Council Present: Bill Ecret, Dick Deane, Jason Avila, David Curnel, Jon Lane, Brent Reese, and
Karen Liebrecht
The meeting was called to order at 7 p.m. by Mayor Ecret.
PLEDGE OF ALLEGIANCE: Jennifer Hassan, high school student, led the Council in the pledge
of allegiance.
PRESENTATIONS AND AWARDS -None
CONSENT AGENDA
Minutes: The minutes of the January 8 meeting were presented for approval.
National Frozen Food Final Major Plat and Findings of Fact: National Frozen Foods Corporation
submitted a final plat for a one lot plat of 63.76 acres at 14406 Wheeler Road, which is the existing
plant site and the agricultural land to the north. The site is zoned Heavy Industrial, which
corresponds with the Comprehensive Plan Land Use Designation of Industrial. The Planning
Commission recommended that the final plat be approved with conditions. The Findings of Fact
were also provided.
Action Taken: Mr. Deane moved that the Consent Agenda be approved, seconded by Mr. Avila,
and passed unanimously.
Approval of Claims, Prepaid Claims, Checks, and Payroll: Vouchers audited and certified by the
Finance Director as required by RCW 42 .24.080, and those expense reimbursement claims,
certified as required by RCW 42 .24 .090, have been recorded on a listing which has been made
available to the Council for approval and is retained for public inspection at the Civic Center. As
of January 22, 2013 the Council does approve for payment claims in the amount of $996,509.58 ;
prepaid claims in the amount of $41 ,448.49; claim checks in the amount of $916,721 .76 ; and
payroll in the amount of $318,572.32.
Dr. Curnel questioned the payment to WCIA for liability insurance and the equipment rental costs .
Staff explained what the payments covered.
Action Taken: Dr. Curnel moved that the bills and checks be approved, seconded by Mr. Avila, and
passed unanimously.
COMMISSION APPOINTMENTS -None
CONSIDERATION OF BIDS AND QUOTES
TREE REPLACEMENT PROJECT
The City received eight bids for the 2013 Tree Replacement Project. This project includes
removing thirty trees and tree planters in the downtown paver district and replacing twenty-five of
them with European Hornbeam. Additive 1 includes removal and replacement of five additional
trees and tree planters.

There was some discussion by the Council.
Action Taken: Mr. Lane moved that the bid be awarded to Matia Contractors, Inc. in the amount
of $157,532, seconded by Mr. Reese, and passed with Dr. Curnel and Mrs. Liebrecht opposed .
PETITIONS, COMMUNICATIONS, OR PUBLIC HEARINGS -None
ORDINANCES AND RESOLUTIONS
ORDINANCE -2012 COMPREHENSIVE PLAN AMENDMENTS -1ST READING
An ordinance was presented which adopts the 2012 Comprehensive Plan amendments.
The ordinance adopting the 2012 Comprehensive Plan Amendments was read by title only .
Gilbert Alvarado, Community Development Director, explained that the City was informed that
comprehensive plan amendments should be adopted by ordinance rather than by resolution .
Action Taken: Mrs. Liebrecht moved that the first reading of the ordinance be adopted, seconded
by Dr. Curnel , and passed unanimously.
ORDINANCE -AMEND 17.15 -REQUIREMENTS FOR PLAT AND SITE PLANS -1ST READING
An ordinance was presented which amends Chapter 17.15, Requirements for Plat and Site Plans,
to require either deeded property or a dedication for right-of-way, installing monuments when the
surveyor does not accept the existing monuments, and allowing the plat to be recorded on 24" x
36" sheets.
The ordinance amending Chapter 17.15 of the Moses Lake Municipal Code entitled "Requirements
for Plat and Site Plans" was read by title only.
Action Taken : Mr. Reese moved that the first reading of the ordinance be adopted , seconded by
Mr. Avila, and passed unanimously.
ORDINANCE -REPEAL 9.05 -FIREARMS -1ST READING
An ordinance was presented which repeals Chapter 9.05, Firearms, because the statutes
referenced have been repealed by the state legislature.
The ordinance repealing Chapter 9.05 of the Moses Lake Municipal Code entitled "Firearms" was
read by title only.
Action Taken: Mr. Lane moved that the first reading of the ordinance be adopted, seconded by Mr.
Deane, and passed unanimously.
RESOLUTION -ACCEPT DONATION
A resolution was presented which accepts $1 ,500 from an anonymous foundation. The funds will
be used in the Police Department for the purchase of ballistic body armor for the patrol officers.
The resolution accepting a donation to the Moses Lake Police Department was read by title only.
Action Taken: Dr. Curnel moved that the resolution be adopted, seconded by Mr. Avila, and passed
unanimously.

RESOLUTION -LEASE PURCHASE AGREEMENT
A resolution was presented which accepts the Lease/Purchase Agreement from U. S. Bancorp and
authorizes the City Manager to sign the necessary documents.
The resolution authorizing the execution and delivery of a Maser Equipment Lease/Purchase
Agreement, and related instruments, and determining other matters in connection therewith was
read by title only.
Action Taken: Mr. Avila moved that the resolution be adopted, seconded by Mr. Lane, and passed
unanimously.
RESOLUTION -ACCEPT EASEMENT -CENTRAL TERMINALS, LLC
A resolution was presented which accepts an access easement from Central Terminals LLC for
municipal purposes to access any existing or future on-site water meters and electronic reading
devices and/or sanitary sewer meters.
The resolution accepting an easement to the City of Moses Lake from Central Terminalis, LLC was
read by title only.
Action Taken : Mrs. Liebrecht moved that the resolution be adopted, seconded by Mr. Reese, and
passed unanimously.
RESOLUTION -BUILD ON UNPLATTED PROPERTY -CITY OF MOSES LAKE
A resolution was presented which allows the City of Moses Lake to build restrooms on unplatted
property at Cascade Park without the requirement to plat. The resolution also rescinds Resolution
No. 3280 which previously granted the same permission but with the requirement to plat. It was
discovered that platting Cascade Park would be cost prohibitive.
The resolution allowing the City of Moses Lake to build on unplatted property was read by title only.
Action Taken: Mr. Reese moved that the resolution be adopted, seconded by Mr. Lane, and passed
unanimously.
RESOLUTION -GRANT DEED -WITRON
A resolution was presented which grants a deed to Ismael Witron for property located adjacent to
Lot 7, Block 1, Replat of Battery Orchard Tract 31 on Wanapum Drive.
The resolution declaring City owned real property as surplus and authorizing its sale was read by
title only.
Gilbert Alvarado, Community Development Director, provided the background of the situation for
the Council.
Action Taken : Mr. Deane moved that the resolution be adopted , seconded by Mr. Avila , and passed
unanimously.

REQUEST TO CALL FOR BIDS
STORMWATER RETROFIT PROJECT
Staff requested authorization to call for bids forthe Storm water Retrofit Project, Site B. The project
includes construction of a bio-infiltration swale on Sage Road, installation of storm water pipe and
catch basins, abandonment of existing drywells, and associated work.
Action Taken: Mr. Lane moved that staff be authorized to call for bids, seconded by Mrs. Liebrecht,
and passed unanimously.
2013 CRACK SEAL PROJECT
Staff requested authorization to call for bids for the 2013 Crack Seal Project. This project includes
sealing approximately 500,000' of cracks in streets, alleys, and parking lots throughout the City.
Action Taken: Mr. Reese moved that staff be authorized to call for bids, seconded by Mr. Avila, and
passed unanimously.
REFERRALS FROM COMMISSIONS
FEE INCREASE -SURF N SLIDE WATER PARK
The Parks and Recreation Commission has recommended that the City increase the fees at the
Surf 'n Slide Water Park.
Action Taken : Mr. Deane moved that staff be authorized to increase the fees at the Surf 'n Slide
Water Park, seconded by Mr. Lane, and passed unanimously.
OTHER ITEMS FOR COUNCIL CONSIDERATION
SEWER MAIN -GRANT
Authorization was requested for the City Managerto sign the Grant County Strategic Infrastructure
Program Award Terms and Conditions Acceptance Letter regarding an award of a $100,000 grant
and a $60,000 no interest loan for the installation of approximately 2,100 linear feet of sewer main
along Randolph Road . The sewer main is intended to provide service to what has been described
as Project Jackson, a new industrial development. The $60,000 loan will be repaid by Project
Jackson.
Action Taken : Mr. Lane moved that the City Manager be authorized to sign the agreement,
seconded by Mrs. Liebrecht, and passed unanimously.
GRANT TRANSIT AUTHORITY
The Grant Transit Authority requested the appointment of a representative from the City Council
to serve on their Board of Directors for the year 2013.
Action Taken: Dr. Curnel moved that Mr. Deane be re-appointed to serve on the Board, seconded
by Mr. Avila, and passed with Mr. Deane abstaining.

GRANT COUNTY MOSQUITO CONTROL
The Grant County Mosquito Control District #1 requested the appointment of Chris Blessing to their
Board to replace YaDell Yada.
Action Taken: Mr. Deane moved that Chris Blessing be appointed to the Board of the Grant County
Mosquito Control District #1 , seconded by Mr. Lane , and passed unanimously.
NON-AGENDA ITEMS AND PUBLIC QUESTIONS AND COMMENTS -None
COUNCIL QUESTIONS AND COMMENTS
COUNCIL TRAVEL
Mr. Lane stated that he serves on the Grant County Economic Development Retail Task Force
which will be attending a Global Retail Real Estate Convention in Las Vegas on May 19 -22 and
have requested that he attend. He mentioned that a past policy of the Council provides that the
City may reimburse a City Council member for travel expenses if they are given prior authorization
for the travel.
There was some discussion and it was the consensus of the Council that approximate costs for the
trip be provided prior to any decision being made.
CITY MANAGER REPORTS AND COMMENTS
GAMBLING TAX
The City received $74,322.48 from gambling tax for the fourth quarter.
INVESTMENT REPORT
The City received $15,501.19 in investment income for December 2012.
QUARTERLY FINANCIAL REPORT
The fourth quarter financial report has been placed on the website.
SALES TAXITRANSIENT RENTAL INCOME
The City received $424,167.87 in sales tax and $34,675.70 in transient rental income in December
2012.
The regular meeting was recessed at 8:05 p.m. and the Council met in an executive session with
the City Attorney to discuss litigation. The executive session was adjourned at 8:45 p.m. and the
regular meeting was reconvened. The regular meeting was adjourned at 9:45 p.m.

SUBJECT: Blackstone OTR Final Major Plat and Findings of Fact
Castle Farms Enterprises has submitted a final plat application for a one-lot plat of 27
acres at 8037 Randolph Road , the site of the Blackstone OTR facility under construction.
The site is zoned Heavy Industrial, which corresponds with the Comprehensive Plan Land
Use Designation of Industrial. There have been no significant changes from the
preliminary plat. The Planning Commission recommended that the final plat be approved
with conditions. Attached are the Findings, Conclusions and Decision of the Planning
Commission. The Council's approval of this decision incorporates and adopts the
Findings, Conclusion and Decision of the Planning Commission .

FINDINGS OF FACT, CONCLUSIONS , AND
DECISION
1. HEARING BEFORE THE PLANNING COMMISSION.
1.1 Date. A public meeting was held upon proper notice before the Commission on January 24,
2013.
1.2 Proponent. Castle Farms Enterprises, Inc. is the proponent of this plat.
1.3 Purpose. The proponent has submitted a final plat application to create one platted lot of
27.24 acres for property which is legally described upon the plat. City staff has confirmed the
property described on the plat is the property submitted for platting .
1.4 Evidence. The Commission considered the following materials in reaching its decision:
A. The final plat submitted.December 20,2012.
B. Staff report and attachments.
2. FINDINGS OF FACT BY THE PLANNING COMMISSION.
Based upon the evidence presented to them, the Commission makes the following findings of fact:
2.1 The proponent is the owner of the property.
2.2 The property is zoned Heavy Industrial.
2.3 There were no significant changes between the preliminary plat and final plat.
2.4 Corrections to the drawing are needed, as noted in the Development Engineer's comments.
2.5 Because the property owner is a corporation rather than an individual, documentation is
needed showing that the person signing the plat is authorized by the corporation to do so.
2.6 Because the proponent also submitted a binding site plan, an easement for access to the
water meters will be required. This easement is easiest to track when it is located on the
face of the plat, rather than a separate document.
2.7 Cascade Natural Gas installed a gas line and were told it would be with in an easement.
However, that easement is not shown on the plat.
3. CONCLUSIONS BY THE PLANNING COMMISSION.
From the foregoing findings of fact the Commission makes the following conclusions:
3.1 The Planning Commission of the City of Moses Lake is vested with the authority to determine
approval of plats.
3.2 It is in the best interests and welfare of the city's citizens to plat the property as proposed.
3.3 Before the plat can be recorded, staff needs to verify that the person signing the plat on
behalf of the property owner is authorized by the owner to do so.
3.4 The easement for access to the water meters easement is best located on the face of the
plat, rather than a separate document.
3.5 Cascade Natural Gas installed a gas line in good faith, believing it to be within an easement.

On the basis of the foregoing findings of fact and conclusions, it is the recommendation of the
Planning Commission that the plat be approved with the following conditions:
4.1 The comments of the Development Engineer shall be addressed.
4.2 Before the plat is recorded, the proponent shall provide documentation, acceptable to the City
Attorney, that the person signing the plat is authorized by the property owner to do so.
4.3 The easement for access to water meters shall be dedicated on the face of the plat.
4.4 The proponent shall provide an easement to Cascade Natural Gas to address the gas
facilities on the site. This easement may be a private easement or a public utility easement.

SUBJECT: MLSD 161 Final Major Plat and Findings of Fact
Moses Lake School District 161 has submitted a final plat application for a two-lot plat of
80 acres, including all of the School District's property between the existing high school and
the freeway. The portion of the site north of Yonezawa is zoned Public, and the portion
south ofYonezawa is zoned C-2 , General Commercial. The zoning corresponds with the
Comprehensive Plan Land Use Designations for these parcels. The Planning Commission
recommended that the final plat be approved with conditions. Council's approval of this
decision incorporates and adopts the Findings, Conclusion and Decision of the Planning
Commission.

2.5 The United States Bureau of Reclamation provided comments that must be addressed
before USBR will sign the plat.

Dear Council Members,
I am contacting you in the hope that I may be granted the time to present a request of the
two homeowner's associations I represent at an upcoming City Council meeting.
I represent two homeowner's associations at 807 Westshore Drive NE, Moses Lake, WA
98837; Poplar Sands Homeowners Phase I and Poplar Sands Homeowners Phase II.
A brief history of our associations:
Poplar Sand HOA Phase I was built between 1982 and 1983 and consists of four single-
story four-p1ex condominium homes along the shoreline (16 total units). It is my
understanding that the original intentions called for Phase II to be built soon thereafter the
completion of Phase I.
For a variety of reasons, Phase II did not start construction for approximately twenty
years. Phase II is still not complete. The current plans call for the construction of an
addition four units at some unknown date in the future.
Phase II currently consists of 16 units comprised of single-family condominium homes
and duplexes.
During the past thirty years, there have been at least three different declarants associated
with the completion and merging of the two associations.
The current declarant (four Phases I & II) and owner of the last four lots is Ken Condict
of Moses Lake. Mr. Condict wishes to sell the remaining four lots. When this sale takes
place, the existing Phases will see yet another declarant. May I remind you that this
Association is heading toward forty years without completion.
Mr. Condict currently has earnest money on the remaining four lots. The prospective
buyers do not wish to be the next declarant. They do not wish to be associated with
Poplar Sands Phases I & II.
The existing thirty-two homeowners comprising Phases I & II respectfully petition the
City Council to allow re-platting of the existing Phase II allowing for the separation of
the remaining four lots from any association with Phases I or II.
Further, the existing platting for the remaining four lots calls for access from the private

The existing thirty-two homeowners of Phases I & II also respectfully petition the City
Council to grant the prospective new owners (or Mr. Condict) access to the existing four
lots from Westshore Drive NE. This would allow a "clean break'.
Further, Phases I & II are then complete, the declarant issue is settled in concert with the
sale of the final four lots as well as the access issue for the new owner of the four lots.
The homeowners of Poplar Sands would greatly appreciate your granting our request and
allow Mr. Condict to re-plat and separate the aforementioned four lots and grant him

AN ORDINANCE ADOPTING THE 2012 COMPREHENSIVE PLAN AMENDMENTS
Recitals:
1. The City of Moses Lake's' Comprehensive Plan was adopted on September 11 , 2001 in
accordance with the Grow1h Management Act and the State Environmental Policy Act.
2. The Comprehensive Plan includes five (5) of the seven (7) mandatory elements required by GMA,
except that GMA declares that the requirements for an Economic Development Element and a
Park and Recreation Element are null and void until funds sufficient to cover applicable local
government costs are appropriated and distributed by the state at least two (2) years before the
city must update its Comprehensive Plan as required by RCW 36.70A.130.
3. The Washington State Grow1h Management Act requires the city to establish procedures and
schedules whereby updates, proposed amendments, or revision of the Comprehensive Plan may
be considered.
4. The amendments to the Comprehensive Plan have been submitted to the State of Washington
Office of Community Development for review and comment as required by GMA, and the sixty (60)
day review period has ended with no formal comments.
5. The amendments to the City of Moses Lake's Comprehensive Plan have been reviewed by the
Planning Commission and the Commission has made a recommendation to Council regarding
each proposed amendment.
6. Chapter 294, Laws of 205, Section 2 requires the city to take legislative action to review and, if
needed, revise its comprehensive plan and regulations to comply with GMA requirements.
7. On November 27, 2012 the City Council took legislative action to accept all of the Planning
Commission's recommendations.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON, ORDAINS AS
FOLLOWS:
Section 1: The recitals set forth above are incorporated herein as findings of fact.
Section 2: The City Council hereby adopts the following amendments to the Comprehensive Plan:
1. The request from Mary Kile to change the land use designation of 1548 to 1556 Bailey Avenue
from Low Density Residential to Medium Density Residential is denied. (Parcel #090865163,

2. The request from John and Jacie Daschel to change the land use deSignation of 202, 208, 212,

Section 1. Chapter 17.15 of the Moses Lake Municipal Code entitled "Requ irements for Plat and Site Plans'"

17.15.010 Purpose: The purpose of this chapter is to provide techn ical specifications for plats and site plans.
17.15.020 General Requirements: A plat shall consist of I~e fiFsls~eel OF one or multiple sheets that show

or land surveyor that performed the survey.
B. Each sheet of the plat shall be numbered consecutively with have a sheet identification
number such as "Sheet 1 of 2".
C. Each sheet shall have an identical heading at the top of the sheet. The heading shall be
written per the following format, with modifications approved such that an accurate
description is provided for the underlying property:

When GPS is used to derive the bearings and elevations shown on the plat. the NAD 83
and NAVD 88 datums shall be used, and shall be stated in the Bearing Datum and Vertical

similar sounding to existing street names in the vicinity of Moses Lake, and they are not
offensive in nature. Approved street names shall be shown on the final plat mylars.
X. Final mylar plats shall be suitable for microfilming and digital filing , such that the quality of
the microfilm and digital file are not diminished.
Y. Final mylar plats shall be drawn without cross hatching, shading, and other highlighting
techniques that diminish the legibility of the details or text on the plat.
Z. All drafting details and text shall be drawn on the plat such that they are not overlapping
and all details and text are distinguished independently from each other.
AA. All text on the plat shall be no smaller than eight hundredths (0.08) of an inch, except that
a smaller text is authorized on vicinity maps and land surveyor seals, provided that the
smaller text is legible.

17.15.040 Specific Site Plan Requirements: A site plan shall be ~f(),ided included for review with-a the
preliminary subdivision application. Site plans will not be recorded with the approved final plat, and
shall not be consecutively numbered with the plat sheets. Acceptable site plans will be filed in the
City's plat folders. Site plans shall be used as guidelines for public agencies to comment on the
validity or necessity of existing or additional utilities and municipal improvements that are required
to serve the subdivision. Agency reviews do not verify the accuracy of the site plans that are
provided by the applicant's surveyor. Review of the site plan does not rep lace the requirement of
the applicant to provide construction plans for review and approval, as may be required by the
preliminary subdivision approval. Site plans shall include the following items:
A. The site plan shall clearly show the boundaries of the subdivision , including blocks, lots,
and public dedications as shown on the preliminary plat.
B. The site plan shall include sufficient information from the plat to establish that the site plan
corresponds with the plat, including orientation, size, layout, and location.
C. Site plans shall be drawn one hundred feet (100') per inch, or at an alternate scale that is
approved by the Municipal Services Director. Alternate scales shall be at ten (10), twenty
(20), thirty (30), forty (40), fifty (50), or sixty (60) feet per inch; or multiples of ten (10) to
these six (6) scales. A graphical scale shall be included on the site plan.
D. The sheet size for the site plan shall be eighteen inches (18") by twenty-four inches (24"),
twenty-four inches (24") by thirty-six inches (36"), or at an alternate size as approved by
the Municipal Services Director. The Municipal Services Director may approve additional
sheets to be used for the site plan.
E. Margins on the site plan shall be no less than one inch (1") on the left margin and one-half
inch (W') on the remaining margins.
F. The site plan shall show all utilities, drainage ways, and improvements within the
subdivision and within the adjacent public lands, right-of-ways, and easements. All existing
and proposed utility service lines that will serve the subdivision shall be shown on the site
plan.
G. If utilities and improvements are required to be extended beyond the immediate vicinity of
the subdivision boundaries in order to serve the subdivision , the general routes and layouts
for those offsite utilities shall be shown on the site plan.
H. Contour lines shall be shown on the site plan at two foot (2') intervals. Shorter intervals
sftetttd shall be shown if two foot (2 ') intervals are not sufficient to show the drainage
across the subdivision.
I. Existing zoning classifications shall be shown for the subdivision and the adjacent
properties.

Attached is an ordinance amending Chapter 18.58, Signs, of the Moses Lake Municipal Code that
would allow for the placement of wayfinding signs, which are currently not permitted under the Sign
Code.
The Parks and Recreation Department recently submitted building permit applications for
wayfinding signs that are not described or permitted within our current Chapter 18.58, Signs. The
idea of way finding signs are part of the Destination Development Inc. work and document that was
adopted by the City Council on August 14, 2007. They are intended to assist the public with finding
local tourist destinations and places of interest. Stafftook this issue before the Planning Commission
and drafted the language contained in the attached ordinance. The Planning Commission considered
the draft language and has recommended that the City Council adopt the language as proposed.
The ordinance is presented for Council consideration. This is the first reading of the ordinance.

AN ORDINANCE AMENDING CHAPTER 18.58 OF THE MOSES LAKE MUNICIPAL
CODE ENTITLED "SIGNS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Chapter 18.58 of the Moses Lake Municipal Code entitled "Signs" is amended as follows:
18.58.020 Definitions:
A. Abandoned Sign: means a sign which no longer serves its intended purpose.
B. Architectural Appendage Sign: means a building sign that is suspended from, attached to,
applied to, or part of an awning, marquee, false mansard, canopy, or similar projection
from the exterior walls of a building .
C. Billboard: means an off-site sign that is substantial in size and construction, usually is
owned by an outdoor advertising company, and contains advertising space that is for rent
or lease.
D. Building: means an enclosed structure for a use or occupancy.
E. Building Sign: means any sign that is attached or applied to, mounted on, suspended from,
painted on , or part of the exterior of a building or architectural appendage, including the
roof and facade.
F. Cabinet Sign: means a sign enclosure which has access for the replacement of one (1) or
more sign faces and lamps, if internally-illuminated.
G. Changeable Copy Sign: means a sign that is designed to easily rotate or alternate
messages by mechanical means. Examples of changeable copy signs are reader boards
with removable letters.
H. Community Sign: means a temporary sign that promotes, celebrates, or commemorates
a community event, public awareness, community service, holiday season, or similar public
function.
I. Construction Sign: means a temporary standing or portable sign that is non-illuminated.
A construction sign provides information about a construction project.
J. Directional Sign: means a sign which only identifies a business or activity and directs traffic
to that business or activity.
K. Directory Sign: means a sign that has space which is limited to the name, address, and
logo of the developed site and the names, addresses, and logos of several on-site
businesses, organizations, or facilities.
L. Double-Face Sign: means two (2) sign faces which are identical in size and message and
either are displayed back-to-back or within 30 0 interior angle.
M. Electronic Sign: means an on -premise advertising sign having a signboard display that can
be changed by an electrical, electronic, or computerized process.
N. Facade: means one (1) or more exterior wal ls of a building that face one (1 ) direction,
including parapets and openings such as doors and windows.
O. Flashing Sign: means a sign that has external or internal lighting which changes intensity,
rotates, animates, travels, or switches on and off in a blinking manner. Examples of such
lighting are lamp banks with blinking or traveling messages, traveling arrows and revolving
beacons.
P. Free-Standing Sign: means a sign that has vertical support which is permanently anchored
in the ground. Examples are pole (or pylon), post, and monument signs.
Q. Freeway Interchange Sign: means a free-standing sign that is intended to attract the
attention of traffic entering or exiting an Interstate 90 interchange. A freeway interchange
sign is located within one thousand five hundred feet (1,500') of the interchange as
measured from the centerline of Interstate 90 right-of-way and the intersecting right-of-way
centerline.
R. Freeway Sign: means a free-standing sign that is intended to attract the attention of traffic
on Interstate 90. A freeway sign is located within two hundred fifty feet (250') of Interstate
90 right-of-way.
S. Garage Sale Sign: means a temporary sign for the sale of household items.
T. Home Occupation Sign: means an on-site sign that advertises a home occupation as
defined in Section 18.55.020 of this title.
U. Incidental Sign: means a non-illuminated, on-site, convenience sign. Examples of
incidental signs are credit card , telephone, and restroom signs.
V. Monument Sign: means a free-standing sign in the shape of a monolith. Usually the sign
is vertically supported on a base which is on a pedestal, but the sign may be a pole-
covered sign. A monument sign is intended to be viewed at eye level.
W. Non-Conforming Sign: means a permanent sign that was lawfully erected , installed, or
otherwise displayed according to the applicable Grant County or city zoning regulations,
but does not conform to the sign regulations of this chapter.
X. Off-Site Sign: means a sign that is not related to an activity that is on the same site as the
sign, or the sign is on a vacant site.
Y. Official Sign or Legal Notice: means an official sign or legal notice issued by a court,
public agency, or as authorized by law or federal, county, or city authority.
Z. On-Site Sign: means a sign that is related to an activity that is on the same site as the sign.
AA. Permanent Sign: means any sign which is not a temporary sign as defined in Section
18.58.02000
BB. Pole (or Pylon) Sign: means a free-standing sign on one (1) or more upright supports in a
foundation. The upright supports may be covered for aesthetic purposes. A pole sign is
the same as a pylon sign.
CC . Portable Sign: means a sign that either is a sign structure or is part of or affixed to a sign
structure that is designed to be movable.
DO. Private Warning/Directional Sign: means a permanent, portable, or temporary sign that is
erected for a private purpose such as KEEP OUT, NO TRESPASSING, RIGHT TURN
ONLY, STOP, SECURITY ALARM, or NO DUMPING.
EE. Projecting Sign : means a type of building sign that either is: 1) mounted at right angle to
a facade; 2) suspended under an architectural appendage and at right angle to a facade;
or 3) a wall sign that extends eighteen (18) or more horizontal inches from the facade.
FF. Public Facility Directional Sign: means a sign, in the public zone, which only identifies a
public facility or activity and directs traffic to that public facility or activity.
GG. Public or Recreational Identification Sign: means a sign for a public or semi-public facility
or area. Examples of such signs are park, school, or hospital signs.
HH. Real Estate Sign -Other: means a sign that either advertises a parcel or lot of non-
residential land, or the buildings thereon, or both which is for sale, lease, or rent.
II. Real Estate Sign -Residential Lot: means a sign that either advertises a parcel or lot of
residential land, or the buildings thereon, or both which is for sale, lease, or rent.
Residential land includes land that is vacant and within a residential zone or land that is in
residential use, regardless of zone.
JJ. Residential Identification Sign: means a sign that identifies a residential subdivision,
planned residential development, neighborhood, condominium development, manufactured
home park, multi-family residential development, or similar residential developments.
KK. Residential Subdivision Sign: means a sign which advertises the sale of lots in a residential
subdivision, parcels in a manufactured home binding site plan , or lots in a residential
planned development.
LL. Right-Of-Way: means a corridor which either is reserved for or contains a public street,
road , alley, pathway, highway, or freeway.
MM. Roof Sign: means a building sign that is mounted on the roof of a building as defined in this
section . A roof sign does not project beyond the vertical planes of the building facades.
NN. Sandwich Board Sign: means a portable sign that is A-frame, does not exceed four feet (4')
in height or two feet (2') in width, and is non-illuminated.
00. Sign: means a visual message that is displayed to attract the outdoor attention of the
general public. A sign may be: 1) advertising of a generic or specific product, item, or
service; 2) a promotion of an activity or event; 3) any other implicit or explicit message
which informs, alerts, directs attention to, or warns; 4) the name of a business, building,
place, or organization; or 5) any combination of advertising, promotion, other message,
or name. A sign may consist of, but is not limited to words, pictures, drawings, logos,
symbols, other graphics, border, trim, frame, cabinet, background , space, material, or
devices which are integral to the visual message. A sign may contain multiple visual
messages wh ich are related in content and proximity.
PP. Sign Face: means one dimension of a sign that contains the visual message.
QQ. Sign Height: means the vertical distance as measured from finished grade at the base of
a sign or sign structure to the top of the sign.
RR . Sign Structure: means the horizontal and vertical support for a sign.
SS. Site: means either: 1) a parcel of unplatted land, a parcel in a binding site plan, a tract, or
a lot in a subdivision; or 2) two (2) or more contiguous parcels, tracts, or lots under one (1)
ownership without intervening right-of-way and identified or delineated as one (1)
development site; or 3) two (2) or more contiguous parcels, tracts, or lots under different
ownerships, without intervening right-of-way, and identified or delineated as one (1)
development site.
TT. Street Frontage: means that portion of a site boundary that borders one or more streets as
defined in Section 18.06.590.
UU. Temporary Sign: means a sign affixed to , applied on, or made from lightweight material,
with or without a frame or backing which is designed to be displayed for a limited time
including, but not limited to, a feather or tear drop sign . Examples of lightweight materials
are vinyl , cardboard, card stock, corrugated plastic, and fabric.
W . Traffic Control Sign : means any permanent or temporary traffic control, traffic signal, or
construction sign that is subject to: 1) the latest edition of the Standard Specifications for
Road , Bridge, and Municipal Construction as published by the Washington State
Department of Transportation in conjunction with the Washington State Chapter of the
American Public Works Association, as amended by the City of Moses Lake Community
Street and Utility Standards; and 2) the Manual on Uniform Traffic Control Devices.
WW. Vehicle Sign: means a sign that is affixed or painted on a vehicle which is primarily used
for transportation rather than parked for the purpose of displaying the sign.
XX. Wall Sign: means a building sign that is painted or flush-mounted on a facade, fascia, or
architectural appendage, less than eighteen inches (18") horizontal projection.
YY. Wayfinding Sign: an off-premise sign that is part of a City-sponsored and coordinated
program for the purpose of facilitating vehicular tourist and pedestrian traffic to local tourist
destinations.
ZZW. Wheeler Corridor Heavy Industrial Area: means the area within City limits, located east of
Road L and zoned Heavy Industrial.
AAAl=l:. Window or Door Sign: means a building sign that is suspended or mounted flush with
an exterior window, or painted on a window or door, and directed outside.
18.58.030 Sign Regulations:
A. Only a sign as defined in Section 18.58.020.00 is subject to the provisions of this chapter.
B. A sign type that is listed "A" in the following table is allowed to be displayed, subject to the
applicable sign regulations listed in this section and in the table.
C. A sign type that is listed "P" in the following table is prohibited from display, unless it is a
non -conforming sign as provided in Section 1858090
D. A sign type that is listed "E " in the following table is exempt from the provisions of this
chapter.
E. A sign type that is not listed in the following table is not allowed to be displayed.
F. A sign shall comply with applicable provisions of the State Building Code and Chapter
16.02 of this code entitled Building Permits.
G. A sign is subject to Chapter 8.14 of this code entitled Nuisances.
H. State law (RCW 70.54.090) prohibits the attachment of a sign to a utility pole.
I. No sign is allowed on or over right-of-way except as approved by City Council for city
streets. No sign is allowed within right-of-way of the interstate or primary system where
there are no curbs. A sign may be allowed within right-of-way of the primary system where
there are curbs and other streets, subject to the following conditions and circumstances:
1. A projecting sign is allowed over a sidewalk in right-of-way in the C-1 Zone and in the
C-2 Zone where the building is not set back from right-of-way, provided that the sign
does not project more than eighty percent (80%) of the distance between the right-of-
way line and back of curb line, and there is a minimum of eight feet (8') vertical
clearance under the sign
2. A political sign is allowed in right-of-way subject to the remainder of the applicable sign
regulations in this section and in the following table.
J. No permanent sign is allowed on or over a public utility easement.
K. A permanent sign may be allowed over but not on a municipal easement, upon approval
by the Municipal Services Director.
L. Every sign shall be maintained in a safe and secure manner. A torn , broken, hazardous,
dilapidated, or outdated sign, as determined by the Building Official, shall be repaired,
replaced, or removed.
M. The City Engineer shall review each application for a sign permit for sight distance. The
City Engineer shall consider whether a sign would be located or constructed so as to
obscure or obstruct an official traffic sign, signal, or device , or obstruct a motorist's view
of approaching, merging, or intersecting traffic before approving or disapproving the
application.
N. Internal or external sign lighting shall be shaded, hooded, site screened, or directed so that
the light's intensity or brightness shall neither adversely affect adjacent or nearby property,
nor create a public nuisance, nor create a traffic hazard.
O. A sign rnay be located within the front or exterior yard (as defined in sections 18.06.630
and 18.06.650 of this title) but shall not be located in the interior side or rear yard (as
defined in sections 18.06.650 and 18.06.640 of this title).
P. Where electronic signs are allowed, the following conditions apply:
1. The message shall have a static display time of at least two (2) seconds after mov ing
on to the signboard, with all segments of the total message to be displayed within ten
(10) seconds.
2. Displays may travel horizontally or scroll vertically onto electronic signboards, but must
hold in a static position for two (2) seconds after completing the travel or scroll.
4. Electronic signs requiring more than four (4) seconds to change from one (1) single
message display to another shall be turned off during the change interval.
5. No electronic sign lamp may be illuminated to a degree of brightness that is greater
than necessary for adequate visibility. In no case may the brightness exceed eight
thousand (8,000) nits or equivalent candelas during daylight hours, or one thousand
(1,000) nits (illuminative brightness measurement),or equiva lent candelas between
dusk and dawn. Signs found to be too bright shall be adjusted as directed by the City
of Moses Lake.
6. Minimum height for the sign shall be thirteen feet (13') from grade of the adjacent
roadway to the bottom of sign.
7. The sign background shall not be white in color. White lights shall not be used as the
sign background.
8. Businesses, churches, or schools are allowed changeable signs providing that
changeable displays in residential zones shall be turned off between the hours of 10
p.m. and 7 a.m.
Q. No sign shall be erected or maintained if it is visible from the main traveled way of the
interstate or primary system except as permitted by Washington Adm inistrative Code
Chapter 468-66 entitled HIGHWAY ADVERTISING CONTROL ACT or Revised Code of
Washington Chapter47.42 entitled HIGHWAY ADVERTISING CONTROL ACT -SCENIC
VISTAS ACT.
R. Signs constructed of temporary sign materials, as defined in Section 18.58.010.1T, shall
not be used as a permanent sign. Any sign that does not currently meet this standard must
be removed within ninety (90) days.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOSES LAKE
DECLARING ITS INTENTION TO REIMBURSE ITSELF FROM THE
PROCEEDS OF ONE OR MORE TAX-EXEMPT FINANCINGS FOR
CERTAIN EXPENDITURES MADEAND/ORTO BE MADE IN CONNECTION
WITH THE ACQUISITION, CONSTRUCTION AND EQUIPPING OF
CERTAIN CAPITAL IMPROVEMENTS
RECITALS:
1. The City of Moses Lake (the Issuer) is a political subdivision organized and existing under the
laws of the State of Washington.
2. The Issuer has paid, beginning no earlier than February 25,2013 and will pay , on and after the
date hereof, certain expenditures (the Expenditures) in connection with the capital project (the
Project), as more fully described in Appendix A attached thereto.
3. The City Council of the Issuer (the Board) has determined that the money previously advanced
no more than 60 days prior to the date hereof and to be advanced on and after the date hereof
to pay the Expenditures are available only for a temporary period and it is necessary to
reimburse the Issuer for the Expenditures from the proceeds of one or more issues of tax-
exempt obligations (the Obligations).
RESOLVED:
1. The Board hereby declares the Issuer's intent to reimburse the Issuer with the proceeds of the
Obligations for the Expenditures with respect to the Project made on and after February 25,
2013, which date is no more than 60 days prior to the date hereof. The Issuer reasonably
expects on the date hereof that it will reimburse the Expenditures with the proceeds of the
Obligations.
2. Each Expenditure (was and) will be (a) of a type properly chargeable to capital account under
general federal income tax principles (determined in each case as of the date of the
Expenditure) and (b) complies with all applicable Literary Fund regulations .
3. The maximum cost of the Project is expected to be $560,000.00.
4. The Issuer will make a reimbursement allocation, which is a written allocation by the Issuer that
evidences the Issuer's use of proceeds of the Obligations to reimburse an Expenditure, no later
than 18 months after the later of the date on which the Expenditure is paid or the Project is
placed in service or abandoned, but in no event more than three (3) years after the date on
which the Expenditure is paid. The Division recognizes that exceptions are available for certain
"preliminary expenditures," costs of issuance, certain de minimis amounts, expenditures by
"small issuers" (based on the year of issuance and not the year of expenditure) and
expenditures for construction projects of at least 5 years.

OBJECTIVES
A. To provide procedures for reviewing both proposed loan and gifts of art work to the
City of Moses Lake's collection of public art.
GUIDELINES
A. Proposed gifts or loans to the City of Moses Lake shall be reviewed by the Art
Accession Committee (AAC). The Art Accession Committee will make a
recommendation to the City Council for final action . For proposed art work siting in
a City park, a recommendation from the Parks and Recreation Commission will be
requested.
B. Proposed gifts or loans will be evaluated on the following criteria :
1. The quality of art work.
2. Context in the City collection. Does art work enhance the existing collection
or add diversity? How does the piece engage the public? Are the materials
appropriate? Is the piece susceptible to vandalism or graffiti?
3. Availability of an appropriate site.
4. Coordination with the AAC concerning siting, costs of installation, and
maintenance of art work.
5. Donor conditions, if applicable.
6. Condition of the art work.
7. Durability of the art work.
8. Ability to maintain the art work.
9. Aesthetic merit.
C. For a work proposed for loan to the City, the owner or owner's representative will
be requ ired to enter into an Art Display Agreement setting forth the length of the
loan and other terms such as location, maintenance, requirements, insurance, value
of art work, installation and removal responsibility, and other conditions pertinent to
the agreement.
D. Donated or loaned art work wi ll include identifying plaques.
E. All donated works become part of the City art collection and, as such , may be
relocated.
F. Monetary donations to help fund public art acquisitions will be accepted at any time.

RECITALS:
1. Code cities over 20,000 in population are subject to the provisions of RCW 35AAO.210 as now or
hereafter amended and RCW 35 .22.620 as referenced in RCW 35AAO.210.
2. RCW 35 .23.352(3) authorizes code cities to use a small works roster and award contracts without
advertising and conforming to the competitive bidding process .
RESOLVED:
1. The City of Moses Lake may make purchases of supplies, materials, equipment, or services
other than professional services and contract for public works or improvements pursuant to
RCW 35AAO.21 0 and any other policies subsequently adopted administratively or by the City
Council.
2. The City of Moses Lake is authorized to establish and use a small works roster pursuant to
RCW 35.23.352(3) for public works and improvement projects up to the dollar limit set forth in
RCW 35.23.352(3) without preparing and advertising competitive bid specifications and shall
adopt a resolution establishing specific procedures for implementing a small works roster
process.
3. This resolution supercedes as of its effective date Resolution No . 1339.

Staff is nearing completion of the plans and specifications for the 2013 Sewer Lining Project.
The project includes lining 25,000 feet of sanitary sewer pipe and 1,585 feet of storm sewer pipe
throughout the City.
The estimated construction cost for the project is $765,000. Plans and specifications are
available at the engineering office for review.
The City began lining its 50 miles of concrete sewer mains in 1980 and has had an annual
project since 1999. This final project will address all the remaining concrete sewer mains that
are viable candidates and will complete the program.

FIREWORKS 2010 Edition (National Fire Protection Association) 4-1.1.1, the SPONSOR shall consult with the authority
having jurisdiction to determine the level of fire protection required and provide adequate fire protection for the
display. It is further agreed that in accordance with NFPA 1123 4-1.2 that the SPONSOR shall provide monitors whose
sole duty shall be the enforcement of crowd control located around the display area during the display and until the
discharge site has been inspected after the display.

OF THE NATURE OF FIREWORKS, AN INDUSTRY ACCEPTED LEVEL OF 3% OF THE PRODUCT USED IN ANY DISPLAY MAY NOT
FUNCTION AS DESIGNED AND THIS LEVEL OF NONPERFORMANCE IS ACCEPTABLE AS FULL PERFORMANCE.
INTEREST at 11/2% per month (AN ANNUAL PERCENTAGE RATE OF EIGHTEEN PER CENT PER ANNUM APR 18%) will be charged
on all accounts 30 days past due, and buyer agrees to pay the same. Buyer also agrees to reimburse WESTERN DISPLAY
FIREWORKS, LTD for its attorney fees incurred in coliection if this account is delinquent.

MULTI-YEAR AGREEMENT
THIS AGREEMENT is made between WESTERN DISPLAY FIREWORKS, LTD here and after referred to as
WESTERN and the CITY OF MOSES LAKE here and after referred to as the SPONSOR.
The execution of this contract demonstrates the SPONSOR'S commitment to purchase fireworks from
WESTERN in the years 2013 through 201S, and qualifies the SPONSOR for complimentary product.
Based on your 2013 budget of $16,000.00 you will receive no less than Six (6) 2,S" to 3" multi-
shot boxes at no additional cost. These 25-36 count multi-shot boxes include spectacular
effects such as:

In the event your budget increases or decreases in 2014 or 2015, the value for the complimentary items
will adjust accordingly. The exact amount of product offered will depend upon the value of your show and
product costs each year. The complimentary product will be clearly identified as part of your proposal
each year of the agreement.
As the SPONSOR, you agree to negotiate in good faith with WESTERN regarding all fireworks
presentations in the years 2013 through 2015. In addition, WESTERN will be given the Right of First
Refusal for the SPONSOR presented firework display events in the years 2013 through 2015.
THIS AGREEMENT shall bind the parties hereto and also their respective successors in interest, personal representatives and
. aSSigns. The person signing below certifies that they are duly authorized to enter into this agreement on behalf of SPONSOR.

Attached is sales tax information for November 2012 sales which the City received on
January 31 ,2013. This report indicates the City received $401,499.05. The $401,499.05
in receipts for January compares with January 2012 receipts of $403,504.15. Forthe year,
the 2013 receipts are approximately 0% lower than the 2012 receipts for the same period .
Also provided is the transient rental income report for income the City received on January
31 ,2013. This report indicates January 2013 income (for November sales) of $37,239.62.
This compares with $25,073.90 for the same period in 2012. Forthe year, transient rental
income receipts are approximately 49% higher than the 2012 receipts for the same period .
