PLEDGE OF ALLEGIANCE: Nia Watts, high school student, led the Council in the pledge of allegiance. PRESENTATION AND AWARDS RECOGNITION Cleo Stevens and Steffanie Bonwell were recognized for their outstanding efforts and contributions to the 2014 "Point in Time" homeless count, which is a nationwide effort to count the homeless and for their efforts to hold an event in Moses Lake which offered many service to those people in need. CONSENT AGENDA Minutes: The minutes of the January 28 meeting were presented for approval. Approval of Claims. Prepaid Claims. Checks. and Payroll: Vouchers audited and certified by the Finance Director as required by RCW 42.24.080, and those expense reimbursement claims, certified as required by RCW 42.24.090, have been recorded on a listing which has been made available to the Council for approval and is retained for public inspection at the Civic Center. As of February 11, 2014 the Council does approve for payment claims in the amount of $530,781.06; prepaid claims in the amount of $17,946.22; claim checks in the amount of $1, 171 ,658.64; and payroll in the amounts of $314, 773.43 and $5,07 4.25. Resolution -Alley Vacation -Set Public Hearing: A resolution was presented which sets the public hearing for consideration of the request by Fox Properties, LLC for the vacation of a portion of the alley between Third Avenue and Marina Drive adjacent to Lots 6 -11 , Lewis Elliott Add ition #2. Action Taken: Mr. Voth moved that the Consent Agenda be approved, seconded by Dr. Curnel, and passed unanimously. COMMISSION APPOINTMENTS -None CONSIDERATION OF BIDS AND QUOTES -None PETITIONS, COMMUNICATIONS. OR PUBLIC HEARINGS ORDINANCE -MARIJUANA MORATORIUM -2N° READING/PUBLIC HEARING An ordinance was presented which extends the moratorium on the establishment of "collective gardens" for the medical use of marijuana. The ordinance of the City of Moses Lake extending a moratorium on the establishment of medical marijuana collective gardens, defining "medical marijuana collective gardens", providing for a public hearing establishing an effective date, and providing that the moratorium, unless extended, will sunset within six (6) months of the date of adoption was read by title only. The public hearing was opened. There were no comments. Action Taken: Dr. Curnel moved that the public hearing be closed, seconded by Mr. Lane, and passed unanimously. Joseph K. Gavinski, City Manager, explained that the legislature is still debating the issue of medical marijuana and may make some changes in the law. Staff is recommending that the moratorium be continued until the legislature makes a final determination on the issue. CITY COUNCIL MINUTES: 2 February 11, 2014 Action Taken: Mr. Lane moved that the second reading of the ordinance be adopted, seconded by Mr. Voth, and passed unanimously. ORDINANCES AND RESOLUTIONS ORDINANCE -AMEND GARBAGE COLLECTION -2N° READING An ordinance was presented which amends the garbage regulations to provide for a franchise to haulers who hold a state Certificate of Public Convenience and Necessity in areas annexed by the City and providing that garbage, recycling, and yard waste containers in residential areas are not intended for commercial purposes. The ordinance amending Chapter 8.08 of the Moses Lake Municipal Code entitled "Garbage Collection" was read by title only. Action Taken: Mrs. Liebrecht moved that the second reading of the ordinance be adopted, seconded by Dr. Curnel, and passed unanimously. ORDINANCE -AMEND RESIDENTIAL VEHICLE STORAGE -2N° READING An ordinance was presented which amends the residential vehicle storage by changing the enforcement procedure. The ordinance amending Chapter 8.52 of the Moses Lake Municipal Code entitled "Residential Vehicle Storage" was read by title only. Joseph K. Gavinski, City Manager, pointed out that the only change is to the penalty provision and includes a written warning before any citation is issued. Gilbert Alvarado, Community Development Director, stated that in 2013 the Code Enforcement Officers dealt with 187 cases, all of which complied without having to resort to a fine. He explained the process that staff uses to gain compliance. There was considerable discussion by the Council. Action Taken: Dr. Curnel moved that the second reading of the ordinance be adopted, seconded by Mr. Ecret, and passed with Mr. Voth opposed as he felt the language in the ordinance was too open ended. ORDINANCE-AMEND STREET CONSTRUCTION OR IMPROVEMENT REIMBURSEMENT CHARGES- 2N0 READING An ordinance was presented which provides for the street improvement charges to Wapato Drive. The ordinance amending Chapter 12.40 of the Moses Lake Municipal Code entitled "Street Construction or Improvement Reimbursement Charges" was read by title only. Action Taken; Dr. Curnel moved that the second reading of the ordinance be adopted, seconded by Mr. Avila, and passed unanimously. ORDINANCE -AMEND SIDEWALK CONSTRUCTION -1sT READING ADOPTED An ordinance was presented which updates the sidewalk construction requirements to reflect current policies. The ordinance amending Chapter 12.12 of the Moses Lake Municipal Code entitled "Sidewalk Construction" was read by title only. Gary Harer, Municipal Services Director, explained that the changes are being proposed to reflect current practices and to update the language in certain areas. Action Taken: Mr. Lane moved that the first reading of the ordinance be adopted, seconded by Mr. Avila, and passed unanimously. CITY COUNCIL MINUTES: 3 February 11 , 2014 RESOLUTION -LEASE/PURCHASE A resolution was presented which provides for the reimbursement of capital expenditures from the proceeds of the lease/purchase agreement. The resolution of the City Council of the City of Moses Lake declaring its intention to reimburse itself from the proceeds of one or more tax-exempt financings for certain expenditures made and/or to be made in connection with the acquisition, construction and equipping of certain capital improvements was read by title only. Action Taken: Mr. Avila moved that the resolution be adopted, seconded by Mr. Lane, and passed unanimously. RESOLUTION -LOCAL GOVERNMENT INVESTMENT POOL PARTICIPATION A resolution was presented with reaffirms the authorization of the Finance Director to act on behalf of the City in contributing and withdrawing the City's monies in the Local Governments Investment Pool. The resolution authorizing investment of City of Moses Lake monies in the Local Government Investment Pool was read by title only. Action Taken: Dr. Curnel moved that the resolution be adopted, seconded by Mrs. Liebrecht, and passed unanimously. REQUEST TO CALL FOR BIDS -None REFERRALS FROM COMMISSIONS -None OTHER ITEMS FOR COUNCIL CONSIDERATION GUIDELINES -LODGING TAX FUNDING Currently the City is funding tourism promotion and the operations of special events and festivals without any written guidelines, application, or worksheet. Staff provided a draft set of General Guidelines for Lodging Tax Funding Support, a draft of a Lodging Tax Grant Application, and a draft of a Lodging Tax Expenditure Report. Joseph K. Gavinski, City Manager, explained the process that would be used to apply for the funds. Action Taken: Mr. Lane moved that the draft documents be adopted, seconded by Mr. Avila, and passed unanimously. NON-AGENDA ITEMS AND PUBLIC QUESTIONS AND COMMENTS -None COUNCIL QUESTIONS AND COMMENTS -None BIG BEND COMMUNITY COLLEGE Mr. Lane stated that Big Bend Community College is applying to the state for funds for a professional and technical building and suggested that the Council endorse the proposal. He mentioned that many of the college buildings were constructed for the old Larson Air Force Base and are 50 to 60 years old. The funds would provide for a new building. Action Taken: Mr. Lane moved that the Council endorse the letter of support for a professional and technical building at Big Bend Community College, seconded by Dr. Curnel , and passed unanimously. CITY MANAGER REPORTS AND COMMENTS AMBULANCE REPORT The cash report on the ambulance operations for the month of January was provided. CITY COUNCIL MINUTES: 4 February 11, 2014 BUILDING ACTIVITY REPORT The January building activity report was provided. SALES TAX/TRANSIENT RENTAL INCOME The City received $430, 110.34 in sales tax and $33,221 .58 in transient rental income in January. The regular meeting was recessed at 8 p.m. and the Council met in an executive session with the City Attorney to discuss litigation. No. 1 MAJOR PLAT FINDINGS OF FACT, CONCLUSIONS, AND DECISION 1. HEARING BEFORE THE PLANNING COMMISSION. 1.1 Date. A public hearing was held upon proper notice before the Planning Commission on January 16, 2014. 1.2 Proponent. Sam Lee & Associates, Inc., is the proponent of this plat. 1.3 Purpose. The proponent has requested to replat an existing 12-acre one-lot plat into two lots in the C-2 General Commercial Zone upon property legally described as the S. L. & A. Major Plat (Assessor Parcel #11-1766-600), and more fully described on the face of the plat. 1.4 Evidence. The Commission considered the following materials in reaching its decision: A. The plat submitted December 15, 2013. B. Staff report and attachments. C. Testimony from Anne Henning, staff; and Kevin Richards, Western Pacific Engineering; representing the proponent. 2. FINDINGS OF FACT BY THE PLANNING COMMISSION. Based upon the evidence presented to it, the Commission makes the following findings of fact: 2.1 The proponent is the owner of the property legally described above located within City limits. 2.2 The site is currently vacant. The plat will divide an existing platted lot into two platted lots. No development is proposed at the present time. 2.3 Surrounding land uses are a mix of residential, commercial, and vacant land. 2.4 Central Drive is classified as a secondary street. Existing improvements meet Community Standards. 2.5 The Development Engineer provided a list of comments and corrections that must be addressed before the final plat is submitted for review. 2.6 The Assistant Fire Chief commented that even though some hydrants have been installed on this property, additional and/or relocated hydrants may be required at the time of building construction. 2. 7 The Bureau of Reclamation (USBR) commented that the proposal does not involve Columbia Basin Project Facilities, therefore they have no comment. 2.8 The East Columbia Basin Irrigation District (ECBID) commented that the plat is outside ECBI D boundaries and. does not have any District facilities running through it, so they have no comment. 2.9 The Department of Transportation commented that they have no issues or concerns with the project. 2.10 A Mitigated Determination of Non-Significance (MONS) was issued for the previous plat on April 25, 2012, under the State Environmental Policy Act Rules (WAC 197-1 1). There were 9 conditions, related to street and utility improvements, deleterious materials spills, stormwater, fill, site stabilization, water rights, and retaining sediment on site. The conditions of the MONS automatically become conditions of the project approval. 2.11 The Comprehensive Plan sets minimum acceptable transportation levels of service for the Valley Road Corridor. 2.12 Comprehensive Plan General Land Use Policy 1 encourages cost-effective development adjacent to urban areas where adequate public facilities and services exist or can be provided in a timely and efficient manner. 2.13 Comprehensive Plan Land Use Policy 4 encourages infill developments that are scaled and designed to fit their surroundings on properties suited to urban development. 2.14 Comprehensive Plan Commercial Goal 7 is to create an attractive and well-distributed system of commercial locations to serve community needs. 2.15 Comprehensive Plan Commercial Policy 37 is for commercial areas outside the central business district to complement downtown and help to meet other community needs. 2.16 Commercial Land Uses Policy 38 is to avoid strips of commercial uses. Commercial areas of all types should be compact, allow for walking between businesses, and be located at an intersection of arterials or be bounded by arterials or other boundaries such as topography, that would discourage commercial development in long, narrow strips. Commercial uses should be designed so that impacts on adjacent uses will not pressure adjacent uses to convert to commercial uses. 2.17 Commercial Land Uses Policy 39 encourages new commercial development to locate within existing commercial areas in order to enhance the area's econom ic viability. 2.18 Commercial Land Uses Policy 40 directs the city to maintain an adequate supply of suitable commercial sites to meet the anticipated demand for the planning period. 3. CONCLUSIONS BY THE PLANNING COMMISSION. From the foregoing findings of fact, the Planning Commission makes the following conclusions: 3.1 The decision of the Planning Commissiqn must be supported by the evidence presented and must be consistent with the standards and criteria for review specified in state statutes and city ordinances. The standards and criteria for review of preliminary plat applications are found in Chapter 58 .17 of the Revised Code of Washington (RCW), Title 17 of the Moses Lake Municipal Code (MLMC), and Title 20 MLMC. 3.2 MLMC 20.09.020 requirements: 1. Comprehensive Plan/Municipal Code: The development is consistent with Comprehensive Plan goals and policies on infill and commercial uses by platting a site in a commercial area that already has access to City services and making it su itable for future development. The development is consistent with the Municipal Code. 2. Adequate provisions for necessary improvements: All improvements exist or will be provided with development. 3. Impacts: No impacts have been identified under Chapters 14 through 19 that will not be mitigated through existing regulations and conditions. 4. Public health, safety, welfare, and interest: The development is beneficial to the public health, safety and welfare and is in the public interest by platting land consistent with the intent of the C-2 Zone. 5. Transportation Level of Service: The development does not lower the level of service of transportation facilities below the minimum standards established in the Comprehensive Plan because platting the property does not change the traffic generated by the site. 6. Parks Level of Service: This project will not affect parks level of service. 7. Dedications: No street right-of-way is proposed for dedication with this development proposal. 4. DECISION OF THE PLANNING COMMISSION. On the basis of the foregoing findings of fact and conclusions, it is the decision of the Planning Commission of the City of Moses Lake that the request for a preliminary major plat as submitted on the property designated above be approved with the following conditions: 4.1 The comments of the Development Engineer shall be addressed before final plat submittal. However, the Municipal Services Director may allow planteFs, trash receptacles cans, benches, utility poles, fire hydrants, tree wells, trees, traffic signal controllers, etc. to be installed in the sidewalk areas that are within the Paver District and commercial zones. In all cases, sidewalks shall be constructed to provide at least a minimum of five feet (5') of clearance from all obstructions. C. Owners in the Paver District may place items such as small tables, chairs, flower pots, and benches on the first three-foot (3') area of their abutting sidewalk as measured from the property line. but said sidewalks shall be nine feet (9') wide or greater and shall provide at least five feet (5') of clearance for clear passage. Advertisements. signs. and similar items are not permitted with this authorization. 12.12. 015 Activity Trail Specifications: Activity trails shall be installed along routes as directed or approved by City Council. Activity trails shall be constructed in accordance with the pet plans that are approved by the Municipal Services Director. Construction shall be consistent with requirements of the Community Street and Utility Standards with the exception that activity trails in the Paver District shall be constructed with concrete brick pavers per Section 12.12.010 of the Moses Lake Municipal Code. 12.12.020 Curb Requirements: All curbs shall be constructed of natural colored Portland cement concrete and shall be constructed in accordance with the Community Street and Utility Standards; however, in existing developed areas, curb replacement ettfbs shall be constructed in accordance with existing curb improvements. 12 .12.030 Rolled Curb Allowed: Rolled curb is not allowed on new streets. Rolled curb may only be installed to replace existing rolled curb. 12.12. 060 Duty to Maintain and Service Sidewalks: A. The owner or occupier of property that abuts sidewalks or abuts dedicated city right-of-way or deeded city property adjacent to sidewalks shall bear the duty and expense of maintaining and servicing sidewalks in a good state of repair, free from obstructions, and in a clean condition. However, the city shall bear the duty and expense to repair sidewalks in the Paver District that are constructed with concrete brick pavers, and all sidewalks that were constructed of concrete brick pavers through city participation. For sidewalks to be in a good state of repair, the sidewalks shall not have any vertical differences of one inch (1 ")or greater; and they shall not have any contiguous areas of spalling greater than four (4) square feet. Exposed aggregate in existing sidewalks shall be considered spalling when the surface wear measures one- quarter inch (!4") or greater in differential elevation. B. The city may participate in sidewalk repairs for sidewalks that are wider than six feet (6'). Such participation may be made for sidewalk repairs that are within the right-of-way and that are beyond the first six feet (6') of sidewalk nearest to the curb. Such participation is valid only if the city has provided written pre-approval for the sidewalk repairs. When the city agrees to participate with sidewalk repairs for over-width sidewalks, the owner will pay the contractor for the full repairs; and the city will make payment directly to the owner for pre-approved sidewalk repairs after the owner has provided a paid invoice from their contractor. C. Unless otherwise approved by the Fire Chief, an all weather surface shall mean an asphaltic or Portland cement concrete hard surface or pavement which can be well maintained. Additionally, access roads serving one and two family residences may be surfaced as approved by the Fire Chief. B. Turning Radius: 1. The turning radius for any turn around or cu l-de-sac that is greater than 220 feet long, measured from the intersection of the streets to the center of the cul-de-sac, on a required fire apparatus access roadway within city street right-of-way or on private property shall not be less than forty-six feet (46'). The forty-six foot (46') radius shall be measured from the center point of the cul-de-sac or turn around and extend to the back of the curb, or on private access roads to the edge of asphalt if no curb is installed. 2. The turning radius for any turn around or cul-de-sac that is equal or less than 220 feet long, measured from the intersection of the streets to the center of the cul-de-sac, on a required fire apparatus access roadway within City street right-of-way shall not be less than thirty feet (30'). The thirty foot (30') radius shall be measured from the center point of the cul-de- sac or turn around and extend to the back of the curb. 3. Turnarounds or cul-de-sacs installed on required private fire apparatus access roadways shall be hard surfaced capable of withstanding heavy vehicle traffic. Alternate methods of creating private access road turnarounds may be approved by the Fire Chief. Approved temporary turn arounds may include hammerhead arrangement designs or a graveled surface ninety-two feet (92') in diameter. C. Grade: The gradient for a private fire apparatus access road shall not exceed fifteen percent (15%), except that fire apparatus access roads leading to buildings fully protected by automatic sprinkler systems may exceed fifteen percent (15%) when, in the opinion of the Fire Chief, fire fighting or rescue operations would not be impaired. D. Signs shall have three inch (3") reflective red lettering on a white background. The top of the sign shall not be less than four feet (4') nor more six feet (6') from the ground. Vertical curbs shall be painted yellow or red on the top and side. Rolled curbs or surfaces without curbs shall have a yellow or red six inch (6") wide painted stripe. The paint or striping shall extend the length of the designated fire lane. F. Aerial Fire Apparatus Access Roads: Buildings or portions of buildings, or facilities exceeding thirty feet (30') in height above the lowest level of Fire Department access shall be provided with a roadway that complies with Section D105 of the 2009 State Fire Code as currently adopted or as amended in the future. G. Residential Developments: Access shall be provided to new residential developments in accordance with Sections D106 and D107 of the 2009 State Fire Code as currently adopted or as amended in the future. The proposed amendment would require that developed residential properties maintain all grasses, weeds or other vegetation, no taller than six inches (6") in height as measured above the ground. Also, I would add that staff did talk with the City Council about some of the site conditions with some of the residential areas. Some areas have a presence of sage, grease wood and other woody vegetation. Staff was not provided any direction with regards to dealing with these types of site conditions. Defective or overflowing septic or sewage systems, and the existence of any noxious, foul , or putrid liquid or substance which poses a health hazard or creates a noxious odor. C. Any man-caused pool of standing or stagnant water, except storm drainage systems, which serves as a breeding area for insects. D. E. All other acts, failure to act, occupations, or use of property which is determined by the Health Officer to be a menace to the health of the public. F. All limbs of trees which are less than seven (7) feet above the surface of any public sidewalk, or twelve (12) feet above the surface of any street. G. All buildings, other structures, or portions thereof which have been damaged by fire, decay, neglect, or have otherwise deteriorated or become dilapidated so as to endanger the safety of the public. H. All explosives, flammable liquids, and other dangerous substances stored or used in any manner in violation of the State Fire Code. I. The keeping or harboring of any dog, fowl, or other animal which by frequent or habitual howling, yelping, barking, crowing, or in the making of other noises, annoys or disturbs the public, or the habitual allowing of dogs kept at any one address to run at large in violation of Chapter 6.05 of the Moses Lake Municipal Code entitled "Animal Control". J. Making or causing to be made by any means whatsoever any noise of any kind which is a violation of Chapters 8.28 of the Moses Lake Municipal Code entitled "Noise Control". K. The frequent, repetitive, or continuous sound made by any secured, unsecured, or deteriorated membrane or sheet metal, being moved by the wind or other source, which unreasonably interferes with the peace, comfort and repose of adjacent property owners or possessors. Dumping, throwing , placing, leaving or causing or permitting to be dumped, thrown, placed or left, any filth, paper, cans, glass, rubbish, trash garbage, grass trimmings, shrub trimming, and shrubbery of any kind, in or upon any street, alley, sidewalk, ditch, or public or private property of another in the city. M. The erecting, maintaining, using, placing, depositing, leaving or permitting to be or remain in or upon any private lot, building, structure or premises, or in or upon any street, alley, sidewalk, park, parkway or other public or private place in the city, any one or more of the following disorderly, disturbing, unsanitary, fly-producing, rat-harbori ng, disease-causing places, conditions or things: 1. Any putrid, unhealthy or unwholesome bones, meat, hides, skins, or whole or any part of any dead an imal, fish or fowl, or waste parts of fish, vegetable or animal matter in any quantity; but nothing herein shall prevent the temporary retention of waste in approved covered receptacles. 2. Any privies, vaults, cesspools, sumps, pits or like places which are not securely protected from flies and rats, or which are foul or malodorous. 3. Any filthy, littered or trash-covered dwellings, cellars, house yards, barnyards, stable yards, factory yards, vacant areas in the rear of stores, vacant lots, houses, buildings or premises. 4. Any animal manure in any quantity which is not securely protected from flies or weather conditions, or which is kept or handled in violation of any ordinance of the city. 5. Any poison oak or poison ivy, Russian thistle or other noxious weeds, as defined by Chapter 8.22 of the Moses Lake Municipal Code entitled "Noxious Weed Control" whether growing or otherwise; but nothing herein shall prevent the temporary retention of such weeds in approved covered receptacles. 6. Any bottles, cans, glass, ashes, small pieces of scrap iron, wire, metal articles, bric-a-brac, broken crockery, broken glass, broken plaster and all such trash, or abandoned material, unless it is kept in approved covered bins or galvanized iron receptacles. 7. Any trash, litter, rags, accumulations or empty barrels, boxes, crates, packing cases, mattresses, bedding, excelsior, packing hay, straw or other packing material, lumber not neatly piled, scrap iron, tin or other metal not neatly piled, or anything whatsoever in which flies or rats may breed or multiply or which may be a fire hazard. N. The permitting to remain outside any dwelling, building, or other structure, or within any unoccupied or abandoned building, dwelling, or other structure, in a place accessible to children, any abandoned, unattended, or discarded ice chest, refrigerator or other airtight contained, which does not have the door, lid or other locking device removed. 0. Q. The repair or abandonment of any automobile, truck, or other motor vehicle of any kind upon the public streets or alleys of the city. R. The keeping or permitting the existence of any bees or other insects, reptiles, rodents, fowl, or any other animals, domestic or wild, in any manner contrary to law, or which affect the safety of the public. S. The existence of any fence, other structure, or thing on private or public property abutting or fronting upon any public street, sidewalk, or place, which is sagging, leaning, fallen, decayed or is otherwise dilapidated and creating an unsafe condition. T. The existence of any vine, shrub, or plant growing on, around, or in front of any fire hydrant, utility pole, utility box, or any other appliance or facility provided for fire protection, public or private utility purposes in such a way as to obscure from view or impair access thereto. U. Except for any designated public park land, natural area, or environmentally sensitive area, or any undeveloped parcels of land not adjacent to developed areas or which are used for agricultural purposes, all grasses, weeds, or other vegetation growing or which has grown and died, which is determined to be a fire or safety hazard or a nuisance to persons, shall not exceed twelve inches (12") in height measured above the ground. In developed residential areas all grasses, weeds, or other vegetation growing or which has grown and died, which is determined to be a fire or safety hazard or a nuisance to persons. shall not exceed six inches (6") in height measured above the ground. 1. The above exception may be waived and additional maintenance required by the Code Enforcement Officer if he determines such action is necessary to protect the safety of persons or adjoining property. 2. All maintenance shall be done in a manner so that soil stability will not be disrupted or disturbed. Grass, weed, or vegetation control shall not include plowing, discing, or scraping the soil to eliminate the grasses, weeds, or other vegetation unless a soil stabilization plan, which will minimize blowing dust and maintain soil stability and which shall be approved by the city prior to any plowing, discing, or scraping, is implemented immediately. V. The existence of any dead, diseased, infected, or dying tree, shrub, or other vegetation which may pose a danger to vegetation, crops, property, or persons. W. The existence of any accumulation of materials or objects in a location when the same endangers property, safety or constitutes a fire hazard. X. The depositing or burning or causing to be deposited or burned in any street, alley, sidewalk, parkway or other public place which is open to travel, of any hay, straw, paper, wood, boards, boxes, leaves, manure or other rubbish or material. Y. The storage or keeping on any premises for more than thirty days of any used or unused building materials as defined in Section 8.14.010 (F), whose retail cost new would exceed one hundred dollars, without a special permit from the building official; provided, that nothing herein shall: 1. Prohibit such storage without a permit when done in conjunction with a construction project for which a building permit has been issued and which is being prosecuted diligently to completion. 2. Prohibit such storage without a permit upon the premises of a bona fide lumber yard, dealer in building materials or other commercial enterprise when the same is permitted under the zoning ordinance and other applicable laws. 3. Make lawful any such storage or keeping when it is prohibited by other ordinances or laws. Z. The existence on any premises of any unused and abandoned trailer, house trailer, automo- bile, boat or other vehicle or major parts thereof. AA. The keeping or maintenance in any area on private property which is clearly visible from a public street, sidewalk, park or other public area any accumulation, collection or untidy storage of any of the following : old appliances or parts thereof; old iron, steel, aluminum or other metal; inoperable vehicles, vehicle parts, machinery or equipment; mattresses, bedding, clothing, rags or cloth; straw, packing materials, cardboard or paper, tin cans, wire, bottles, glass, cans, barrels, bins, boxes, containers, ashes, plaster or cement; or wood. This determination shall not apply to conditions completely enclosed within a building or fencing so as not to be visible from public property. BB. The keeping, permitting or harboring of any fowl, pigeons, rabbits, hoofed or cloven footed animals, except for caged birds kept within a residence or business. CC. The depositing of any debris, vegetation, lawn clippings, lumber piles, wood piles, auto parts or bodies, garbage and the like, or storing of any material of any kind, provided that in residential zones that shall include garbage cans or refuse containers in the alleys of the city, except on garbage pickup day. DD. The existence of graffiti, which is defined as a defacing, damaging, or destructive inscription, figure or design painted, drawn or the like, on the exterior of any building, fence, gate, or other structures or on rocks, bridges, trees, or other real or personal property. EE. The locating of automobiles, trucks, recreational vehicles, trailers, boats, or any other vehicles, vessels, or the like for the purpose of advertising its sale on property located in any commercial or industrial zone not owned by the seller. FF. The permitting of any condition or situation where the soil has been disrupted, disturbed, or destablized so as to allow blowing dust to exist. GG. The existence on any premise any unsecured, unused, or abandoned building or structures. HH. For any building the existence of any broken glass in windows or doors for more than thirty (30) days. II. Buildings or portions thereof that have faulty weather protection, such as openings in walls and roofs. Faulty weather protection shall include temporary weather barriers, such as tarps, plastic or similar material, left in place for more than thirty (30) days. JJ. Any bu ilding which has a window, door, or other exterior opening closed by extrinsic devices or some other manner, with material that has not been painted to match or compliment the buildings exterior or remains boarded up for more than sixty (60) days. KK. Any boarded up building that remains boarded up for more than ninety (90) days. LL Permitting any violation of RCW 59.18.510 in any rental dwelling unit. MM. Criminal street gangs and any pattern of criminal street gang activity are each declared to be a public nuisance in violation of this chapter and other applicable code provisions, including but not limited to the Uniform Code for the Abatement of Dangerous Buildings and State Housing Code, subject to abatement through all available means. In addition thereto and without limitation, any pattern of criminal street gang activity upon, and the presence and use of property by, a criminal street gang, with the owner's knowledge or consent, constitutes a public nuisance and grounds for revocation of any permit or license regulating or authorizing the use of such property. Section 2. This ordinance shall take effect and be in force five (5) days after its passage and publication of its summary as provided by law. Kenison, City Attorney 7423 CITY COUNCIL MEETING September 24, 2013 RESOLUTION -ABANDON EASEMENT -ANDERSON A resolution was presented which provides for the abandonment of the 5' public utility easement on the west side of Lot 3, Moses Lake Industrial Park Replat of Lots 8 and 10, Block 4, located at 3326 Citation Road. The resolution authorizing abandonment of an easement was read by title only. Gilbert Alvarado, Community Development Director, stated that the East Columbia Irrigation District has an easement along the rear of the property and so long as there is no encroachment into their easement they have no problems with the abandonment. Action Taken: Mr. Reese moved thatthe resolution be adopted, seconded by Mr. Avila, and passed unanimously. RESOLUTION -GREAT WASHINGTON SHAKEOUT A resolution was presented which supports the City's participation in the Great Washington Shakeout "Drop Cover and Hold On" earthquake drill on October 17 at 10:17 a.m. The resolution of intent to participate in the Great Washington Shakeout and Work Toward Becoming a Safer Community was read by title only. The current ordinance should be amended to address these vacant lots. Gilbert Alvarado, Community Development Director, explained that the current policy requires a property owner to remove weeds a distance of 1 O' back from the sidewalk but does not require weed removal on the entire lot. Joseph K. Gavinski, City Manager, gave some background on the current weed removal policy. There was considerable discussion on how to address the weeds and staff was directed to provide an amendment to the ordinance to deal with the entire lot. 7436 CITY COUNCIL MINUTES October 22, 2013 WEED ABATEMENT Gilbert Alvarado, Community Development Director, stated that staff was requested to investigate what other jurisdictions do about taking care of vacant lots with regard to weeds. He explained the requirements of other cities. He also pointed out that Moses Lake is unique in that there are large tracts of vacant land inside the City's limits, which is not the case in other jurisdictions. He reminded the Council that Moses Lake requires property owners to trim and maintain 1 O' behind the right-of-way or sidewalk and not the perimeter. There was some discussion by the Council and no action was taken . INSURANCE Joseph K. Gavinski, City Manager, mentioned that the City is audited each year by WCIA and provided the Risk Profile to the Council. AMBULANCE REPORT The cash report on the ambulance operations for the month of September was provided. BUILDING ACTIVITY REPORT The September building activity report was provided. He requested staff provide an amendment to the current ordinance to address weed abatement and trash in vacant lots, mainly in residential areas and areas adjacent to a residential neighborhood. CITY MANAGER REPORTS AND COMMENTS DECEMBER MEETING Joseph K. Gavinski, City Manager, reminded the Council that the second meeting in December is scheduled for the 24th and he suggested that it be changed to Monday, December 30 at 7 p.m. in order to make any needed budget adjustments. It was the consensus of the Council to move the second meeting in December to the 301h at 7 p.m. COUNCIL/STAFF RETREAT Joseph K. Gavinski, City Manager, stated that the Council/staff Retreat has been tentatively scheduled for March 7 and 8 at the Atech Building at Big Bend Community College. Garbe from Lake Bowl and Ten Pin Brewing Co. I have been asked by the Seattle Outboard Association if I would be willing to set up a Ten Pin beer garden featuring our beers during their Stock-mod Outboard National boat races in August. This is a large event that is bringing hundreds of participants and fans into our community from all over the country. After speaking with Spencer Grigg, he recommended that I send you a letter to detail the specifics of the event and the beer garden. The details are as follows: The races begin August 41h at Cascade Park and end on August 91h. I would like to propose to set up a beer garden each day of the event from no earlier than 11 am and to close no later than Bpm. The beer garden will be located inside the fenced concrete area of the park. Beer will only be served inside the designated area and must remain there at all times. Beer will not be allowed outside of the designated beer garden. All sales and consumption will be strictly in compliance with the Washington State Liquor Control Board laws. The Seattle Outboard Association would like to have the beer garden, not to create a "party" type atmosphere but rather to enhance the experience of the event with food and drink options. They hope to make Moses Lake a regular destination for future national events. I am also looking for a non-profit organization to share in this event with me in hopes to raise money for a worthy cause. I plan on speaking to the Moses Lake Chamber of Commerce or the Columbia Basin Cancer Foundation. I appreciate your consideration in this matter.
