The meeting was called to order at 7 p.m. by Mayor Ecret.
PLEDGE OF ALLEGIANCE: Mr. Avila led the Council in the pledge of allegiance.
PRESENTATIONS AND AWARDS
VISION 2020 AWARD
Richard Teals, Vision 2020, presented an award to the Moses Lake Farmer's Market for being an asset to the
community for more than 30 years.
PROCLAMATION
Gilbert Alvarado, Community Development Director, stated that Community Planning Month is and effort to
increase awareness of the importance and need for citizen and professional planners, and public engagement
in the planning process. He mentioned that the State of Washington is a leader in the planning field and went
over some of the effects of planning .
The proclamation declaring October as Community Planning Month was read by title only.
CONSENT AGENDA
Minutes: The minutes of the September 25 meeting were presented for approval.
Approval of Claims, Prepaid Claims, Checks, and Payroll: Vouchers audited and certified by the Finance
Director as required by RCW 42.24.080, and those expense reimbursement claims, certified as required by
RCW 42.24.090 , have been recorded on a listing which has been made available to the Council for approval
and is retained for public inspection at the Civic Center. As of October 9, 2012 the Council does approve for
payment claims in the amount of $822 ,005.35; prepaid claims in the amounts of$14,394.11 and $47,323.67;
claim checks in the amount of $928,294.69; and payroll in the amounts of $325,809.22, $4,437.46, and
$740.18.
Resolution -Accept Easement -Barney: A resolution was presented which accepts an easement from James
Barney for the installation, repair, operation, and maintenance of a municipal sewer main on Lot 1, Schwan's
Short Plat located off of Patton Boulevard.
Resolution -Accept Easement -Ramsden: A resolution was presented which accepts an easement from Scott
Ramsden for the installation, repair, operation, and maintenance of a municipal sewer main on Lot 1,
Schwan's Short Plat located off of Patton Boulevard.
Resolution -Accept Easement -Sparks: A resolution was presented which accepts an easement from David
Sparks wh ich provides city access to water and/or sewer meters located along 12238 N. Frontage Road E.
Action Taken: Dr. Curnel moved that the Consent Agenda be approved, seconded by Mr. Avila, and passed
unanimously.

CITY COUNCIL MINUTES: 2 October 9, 2012
PETITIONS, COMMUNICATIONS, OR PUBLIC HEARINGS
ORDINANCE -ANNEXATION -WEST WORLDWIDE INC. -2ND READING/PUBLIC HEARING
An ordinance was presented which annexes approximately 2.29 acres located adjacent to Hamilton Road and
described as Lot 11 less the west 60' of Wiser Commercial Park Plat.
The ordinance annexing property commonly known as the Wiser Commercial Park Annexation to the City of
Moses Lake, Washington, and incorporating the same within the corporate limits of the City of Moses Lake
was read by title only. .
The public hearing was opened. There were no comments.
Action Taken: Mr. Reese moved that the public hearing be closed, seconded by Dr. Curnel, and passed
unanimously.
Action Taken: Mr. Deane moved that the second reading of the ordinance be adopted, seconded by Mrs.
Liebrecht, and passed unanimously.
ORDINANCES AND RESOLUTIONS
ORDINANCE -AMEND 13.05 -WASTEWATER REGULATIONS -2ND READING
An ordinance was presented which requires a legal method for City staff to access the meters and electronic
reading devices for privately owned metered sewer mains and service lines.
The ordinance amending Chapter 13.05 of the Moses Lake Municipal Code entitled "Wastewater Regulations"
was read by title only.
Action Taken: Mrs. Liebrecht moved that the second reading of the ordinance be adopted, seconded by Mr.
Reese, and passed unanimously.
ORDINANCE -AMEND 13.07 -WATER REGULATIONS -2ND READING
An ordinance was presented wh ich requires a legal method for City staff to access the meters and electronic
reading devices for privately owned metered water mains and service lines.
The ordinance amending Chapter 13.07 of the Moses Lake Municipal Code entitled "Water Regulations" was
read by title only.
Action Taken: Mr. Avila moved that the second reading of the ordinance be adopted, seconded by Mr. Reese,
and passed unanimously.
ORDINANCE -AMEND 13.12 -WATER, SEWER AND STORMWATER RATES -2ND READING
An ordinance was presented which clarifies that there are no minimum monthly charges for a metered fire
protection system. The only charges imposed are for actual water usage.
The ordinance amending Chapter 13.12 of the Moses Lake Municipal Code entitled "Water, Sewer, and
Stormwater Rates" was read by title only.
Action Taken: Mr. Reese moved that the second reading of the ordinance be adopted, seconded by Mr. Avila,
and passed unanimously.
ORDINANCE -AMEND 10.12 -PARKING REGULATIONS -1ST READING
An ordinance was presented which changes the restricted parking in front of the Senior Center on Third
Avenue from a loading and unloading zone to a GTA and People for People bus stop and eliminates the
handicapped accessible parking spaces.

read by title only.
Action Taken: Mrs. Liebrecht moved that the first reading of the ordinance be adopted, seconded by Mr.
Reese, and passed unanimously.
RESOLUTION -ABANDON EASEMENT -HUBERDEAU
A resolution was presented wh ich provides for the abandonment of a portion of the public utility easement on
the north property line of Lot 1, Block 1, Pioneer Commercial Park 1" Addition located at the corner of Sharon
Avenue and Pilgrim Street.
The resolution authorizing abandonment of an easement was read by title only.
Gilbert Alvarado, Community Development Director, stated that the East Columbia Irrigation District has an
easement along the rear of the property and so long as there is no encroachment into their easement they
have no problems with the abandonment.
Action Taken : Mr. Avila moved that the resolution be adopted, seconded by Mr. Reese, and passed
unanimously.
RESOLUTION -NUISANCE ABATEMENT -CHAMBERS
A resolution was presented which provides for the abatement of nuisances at 1946 Beaumont. The property
is owned by Patrick and Shirley Chambers Estates.
The resolution determining that Patrick E. and Shirley E. Chambers Estates is the owner of certain real
property within the City; that a nuisance requiring abatement by City forces or forces contracted by the City
exists on such property; and directing the use of such forces to abate the nuisance found was read by title
only.
Rick Rodriguez, Code Enforcement Officer, was sworn in and provided testimony concerning this issue.
There was no other testimony. The hearing was closed.
Action Taken: Mr. Reese moved that the resolution be adopted, seconded by Mr. Avila, and passed
unanimously.
RESOLUTION -NUISANCE ABATEMENT COSTS -WATSON
A resolution was presented which authorizes staff to collect the funds expended for the nuisance abatement
at 502 Kentucky. The property is owned by Michael Watson.
The resolution establishing the billing to be imposed against Michael Watson as the owner of certain real
property upon which the City caused abatement of a nuisance to be preformed after a failure of the property
owners to abate the same was read by title only.
Action Taken: Mrs. Liebrecht moved that the resolution be adopted, seconded by Dr. Curnel, and passed
unanimously.

NON-AGENDA ITEMS AND PUBLIC QUESTIONS AND COMMENTS
CHARITY CAR WASHES -WATER USE
Alice Ness, 211 E. 7th Avenue, Apt. #4, stated that charity car washes do not harm the storm drains and
requested that they be allowed to continue.
It was pointed out that additional information has been provided on the issue of charity car washes and that
it will be considered by the Council at its October 23 meeting.
USE OF CITY PROPERTY -REEVES
Nick Reeves, Barry's Used Cars, stated that they have a used car lot at the corner of Third Avenue and W.
Broadway. He mentioned that the area 35' back from the curb on Third Avenue as it connects to W.
Broadway is owned by the City and that is where they have been parking their cars. He stated that they would
like permission to park their cars on the property owned by the City.
Gilbert Alvarado, Community Development Director, stated that the area is not right-of-way but is property
owned by the City.
Joseph K. Gavinski, City Manager, stated that, since the property is owned by the City, if the Council is
considering allowing the commercial business to use the property, there should be some kind of consideration
to the City, otherwise it could be considered a gift of public funds.
There was some discussion by the Council.
Action Taken: Mr. Reese moved that Mr. Reeves work with staff on the amount of compensation for the use
of the City's property at the corner of Third and W. Broadway, seconded by Mr. Avila, and passed
unanimously.
COUNCIL QUESTIONS AND COMMENTS -None
CITY MANAGER REPORTS AND COMMENTS
WATER RIGHTS AND CLAIMS
Joseph K. Gavinski, City Manager, stated that in the past the City was concerned about its ability to continue
to provide water to its residents and commercial and industrial users. Recently the Department of Ecology
reversed their stance on 6,600 acre feet of water claims they said were invalid in 1979.
Gary Harer, Municipal Services Director, pointed out that the amount of water used before 1945, when ground
water laws came into effect, could be formalized by submitting a claim to the Department of Ecology. In 1979
the Department of Ecology ruled invalid 6,600 acre feet of water claimed by the City. The the City has always
verbally protested that ruling and in September 2012, the Department of Ecology admitted their error and
validated the City's water claims. This adds another 6,600 acre feet of water available to the City. He
mentioned out that when private property owners connect to the City water, their water claims become the
property of the City. At this time, the City actually has 10,400 acre feet of valid water claims and 9,304 acre
feet of certificated water rights.
STORMWATER REPORT
Gary Harer, Municipal Services Director, provided a report on the work the Stormwater Division has done and
what will be done in the future.
BUILDING ACTIVITY REPORT
The September 2012 Building Activity Report was presented.

The City received $76 ,980.54 from gambling tax for the third quarter.
INVESTMENT REPORT
The City received $15,081.42 in investment income for September 2012.
SALES TAX!TRANSIENT RENTAL INCOME
October 9, 2012
The City received $407,813.31 in sales tax and $53,987.68 in transient rental income in September 2012.

I am writing this letter to call to the attention of the City of Moses Lake that I would like to discuss the
usage of City Utilities that are used during the Fundraiser Car Washes. And also the enforcement and
clarification of the current City of Moses Lake Codes, that would regulate such Fundraisers.
I would like to address the following:
• The usage of City Water from business that doesn't have means to contain the water being
generated to the ground.
• Water Rates
• Water being generated to the City Drainage.
• Flow rates on hoses being used at Fundraiser Car Washes.
• Definition on "Non-Profit" in the city RCW's
• Registration of "Non-Profit" organizations with the City so Water Department will know when
and Where Fundraise r Car Washes will be held.
• Code enforcement of RCW's
• Discussion on different avenues Fundraising Carwashes can take.
• Examples of Proactive measures being take in the Puget Sound area and other Municipalities to
insure no contamination occurs.
I have also included documentation form other Cities, Pictures of Fundraisers here in the Moses Lake
not being Regulated and some suggestions for future Car Washes.

Home Car Washing Wastes Water and Leads to Water Pollution
Most people who wash their cars at home don't realize where the contaminated water goes or how
much is wasted. Home car washing releases contaminated water directly into the environment or
into storm drains intended for rainwater. This causes pollution in our rivers, lakes and streams. Also,
engineering studies show that a 5/8" hose running at 50 pounds per square inch uses 10 gallons of
water per minute compared to washing your car at a self-serve car wash for only 1 L 1 gallons.
Consider the alternatives of professional car washing:
o Average flow rate wash and rinse: 3GPM (gallons per minute)
o Average flow rate per-soak foaming brush and tire & engine cleaning: 0.6 GPM

We have learned our lessons about polluting the environment We disposed of trash by burning it in
open areas until environmental concern decreased this form of pollution. It's time to recognize that
home car washing is another serious pollution but it can be eliminated simply by using professional
car washes.
Professional Car Washes Use Water Safely and Efficiently
The Clean Water Act requires professional car washes to pipe their dirty water to water treatment
facilities or into state-approved drainage facilities designed to protect the environment Automatic
and self-serve car washes also use water efficient equipment such as computer controlled systems
and high-pressure nozzles and pumps, allowing them to clean cars thoroughly while conserving
water.

ABSTRACT
To better understand the nature of urban stormwater discharges to the City of Federal Way
Municipal Separate Storm Sewer System (MS4), the Water Quality section of the Surface Water
Management (SWM) Division of Public Works embarked on a small study to illustrate the links
between car washlng, stormwater, local surface waters, and Puget Sound. Findings from the
study will be presented to the public as part of our on-going stormwater pollution prevention
education campaign targeting residential activities.
The findings presented herein show that most wash water from residential car washlng is a
source of stormwater pollution. It also demonstrates that any single uncontrolled residential car
wash activity might be inconsequential with respect to its contribution to the pollutant load being
delivered to the MS4, however, when extrapolated over the entire City of Federal Way fOT a year,
the pollutant loading becomes significant.
The following are several of the crucial pollutants detected and the calculated annual pollutant
loading to the City's MS4:
• Petroleum hydrocarbon waste: gasoline, diesel, and motor oil (estimated 190 gallons of
annual mass loading).
• Nutrients: phosphorous and nitrogen (estimated 400 pounds of annual mass loading).
• Ammonia (estimated 60 pounds of annual mass loading).
• Surfactants (estimated 2,200 pounds of annual mass loading
• Solids (estimated 3,000 pounds of annual mass loading).
The results of this study support the findings of the Puget Sound Partnership 2008 Action
Agenda declaring that pollution-related water quality problems in the fresh waters and marine
waters of Puget Sound include excess nutrients and contamination by toxic chemicals draining
from urban areas. The Action Agenda also points out that pollution entering Puget Sound's
rivers, lakes, and marine waters does so through a variety of pathways, and that surface water
runoff appears to be the primary transportation route, with the most concentrated loads coming
from developed lands.

1.0 INTRODUCTION
Stormwater generated in Federal Way drains into Puget Sound. Fed by seasonal freshwater from
the Olympic and Cascade Mountain watersheds, Puget Sound is a ninety-mile long saltwater
estuary in rapidly growing Western Washington. This water body provides recreation for people,
and is home to a diverse, but endangered, ecosystem.
In 2007 the Washington State Legislature created the Puget Sound Partnership (PSP), an effort
undertaken to implement a strategic and bold plan to restore the health of this regionally
important waterbody by 2020. Released at the end of 2008, the PSP issued an Action Agenda
that spells out measurable goals for Puget Sound's recovery by demonstrating the complex
connections between the land and water. With a good deal of alarm, the PSP emphasizes, in no
uncertain terms, that urban stormwater runoff poses a major threat to Puget Sound's ecosystem.
Often society has been slow to recognize the link between individual behaviors and practices,
and the detrimental impacts that they may have on our natural aquatic resources. One of these
practices, residential car washing, may give rise to surface water quality impacts that can be felt
well beyond the front yards and driveways of the communities where it occurs.
In some instances, car washing is carried out on lawns, in sideyards, or on graveled areas, which
all allow for the infiltration of the wash water. However, in most cases, it is performed on
impervious surfaces -that is, driveways or streets -where the washwater drains directly into the
Municipal Separate Storm Sewer System (MS4).
To better understand the nature of urban stormwater discharges to the City of Federal Way
Municipal Separate Storm Sewer System (MS4), the Water Quality section of the Surface Water
Management (SWM) Division of Public Works embarked on a small study to illustrate the links
between car washing, stormwater, local surface waters, and Puget Sound.
1.1 Regulatory Background
In 1999, the Environmental Protection Agency (EPA) issued the National Pollutant Discharge
Elimination System (NPDES) stormwater Phase II program regulations (40 CFR Part 122). The
ruling was a Federal mandate established to address discharges from small MS4s in an effort to
reduce sources of stormwater pollution that impact the water quality of our natural water bodies.
EPA's primary role in the NPDES program was to develop the overall regulatory framework.
Under the ruling, authorized states (including Washington) were permitted to tailor their
stormwater discharge control programs so that water quality needs and objectives could be
addressed through a fme-tuning and adjustment of the regulatory process at a state level. In early
2007, the State of Washington Departrnent of Ecology (DOE) issued the Western Washington
Phase II Municipal Stormwater Permit. Over 100 jurisdictions are subjected to this permit,
including Federal Way.

The Phase II rule requires that all affected municipalities implement a series of individualized
programs designed to control non-stormwater discharges, including both a public education track
and procedures to detect and eliminate stormwater pollutants (illicit discharges). With some
exceptions, the EPA defines an illicit discharge as "any discharge to an MS4 that is not
composed entirely of stormwater".
Phase IIjurisdictions are to "effectively prohibit through ordinance, or other regulatory
mechanism, illicit discharges into the MS4, and implement appropriate enforcement actions as
needed". The Western Washington Phase IT Municipal Stormwater permit requires Federal Way
to develop a regulatory mechanism that effectively prohibits non-stormwater, illegal discharges,
andlor dumping into the MS4 to the maximum extent allowable under State and Federal law . An
ordinance accomplishing this will go into effect for the City of Federal Way on August 16, 2009.
By definition, residential car wash water is a non-stormwater discharge, however, the EPA ruling
sets it and other types of non-storm water discharges (including water line flushing, landscape
irrigation, de-chlorinated swimming pool discharges, etc.) apart. These discharges would only
need to be included in the scope of an illicit discharge detection and elimination (IDDE) program
if they were identified as significant contributors ojpollutants to the MS4. In these cases,
specific stormwater controls would need to be implemented. If deemed to be ineffective, an
affected municipality would have the authority to prohibit the discharge completely.
1.2 Recent Permit Clarifications
In September of 2008, the Department of Ecology began recommending that permitted
municipalities implement a public education approach when attempting to obtain compliance
with residential car wash discharges. These recommendations were included in a number of
DOE-issued correspondences, including news releases, a fact sheet, and a guidance document to
cities and counties clarifying the recommended response actions. DOE recommendations include
a learning phase period to allow for behavior change, letting each permitted entity to decide
which group of actions would be effective enough to eliminate "significant" prohibited
discharges (Howard, 2009).
2.0 STUDY DESIGN
Attempting to sample and quantify stormwater contaminants generated by common residential
activities can be difficult. These elusive constituents, many of which are which are invisible to
the naked eye, include bacterial loadings produced by poor pet waste management practices,
fertilizers, herbicides and or pesticides dissolved in surface runoff from lawns. Depending on the
frequency and volume of stormwater flows, concentrations of these pollutants can be highly
variable. These type of contaminant loadings are classified as non-point discharges.
Conversely, car wash water streaming into neighborhood stormwater structures presents a more
simplified sampling opportunity. It offers a much easier target to examine: the flow stream is
often foamy and visible; it can be readily captured as it drops into a catch basin; the
concentration of contaminants is relatively consistent; the discharges occur predictably (on nice

days); and the transport of pollutants generated by the activity is not dependant upon fluctuating
stormwater runoff. Accordingly, discrete flows of residential car washwater are point source
discharges to the MS4.
Sampling multiple individual driveway or street locations around the city in an effort to examine
the issue for this study was found to be difficult with respect to timing, coordination, and
potentially uneasy interactions with the public. Therefore, washwater grab samples were instead
collected at five distinct weekend car wash fund raising events (see Section 4.1), which was
considered to be representative of pollutants typically generated by individual car washing
activities (See Section 4.2).
3.0 GOALS AND OBJECTIVES
The following were the goals and objectives of the Federal Way Residential Car Washwater
Monitoring Study:
• Collect and analyze representative residential car washwater samples in accordance with
procedures outlined in Standard Methods for the Examination of Water and Wastewater,
20th Edition.
• Estimate the annual mass loading of select individual pollutants to the MS4.
4.0 VEHICLE WASHWATER TESTING METHODS
4.1 Location of Sampling
The study utilized car washwater from five distinct weekend fund raising functions in the City of
Federal Way during the summers of 2007 and 2008. The events were typical, and included
groups washing cars and trucks for donations at settings such as commercial business locations
and church parking lots. No significant precipitation events occurred before or during any event.
Due to the large number of vehicles washed, and the volume of washwater generated, event
organizers were required to install a car wash kit to divert the flow away from the stormwater
system. The kit, supplied by the City at no cost, includes power cords, hoses, a small
submersible pump, and a plastic insert which fits into catch basin structures that receive the
soapy flow.
By means of this set-up (Figure 1), discrete grab samples of the washwater were easily retrieved
from the car wash kit discharge hose during the mid-point of each scheduled event. All water
flowing across the pavement in the car washing area was collected within the catch basin insert.
Collected washwater was delivered as effluent through a hose to either a sanitary clean out,
sanitary sewer manhole, or pervious area at the site.

4.2 List of Parameters
It is known that washwater generated from car washing may contain many types of contaminants
including high amounts of petroleum hydrocarbons, heavy metals and nutrients. In addition, data
provided by the International Carwash Association (ICA) representing wastewater discharged to
publicly owned treatment works from various commercial facilities indicates a similar inventory
of pollutants generated by car washing activity (ICA, 2002).
Based upon this information, a list of constituents to be analyzed for was developed. The
constituents tested are shown in Table 1. The following presents a brief description of the
general pollutant categories that were selected to be tested:
• Petroleum hydrocarbons (gasoline, diesel fuel, motor oil, fluids and lubricants) from
automobile engines, leaks, and fuel combustion processes.
• Heavy metals resulting from normal wear of auto brake linings (copper), tires, exhaust,
and fluid leaks.
• Phosphorous-and nitrogen-containing detergents contained in wash water from cleaning
vehicles.
• Surfactants in detergents and cleaning formulations (both synthetic and organic agents)
that lower the surface tension of water, allowing dirt or grease to be washed off of cars.
4.3 Sample Collection, Containers, Preservation, and Storage
Laboratory guidance was used to detennine the number and type of sample containers used, the
correct sample volume, and the proper sample preservative required for each parameter analyzed.
Before each sampling event, the following supplies were prepared:
• Sampling bottles, labels, and chain-of-custody forms from the laboratory.
• Powder-free disposable latex gloves.
• Coolers and ice.
• Field notebook to keep records concerning sampling.
The fo llowing describes the sampling method:
• Samples of car washwater were collected directly into the sample bottles without
transferring into another container to prevent unnecessary contamination.
• Bottles were filled to within two inches of the top to allow for thermal expansion (unless
sample analysis requires that no air space be left)

• The samples were placed immediately into a cooler with ice (and then refrigerator) to
maintain a 4°C environment until delivery to the laboratory. Samples were delivered
within the shortest holding time of the water parameter need to be analyzed.
• No replicates or field blanks were collected.
4.4 Chain of Custody Procedures
The chain-of-custody (CaC) refers to the documented account of changes in possession that
occur for a particular sample or set of samples. The cac record allows an accurate step-by-step
recreation of the sampling path, from origin through analysis. With the cac documentation,
there exists confidence that samples have not been tampered with and that they are representative
of the car wash water collected from that particular site. Information recorded on the cac
includes:
• Name of the persons collecting the sample
• Sample ID number
• Date and time of the sample collection
• Location of the sample collection
• Names and signature of all persons handling the samples in the field and in the laboratory
4.5 Field Records
The following sampling information was submitted on the cac to the laboratory ensuring proper
sample handling and analysis by the laboratory:
• A unique identification number assigned to all samples.
• The date and time of sample collection
• The source of the sample.
• The name of sampling personnel.
• Specific analysis required.

5.0 SAMPLE ANALYSIS
5.1 Methods
Analytical methods followed the procedures outlined in Standard Methods for the Examination
of Water and Wastewater, 20th Edition. Table 1 describes each parameter analyzed, the
analytical method used, and the proper sample preservatives required.
Test America Laboratories prepared written narratives assessing the quality of the data collected
for this project. These reviews include a description of analytical methods and assessments of
holding times, initial and continuing calibration and degradation checks, method blanks,
surrogate recoveries, matrix spike recoveries, laboratory control samples, and laboratory
duplicates. No significant problems were encountered in the conventional water quality analyses.
6.0 PREDICTED CONTAMINANT LOADING
The following series of steps were conducted to estimate annual pollutant loadings to the MS4:
1. An average concentration value was calculated for each parameter tested during the five
individual sampling events.
2. The average values were converted into an appropriate volume or mass quantity (either
gallons or pounds).
3. Total annual MS4 pollutant loadings were calculated based upon the amount of
residential car washing estimated to be carried out in Federal Way.
6.1 Laboratory Results
Table 2 provides a summary of laboratory results for each of the five separate sampling events
and the calcul ated average concentration for each parameter.

6.2 Conversion Factors
The final study figures hinged upon the following key referenced statistics and conversion
factors:
• There are an estimated 62,000 passenger cars and trucks registered in Federal Way
(WDOL, 2009).
• Thirty-eight percent (38%) of car owners wash their cars in the driveway (leA, 2005).
• The average frequency of residential car washing in the Puget Sound region is once
every two weeks (Hardwick, 1997).
• Twenty (20) gallons is the average amount of water used to wash a vehicle (based upon
field observations and simulations using a low-flow nozzle).
• Assumed that 80% of driveway car washing effluent drains to MS4.
• The average weight of used motor oil is 7.0 Ibs/gal, (USEPA, 1993).
• The average weight of gasoline is 6.llbs/gal, (USDOE, 2009).
• The average weight of#2 diesel fuel is 7.0 Ibs/gal, (USDOE, 2009).

6.3 Final Results
By converting sample concentration to mass or volume, hypothetical annual pollutant loading
estimates to the MS4 could be calculated. Significant findings are summarized in Table 3 that
lists select contaminants tested and their average annual estimated mass loading to the City of
Federal Way MS4 from residential car washing.
7.0 DISCUSSION OF STUDY RESULTS
The following is a brief discussion concerning several of the crucial pollutants detected, the
calculated annual pollutant loading, impacts to the City's MS4, potential effects on downstream
water quality:
Petroleum hydrocarbon waste: gasoline, diesel, and motor oil (estimated 190 galions of annual
mass loading). Compounds in petroleum hydrocarbons are highly toxic, and in the surface water
environment, they can cause harm to wildlife through direct physical contact, contamination by
ingestion, and the destruction of food sources and habitats.
Bottom-dwelling or bottom-feeding aquatic organisms may ingest petroleum contaminants and
transmit them up through the food chain until they accumulate in dangerous concentrations in
fish. Hydrocarbons also harm fish directly, and damaged fish eggs may not develop properly
(EPA, 2003). Additionally, oil can be particularly problematic because a single spilled cup can
contaminate the surface area of a waterbody the size of a football field (EPA, 2003).
Dissolved copper (estimated 14 pounds of annual mass loading). Exposure to dissolved copper
may be sufficient to impair the sensory biology (olfactory system) of coho salmon
(Oncorhynchus kisutch), listed as an ESA Species of Concern. Coho and other salmonids rely on
their sense of smell for critical behaviors such as homing, foraging, and predator avoidance. Sub-
lethal impacts on olfactory function may reduce the chances of survival or reproduction of
individual salmon and, therefore, are a concern for the survival of salmon populations within the
Pacific Northwest (Baldwin, et al, 2003). Dissolved copper is also toxic to phytoplankton, the
base of the aquatic food chain (National Research Council, 2008).
Nutrients: phosphorous and nitrogen (estimated 400 pounds of annual mass loading). An
increase in nutrient loading to a surface water body leads to excessive plant growth and decay.
This creates low dissolved oxygen levels, changes in animal populations, and an overall
degradation of water quality and aquatic habitat. This process is known as eutrophication. In the
2008 Water Quality Assessment, DOE found numerous locations in South Puget Sound impaired
due to a lack of dissolved oxygen caused by excess sources of nitrogen from human-related
pollution.

Nutrient availability al so impacts the formation of hazardous algal blooms (HABs) which can
produce high concentrations of nerve or liver toxins in the water column at levels that pose
human health concerns (WDOE, 2009). HABs in WaShington ponds, lakes, and reservoirs
(including Federal Way) have been documented at an increasing rate over the past 25 years
(WDOH, 2008).
Ammonia (estimated 60 pounds of annual mass loading). Forms of nitrogen (ammonium), in
combination with pH and temperature variations, can be toxic to fish. When this toxic
combination occurs, large amounts of oxygen in the water is consumed, subsequently stressing or
killing fish and other aquatic organisms (King County, 2009).
Suifactants (estimated 2,200 pounds of annual mass loading. In surface water environments,
surfactants are acutely toxic to aquatic life, stripping fish gills of natural oils, thereby
interrupting the normal transfer of oxygen.

Solids (estimated 3,000 pounds of annual mass loading). Sediment, the most common pollutant
in stormwater runoff by volume and weight, makes streams and lakes less suitable for recreation,
fish life, and plant growth. Sediment is of particular concern in fish-bearing streams where it can
smother trout and salmon eggs, destroy habitat for insects (a food source for fish), and cover
prime spawning areas. Uncontrolled sediment can also clog storm drains, leading to increased
private and public maintenance costs and flooding problems (King County, 2009).
B.O CONCLUSION
The purpose of this study was to quantify the pollutant loading to the MS4 from residential car
washing activities in areas upstream of in-flow treatment structures such as catch basin sumps,
oil/water separators, ditches and retention/detention ponds.
While many of the known contaminants in car wash water were tested for, there are many other
chemicals that were not. Some of these compounds include degreasers, metal brighteners, waxes
and other potentially toxic components, and are more extensively addressed by recent studies
investigating the overall aquatic toxicity of car wash effluent and synthetic detergents (Abel,
2006) (Brasino, et aI, 2007).
Given both the nature and concentration of the pollutants found in the car washwater tested, it is
apparent that significant quantities of stormwater contaminants are generated annually from
residential car washing activity in Federal Way. Stormwater carries these pollutants -soapy
water and all-to storm drains in urban areas, which then flow to surface waters with little or no
water quality treatment (WDOE, 2009). This study demonstrates that while any single residential
car wash might be considered inconsequential with respect to its contribution to the pollutant
load being delivered to the MS4, however, when extrapolated over the entire City of Federal
Way for a year, the pollutant loadings becomes more significant.
The City of Federal Way recognizes the challenges faced by the average homeowner as they
struggle to implement car wash stormwater pollution prevention best management practices in
their own driveway or neighborhood street. Solving these challenges becomes more urgent when
considering the population growth trends developed for Washington'S ten central Puget Sound
counties. Currently, there are approximately 4.2 million people residing here, but the figure is
expected to swell 1.3 million more by 2020 (WSOFM, 2009). These census predictions show us
how powerful and effective incremental behavioral changes by people can be, and how small
changes -when they benefit the environment -can translate into larger and more geographically
significant water quality improvements.
Even though professional car washing facilities employ water treatment systems, and in many
cases recycle the wastewater, surveys conducted by the International Carwash Industry from
1999 to 2008 indicate that the majority of home washers consistently feel that residential car
washing is better for the environment than commercial car washes (lCA, 2008). From this
information, it appears that more effective public education efforts will be needed to affect

sufficient behavior changes to reduce prohibited discharges caused by residential car washing
activity.
Other survey data indicates that people will act more environmentally responsible as more
accurate information is attained (NEETF, 2005). The City of Federal Way's public education
program continues to embrace this concept, and will follow the DOE lead in utilizing the results
of this study to craft more meaningful, effective, and accurate educational tools that describe the
overall magnitude of stormwater pollution created by all home-based activities, including
residential car washing.
For the average resident, we hope that this study will bring to view the amount of car washing
contamination produced in their own community, causing them to be concerned by the prospects
of pollutant loadings to our local salmon streams and Puget Sound when the sum of discharges
from the entire Western Washington region are considered.

THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. Preamble:
A. RCW 84.52 requires the governing body of the City of Moses Lake to fix the estimated amount
to be raised by taxation on assessed valuation on property within the City of Moses Lake
B. The City of Moses Lake's actual levy amount from the previous year was $10,222,955.
C. The City of Moses Lake has a population of more than 10,000.
D. Public hearings were held, with notice duly provided, to consider the city's current expense
budget for the 2013 calendar year pursuant to RCW 84.55.120.
E. The City Council of the City of Moses Lake, after hearing and duly considering all relevant
evidence and testimony presented, determine that the City of Moses Lake requires an increase
in property tax revenue from the previous year, in addition to that resulting from the addition
of new construction and improvements to property, any increase in the value of state assessed
utility property, and any increase due to the annexation of new territory and refunds made, in
order to discharge the expected expenses and obligations of the city.
Section 2: Tax Levy: The following taxes for general municipal purposes for the City of Moses Lake for the
year 2013 be and the same are hereby levied upon all taxable property within the City of Moses Lake. An
increase in the regular property tax levy of $1 02,230, in addition to the increase resulting from the addition of
new construction and improvements to property as authorized by RCW 84.55.010, and any increase in the
value of state assessed utility property, is hereby authorized for the 2013 levy in the amount of $15,000,000
which is a percentage increase of 1.00% from the previous year, and any increase due to the annexation of
new territory, new construction, and refunds made.
Section 3. Effective Date: This ordinance shall take effect and be in force five (5) days after its passage and
publication as provided by law.

The City Council shall meet on October 23,2012 at 7 p.m. in the Council
Chambers pursuant to RCW 84.55.120 and hold a public hearing on revenue
sources for the city's 2013 current expense budget and on the estimated
amount of property taxes to be received from assessed valuations on
property within the City of Moses Lake. "Current expense budget" means
that budget which is primarily funded by taxes and charges and reflects the
provision of on-going services. "Current expense budget" does not mean the
capital, enterprise, or special assessment budgets of the city. The hearing
shall include consideration of possible increases in property tax revenues.
The proposed 2012 property tax levy for collection in 2013 is $15,000,000,
which is the amount levied in 2011 for collection in 2012, plus an increase of
1.00% on the maximum tax rate allowed by law which is an estimated
increase of $102 ,230 plus an increase equal to the amount allowed under
the new construction provisions of RCW 84.55.010, any increase due to the
annexation of new territory and any increase in the value of state-assessed
utility property. After the October 23, 2012 public hearing the City Council
shall consider the first reading of an ordinance setting the 2013 property tax
levy. The City Council shall then meet on November 13, 2012 at 7 p.m. in

PUBLIC HEARING NOTICE
The Preliminary Budget for the 2013 fiscal year has been filed
with the Finance Director. Copies of the preliminary budget
may be examined and/or obtained at the Office of the Finance
Director during normal business hours.
The City Council shall meet on November 13, 2012 at 7 p.m.
in the Council Chambers and following a public hearing, shall
consider the first reading of an ordinance adopting the 2012
budget. The City Council shall meet on November 27,2012 at
7 p.m. in the Council Chambers and consider the second
reading of an ordinance fixing and adopting the 2013 budget.
Any taxpayer will have the right to appear and provide written
and oral comments for or against any part of the budget and
ask questions concerning the entire budget at the public
hearing.

Dear Joe:
It is with great pleasure that I respond to your letter, dated September 11, 2012,
regarding this Charitable Contribution to name and enhance the public space
outside of the Japanese Peace Garden located at 800 Alder Street in Moses Lake.
I would like to suggest a two-year payment plan, as follows: one installment of
$25,000 in 2012 and one installment of$25,000 in the year 2013. This contribution
of $50,000, over two years, will ensure that this piece of property is preserved as a
historical location to honor the pioneers of Neppel (platted in 1912) and later Moses
Lake (named in 1938).
Along with my family, I will be actively involved with the City of Moses Lake design
team in the development and design of the structures and plaques that will
ultimately be incorporated into the park I would ask that a panel of members of the
Moses Lake Museum and Art Center and its friends be formed. This panel would
review requests from families who wish to record their family history in this
location.
I am excited that I have the opportunity to share my love for this community and
knowledge of its history with others who share my feelings. For over 40 years, it has
been my wish to preserve a piece of Moses Lake that is dedicated to our fine
community. My hope is that this location will highlight the rich heritage of our
residents and become a gathering place for generations to come.
Together we will embark on this project and establish a timeline of critical dates to
reopen this "yet to be named" park

D. SCHMITT AS THE OWNERS OF CERTAIN REAL PROPERTY UPON WHICH THE CITY
CAUSED ABATEMENT OF A NUISANCE TO BE PREFORMED AFTER A FAILURE OF THE
PROPERTY OWNERS TO ABATE THE SAME.
RECITALS:
1. Real Property Location and Ownership. The records of Grant County show that Eric D. & Michele D.
Schmitt are the owners of property within the city limits located at 1146 Gem. The parcel number of this
property is 091728000. Eric D. & Michele D. Schmitt were provided notice of a hearing held before the
City Council on August 28, 2012, to consider the allegations of the Code Enforcement Officer that a
nuisance requiring abatement existed on property owned by Eric D. & Michele D. Schmitt.
2. On August 28, 2012 the City Council conducted a hearing to determine if a nuisance existed on the
property at 1146 Gem. At the conclusion of that hearing, the City Council adopted Resolution No. 3313
which provided a nuisance existed on the property at 1146 Gem, that the owner had fifteen (15) days to
abate such nuisance and if the nuisance was not abated within fifteen (15) days of adoption of that
resolution, the City would cause the nuisance to be abated and the costs of that abatement to be charged
against the property owner.
3. The nuisance identified in Resolution No. 3313 was not abated by the property owner within fifteen (15)
days of the adoption of that resolution . On September 5,2012 the City caused the nuisance identified
to be abated through the use of contracted and/or City labor and equipment.
RESOLVED:
1. The costs to the City to abate the nuisance identified in Resolution 3313 on the property at 1146 Gem are
set forth below. Those costs are derived from the attached documents which detail the costs incurred.
2. The costs to be recovered from Eric D. & Michele D. Schmitt are:
City labor and equipment costs $0.00
Contracted labor and equipment (company) $107.90
Total $107.90
3. This charge is certified by the City Council as due and owing the City. This charge shall be forwarded in
writing to Eric D. & Michele D. Schmitt for payment. If payment is not received within thirty (30) days of

Attached is a resolution providing for the abatement of nuisances at 403 N. Earl , owned
by Marjorie Francis Rodriguez Estate. The Council should hold a hearing to consider the
allegations of the Code Enforcement Officer that the property contains a public nuisance
which has not been corrected. If the Council concurs that a public nuisance exists, the
resolution should be adopted allowing the City to remove the public nuisance.
The resolution is attached for Council cons ideration.

A RESOLUTION DETERMINING THAT MARJORIE FRANCIS RODRIGUEZ ESTATE IS
THE OWNER OF CERTAIN REAL PROPERTY WITHIN THE CITY; THAT A NUISANCE
REQUIRING ABATEMENT BY CITY FORCES OR FORCES CONTRACTED BY THE CITY
EXISTS ON SUCH PROPERTY; AND DIRECTING THE USE OF SUCH FORCES TO
ABATE THE NUISANCE FOUND
Recitals:
1. Real Property Location and Ownership. It is alleged by a Code Enforcement Officer of the City,
a person authorized to enforce the ordinances and municipal code of the City, that the real
property located at 403 N. Earl Road (Lot 29, Knolls Vista 13th Addition), Parcel #100488000,
Moses Lake, Washington, is the site of public nuisance violations of Moses Lake Municipal
Code (MLMC) 8.14.030 U. The records of Grant County show the owners of the subject
property to be Marjorie Francis Rodriguez Estate, c/o Mary Gurnard, 405 N. Marie, Wenatchee,
WA 98801 .
2. Notice. On August 30, 2012, the Code Enforcement Officer caused to be delivered by regular
mail and certified mail to the owner of record of the subject property a Notice of Violation and
Order to Correct or Cease Activity. No appeal was filed to challenge that order. The time to
comply under that order has passed. The nuisance described in that order has not been abated
by correction of the condition of the property and a nuisance continues to exist on the subject
property. On October 10, 2012, the Code Enforcement Officer caused to be delivered to
Marjorie Rodriguez, c/o Mary Gurnard a notice of the intent of the City Council to consider
adoption of a resolution such as this at its meeting of October 23, 2012. Such notice was in
writing, in the English language and was delivered by return receipt mail and regular mail to the
record owner of the subject property.
3. Violations. It has been established by the Notice of Violation and Order to Correct or Cease
Activity that the following violations exist on the subject property and have not been corrected:
3.1 A violation of MLMC 8.14.030U -8.14.030 Nuisance Defined. Each of the following conditions,
unless otherwise permitted by law, is declared to constitute a public nuisance, and whenever the
Code Enforcement Officer determines that any of these conditions exist upon any premises or in
any stream, drainage way or wetlands, the officer may require or provide for the abatement thereof
pursuant to this chapter.
U. Except for any designated public park land, natural area, or environmentally sensitive area,
or any undeveloped parcels of land not adjacent to developed areas or which are used for
agricultural purposes , all grasses, weeds, or other vegetation growing or which has grown
and died, which is determined to be a fire or safety hazard or a nuisance to persons, shall not
exceed twelve inches (12") in height measured above the ground.
1. The above exception may be wa ived and additional maintenance required by the Code
Enforcement Officer if he determines such action is necessary to protect the safety of
persons or adjoining property.
2. All maintenance shall be done in a manner so that soil stability will not be disrupted or
disturbed. Grass, weed , or vegetation control shall not include plowing , discing, or
scraping the soil to eliminate the grasses, weeds , or other vegetation unless a soil
stabilization plan , which will minimize blowing dust and maintain soil stability and which

sha ll be approved by the city prior to any plowin g, discing, or scraping, is implemented
immediately.
4. Hearing. On October 23,2012 the Moses Lake City Council conducted a hearing to cons ider
the allegations of the Code Enforcement Officer that the subject property contains a public
nuisance ordered corrected which remains uncorrected and that the record owner is
responsible for the costs of correcting and abating such violations if such corrections and
abatement is accomplished by City forces or forces contracted by the City for such purpose.
All interested persons were permitted to provide written or oral evidence relevant to the issue.

1. A public nuisance in violation of MLMC 8.14.030 U exists on the subject property at 403 N. Earl,
Moses Lake, Washington. Marjorie Rodriguez, c/o Mary Gurnard, 405 N. Marie, Wenatchee,
WA 98801 is the record contract owner of the subject property perthe records of Grant County.
2. The public nuisance located upon the subject property consists of:

3. The maintenance of these public nuisance violations on the subject property by the record
owner is detrimental to the health, safety, welfare, peace and tranquility of the residents of
the City impacting the quality of life and diminishing property values.
4. Marjorie Rodriguez, the record contract owner, has fifteen (15) days from the date of the
adoption of this resolution to cause the nuisance violations listed herein to be removed to
the satisfaction of the Code Enforcement Officer. Those improvements include the
following :

5. City staff shall provide a status report to City Council on the progress of the record contract
owner to make the clean up required on the subject property. If the improvements, as listed
above, are not to the satisfaction of the Code Enforcement Officer, the City is authorized
to use City forces or contract forces to cause the identified public nuisances to be removed
from the subject property to the satisfaction of the City Manager. All costs of any removal
of the identified public nuisances done at City expense shall be recovered by the City
Manager by all reasonable means including immediate assignment of the costs so incurred
for collection.
6. A copy of this resolution shall be provided to the record contract owner by return receipt and
regular mail after its approval by the City Council.

Nuisance Defined. Each of the following conditions, unless otherwise permitted by law, is
declared to constitute a public nuisance, and whenever the Code Enforcement Officer deter-
mines that any of these conditions exist upon any premises or in any stream, drainage way
or wetlands, the officer may require or provide for the abatement thereof pursuant to this
chapter.
The existence of any trash, dirt, filth, and carcass of any animal, waste shrubs, accumulation
of lawn or yard trimmings or other offensive matter.
Defective or overflowing septic or sewage systems, and the existence of any noxious, foul,
or putrid liquid or substance which poses a health hazard or creates a noxious odor.
Any man-caused pool of standing or stagnant water, except storm drainage systems, which
serves as a breeding area for insects.
Accumulation of garbage, decaying vegetation, manure, dead animals, or other noxious
things in a street or alley, or on public or private property to an extent injurious to the public
health as determined by the Health Officer.
All other acts, failure to act, occupations, or use of property which is determined by the Health
Officer to be a menace to the health of the public.
All limbs of trees which are less than seven (7) feet above the surface of any public sidewalk,
or twelve (12) feet above the surface of any street.
All buildings, other structures, or portions thereof which have been damaged by fire, decay,
neglect, or have otherwise deteriorated or become dilapidated so as to endanger the safety
of the public.
All explosives, flammable liquids, and other dangerous substances stored or used in any
manner in violation of the State Fire Code.
The keeping or harboring of any dog, fowl, or other animal which by frequent or habitual
howling, yelping, barking, crowing, or in the making of other noises, annoys or disturbs the
public, or the habitual allowing of dogs kept at anyone address to run at large in violation of
Chapter 6.05 of the Moses Lake Municipal Code entitled "Animal Control".
Making or causing to be made by any means whatsoever any noise of any kind which is a
violation of Chapters 8.28 of the Moses Lake Municipal Code entitled "Noise Control".
The frequent, repetitive, or continuous sound made by any secured, unsecured, or
deteriorated membrane or sheet metal, being moved by the wind or other source, which
unreasonably interferes with the peace, comfort and repose of adjacent property owners or
possessors.
Dumping, throwing, placing, leaving or causing or permitting to be dumped, thrown, placed
or left, any filth, paper, cans, glass, rubbish, trash garbage, grass trimmings, shrub trimming,
and shrubbery of any kind , in or upon any street, alley, sidewalk, ditch, or public or private
property of another in the city.
The erecting, maintaining, using, placing, depositing, leaving or permitting to be or remain
in or upon any private lot, building, structure or premises, or in or upon any street, alley,
sidewalk, park, parkway or other public or private place in the city, anyone or more of the
following disorderly, disturbing, unsanitary, fly-producing, rat-harboring , disease-causing
places, conditions or things:
1. Any putrid, unhealthy or unwholesome bones, meat, hides, skins, or whole or any
part of any dead animal, fish or fowl, or waste parts of fish, vegetable or animal

matter in any quantity; but nothing herein shall prevent the temporary retention of
waste in approved covered receptacles.
2. Any privies, vaults , cesspools, sumps, pits or like places which are not securely
protected from flies and rats, or which are foul or malodorous.
3. Any filthy, littered or trash-covered dwellings, cellars, house yards, barnyards, stable
yards, factory yards, vacant areas in the rear of stores, vacant lots, houses, buildings
or premises.
4. Any animal manure in any quantity which is not securely protected from flies or
weather conditions, or which is kept or handled in violation of any ordinance of the
city.
5. Any poison oak or poison ivy, Russian thistle or other noxious weeds, as defined by
Chapter 8.22 of the Moses Lake Municipal Code entitled "Noxious Weed Control"
whether growing or otherwise; but nothing herein shall prevent the temporary
retention of such weeds in approved covered receptacles.
6. Any bottles, cans, glass, ashes, small pieces of scrap iron, wire, metal articles, bric-
a-brac, broken crockery, broken glass, broken plaster and all such trash, or
abandoned material, unless it is kept in approved covered bins or galvanized iron
receptacles.
7. Any trash, litter, rags, accumulations orempty barrels, boxes, crates, packing cases,
mattresses, bedding, excelsior, packing hay, straw or other packing material, lumber
not neatly piled , scrap iron, tin or other metal not neatly piled, or anything whatsoever
in which flies or rats may breed or multiply or which may be a fire hazard.
N. The permitting to remain outside any dwelling, building, or other structure, or within any
unoccupied or abandoned building, dwelling, or other structure, in a place accessible to
children, any abandoned, unattended, or discarded ice chest, refrigerator or other airtight
contained, which does not have the door, lid or other locking device removed.
O. Any pit, hole, basin or excavation which is unguarded or dangerous to life or has been
abandoned, or is no longer used for the purpose constructed, or is maintained contrary to
statutes, ordinances, or regulations.
P. Any well or storage tank permitted to remain on any public or private property without being
securely closed or barring any entrance or trap door thereto, or without filling or capping any
well.
Q. The repair or abandonment of any automobile, truck, or other motor vehicle of any kind upon
the public streets or alleys of the city.
R. The keeping or permitting the existence of any bees or other insects, reptiles , rodents, fowl,
or any other animals, domestic or wild , in any manner contrary to law, or which affect the
safety of the public.
S. The existence of any fence, other structure, or thing on private or public property abutting or
fronting upon any public street, sidewalk, or place, which is sagging, leaning, fallen, decayed
or is otherwise dilapidated and creating an unsafe condition.
T. The existence of any vine, shrub, or plant growing on, around, or in front of any fire hydrant,
utility pole, utility box, or any other appliance or facility provided for fire protection, public or
private utility purposes in such a way as to obscure from view or impair access thereto.

implemented immediately.
v. The existence of any dead, diseased, infected, or dying tree, shrub, or other vegetation which
may pose a danger to vegetation, crops , property, or persons.
w. The existence of any accumulation of materials or objects in a location when the same
endangers property, safety or constitutes a fire hazard.
x. The depositing or burning or causing to be deposited or burned in any street, alley, sidewalk,
parkway or other public place which is open to travel, of any hay, straw, paper, wood, boards,
boxes, leaves, manure or other rubbish or material.
Y. The storage or keeping on any premises for more than thirty days of any used or unused
building materials as defined in Section 8.14.010 (F), whose retail cost new would exceed
one hundred dollars, without a special permit from the bu ilding official; provided, that nothing
herein shall:
1. Prohibit such storage without a permit when done in conjunction with a construction
project for which a building permit has been issued and which is being prosecuted
diligently to completion.
2. Prohibit such storage without a permit upon the premises of a bona fide lumberyard,
dealer in building materials or other commercial enterprise when the same is
permitted under the zoning ordinance and other applicable laws.
3. Make lawful any such storage or keeping when it is prohibited by other ordinances
or laws.
z. The existence on any premises of any unused and abandoned trailer, house trailer, automo-
bile, boat or other vehicle or major parts thereof.
AA The keeping or maintenance in any area on private property which is clearly visible from a
public street, sidewalk, park or other public area any accumulation, collection or untidy storage
of any of the following : old appliances or parts thereof; old iron, steel, aluminum or other
metal; inoperable vehicles, vehicle parts, machinery or equipment; mattresses, bedding,
clothing, rags or cloth; straw, packing materials, cardboard or paper, tin cans, wire, bottles,
glass, cans, barrels, bins, boxes, containers, ashes, plaster or cement; or wood . This
determination shall not apply to conditions completely enclosed within a building or fencing so
as not to be visible from public property.
BB. The keeping, permitting or harboring of any fowl , pigeons, rabbits, hoofed or cloven footed
animals, except for caged birds kept within a residence or business.

CC . The depositing of any debris, vegetation, lawn clippings, lumber piles, wood piles, auto parts
or bodies, garbage and th e like, or storing of any material of any kind, provided that in
residential zones that shall include garbage cans or refuse containers in the alleys of the city,
except on garbage pickup day.
DO. The existence of graffiti, which is defined as a defacing, damaging, or destructive inscription,
figure or design painted, drawn or the like, on the exterior of any building, fence, gate, or other
structures or on rocks, bridges, trees, or other real or personal property.
EE. The locating of automobiles, trucks, recreational vehicles, trailers, boats, or any other vehicles,
vessels, or the like forthe purpose of advertising its sale on property located in any commercial
or industrial zone not owned by the seller.
FF. The permitting of any condition or situation where the soil has been disrupted, disturbed, or
destablized so as to allow blowing dust to exist.
GG. The existence on any premise any unsecured, unused, or abandoned bu ilding or structures.
HH. For any building the existence of any broken glass in windows or doors for more than thirty (30)
days.
II. Buildings or portions thereof that have faulty weather protection, such as openings in walls and
roofs. Faulty weather protection shall include temporary weather barriers, such as tarps,
plastic or similar material, left in place for more than thirty (30) days.
JJ. Any building which has a window, door, or other exterior opening closed by extrinsic devices
or some other manner, with material that has not been painted to match or compliment the
buildings exterior or remains boarded up for more than sixty (60) days.
KK. Any boarded up building that remains boarded up for more than ninety (90) days.
LL Permitting any violation of RCW 59.18.510 in any rental dwelling unit.
MM. Criminal street gangs and any pattern of criminal street gang activity are each declared to be
a public nuisance in violation of this chapter and other applicable code provisions, including
but not limited to the Uniform Code for the Abatement of Dangerous Buildings and State
Housing Code, subject to abatement through all available means. In addition thereto and
without limitation, any pattern of criminal street gang activity upon, and the presence and use
of property by, a criminal street gang, with the owner's knowledge or consent, constitutes a
public nuisance and grounds for revocation of any permit or license regulating or authorizing

I. Any violation for which a Notice of Violation and Order to Correct or Cease Activity has
been issued but which has not been corrected within the the time specified shall incur a
civil penalty of two hundred fifty dollars ($250) per day up to a sum of five thousand
dollars ($5000) .. beginning on the day the correction was to be completed. The
cumulative penalty provided for in this paragraph shall not accrue while an appeal is
pending, nor shall the penalty preclude the initiation of appropriate legal action to correct

Pursuant to Moses Lake Municipal Code (MLMC) 8.14.070 the City of Moses Lake is giving you notice that it will
conduct a hearing before the Moses Lake City Council at the Council's regular meeting on Tuesday, October 23,2012
which is more than ten days from the date of this lener. That meeting wi ll begin at 7:00 p.m. in the Council Chambers in
the Moses Lake Civic Center. The purpose of this hearing is for the City Council to determine if a nuisance exists on
your property and if a nuisance is found to exist to direct the abatement of that nui sance by use of City contracted
forces. The cost of that abatement will be assessed against you as the owner of the subject property. At that hearing all
persons interested in the abatement of the nuisance existing on the subject property will have the opportunity to be heard
under oath. At that time. you may present all relevant evidence you wish for the City Counci I to consider, whether that
be documents, photos, or live testimony from yourselfor others. At the conclusion of that hearing. it is expected the
City Council will deternline if an abatement of a nuisance located on the subject property should take place and when.

A RESOLUTION ALLOWING THE CITY OF MOSES LAKE TO BUILD ON UNPLATTED
PROPERTY
RECITALS:
1. Moses Lake Municipal Code 16.12.030 allows for the issuance of a building permit to a proponent
who wishes to build on unplatted property after a resolution from the City Council.
2. The City of Moses Lake has requested the City Council to allow it to build on unplatted property
described as follows:
TaX# 5790 in East Y, East Y, East Y, of Section 33, Township 20 North, Range 28 and in the West
Y, of Section 34, Township 20 North, Range 28 -That part of Larson Air Force Base located in
Township 20 North, Range 28 East Willamette Meridian, described as follows: beginning at a point
on the east line of Section 33 , Township 20, Range 28 , which is North 00°53'26" West 2272.35 feet
from the southeast corner of said Section 33 (whose Washington State Grid South Zone coordinates
are Y=674047.08 -X=2298909.20 and are referred to U.S.C.& G.S. Station "SPAD" whose WS.G.S.
zone coordinates are Y=676911.66 -X=2288625. 74) thence South 00°53'26" East along the east line

6691 RANDOLPH ROAD NE -LARSON TREATMENT PLANT
City staff is requesting to build a new vehicle storage shop on the Larson Treatment Plant site at

The Engineering Division staff has started the process to plat the City's land where the Larson
Treatment Plant is located.

The resolution establishing a Lodging Tax Advisory Committee and appointing members
thereto stated that the City Council would review the membership of the Committee on an
annual basis and make changes as appropriate.
Original members of the Advisory Committee were appointed by the Council in September
1997. Current members of the Committee are Debbie Doran-Martinez, Moses Lake
Chamber of Commerce and Tourism Commission, Brenda Teals, Allied Arts and Friends
of the Adam East Museum and Art Center, and Tourism Commission. Currently two
positions on the Committee are vacant and should be filled by the Council. Mayor Ecret
is the Chairman.
For your information, attached is a copy of Resolution #2065.
Upon review, if the City Council desires, changes can be made. On the other hand, the
City Council can confirm the membership as it stands.

RESOLUTION NO. 2065
A RESOLUTION ESTABLISHING A LODGING TAX ADVISORY COMMITTEE AND APPOINT·
ING MEMBERS THERETO
Recitals:
1. The City of Moses lake currently levies a lodging tax pursuant to Chapter 67.28 RCW.
2. The State legislature has passed SSB 5867, enacted as Chapter 452, Laws of 1997, which
modifies or repeals some previous lodging tax authority but also adds new lodging tax authOri-
ty.
3. SSB 5867 requires that, In cities with a population over 5,000, any new Imposition of a lodging
tax enacted under Chapter 67.28 RCW be first submitted for consideration to a lodging tax
advisory committee not less than 45 days in advance of final action on the lodging tax by the
city.
4. SSB 5867 was effective on July 27, 1997.
5. SSB 5867 replaces the current lodging tax authority with a new statutory scheme.
6. To insure continued authorization for the imposition of the lodging tax it is deemed to be in the
best interests of the city that a lodging tax advisory committee be created and that a proposal
be submitted to this committee regarding continuation of the lodging tax.
Resolved:
1. There is hereby created a City of Moses Lake Lodging Tax Advisory Committee to serve the
functions prescribed in SSB 5867, which was enacted as Chapter 452, Laws of 1997.
2. The membership of the Lodging Tax Advisory Committee shall consist of five (5) members, ap-
pointed by the City Council. One member shall be an elected official of the city who shall
serve as chair, two members shall be representatives of businesses required to collect the tax,
and two members shall be persons involved in activities authorized to be funded by revenue
received from the tax. The City CounCil will review the membership on an annual basis and
make changes as appropriate. Vacancies on the committee shall be filled by the City Council.
3. The City Council shall submit to the lodging Tax Advisory Committee, for its review and
comment. proposals on:
a. The imposition of a tax under SSB 5867.
b. Any increase in the rate of such a tax.
c. Repeal of an exemption from such a tax.
d. A change in the use of the revenue received from such a tax.
The City Council shall submit such a proposal to the Committee at least forty-five (45) days
before taking final action on any such proposal. Comments by the Committee should include
an analysis of the extent to which the proposal will accommodate activities for tourists or
Increase tourism, and the extent to which the proposal will affect the long-range stability of the
special fund created for the lodging tax revenues.

Subject: Longview Tracts -Sewer Service
Pursuant to our discussions regarding the Longview Tracts sewer main
improvement project, I am attaching a Draft letter intended for those
residents that have yet to connect to our sewer system. The purpose of
providing the Draft letter is to update the City Council on our efforts with
those property owners who have to yet to connect to our sewer system.
This update may also raise the question of what to do with those property
owners who do not comply with the requirement to connect to our
system . Staff is very interested in Council's direction if we find ourselves
in a position where we can't get a property owner to connect to our sewer
system .
Also, I have attached a map with a legend that details those properties
that have completed their sewer connections and those who have yet t o
connect.

SUBJECT: Longview Tracts Neighborhood -Sewer Connections

In October 0[2011, the City of Moses Lake completed the installation of the sewer main project in
the Longview Tracts neighborhood. We hope that residents of the neighborhood understand the
importance of having adequate sewer facilities as the area has been plagued with septic system
problems in the past. The installation of the sewer main is a demonstration that the City Council is
committed to improving the condition of the neighborhood.
Staff is continuing to work with property owners with the installation of sewer service to each and
every home in the Longview Tracts neighborhood. Currently we have several homes that still need
to connect to our sewer service. All homes in the Longview Tracts neighborhood were required to
connect by September 15,2012. You are receiving this letter because your home has not yet been
connected to our sewer service. Because you have not connected to our sewer system, this matter
may become a Code Enforcement issue which could include fines. I hope you understand that we
wish to have compliance with connecting to our sewer service rather than imposing fines.
Given the seriousness of this issue, we want to meet with you and others that have yet to connect to
our sewer service before this matter becomes a Code Enforcement issue. Our intent in meeting with
you is to better understand your delay in connecting to our sewer service. We have scheduled a
meeting at Longview Elementary School on October 29th at 7 p.m. to talk about how we can get your
home connected to our sewer system.
If you have any questions before the October 29th meeting, please contact me at 764-3745 and we
can set up a time and date to meet.
