of the intent of the City Council to
consider adoption of a resolution such as this at its meeting of September 8, 2015. Such notice was in
writing, in the English language and was delivered by return receipt mail and regular mail to the record
owner of the subject property.
3. Violations. It has been established by the Notice of Violation and Order to Correct or Cease Activity that
the following violations exist on the subject property and have not been corrected:

Reza Firouzi submitted a building permit application for Lot 4, Tullis Plat, 1702 W. Lee
Street, which is a legally platted parcel. At the time the property was platted, the
development did not require municipal improvements that are now required with current
plats. Municipal improvements could include the extension or provision of City water,
sewer, storm sewer, curb, sidewalks, street or other provisions. Since the legally platted
parcel does not meet our current municipal improvements standards. it falls under the
provisions of MLMC 16.02.110, Platting Deemed Insufficient.
A building permit cannot be issued for this property unless the property is brought into
conformance with the standards of our current plat improvements or the City Council grants
a waiver, deferral, or deviation from the requirements to install the deficient plat
improvements. The applicant has chosen to request a deferral from the requirement to
install improvements pursuant to MLMC 16.02.110 B.
The City Council has considered requests in the past for building permits for parcels that
fall under the provisions of MLMC 16.02.110. The provisions of MLMC 16.02.110(8) were
considered in the granting of such requests. If the Council is inclined to grant the request,
staff would recommend that a Covenant securing future municipal improvements be
required.

CHAPTER 16.02 -BUILDING PERMITS
16.02.110 Platting Deemed Insufficient -When:
A Property located within the city which is presently platted and which property was platted
without the extension or provision of city water, city sewer, storm sewer, curb, sidewalk, streets
or other improvements through some or all of the lots of the plat shall be deemed to be
unplatted for purposes of the issuance of any development permit or building permit. Any lot
so affected shall be permitted to develop and a building permit will be issued upon the
installation of city water, city sewer, storm drains, curbs, sidewalks, streets, and other
improvements to community standards, including fire protection devices, or upon the posting
of security in an amount approved by the city, which is equal to the estimated cost of the
extensions and/or improvements remaining to be installed through the lot, in a form acceptable
to the City Attorney to insure the construction of the required improvements and extensions
at the same time as construction of the building for which the building permit was issued or at
the time of the improvement of the affected lot.
B. Any property owner can make application to the City Council for a waiver, deferral, or deviation
from or of the requirement to install improvements. A waiver, deferral, or deviation from or of
the requirement to install improvements shall not be granted unless the City Council finds that
because of the nature of the property, its topography, the conditions or nature of the adjoining
areas or the existence of unusual physical conditions, the requ irement to install improvements
wou ld cause an unusual and unnecessary hardship on the property owner. In granting a
waiver, deferral or deviation from or of the requirements to install improvements, the City
Council may require such conditions as will secure the objectives of the requirement waived,
deferred, or deviated from or of. Any waiver, deferral, or deviation authorized shall be entered
in the minutes of the Moses Lake City Council together with the circumstances that justify the

VISITORS
* To quality for the senior rate you must be 65 years or older, the property owner, and living at the
property. Visit us at the Utility Department located at 401 S. Balsam, Moses Lake, WA 98837 to update
your account. Valid ID is required.
All recycling and yard waste carts are provided to you by the City of Moses Lake at no additional monthly
cost.
Recycling carts and yard waste carts are available in both 64 gallon and 96 gallon sizes. You may also
have multiple carts at no additional monthly cost to you. A delivery fee may apply. Call or visit our Utility
Department to change your cart configuration, (509)764-3715 or (509)764-3719.
The City Council recently passed an ordinance to raise the garbage rates to reflect our contract increase.
The ordinance was passed on a single reading to match the September 1st increase that the city is
contractually obligated to pay to the two contactors that haul the garbage.
The rates paid to the contactors are automatically adjusted every year on September 1st based on the July
Consumer Price Index. The rate was not made available until August 20th. Had the City gone through the
2nd reading process the City would have gone a full month between the increase in payments to the
contractor and the increase of the rates to the public further contributing to the decrease in the fund
balance. By raising rates the City charges at the same time as the contactor increase it reduces staff time
and cost by only changing the rates in the utility system one time. Otherwise the hundreds of different
rates would need to be changed prior to the first billing in September and then again by the first billing in
October.
Additional Charges
An additional fee up to $11.44 may apply for cart exchanges, pick-up or deliveries.
Garbage Tags
Garbage tags can be purchased in the Utility Department. Each tag is $2.60 and is good for a 32 gallon
bag.
