The meeting was called to order at 7 p.m. by Mayor Lane.
PLEDGE OF ALLEGIANCE: Mr. Pearce led the Council in the pledge of allegiance.
PRESENTATIONS AND AWARDS -None
CONSENT AGENDA
Minutes: The minutes of the March 22, 2011 meeting were presented for approval.
Action Taken: Mr. Pearce moved that minutes be approved, seconded by Mr. Reese, and passed
unanimously.
Approval of Claims, Prepaid Claims, Checks, and Payroll: Vouchers audited and certified by the
Finance Director as required by RCW 42.24.080, and those expense reimbursement claims,
certified as required by RCW 42.24.090, have been recorded on a listing which has been made
available to the Council for approval and is retained for public inspection at city hall. As of April 12,
2011 the Council does approve for payment claims in the amount of $1 ,91 0, 194.42; prepaid claims
in the amounts of $47,503.69 and $35,162.52; claim checks in the amount of $831,918.35; and
payroll in the amounts of $26,323.94 and $2,823.38.
Dr. Curnel questioned the cost of tree placement. Gary Harer, Municipal Services Director, stated
that it is the final payment on the replacement of the trees in the current paver district project. He
mentioned that the cost includes repair and replacement of both the tree wells and tree species.
A more detailed report will be provided at the next meeting.
Action Taken: Dr. Curnel moved that the bills and checks be approved, seconded by Mrs.
Liebrecht, and passed unanimously.
Accept Work -Mae Valley Well Project 2010: Advanced Excavation, Inc. has completed work on
the 2010 Mae Valley Well Project. This project consisted of constructing a new well house and
setting the pump for the recently drilled Well 31 located in the Westlake area and modifying the well
house and setting the pump at Well 19 that is located at Moses Pointe.
Mr. Deane pointed out that the increase in the water and sewer bills helped pay for these
improvements.
Action Taken: Mr. Deane moved that the work be accepted, seconded by Mrs. Liebrecht, and
passed unanimously.

VISION 2020 -CITY WIDE CLEAN UP
April 12, 2011
Vision 2020 has scheduled the 9th Annual City Wide Clean Up for Saturday, May 7, from 8 a,m, to
noon, Permission was requested to use the parking lot at the Surf and Slide Water Park for city
cleaning assignments, garbage collection, and lunch, Vision 2020 also requested the city allow
Lakeside Disposal to staff and use their compactor truck on site and to cover the cost of the landfill
fees.
Action Taken: Mr. Ecret moved that the request be granted, seconded by Mr. Reese, and passed
unanimously,
REQUEST TO USE CITY PROPERTY -MOSES LAKE BUSINESS ASSOCIATION
The Moses Lake Business Association is planning a barbeque competition for September 24.
There will be about 25 teams competing for a $5,000 purse. They will begin cooking at 6 a.m. and
the judging will be at 5 p.m. The public will be invited to attend. Permission was requested to close
Third Avenue from Alder Street to Cedar Street and the 200 and 300 blocks of Ash Street from
Friday September 23 at 8 p.m. to 8 p.m. on Saturday, September 24; permission to use Sinkiuse
Square on September 24; permission to allow a non-profit group to host a beer garden in the 300
block of Ash Street; permission to discharge grey water into the city sewer system; and permission
for tem members to stay in self-contained vehicles overnight in the Surf 'n Slide parking lot.
There was some discussion conceming the closure of side streets, access to the post office, and
access for emergency vehicles.
Marianne Bondi, Executive Director, Moses Lake Business Association, stated that they would be
glad to work with city staff to address the concerns, They felt it would be a good event for Moses
Lake,
There was some discussion by the Council concerning the beer garden and the camping in the Surf
'n Slide parking lot. It was suggested that a non-alcoholic beverage garden would do well also and
overnight parking is allowed for other events,
Action Taken: Mr. Reese moved that the request be granted, seconded by Dr. Curnel.
Action Taken: Mr. Pearce moved that the request be tabled, seconded by Mr, Deane, and failed
with Mr. Pearce, Mrs. Liebrecht, and Mr. Deane in favor and Mr, Lane, Mr. Reese, Dr. Curnel, and
Mr. Ecret opposed,

ORDINANCES AND RESOLUTIONS
ORDINANCE -AMEND 19.06 -CLASSIFICATION AND DESIGNATION OF WETLANDS -SINGLE
READING
An ordinance was presented which amends the requirements in the Classification and Designation
of Wetlands by deleting the provision that the Department of Ecology use the Washington State
Wetland Delineation Manual. This change brings the city into compliance with state law,

The ordinance amending Chapter 19.06 of the Moses Lake Municipal Code entitled "Classification
and Designation of Wetlands and Regulations for the Conservation and Protection of Wetlands"
was read by title only.
Gilbert Alvarado, Community Development Director, pointed out that the change was made at the
legislative level and is in effect state wide at this time. This changes clarifies which manual is to
be used in delineating a wetland.
Action Taken; Mr. Deane moved that an emergency be declared and the ordinance be adopted on
a single reading, seconded by Mr. Reese, and passed unanimously.
ORDINANCE -AMEND GARBAGE RATES -1ST READING
An ordinance was presented which establishes a rate for a 40 yard roll-Off two times a week and
a return trip charge. The return trip charge would be assessed for those individuals who fail to
have their carts out on the street on time.
The ordinance establishing charges for garbage collection was read by title only.
Action Taken: Mr. Pearce moved that the first reading of the ordinance be adopted, seconded by
Mr. Reese, and passed unanimously.
ORDINANCE -AMEND 10.12 -PARKING REGULATIONS _1 ST READING
An ordinance was presented which amends the parking regulations by deleting unnecessary
sections, moving some restricted parking to the correct category, and rewording some sections for
consistency.
The ordinance amending Chapter 10.12 of the Moses Lake Municipal Code entitled "Parking
Regulations" was read by title only.
Gary Harer, Municipal Services Director, explained the changes.
Action Taken: Mrs. Liebrecht moved that the first reading of the ordinance be adopted, seconded
by Mr. Reese, and passed unanimously.
RESOLUTION -ACCEPT DONATION -SOROPTIMIST INTERNATIONAL
A resolution was presented which accepts $740 from Soroptimist International. The funds are to
be used for the purchase of a bench in memory of Faye Maslen and Ruby Helmbolt
The resolution accepting a cash donation of $750 from Soroptimist International of Moses Lake
was read by title only.
Action Taken: Mr. Reese moved that the resolution be adopted, seconded by Mr. Ecret, and
passed unanimously.
REQUEST TO CALL FOR BIDS
ALLEY RECONSTRUCTION PROJECT 2011
Staff requested authorization to call for bids for the 2011 Alley Reconstruction Project. This project
will pave the alleys located between Third Avenue and Broadway Avenue starting at Alder Street
and ending at Fir Street.

Action Taken: Mr. Ecret moved that staff be authorized to call for bids, seconded by Dr. Curnel, and
passed unanimously.
COF IMPROVEMENT PROJECT 2011
Staff requested authorization to call for bids for the 2011 COF Improvement Project. This project
will construct a one million gallon storage basin and improve the headworks at the Central
Operations Facility.
Gary Harer, Municipal Services Director, stated that the storage basin is being constructed to
handle any wastewater in case the force main should break between the Central Operations Facility
and the Sand Dunes Wastewater Treatment Plant.
Action Taken: Mr. Reese moved that staff be authorized to call for bids, seconded by Mr. Pearce,
and passed unanimously.
STORMWATER DECANT FACILITY PROJECT 2011
Staff requested authorization to call for bids for the 2011 Stormwater Decant Facility Project. This
project will construct a decant facility that will be used instead of the existing drain pad that
discharges to the stormwater system.
Gary Harer, Municipal Services Director, stated that this project will bring the city into compliance
with state law. He mentioned that the city received comments from the neighbors and staff has
addressed their concerns.
There was some discussion by the Council.
Action Taken: Mr. Ecret moved that staff be authorized to call for bids, seconded by Dr. Curnel, and
passed unanimously.
TRAILER
Staff requested authorization to call for bids for a 25-ton trailer with ramps to transport the new
backhoe. The existing trailer will be transferred to the Parks Department to transport their
backhoe.
There was some discussion by the Council.
Action Taken: Mr. Ecret moved that staff be authorized to call for bids, seconded by Mr. Deane,
and passed unanimously.

OTHER ITEMS FOR COUNCIL CONSIDERATION
WALGREENS -LEFT TURNS
The Community Development Department has received several complaints regarding the left turn
movement into the Walgreens store from Stratford Road. Both the Municipal Services Director and
the Police Chief feel the left turn is a traffic hazard and have requested the left turns be prohibited
by the installation of a concrete curb as a barrier.
CITY COUNCIL MINUTES: 5 April 12, 2011
Gilbert Alvarado, Community Development Director, gave the background on the traffic issues
related to the construction of the Walgreens store.
There was some discussion by the Council.
David Thompson, SE Grangier Development Group, representing Walgreens, was concerned
about the limited access to the site if this access is eliminated. He felt that a traffic analysis should
be done on the site in order to be able to understand what is happening at the intersection. The
reason for the traffic analysis is to determine if there is a specific time of day where the left turn is
more problematic than others and if there may be ways to mitigate the left turn to preclude people
from using it during the problem hours.
There was considerable discussion by the Council.
Action Taken: Mr. Reese moved that the curb be installed on Stratford to prevent left turns into
Walgreens, seconded by Mr. Pearce, and passed unanimously.
NON-AGENDA ITEMS AND PUBLIC QUESTIONS AND COMMENTS -None
COUNCIL QUESTIONS AND COMMENTS
RAILROAD
Mr. Ecret felt the Council should take a firm stand on the issue of the elimination of the railroad
running through town.
There was some discussion and it was the consensus of the Council that staff draft a resolution
declaring the city's decision to eliminate the railroad currently running through town.
CITY MANAGER REPORTS AND COMMENTS
CIVIC CENTER
Joseph K. Gavinski, City Manager, reported that a updated work schedule on the new civic center
shows a completion date of August 8, 2011, which is almost to the original completion date.
AMBULANCE SERVICE
After the study session conceming the ambulance rates, staff was requested to research whether
or not the city would have a net loss if the ambulances only responded to emergencies and left
non-emergency transports to a private service. The research shows that if the non-emergency
calls are eliminated, the net loss may be even greater.
WASHINGTON SURVEY AND RATING BUREAU
Gilbert Alvarado, Community Development Director, mentioned that the Washington Survey and
Rating Bureau audited the city and determined that the city has been awarded a rating of 2 for the
commercial area and is only one half point away from a rating of 2 in the residential area. He
pointed out that a rating of 1 is the highest and there are no cities in the state with a rating of 1 and
very few with a rating of 2.

MOSES LAKE IRRIGATION AND REHABILITATION DISTRICT" DREDGING PERMIT
Joseph K. Gavinski, City Manager, stated that the Moses Lake Irrigation and Rehabilitation District
has received its shoreline conditional use permit for the dredging of the lake.
RETREAT REPORT
Joseph K. Gavinski, City Manager, provided a report of the Council/Staff Retreat held in February
2011.
SIGNS
Joseph K. Gavinski, City Manager, stated that staff is working on regulations dealing with banner
and political signs.
WAYFINDING SIGNS
Joseph K. Gavinski, City Manager, stated that staff is ready to move forward on the wayfinding
welcome signs. It is proposed to place one sign at Larsen Playfield and one near the Conoco
Station at Kittelson Road which would be on property owned by the Department of Transportation.
The Department of Transportation has been contacted concerning the use of their property.
Action Taken: Mr. Ecret moved that staff be authorized to have the signs placed at Larsen Playfield
and nearthe Conoco Station at Kittelson Road, seconded by Dr. Curnel, and passed unanimously.
BUILDING ACTIVITY REPORT
The March 2011 Building Activity Report was presented.
GAMBLING REPORT
The city received $87,819.69 in gambling tax income for the first quarter of 2011.
INVESTMENT REPORT
The city received $20,449.50 in investment income for March 2011.
SALES TAXITRANSIENT RENTAL INCOME
The city received $324.247.20 in sales tax and $30,274.86 in transient rental income in March
2011.

Our agency would like to hold a car show fundraiser on June 26, 2011 at Cascade Valley Park. Community
and Family Services Foundation is a non-profit SOI(c) (3) organization dedicated to foster parents and
children. We license and support foster parents who care and nurture children and youth who have high
needs,. are at risk, developmentally disabled, medically fragile or pregnant and parenting teens. We have
been in the Moses Lake area for over 8 years and have successfully helped many of the children in the area.
The purpose of this fundraiser would be to raise funds to pay for things like clothes, camps, recreational
sports, aquatic center passes and Christmas gifts for the children. 100% of our proceeds go to the children
and families of our agency.
We would like to hold the car show from Ilam-4pm and anticipate about 50 cars. We would like the event
to be free to the public. We will have an announcer with a P A system, a food booth and would like a beer
garden if possible.

The Relay For Life of Moses Lake is requesting permission to close Third Avenue from
Division Street to Beech Street, a total of 2 blocks. We also would like to close SAsh
Street from the alley of the 200 block to the entrance to the parking lot in the middle
of the 300 block from 4 - 9 pm on Saturday, June 4, 2011. This creates a 2 block by 1
block section that surrounds the clock and the stage area. Emergency areas will be
coned off in the center of 3,d at the east end by Division St and at the west end by
Beech Street, per the requirement of the fire departrnent for emergency access. The
actual event will begin at 6 pm. )

on Saturday, June 4,2011. We would like to put on a Street Dance. We would like to
have a band named Copious Notes as the act in Sinkiuse Square. Copious Notes plays
soft rock, old rock, and country. This is a G-rated family show. Mark Gilbert from
Gilbert Nissan is part of the band.
The actual event will begin at 6 pm.

AN ORDINANCE ESTABLISHING CHARGES FOR GARBAGE
COLLECTION
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS
FOLLOWS:
Section 1. Beginning with billings after June 1, 2011, charges for categories of garbage
collection shall be in accordance with the fee schedule set out in Schedule A, which is
attached to this ordinance and by this reference incorporated within the ordinance.
Section 2. This ordinance shall take effect and be in force five (5) days after its passage
and publication of its summary as provided by law.

Subject: Parking Revision on Canterbury at Wheeler Road Intersection
Currently there is a proposal by the City of Moses Lake to restructure the lanes and parking along a one block
section of Canterbury Lane where it intersects with Wheeler Road. This directly affects the use and value of my property.
I understand why they would like to make the changes, however, this new change will no longer allow my tenants of
the duplex to park on the street I met with Gary Harer and Joe Gavinski before the first reading to discuss the impact of
these changes and the use of the property. The no street parking affects me because there is not (and since 1953 has
never been) a curb cutto allow for my tenants to park on my property. They have used the street parking orthe
neighbor's curb cut to access the property to park. Recently the neighbor stopped allowing me to use their curb cutto
access my property, so my tenants have had to resort to street parking. This was not an issue until the proposed "no
parking" on Canterbury in front of my property. Because this was a pre-existing lot without curb cuts for off street
parking there has been no need for me to have a curb cut.
However, if the proposed lane restructuring passes there will essentially be no street parking available for my
tenants. Obviously this causes my property value to be negatively impacted, and I can prove this if needed in your
decision making process. The second issue is that one of my rental units will have no parking access near their home. I
proposed to Mr. Harer and Mr. Gavinski that if the city was willing to put in a curb cut or expand the current curb cut of
the neighbor's that I would not oppose the traffic revision.
After the meeting I was told that I did not need to speak atthe first reading because it takes two readings to pass. I
attended the council meeting during the first reading and Joe mentioned to the council that there was only one neighbor
with an issue and that he thought we had a solution. The following week Mr. Harer called me to inform me that Mr.
Gavinski does not feel that the City of Moses Lake has any responsibility to put in the curb cut for me.
The reasons that I feel that this is a reasonable request is based on the fact that a majority of the increased traffic
atthis intersection is due to the approval of additional business and expansions of the businesses like the Hospital, the
Moses Lake Community Health Clinic, Grant Mental Healthcare.
Please don't misunderstand, I am very much in favor of good growth and with that comes changes. However, I do
not feel that such changes should negatively impact the surrounding individual property owners in a manner that would
cause them direct financial hardship and or negatively affecttheir property values.
When a developer or business wishes to make changes to expand, or a new business wishes to locate somewhere
the process includes getting the appropriate permits and if required pay some form of mitigation due to the impactthat
these changes may cause.
It is my request that the council consider the situation and make the motion to have the City of Moses Lake expand
or install a curb cut as mitigation for the proposed lane revisions and their negative impact to my property.

Section 1. Chapter 10.12 of the Moses Lake Municipal Code entitled "Parking Regulations" is amended as
follows:

(5') of a garbage collection cart or container, as defined in Moses Lake Municipal Code 8.08.030.

THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Chapter 13.08 of the Moses Lake Municipal Code entitled "Water and Sewer Connections" is
amended as follows:
13.08.101 Water Connection Charges-Kittelson Road Extended -Sparks Short Plat #2, Lot 2, and Sparks
Short Plat #3: Water main installation charges constructed with City funds as part of the Sparks
Short Plat #2, Lot #2 and Sparks Short Plat #3 Water Main Projects shall be reimbursed by the
property owner upon property platting, or upon request to connect to city water. The
reimbursement fee shall be $44,150 for the property described below:

The 2010 federal census data for the State of Washington, Grant County, and the City of
Moses Lake has been published and released. The census data shows the City with a
population in 2010 of 20,366.
Under RCW 41.26.11 0, a city must establish its own LEOFF I disability board to administer
the obligations under RCW 41.26 when a city reaches a population of 20,000. Previously
the City's LEOFF I active employees and retirees were subject to the jurisdiction of the
Grant County LEOFF I Disability Board.
Attached is a proposed resolution regarding the formation of a LEOFF I Disability Board
for the City of Moses Lake pursuant to RCW 41.26.110.
The resolution is presented to you for your consideration. The resolution formally states
that the City is establishing a LEOFF I Disability Board with an effective date of June 1,
2011.
The disability board is comprised of 5 individuals. Two members are City Council
members appointed by the Mayor. One member is an active or retired firefighter employed
by or retired from the City and elected by the firefighters employed by or retired from the
City who are subject to the jurisdiction of the Board. One member is an active or retired
law enforcement officer employed by or retired from the City and elected by the law
enforcement officers employed by or retired from the City who are subject to the jurisdiction
of the Board. The last member of the Board is from the public at large who resides within
the City and is appointed by the other four members.
At this time it would be appropriate for the Mayor to appoint two City Council members to
the Board. The City has sent out a notice to all active and retired firefighters and police
officers asking for anyone interested in serving to submit his or her name. The City will
then conduct an election for the firefighter and police officer representatives. Once the
elections are held, the Board should meet and appoint the fourth member.

Rules will be drafted that will be presented to the Board for consideration. Until additional
rules are adopted, the Board would operate under the statutory rules.
It is intended that the Board will be in operation and considering all requests for disability
leave, disability retirement, and medical claims after May 30, 2011, meaning that on June
1, 2011 the Moses Lake LEOFF I Disability Board will assume jurisdiction for those
considerations for all active and retired LEOFF I members who have an association with
the City of Moses Lake.

2. A major portion of the aforementioned rail line runs through the corporate limits of the City of
Moses Lake.
3. The rail line running through the corporate limits of the City of Moses Lake crosses several
streets and thoroughfares.
4. The rail line running through the City of Moses Lake is in need of significant repair in order to
make it fully operational and capable of carrying modern day railroad traffic.
RESOLVED:
1. The City of Moses Lake is in favor and supports the abandonment and elimination of the rail
line running from MP 10.913 to MP 16.045.
2. Abandoning and eliminating the aforementioned rail line will allow for a safer environment within
the City of Moses Lake by eliminating the railroad crossings at several streets and
thoroughfares and eliminating possible dangerous cargo being transported through the City of
Moses Lake by rail car.
3. Abandoning and eliminating the rail line running through the City of Moses lake would allow for
the possible conversion of the railroad right-of-way to a publicly owned activity trail.

RCW 9A.44.193 authorizes the City to prohibit Level 2 and 3 sex offenders from entering
the City's swimming facilities such as the Surf 'n Slide Water Park. The City of Yakima
recently adopted a policy by resolution prohibiting Level 2 and 3 sex offenders from
entering Yakima's swimming facilities. The attached resolution is drawn from the resolution
considered and passed in the City of Yakima. Councilman Bill Ecret that this resolution be
presented to the City Council for consideration.
Before the prohibition against entering a City swimming facility of a Level 2 or 3 sex
offender becomes effective, personal notice must be provided to the offender. It appears
that there may be approximately 20 Level 2 or 3 sex offenders living in and around the City
of Moses Lake that would have committed offenses which allow the City to prohibit them
from entering the City's swimming facilities. There is an approximate $30 to $50 charge
for serving the appropriate notice unless the notices are served by City personnel.
The statutory authority for the resolution is proviedd for your reference. The resolution is
presented for Council consideration.

POOL (SURF 'N SLIDE WATER PARK) PURSUANT TO THIS POLICY
RECITALS:
1. In 2006 the State Legislature passed RCW 9A.44.190, RCW 9A.44.193, and RCW 9A.44.196
which authorized an owner, operator, or manager of a public facility whose primary purpose,
at any time, is to provide for the education, care, or recreation of a child or children, including
swimming pools, to order Level 2 and/or Level 3 sex offenders, "covered offenders", who meet
certain criteria pursuant to RCW 9A.44.190 from the legal premises of the covered facility.
2. The City of Moses Lake's public swimming pool (Surf 'n Slide Water Park) provides for the
education, care, and recreation of children.
3. It is in the best interest of the public health and safety of the citizens of the City of Moses Lake,
specifically the children, to order and exclude Level 2 and/or Level 3 sex offenders who meet
the criteria of RCW 9A.44.190(5) and RCW 9A.44.193 from the premises of the City of Moses
Lake's swimming pool (Surf 'n Slide Water Park).
RESOLVED:
1. The City of Moses Lake's Police Chief and the City of Moses Lake's Parks and Recreation
Director are directed to issue written notices pursuant to RCW 9A.44.193, to all "covered
offenders" as defined in RCW 9A.44.190(5), whose risk level classification has been assessed
at a Level 2 or Level 3 sex offender pursuant to state law, that orders the "covered offenders"
from the legal premises of the City of Moses Lake's public swimming pool (Surf 'n Slide Water
Park). The written notices pursuant to RCW 9A.44.193 are to be issued to all "covered
offenders" as defined in RCW 9A.44.190 who reside within the City of Moses Lake,
Washington's city limits or who reside in surrounding areas within ten (10) miles of the City of
Moses Lake's city limits.
2. The City of Moses Lake's Police Chief and the City of Moses Lake's Parks and Recreation
Director are further authorized to issue said written notices pursuant to RCW 9A.44.193 to
"covered offenders" who reside in other areas as the circumstances warrant.

Criminal trespass against children -Definitions .
As used in this section and RCW 9A.44.193 and 9A.44.196:
(1) "Covered entity" means any public facility or private facility whose primary purpose, at
any time, is to provide for the education, care, or recreation of a child or children, including
but not limited to community and recreational centers, playgrounds, schools, swimming
pools, and state or municipal parks.
(2) "Child" means a person under the age of eighteen, unless the context clearly indicates
that the term is otherwise defined in statute.
(3) "Public facility" means a facility operated by a unit of local or state government, or by a
nonprofit organization.
(4) "Schools" means public and private schools, but does not include home-based
instruction as defined in RCW28A.225.010 .
(5) "Covered offender" means a person required to register under RCW 9A.44.130 who is
eighteen years of age or older, who is not under the jurisdiction of the juvenile rehabilitation
authority or currently serving a special sex offender disposition alternative, whose risk level
classification has been assessed at a risk level II or a risk level III pursuant to RCW
72.09.345, and who, at any time, has been convicted of one or more of the following
offenses:
(a) Rape of a child in the first, second, and third degree; child molestation in the first,
second, and third degree; indecent liberties against a child under age fifteen; sexual
misconduct with a minor in the first and second degree; incest in the first and second degree;
luring with sexual motivation; possession of depictions of minors engaged in sexually explicit
conduct; dealing in depictions of minors engaged in sexually explicit conduct; bringing into
the state depictions of minors engaged in sexually explicit conduct; sexual exploitation of a
minor; communicating with a minor for immoral purposes; *patronizing a juvenile prostitute;
(b) Any felony in effect at any time prior to March 20, 2006, that is comparable to an
offense listed in (a) of this subsection, including, but not limited to, statutory rape in the first
and second degrees [degree] and carnal knowledge;
(c) Any felony offense for which:
(i) There was a finding that the offense was committed with sexual motivation; and
(ii) The victim of the offense was less than sixteen years of age at the time of the offense;
(d) An attempt, conspiracy, or solicitation to commit any of the offenses listed in (a)
through (c) of this subsection;
(e) Any conviction from any other jurisdiction which is comparable to any of the offenses
listed in (a) through (d) of this subsection.

(1) An owner, manager, or operator of a covered entity may order a covered offender from
the legal premises of a covered entity as provided under this section. To do this, the owner,
manager, or operator of a covered entity must first provide the covered offender, or cause the
covered offender to be provided, personal service of a written notice that informs the covered
offender that:
(a) The covered offender must leave the legal premises of the covered entity and may not
return without the written permission of the covered entity; and
(b) If the covered offender refuses to leave the legal premises of the covered entity, or
thereafter returns and enters within the legal premises of the covered entity without written
permission, the offender may be charged and prosecuted for a felony offense as provided in
RCW 9A.44.196.
(2) A covered entity may give written permission of entry and use to a covered offender to
enter and remain on the lega[ premises of the covered entity at particular times and for [awful
purposes, including, but not limited to, conducting business, voting, or participating in
educational or recreational activities. Any written permission of entry and use of the legal
premises of a covered entity must be clearly stated in a written document and must be
personally served on the covered offender. [f the covered offender violates the conditions of
entry and use contained in a written document personally served on the offender by the
covered entity, the covered offender may be charged and prosecuted for a felony offense as
provided in RCW9A.44.196.
(3) An owner, employee, or agent of a covered entity shall be immune from civil liability for
damages arising from excluding or failing to exclude a covered offender from a covered entity
or from imposing or failing to impose conditions of entry and use on a covered offender.
(4) A person provided with written notice from a covered entity under this section may file
a petition with the district court al[eging that he or she does not meet the definition of
"covered offender" in RCW 9A.44.190. The district court must conduct a hearing on the
petition within thirty days of the petition being filed. In the hearing on the petition, the person
has the burden of proving that he or she is not a covered offender. If the court finds, by a
preponderance of the evidence, that the person is not a covered offender, the court shall
order the covered entity to rescind the written notice and shall order the covered entity to pay
the person's costs and reasonable attorneys' fees.

Criminal trespass against children.
(1) A person is guilty of the crime of criminal trespass against children if he or she:
(a) Is a covered offender as defined in RCW 9A.44.190; and
(b) (i) Is personally served with written notice complying with the requirements of RCW
9A.44.193 that excludes the covered offender from the legal premises of the covered entity
and remains upon or reenters the legal premises of the covered entity; or
(ii) Is personally served with written notice complying with the requirements of RCW
9A.44.193 that imposes conditions of entry and use on the covered offender and violates the
conditions of entry and use.
(2) Criminal trespass against children is a class C felony.

This letter is for intent to connect with the city's water and sewer systems at our planned
development of parcel # 171016010. The presumed address is to be 8037 Randolph Rd NE, Moses Lake,

The development shall consist of a thirty thousand square foot, light industrial warehouse. It is the
intention of Blackstone\OTR to proceed immediately with this project, upon local governmental approvals.

I have been working with Chief Clendenin from GCFD5 on an automatic response agreement for
some time and would like you to review the attached draft.
There are certain areas that we both agree would be beneficial to have an automatic response
from each other due to the proximity to our stations. We are only talking about two areas.
We would ask them to be automatically dispatched to the area of 1-90 and SR 17 near the truck
stop on Kittelson Road, Lakeland Estates behind their main station and Chief Moses Middle
School. They would like us automatically dispatched to Mae Valley between Westshore Drive
and Road F NE North to Mae Valley Road.
This is something I've been trying to get put together for almost 8 years to no avail.

AUTOMAID RESPONSE AGREEMENT
This agreement entered into the ___ day of _______ ~, 2011 between the City of Moses
Lake, a municipal corporation, and Grant County Fire District No.5 is for the purpose of providing for
automatic emergency response within each jurisdiction as outlined herein and without otherwise
affecting the Interagency Mutual Aid Agreement of Grant County of which both agencies are party to.
IT IS AGREED THAT:
1. The City of Moses Lake Fire Department will, upon notification by the Multi-Agency
Communications Center (MACe), respond to emergencies within a designated geographical area
under the jurisdiction of Grant County Fire District No.5, provided resources are available. If
resources are not available at the time of the notification, the Moses Lake Fire Department
officer in charge shall notify MACC of the inability to respond.
2. Grant County Fire District No.5 will, upon notification by the Multi-Agency Communications
Center (MACe), respond to emergencies within a designated geographical area under the
jurisdiction of the City of Moses Lake, provided resources are available. If resources are not
available at the time of notification, the Grant County Fire District No.5 officer in charge shall
notify MACC ofthe inability to respond.
3. The City of Moses Lake Fire Department and Grant County Fire District No.5 will respond to all
water rescue, ice rescue and technical rescue emergencies jointly within each other's
jurisdiction.
4. The City of Moses Lake Fire Department will respond automatically to structure fires, rescues,
entrapment and wildland fires in the following area:
Mae Valley area West to Road F NE, East to Westshore Drive, North to Mae Valley Road NE and
South to the Northern portion of North Frontage Road.
5. Grant County Fire District No.5 will respond automatically to structure fires, rescues,
entrapment and wildland fires in the following area:
SR 17 South of Wheeler Road NE to one (1) mile South of Interstate 90, South of Nelson Road
encompassing the entire area one (1) mile South of Interstate 90, West to Road K NE and Clover
Drive and East to Road L NE. North of Nelson Road to Wheeler Road NE, West to SR 17 and East
to Hamilton Road NE. West of SR 17, North to Nelson Road and East of Pioneer Way.
6. Any dispatch of equipment and personnel pursuant to this agreement is subject to the following
conditions:
a. The responding agency shall report to the officer in charge of the jurisdiction having
authority (AHJ) and shall be subject to the orders of that official.
b. A responding agency shall be released by the AHJ when the services are no longer required
or when the responding agency is needed for response within the area for which it normally
responds.
7. Each party waives all claims against the other party for compensation for any loss, damage,
personal injury or death occurring as a consequence of the performance of this agreement.
8. No party shall be reimbursed by the other party for any costs incurred pursuant to this
agreement.
9. All equipment used by either agency in carrying out this agreement will, at the time of action
hereunder, be owned by it; and all personnel acting on behalf of either agency under this
agreement will, at the time of such action, be an employee or volunteer for the agency.
10. This agreement may be modified or terminated by mutual agreement of both parties, or by one
party giving the other party thirty (30) days written notice of modification or termination.
11. This agreement is in addition to the current Interagency Mutual Aid Agreement of Grant County.

After speaking with Kevin Myre, We have completed a re-analysis of the building codes adopted by your
community and the efforts put forth to properly enforce those codes. It is our pleasure to inform you that
your Building Code Effectiveness Grading Classification has improved from Class;! to Class .£ for one and
two family residential property and from Class;! to Class .£ for commercial and industrial property.
The revised classification applies to new buildings receiving a Certificate of Occupancy or final inspection
during or after the calendar year in which the revision takes place.
Attached is a copy of our updated report, which will provide you with additional information about the
classification process and how we have graded various aspects of your community's building codes and their
enforcement. We want to highlight the fact that our focus is on property insurance rating and underwriting
information and does not consider life safety issues.
]fyou have any questions about the re-classification that was developed, please let us know. Additionally, if
you are planning on any future changes in your codes or their enforcement, please advise us as they may
positively impact your classification.
The foregoing comments relate exclusively to the relative effect of various conditions upon property
insurance rates as detennined under our tariffs and schedules which have been filed with and approved by the
Insurance Commissioner. They are not to be construed as bearing in any way upon the question as to
whether "due care" has been exercised with respect to possible liability for personal injury or damage to
property. It is recognized that correctable hazards which could cause or contribute to loss may still exist and
need not be identified or commented upon.

SUBJECT: Tree Replacement Project -2010
There were 28 trees and tree planters replaced during this project. The trees and tree wells were
installed between the years of 1989 and 1991. The project included removing and replacing the
following items:
I. Surrounding pavers.
2. Curb and gutter fronting the tree.
3. Tree, tree well, grate and frame.
4. Irrigation line and electrical conduit.
S. Asphalt fronting the curb.
The total amount for the construction cost for this project was $122,823. The cost per tree was
$4,386.
The reasons for the high cost was that most of the work was done by hand, and the requirement
of paying prevailing wages.
The final estimate is attached.

Recycle Program
Single stream recyclable material that we sell has gone from an initial $55 per ton to $65 per ton.
We are now netting $40 per ton. That along with increased recycling has allowed us to refund
from $.37 to $.74 per month on the utility bill. This year we have refunded over $11,000.
We have also seen an increase in requests for second 64 gallon recycle carts or 96 gallon recycle
carts in place of the 64s.
Comparing the first quarter of 20 1 0 to 2011, we have seen the residential garbage collection go
from 1,600 to 1,091 tons. This is a 32% decrease in the amount of garbage taken to the land fill.
During the first quarter we have recycled over 13 tons of glass.
