Chapter 5.06 of the Moses Lake Municipal Code entitled "Licensing Regulations -Temporary Locations" is amended as follows 5.06.010 Authority: The provisions of this chapter shall be deemed an exercise of the authority and power of the city to license, for the purposes of regulation and revenue, all and every kind of business authorized by law and transacted and carried on within the corporate limits of the city, as provided by RCW 35.24.290 (7) 35A.11.020. 5.06.020 License Required: It is unlawful for any person, firm, corporation, or association to engage in any kind of business, trade or profession authorized by law within the City of Moses Lake as a transient merchant, itinerant merchant, or itinerant vendor as defined in Section 5.06.030 without first obtaining a license therefore in compliance with the provisions of this chapter. 5.06.030 Definitions: For the purpose of this chapter, a transient merchant, itinerant merchant or itinerant vefttief is defined as any person, firm, corporation or association, whether as owner, agent, consignee or employee, whether a resident of the city or not, which engage in a temporary business of selling and delivering goods, wares, and merchandise within said city, and who, in furtherance of such purpose, hires, leases, uses or occupies any building, structure, parking lot or area, motor vehicle, tent, railroad boxcar or both, public room in hotels, motels, lodging houses, apartments, shops, or any street, alley, or other public places within the city, for the exhibition and sale of such goods, wares and merchandise, either privately or at public auction provided that such definition shall not be construed to include any person, firm, corporation or association who, while occupying such temporary location, does not sell from stock but exhibits samples only for the purpose of securing orders for future delivery only. The person, firm, corporation or association so engaged shall not be released from complying with the provisions of this chapter merely by reason of associating temporarily with any local dealer, trader, merchant or auctioneer, or by conducting such transient business in connection with, as a part of, or in the name of any local dealer, trader, merchant or auctioneer. 5.06.045 Application Requirements: The application shall be submitted at least 14 days before the proposed start of business, and shall include the following : A Application form B. Application fee per MLMC 5.06.080 C. Cash deposit per MLMC 5.06.100 .!2. Written permission of the owner of the property where the business is proposed to be located ~ Site plan showing the proposed location of the business, including existing buildings, parking, and any proposed structures, vehicles, tents, etc. F. Proof of insurance coverage, per MLMC 5.06.047. 5.06.047 Insurance: The licensee shall obtain and maintain public liability and property damage insurance in the amount of one million dollars ($1 ,000,000) which shall remain in full force and effect during the duration of the license. The insurance policy shall name the City as an additional named insured and the policy shall not be canceled or reduced without prior written notice to the City as least thirty (30) days in advance of the cancellation. Proof of insurance shall be provided as a condition of issuance of the license. (Same language as 12. 14. 090, Sidewalk Use License) 5.06.060 Location Change: If an existing licensee desires to change the location of the business, trade, or profession from the location designated on the business license, application must be made to the Finance Director at least 14 days prior to the change in location and the Finance Director shall, prior to the issuance of a new business license, submit the application therefor to the Fire Chief and the Building Official of the city for approval of the new location where the licensee is to carry on the business, trade, or profession, and the business license shall be issued only if the location is in compliance with building and fire codes of the city as those codes relate to existing and/or new structures. There shall be no additional business license fee assessed an existing licensee for a change of his location, and the new business license issued shall carry the same expiration date. 5.06.080 Fee Schedule: The business license fee schedule is fixed in the amount of two hundred dollars ($200) per year or part thereof, payable in advance, for each business, trade or profession, conducted or carried on within the corporate limits of the city; except for each busiAess selliflg fireworks as allowed by law wh ich shall pay a busiAess lieeAse fee of six huAdred dollars ($600) per stafld except for those which are operated by flOfl prnfit eoF19paAies, assoeiatiofls, corporations, or eo partnerships which shall pay a fee of three hundred dollars ($300) per stand; provided, that tax exempt nonprofit companies, associations, corporations, or co-partnerships of whatever kind as defined by the federal or state government, shall not be required to pay the business license fee except if they operate fireworks sales operations, but, nevertheless, shall obtain a business license, without fee, if conducting a business in order to raise funds from members outside the organization. The business license for tax exempt nonprofit companies, associations, corporations, or co-partnerships of whatever kind as referred to herein shall be obtained once and shall be effective for the lifetime of the organization except if they operate fireworks sales operatiofls ifl which ease the tax exeffipt Aon prnfit eoF19paAies, assoeiatiofls, eorporatiofls, or eo partnerships of ·whatever kiAd shall obtain a business lieeAse for each year they operate a fireworks sales operatiofl and pay the appropriate fee. This exemption is an addition to that provided in Section 5. 06. 090. No business, trade or profession conducted or carried on in a single location under one (1) management or ownership shall pay more than one license fee regardless of the multiple nature of the business carried on; Provided further that no tax exempt nonprofit company, association, corporation, or co-partnership of whatever kind as defined by the federal or state governments which operates or conducts a community festival or event or event of no more than four (4) days in duration shall be required to obtain a business license as herein previously provided and the exemption which has been provided shall extend to the festival's or event's participants operating under sanction of said festival or event. Any business, profession or trade in more than one (1) location within the city shall pay a license fee for each location where the business, profession, or trade is conducted. 5.06 .090 Certain Businesses Exempt: A Recognizing that there are locally owned and operated small or part-time businesses wh ich would be unduly penalized by requiring licensing under this chapter and the payment of the business license fee as provided in Section 5.06.080, there is exempted from this business licensing chapter those locally owned and operated businesses, professions, or trades wherein the annual gross income is less than one thousand dollars ($1 ,000) per year. B. The provisions of this chapter shall not be construed to apply to the following: .1. Persons selling only fruits, vegetables, berries, eggs, or any farm produce. ~ Persons selling only trees used for the celebration of the Christmas season . 5.06.100 Cash Deposit: Before a license is issued under authority of this chapter, the applicant, in addition to paying the applicable license fees, shall deposit with the Finance Director a refundable cash deposit or a cashier's check in the amount of one hundred fifty dollars ($150). The deposit or cashier's check shall be refunded or returned to the licensee at such time as it has been determined that any check used to pay the license fee has cleared and after the licensee delivers to the city a signed, declaration indicating the amount of gross sales and which calculates the amount of sales tax to be forwarded to the Washington Department of Revenue. In addition the statement shall contain a current address and telephone number of the licensee. 5.06.105 All transient merchants vendors shall have at least one (1) adequately sized garbage receptacle upon the site of business for customer use. 5.06.110 Non-Transferability of License: All licenses provided for in this chapter shall be non-transferable. 5.06.120 Revocation or Denial of License: Any license pursuant to this chapter may be revoked or denied, in writing, by the Community Development Director for any of the following causes: A Any fraud, misrepresentation. or false statement contained in the application for license. ~ Any fraud, misrepresentation, or false statement made in connection with the selling of products. C. Any violation of this chapter. D. Conviction of the licensee of any felony or of a misdemeanor involving moral turpitude. ~ Conducting the business licensed under this chapter in an unlawful manner or in such a manner as to constitute a breach of the peace or to constitute a menace to the health. safety, or general welfare of the public. 5.06.140 General Fund: All funds received by the city under the terms of this chapter shall be paid into the General Fund of the city and budgeted annually for any municipal purpose, as required by law. 5.06.170 Appeal: Any person aggrieved by the denial of an application for a license or by the revocation of a license as provided for in this chapter, shall have the right to appeal to the City Council. Such appeal shall be taken by filing with the Finance Director within fourteen (14) calendar days after the notice of decision has been mailed to the applicant's or licensee's last known address, a written statement setting forth the grounds for the appeal. The City Council shall set the time and place for hearing on such appeal. and notice of such hearing shall be given by mail to the appellant at least five (5) calendar days prior to the date fixed for such hearing. Section 2. This ordinance shall take effect and be in force five (5) days after its passage and publication of its summary as provided by law. Kenison, City Attorney ORDINANCE NO. ~I s 4 AN ORDINANCE AMENDING CHAPTER 5.07 OF THE MOSES LAKE MUNICIPAL CODE ENTITLED "ITINERANT MERCHANTS AND VENDORS" THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. Chapter 5.07 of the Moses Lake Municipal Code entitled "Itinerant Merchants and Vendors" is amended as follows: Section 2. The title of Chapter 5. 06 of the Moses Lake Municipal Code is changed from "Itinerant Merchants and Vendors" to "Mobile and Street Food Vendors" 5.07.010 License Required : It shall be unlawful for aft itinerant mobile or street vendor to engage in business within the City of Moses Lake except when licensed as aft Of itinerant mobile or street vendor as defined in this chapter. A separate license shall be required for each location of any itinerant vendor. 5.07.020 Definitions: The following terms and definitions shall be used in the administration of this chapter. A. "Itinerant Mobile Vendor" shall mean any person, firm, or corporation, whether as owner, agent, consignee, or employee, whether a resident of the city or not, who engages in a business of selling and delivering goods, wares, food~ or merchandise of any kind or description and who may conduct business from a vehicle or other motorized conveyance upon privately or publicly owned property but not on a including any public street, sidewalk, alley, or public way of the city. A person, firm, or corporation so engaged shall not be relieved from complying with the provisions of this chapter merely by reason of associating temporarily with any local dealer, trader, merchant, or auctioneer, or by conducting such temporary business in connection with, as part of, or in the name of any local dealer, trader, merchant, or auctioneer. B. "Food" shall have its usual and ordinary meaning, and shall include all items designed for human consumption, including, but not limited to, candy, gum, popcorn, hot dogs, sandwiches, peanuts, soft drinks, frozen concessions, nonalcoholic beverages, and dairy products. (Ord. 1619, 1994) Products regulated by the Washington State Liquor and Cannabis Board may not be sold by mobile or street vendors. C. "Authorized Concession Stand" shall mean a concession stand operated or maintained for the sale of food or merchandise, in the public parks of the City, or on other public property, by the City.or in accordance with a City-approved agreement or franchise. D. "Public Celebration" shall mean the Spring Festival activities customarily celebrated in and around Mccosh Park and other areas of the City, as well as any other time of public celebration. ~ "Special Event" shall mean an event for which the City has authorized use of City facilities for use by vendors, such as the Farmers Market. F. "Street Vendor" shall mean a vendor selling food within a public or private parking lot, pedestrian plaza, public street, alley, sidewalk, public right-of-way, or public property. using a non-motorized cart or temporary structure. 5.07.030 Exemptions: The provisions of th is chapter shall not be construed to apply to the following: A. Persons selling only fruits, vegetables, berries, eggs, or any farm produce. B. Persons selling only trees used for the celebration of the Christmas season. C. Persons selling fireworks -----1-0+-.-Non-profit organizations with local affiliations 5.07.040 Application: Any person, firm, or corporation desiring to secure a license as aft itiAeFaAt mobile or street vendor shall make application to the city, on forms to be provided by the city, at least 14 days before the requested start date of the business. Such application shall provide: A. The name or names and address of the applicant, vehicle license numbers of all vehicles or a description of the conveyance from which the applicant proposes to conduct business; description of the general type of goods, waFes, meFchaAdise OF food proposed to be sold by the applicant; the place OF places wheFe the applieaAt prnposes to eAgage iA busiAess. B. Each application shall be accompanied with the license fee as provided for in this chapter. C . Each license application for aft itiAeFaAt mobile or street vendor shall be accompanied with the following information to establish compliance with this chapter and other applicable codes: 1. A vvFitteA authoFizatioA from the pFopeFty owAeF to eoAduet the applieaAt's busiAess at the place so noted CA the applieatioA. ------+--A statement explaining the method of trash and litter disposal being proposed by the vendor. 3. (Same language as 12.14.090, Sidewalk Use License) 5.07.050 Investigation and Determination: Upon receipt of such application, the Community Development Director shall cause such investigation of such person or persons' business responsibility to be made as is deemed necessary for the protection of the public good and shall refer the application to the Community Development Department for its determination as to compliance with standards and requirements of this chapter. An application shall be denied by the Community Development Director upon written findings that the applicant's business responsibility is unsatisfactory or that the proposed business activity will violate any applicable law, rule, or regulation. Any license issued under this chapter shall contain the number on the license, the date same was issued, the nature of the business authorized to be carried on, the amount of license fee paid, the expiration date of said license, the place wheFe said busiAess may be ca Fried on uAdeF such liceAse and the name or names of the person or persons authorized to carry on the same. The Community Development Department shall keep a record of all licenses issued under this chapter and shall promptly provide the Washington State Department of Revenue a copy of any license issued under this chapter. 5.07.060 Fees: A. An initial application fee of one hundred fifty dollars ($150) shall be submitted with all applications for each vehicle. conveyance. or stand. The renewal fee for a mobile or street vendor license shall be the same as a standard business license, provided there has been no interruption in maintaining the mobile or street vendor licenses of the vehicles. conveyances. or stands. Any license issued under the provisions of this chapter shall expire thifty (30) days aftef the elate of issuance thereof unless a pfior elate is fixed thefein December 31st of the year it is issued. C. In addition to the application fee, the applicant shall pay a one-time fee of one hundred five dollars ($105) to help defray the cost of screening the applicant for the license. Fingerprinting costs are included in the screening fee. C. In the event a vendof desires to change location, notice shall be given to the Community Development Department at least three (3) business days pfiof to the relocation and a f-ee of one hundfed dollafs ($100) shall be levied pef fequest. 5.07.070 Exhibiting of License/Transfer: A. Any license issued under this chapter shall be posted conspicuously upon all vehicles. conveyances. or temporary structures from which a mobile or street vendor conducts-at-the place of business authofized thefein. B. Any license issued under this chapter shall not be transferred to any other person, firm, or corporation, Of location. 5.07.080 Heet#t Compliance with Regulations: All food vendors shall comply with all laws, rules, and regulations regarding food handling, and all vehicles, conveyances, and stands used for the sale of food shall comply with all the applicable laws, rules, and regulations respecting such vehicles, conveyances. or stands as established by the Grant County Health Department District. the Washington State Motor Vehicle Code. and as set forth in the Moses Lake Municipal Code. 5.07.090 Itinerant Mobile and Street Vendor Standards: All itinefant mobile and street vendors licensed under this chapter shall conform to the following standards: A. No itinefant mobile or street vendor shall be licensed fof a operate from one location in a residential zone as defined in Title 18 of the Moses Lake Municipal Code for longer than fifteen (15) minutes at a time. B. No itinefant mobile or street vendor shall locate his or her vehicle;-Othef QI.conveyance; in that portion of public right of way abutting private property without the written permission of the owner of the abutting private property. No food shall be offered. displayed, or sold. and no customers served. in any vehicle travel lane. A temporary stand, Of merchandise shall not be located within twenty feet (20') of any public right-of-way or within twenty feet (20') of the intersection of any public right-of-way and private driveway. C. No signs or signage shall be permitted other than that which can be contained on the vehicle or conveyance utilized or as otherwise allowed. D. No vehicle, other conveyance or temporary stand shall be located closer than twenty feet (20') from any building or structure on the licensed pfoperty or adjoining pfoperty. E. No vehicle, other conveyance or temporary stand shall locate closer than fifty feet (50') from flammable combustible liquid or gas storage and dispensing structures. F. All itineFant mobile and street vendors shall ptaee have at least one (1) thiFty (30) 9allon adequately sized garbage receptacle upon the site of business or on the vehicle or conveyance for customer use. G. Licensed itineFant Sites used by mobile or street vendor.§ sites shall be cleaned of all debris, trash, and litter at the conclusion of daily business activities. H. All vehicles, other conveyances, or temporary stands shall be equipped with at least one 2A-40 BC fire extinguisher. I. No itinerant mobile or street vendor shall sell or vend from his or her vehicle or conveyance: 1. Within four hundred feet (400') of any public or private school grounds during the hours of regular school session, classes, or school related events in said public or private school, except when authorized by said school. 2. Within-three one hundred fifty feet (300150') of the entrance to any restaurant, cafe, or eating business establishment offeFin9 as a main featured item OF items similaF pFoducts foF sale which is open for business during business hours of the eating establishment, unless the eating establishment has provided written permission to the vendor to locate closer. The vendor shall produce the written permission for inspection if required to do so by any authorized City official. 3. Within three hundred feet (300') of any public park of the city where any city authorized concession stand is located during times other than during the course of a public celebration except as approved by the Parks and Recreation Department of the city. 4. Within three hundred feet (300') of any public park of the city where any city authorized concession stand is located during the course of a public celebration when non-profit organizations are permitted to engage in the sale of merchandise and food in such park. ~ Within 300' of any public park or other public space during a special event for which organizations are permitted to sell merchandise and/or food in the park or public space for a fee, unless the mobile or street vendor obtains written permission from the coordinator of the event. J. No itinerant mobile or street vendor shall conduct business so as to violate the traffic and sidewalk ordinances of the city as now in effect or hereafter amended. K. No itineFant mobile or street vendor shall obstruct or cause to be obstructed the passage of any sidewalk, street, avenue, alley or any other public place, by causing people to congregate at or near the place where goods, wares, food, or merchandise of any kind is being sold or offered for sale. L. All vendors shall opeFate ffom a location with a haFd paved surface. 5.07.100 Revocation or Denial of License: Any license pursuant to this chapter may be revoked or denied, in writing, by the Community Development Director for any of the following causes: A. Any fraud, misrepresentation, or false statement contained in the application for license. B. Any fraud, misrepresentation, or false statement made in connection with the selling of products. C. Any violation of this chapter. D. Conviction of the licensee of any felony or of a misdemeanor involving moral turpitude. E. Conducting the business licensed under this chapter in an unlawful manner or in such a manner as to constitute a breach of the peace or to constitute a menace to the health, safety, or general welfare of the public. 5.07 .110 Appeal: Any person aggrieved by the denial of an application for a license or by the revocation of a license as provided for in this chapter, shall have the right to appeal to the City Council. Such appeal shall be taken by filing with the Finance Director within fourteen (14) calendar days after the notice of decision has been mailed, by certified mail, to the applicant's or licensee's last known address, a written statement setting forth the grounds for the appeal. The City Council shall set the time and place for hearing on such appeal and notice of such hearing shall be given by certified mail to the appellant at least five (5) calendar days prior to the date fixed for such hearing. 5.07.130 Duty of Building Official to Enforce: It shall be the duty of the Building Official of the City of Moses Lake and his designee to examine all places of business and persons subject to the provisions of this chapter. to determine if this chapter has been complied with and to enforce the provisions of this ordinance against any person found to be violating the same. 5.07.140 General Fund: All funds received by the city under the terms of this chapter shall be paid into the General Fund of the city and budgeted annually for any municipal purpose, as required by law. 5.07.150 Fees Collected by Court: The city shall have the power to institute suit or action in any court of competent jurisdiction for the purpose of collecting any license fees that are due and payable. AN ORDINANCE AMENDING CHAPTER 18.57 OF THE MOSES LAKE MUNICIPAL CODE ENTITLED "LANDSCAPING" THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS: Section 1. Chapter 18.57 of the Moses Lake Municipal Code entitled "Landscaping" is amended as follows: 18.57.030 General Requirements: All required landscaped areas shall comply with the following: A Landscaping shall be vegetative and consist of combinations of trees, shrubs, and ground cover. Non-living natural features may also be incorporated. B. Required landscape plantings shall be suited to the climate, location, and physical conditions of the site. The use of drought-tolerant species is encouraged to reduce irrigation and maintenance demands. See MLMC 18.57.055 G Drought Tolerant Landscaping C. All landscaped areas shall be graded to prevent erosion and to facilitate the installation, growth, and maintenance of the landscaping. All turf areas located in public right-of-ways shall have a grade of no greater than 4(h): 1 (v). D. Trees and shrubs shall be chosen and located to avoid interference with underground and overhead utility lines or public improvements. E. Landscaping shall be designed to insure adequate visibility and safety of vehicular traffic, bicyclists, pedestrians, and other users, on and off the proposed site. Height and/or spacing of landscaping may be modified to accommodate sight distances. F. Other than a fence around an individual one-or two-family dwelling, all fences shall be placed on the inward side of any required perimeter landscaping. G. J. If approved by the city, required street frontage landscaping may be placed in city right-of-way. This area shall be maintained by the owner of the property that abuts the right-of-way. The city and other public services shall have the right to remove landscaping placed on city right-of-way for repair, replacement, or installation of utility services. The city will not accept liability for damages to said landscaping from future street expansion, meter reading, or utility installation, inspection, or repair. K. All required landscaping shall be served by irrigation systems appropriate for the plants. L. The incorporation of existing vegetation, especially healthy trees, is strongly encouraged. Where existing trees and associated vegetation serve the same or similar function as the required landscaping, they may substitute for the required landscaping , provided trees are healthy and appropriate for the site at mature size. When necessary, existing vegetation shall be supplemented with new plantings to accomplish the specific intent and purpose of th is chapter. M. Landscape requirements contained in this chapter are minimums. Additional landscaping is encouraged. N. Areas within two hundred feet (200') of the shoreline or associated wetlands are subject to the State of Washington Shoreline Management Act and the City of Moses Lake Shoreline Master Program. 0 . In the event of a conflict between the content of th is chapter and other regulations, the more restrictive regulations shall apply. P. Landscaping may be included within stormwater facilities, provided it does not impede the functionality of the stormwater facility. Q. For interior property line buffers, where a buffer meeting the requirements of this ordinance has previously been installed on the adjoining property, an additional buffer is not required along the screened property line. R. Where buildings are located within 20' of a property line, all landscaping between the building and the property line may be counted toward the required points for the buffer. S. Subdivision Street Trees: Street trees shall be planted clearly on one side of the side property line or the other. to make clear which owner is responsible for maintaining the tree. T. Site Distance: Street trees at corners shall be set back at least th irty-five feet (35') from the extended curb line. and must be trimmed to allow at least five feet (5') of clearance from grade to the bottom of the tree canopy. 18. 57. 040 Specific Requirements A. Buffers: When adjacent to the uses listed, the subject property shall provide the type and width of landscaping listed in the table below along the entire property line between the subject property and the adjacent use, except for vehicular and pedestrian access points. If a building is located in the buffer area, the landscaping displaced by the building shall be located elsewhere on the site. Types of landscaping are as described in Section 18.57.050. Parking Areas: Parking areas shall be landscaped to provide shade and visual relief while maintaining clear lines of sight. 1. Landscaping shall be provided within and/or around all surface parking lots containing ten (10) or more parking stalls, except that no parking lot landscaping shall be required within industrial zones. At a minimum, landscaping shall consist of ground cover and shade trees with a minimum mature canopy spread of fifteen feet (15'). See Section 18.57.055 for required landscape points for parking lots. 2. The minimum area per planter shall be one hundred (100) square feet. 3. Landscaped areas shall be distributed around and/or throughout the parking lot so that the maximum distance between the trunk of shade tree and any parking stall shall be no more than fifty feet (50'). Shade trees used to meet th is requirement are not required to be those specifically included in the parking lot landscaping. 4. Parking lots: two (2) points per required parking space + one ( 1) point for each parking space provided in add ition to required spaces. 5. Permanent curbs or structural barriers shall be provided to protect the landscape plantings from vehicle overhang. 6. Trees shall be planted at least four feet (4') from the outside edge of the planting area. 7. No plant material greater than twelve inches (12") in height shall be located within two feet (2') of the edge of a landscaped area adjacent to a parking stall. 8. Required parking lot planter areas shall be in addition to any required front, side, and rear yard buffer requirements. 9. The requirements of this section shall not apply to parking garages or parking decks, or display areas for automotive and equipment sales and rentals. C. Residential Landscaping 1. Front Yard: The required front yard and exterior side yard of all one (1) and two (2) family residential uses shall be landscaped within one ( 1) year of occupancy and maintained. For the purposes of this section, landscaping shall be defined as the addition of decorative rock, bark, groundcover, lawn, trees, plants, shrubs, and other natural and decorative features. At least fifty percent (50%) of the front and exterior side yard area shall be landscaped. Driveways and parking areas may be located in the remaining area that is not required to be landscaped. 2. Multi-family Structures: Multi-family residential uses shall also landscape the required open space areas so that they are usable for outdoor recreation . 3. Manufactured Home Parks: All areas within the boundaries of the manufactured home park shall be landscaped. All lawns, trees, landscaping, occupied and unoccupied manufactured home spaces, recreation areas, and open space areas shall be continually maintained. A permanent irrigation system shall be installed and maintained for planted common areas. 4. Planter strips: Street frontage planter strips between the curb and sidewalk shall be landscaped with Type IV landscaping consisting of a minimum of twelve (12) points per twenty-five feet (25') of frontage. Timing of landscape installation shall be as follows: a. For new subdivisions, planter strip landscaping shall be installed or bonded for before a Certificate of Occupancy is issued for the house on the lot abutting the planter strip. b. For new planter strips built in existing developed areas, planter strip landscaping shall be installed within one year of completion of the planter strip. c. For areas with existing planter strips, planter strip landscaping shall be installed within one (1) year of the adoption of this ordinance. D. Building Facade Landscaping: To ensure that wall facades are visually interesting when viewed from surrounding streets and buildings, blank building facades more than twenty feet (20') in height or fifty feet (50') in width or length shall be landscaped with Type Ill landscaping to provide visual relief and soften the effect of the new building on the surrounding area. 1. Blank facades are defined as those which do not add to the character of the streetscape and do not contain transparent windows or sufficient ornamental features, decorations, artwork, articulation, high quality building materials (such as brick), or other architectural features. 2. Exceptions: Buildings in industrial zones are not required to screen blank facades. In all other zones, blank facades that are within twenty feet (20') of another building or which are otherwise not visible to the general public are not required to be screened. 18.57.055 Landscape Point Values: A. The Community Development Department will maintain a list of commonly-planted species and the size per the above chart. For species not included in the list, mature height shall be as shown in a standard published source. Where a range of sizes is given in the source, points for the larger size may be claimed, provided the correct minimum size is planted for the points claimed. B. An additional ten percent (10%) in the number of points shall be required adjacent to the following aesthetic corridors: 1. West Broadway from 1-90 to its intersection with Division Street 2. East Broadway from its intersection with Division Street to where it joins with Pioneer Way 3. Pioneer Way from where it joins with East Broadway to its intersection with Highway 17 C. Points for required buffers shall be in addition to the Site Poil'lts al'ld Parking Lot Points required in this section. D. A maximum of twenty-five percent (25%) of required landscape points may be claimed within street right-of-way. E. A minimum of sixty percent (60%) of points shall be used for landscaping in the front and side yards. F. A maximum of twenty-five percent (25%) of required points may be used for turf grass. Turf grass within street right-of-way does not earn any points. G Drought Tolerant Landscaping. Landscaping areas that meet the criteria listed below may have the points required for that area reduced by thirty percent (30%). To qualify as drought tolerant, the following must be incorporated: 1. An approved drip irrigation system 2. Low volume -low pressure -low flow distribution 3. Drought tolerant plant selection 4. Use of mulches, which can include decorative rock .ti. Native and Naturalized Plant Species. New landscaping materials shall include species native to Eastern Washington or hardy, waterwise, and noninvasive species appropriate in the climatic conditions of Eastern Washington (decorative annuals are an exception). Washington State Universitt maintains a list of trees, shrubs, vines, ground covers, perennials, grasses, bulbs, and annuals that are appropriate for Eastern Washington. The selections of plant species should include consideration of soil tJ:'.pe and depth, the amount of maintenance required, spacing, exposure to sun and wind, the slope and contours of the site, compatibility with existing native vegetation preserved on the site, water conservation where needed, and the impact of landscaping on visibility of the site for purposes of public safety and surveillance. I. Alternative Water Source: Projects irrigated from sources other than City water may have the points required for that area reduced by thirty percent (30%). 18.57.080 PreseFVation and Care of Significant Trees: Developments shall retain significant trees to themaximum extent practical. Areas devoted to access and areas to be cleared for required roads, utilities. sidewalks, trails, or storm drainage improvements are exempt from this requirement. A. Significant trees are healthy trees that do not present a safety hazard. are not listed in Section 18.57.100 as prohibited, and that meet one or more ofthe following criteria: 1. Six inches (6") or greater in diameter measured four feet (4') above grade 2. Part of a grouping of five (5) or more trees with canopies that touch or overlap 3. Member of a unique or unusual species 4. Within ffienty five feet (25') of a sensitive area or buffer, as defined in MLMC Title 19 B. The following measures shall be used to protect significant trees during construction: .L There shall be no clearing or grading of the site until after approval of the landscape plan. 2. The developer shall install a temporary but immovable fence four feet (4') high around the tree at the dripline to prevent disturbance during construction. 3. There shall be no impervious surfaces, fill, excavation. or storage of materials within the fenced area. 4. If the grade level around the tree is to be raised bv more than one foot (1 ') , a rock well shall be constructed around the tree, with the inside diameter of the well corresponding to the dripline of the tree. No fill is allowed inside the well area. 5. The grade level shall not be lowered within the larger of the t'vvo (2) areas defined as follows: a. The drip line of the tree, or b. An area around the tree equal to one foot (1 ') in diameter for each inch of tree trunk diameter measured four feet (4') above the ground. C. Alternative protection measures may be used if the city determines they will provide equal or greater tree protection. 18.57.110 Alteration of Landscape Requirements: The applicant may submit for consideration a landscaping plan that differs from the specific criteria set forth in this chapter. The applicant shall in writing, clearly and in detail, state what adjustments are being requested and the reasons that such adjustments are warranted. The application shall be accompanied by a drawing that meets the requirements of MLMC18.57.060, along with any supplemental data, such as sketches, surveys, and statistical information, that is deemed necessary to support the adjustment. The Planning Commission may approve, modify, or deny the requested adjustment. In approving the alteration, the Planning Commission shall make the following findings: A. The alteration would be in keeping with and preserve the intent of this chapter; and B. The alteration would not be contrary to the public interest; and C. The alteration is justified based on at least one ( 1) of the following: 1. The requirements of this chapter would result in more than fifteen percent (15%) of the site area being landscaped. In such cases the Planning Commission may modify those requirements so that not more than fifteen percent (15%) of the site must be landscaped, provided that the landscaping and corresponding setbacks required are those most beneficial to the public. More intensive landscaping may be required if the reduction in area would reduce the effectiveness of landscaping to a point where the intent of the landscaping type cannot be satisfied. 2. The inclusion of significant existing vegetation located on the site would result in as good as or better satisfaction of the purposes of this chapter. 3. Three foot (3') berms or six foot (6') architectural barriers are incorporated into the landscape design. Adjacent to the berm or barrier, the width of the perimeter landscaping strip may be reduced up to twenty-five percent (25%) if the landscaping materials are incorporated elsewhere on site. 4. Existing conditions on or adjacent to the site, such as sign ificant topographic differences, vegetation, structures, or utilities would render application of this chapter ineffective. 5. An existing or proposed structure precludes installation of the total amount of required perimeter landscaping. In such cases, the landscaping material shall be incorporated on another portion of the site. If no portion of the site can be landscaped, approved waterless landscaping features such as decorative rock, qabions, sculptures, and/or facade improvements as defined in 18.57.040 D.1 may be used. The totality of such features must be of sufficient substance and location as to serve the purpose of this chapter. 6. The proposed landscaping represents a superior result or is more effective than that which would be achieved by strictly following requirements of this section. Section 2. This ordinance shall take effect and be in force five (5) days after its passage and publication of its summary as provided by law. The City of Moses Lake recognizes that no community is immune from natural hazards whether it be earthquake, wildfire, flood, winter storms, drought, heat wave, or dam failure and recognizes the importance of enhancing its ability to withstand natural hazards as well as the importance of reducing the human suffering, property damage, interruption of public services, and economic losses caused by those hazards. 2. Major earthquakes pose a particular, significant, and ongoing threat to the entire City of Moses Lake. 3. The City of Moses Lake has a responsibility to promote earthquake preparedness internally as well as with the public and plan appropriately for earthquake-related disasters. 4. The protection of City of Moses Lake employees will allow them to facilitate the continuity of government and assist the public following a major earthquake event. 5. Community resiliency to earthquakes and other disasters depends on the preparedness levels of all stakeholders in the community -individuals, fami lies, schools, community organizations, faith-based organizations, non-profits, businesses, and government. 6. By participating in the Great Washington Shakeout on October 15, 2015, the City of Moses Lake has the opportunity to join and support all Washingtonians in strengthening community and regional resiliency. 7. By supporting the Great Washington Shakeout, the City of Moses Lake can utilize the information on www.ShakeOut.org /washington to educate its residents regarding actions to protect life and property, including mitigating structural and non-structural hazards and participating in earthquake drills. 8.
