CONSTITUTION WEEK
Septem her 17 -23
WHEREAS: September 17,2011, marks the two hundred twenty-fourth anniversary of the
drafting ofthe Constitution of the United States of America by the Constitutional
Convention; and
WHEREAS: It is fitting and proper to accord official recognition to this magnificent
document and its memorable anniversary; and to the patriotic celebrations which will
commemorate the occasion; and
WHEREAS: Public Law 915 guarantees the issuing of a proclamation each year by the
President of the United States of America designating September 17th through the 23 rd as
Constitution Week,
NOW, THEREFORE I, Jon Lane by virtue of the authority vested in me as MAYOR of
the City of Moses Lake do hereby proclaim the week of September 17'h through 23rd as
CONSTITUTION WEEK
AND ask our citizens to reaffinn the ideals of the Framers of the constitution had in 1787
by vigilantly protecting the freedoms guaranteed to us through this guardian of our liberties,
remembering that lost rights may never be regained.

The meeting was called to order at 7 p.m. by Mayor Lane.
PLEDGE OF ALLEGIANCE: Cub Scout Pack 98 led the Council in the pledge of allegiance.
PRESENTATIONS AND AWARDS -None
CONSENT AGENDA
Minutes: The minutes of the August 23, 2011 meeting were presented for approval.
Approval of Claims, Prepaid Claims, Checks, and Payroll: Vouchers audited and certified by the
Finance Director as required by RCW 42.24.080, and those expense reimbursement claims,
certified as required by RCW 42.24.090, have been recorded on a listing which has been made
available to the Council for approval and is retained for public inspection at city hall. As of
September 13, 2011 the Council does approve for payment claims in the amount of$3,513, 139.35;
prepaid claims in the amounts of $92,272.86 AND $62,194.76; claim checks in the amount of
$997,884.31; and payroll in the amounts of $4,714.52 and $368,467.77.
Accept Work -Stormwater Decant Facility Project -2011: Central Washington Excavation has
completed work on the Stormwater Decant Facility Project. The work should be accepted and the
45 day lien period entered into.
Accept Work -Alley Reconstruction Project 2011: Advanced Excavation has completed work on
the 2011 Alley Reconstruction Project. The work should be accepted and the 45 day lien period
entered into.
Resolution -Accept Easement -SGL Automotive Carbon Fibers, LLC: A resolution was presented
which accepts an easement from SGL Automotive Carbon Fibers, LLC which grants the City the
right to access water meters and fire hydrants on a portion of the SGL Carbon Fiber Short Plat
located on Randolph Road
Resolution -Accept Grant -Police Department: A resolution was presented which accepts ajustice
assistance grant in the amount of $11,400. The funds will be used by the Police Department to
purchase two video surveillance cameras as well as accessories to transmit and record.
Industrial Waste Discharge Permit -Americold Corporation: Authorization was requested for the
City Manager to sign an industrial waste discharge permit for Amiercold Corporation.
Nuisance Abatement: The Council should set September 27 as the date to consider a resolution
to abate nuisances at 210 Vine, 1151 Grand, and 502 Kentucky.
Action Taken: Mr. Reese moved that the Consent Agenda be approved, seconded by Dr. Curnel,
and passed unanimously.

COMMISSION APPOINTMENTS -None
CONSIDERATION OF BIDS AND QUOTES
LANDSCAPING PROJECT 2011
The City received two bids for the 2011 Landscaping Project. This project consists of installing
landscaping along Road 4 at the Operations Facility.
Action Taken: Mr. Pearce moved that the bid be awarded to Tatum's Lawn Care in the amount of
$21,818, seconded by Mr. Ecret, and passed unanimously.
CIVIC CENTER PARKING LOT AND LANDSCAPING PROJECT 2011
The City received four bids for the 2011 Civic Center Parking Lot and Landscaping Project. This
project consists of constructing of two parking lots at the intersection of Balsam Street and Fourth
Avenue, constructing a roundabout at the intersection, installing paver sidewalks, and installing
landscaping and irrigation systems for the Civic Center area.
Action Taken: Mrs. Liebrecht moved that the bid be awarded to Oceanside Construction in the
amount of $864,300, seconded by Mr. Deane, and passed unanimously.
PETITIONS, COMMUNICATIONS, OR PUBLIC HEARINGS
ORDINANCE -ALLEY VACATION -ALANIS -1ST READING AND PUBLIC HEARING
An ordinance was presented which provides for the vacation of a portion of the alley adjacent to
the westerly lot line of Lot 27, Broadripple Addition No.1. The lot is owned by Miguel Alanis and
is located on Ashley Way.
The ordinance vacating a portion of an alley was read by title only.
Gilbert Alvarado, Community Development Director, stated that Mr. Alanis has provided
construction plans for a home on this lot. The construction plans have been approved. He pointed
out that the alley on the rear of the property has not been constructed. Vacating 3' of this 20'
unimproved alley will allow Mr. Alanis to adjust the location of his home and will provide the City
better access to existing facilities in an already vacated alley and easement on the north side of
the property. He mentioned that CenturyLink has requested an easement be maintained over the
3' of vacated alley as they have ariel service in this area. No structures or fences will be
constructed over the vacated alley as the 3' is only needed for setback purposes.
The public hearing was opened.
Action Taken: Mr. Pearce moved the public hearing be closed, seconded by Mr. Ecret, and passed
unanimously.
Action Taken: Mr. Reese moved that the first reading of the ordinance be adopted, seconded by
Mrs. Liebrecht, and passed unanimously.
CITY COUNCIL MINUTES: 3 September 13, 2011
COMMUNICATION -JON SMITH
Jon Smith requested time before the Council to speak on a number of issues including left turns
from Stratford into Walgreens, the Dutch Brothers proposed windmill near the intersection of
Broadway and Alder, trees in the downtown area, etc.
ORDINANCES AND RESOLUTIONS
ORDINANCE -AMEND 16.36 -FIRE CODE -2ND READING
An ordinance was presented which rectifies a conflict concerning connections on fire hydrants.
One section requires connections to be fitted with metal, screw-in type caps and another section
requires connections to be fitted with Knox locking caps. The Knox locking caps are the preferred
requirement so the metal screw-in connection has been eliminated.
The ordinance amending Chapter 16.36 of the Moses Lake Municipal Code entitled "Fire Code"
was read by title only.
Action Taken: Mr. Pearce moved that the second reading of the ordinance be adopted, seconded
by Dr. Curnel, and passed unanimously.
ORDINANCE -AMEND 16.48 -FIRE HYDRANTS -2ND READING
An ordinance was presented which clarifies the ownership of fire hydrants for identification
purposes as well as for annual testing and maintenance requirements.
The ordinance amending Chapter 16.48 of the Moses Lake Municipal Code entitled "Fire Hydrants"
was read by title only.
Action Taken: Dr. Curnel moved that the second reading of the ordinance be adopted, seconded
by Mr. Reese, and passed unanimously.
ORDINANCE -MORATORIUM ON MEDICAL MARIJUANA GARDENS -1ST READING
An ordinance was presented which establishes a moratorium on the establishment of "collective
gardens" for the medical use of marijuana. The moratorium is for the purpose of giving the City
time to establish performance standards for such gardens as allowed by the recent passage of a
bill by the state legislature allowing for collective gardens for the medical use of marijuana.
The interim ordinance of the City of Moses Lake adopting a moratorium on the establishment of
medical marijuana collective gardens, defining "medical marijuana collective gardens"; providing
for a public hearing; establishing an effective date, and providing that the moratorium, unless
extended, will sunset within six (6) months of the date of adoption was read by title only.
Gilbert Alvarado, Community Development Director, provided background on the laws pertaining
to the use of medical marijuana.
Katherine Kenison, City Attorney, pointed out that one of the problems is the fact that while the
state has legalized the use of medical marijuana, it is still illegal under the controlled substances
act at the federal level. She mentioned that the bill raises many questions about the regulation of
these collective gardens and it puts the local jurisdictions in a difficult position.

Action Taken: Mr. Ecret moved that the first reading of the ordinance be adopted, seconded by Mr.
Deane, and passed unanimously.
RESOLUTION -ACCEPT GRANT -CROSSWALK ON STRATFORD
A resolution was presented which accepts a $150,000 grantfrom the Department ofTransportation
for the installation of a pedestrian crossing on Stratford Road near Knolls Vista Drive.
The resolution accepting a grant to the City of Moses Lake from the Washington State Department
of Transportation was read by title only.
Gary Harer, Municipal Services Director, explained that the project will consist of a pedestrian
crossing on Stratford Road and safety improvements to the intersection of Stratford Road and
Knolls Vista Drive.
There was some discussion by the Council.
Action Taken: Dr. Curnel moved that the resolution be adopted, seconded by Mr. Deane, and
passed unanimously.
RESOLUTION -NUISANCE ABATEMENT -818 SAGE BAY DRIVE
A resolution was presented which provides for the abatement of nuisances at 818 Sage Bay Drive.
The property is owned by EMC Mortgage Corp for FIS Tax.
The resolution determining that EMC Mortgage Corp for FIS TAX is the owner of certain real
property within the City; that a nuisance requiring abatement by City forces or forces contracted
by the City exists on such property; and directing the use of such forces to abate the nuisance
found was read by title only.
Clair Harden, Code Enforcement Officer, was sworn in and provided testimony concerning this
issue. He mentioned that there has been no response from the property owners to any of the
notices provided by the city and none of the nuisances have been corrected.
Action Taken: Mrs. Liebrecht moved that the resolution be adopted, seconded by Mr. Pearce, and
passed unanimously.
RESOLUTION -NUISANCE ABATEMENT -1230 W. BROADWAY
A resolution was presented which provides for the abatement of nuisances at 1230 W. Broadway.
The property is owned by Joli Pesek.
The resolution determining that Joli Pesek is the owner of certain real property within the City; that
a nuisance requiring abatement by City forces or forces contracted by the City exists on such
property; and directing the use of such forces to abate the nuisance found was read by title only.
Gilbert Alvarado, Community Development Director, mentioned that the owner of this property is
a repeat offender and has been through the process before.
Clair Harden, Code Enforcement Officer, was sworn in and provided testimony concerning this
issue.

Action Taken: Mr. Reese moved that the resolution be adopted, seconded by Mr. Ecret, and
passed unanimously.

OTHER ITEMS FOR COUNCIL CONSIDERATION
GROUP B WATER SYSTEM -MORGAN TRACTS
A Group B water system was requested to serve the Morgan Tracts Unit 1, Short Plat, Replat of
a portion of Lot 8 instead of connecting to the City's water system. The eXisting exempt well on the
original Lot 8, Morgan Tracts Unit 1 Short Plat would serve the three proposed lots. The property
is within the City's UGA and water service area. The nearest city water main is approximately
3,500 feet to the north.
Gary Harer, Municipal Services Director, stated that additional information has been obtained and
the on-site well is considered an allowed well.
Action Taken: Mrs. Liebrecht moved that the request be granted, seconded by Mr. Reese, and
passed unanimously.
NON-AGENDA ITEMS AND PUBLIC QUESTIONS AND COMMENTS -None
COUNCIL QUESTIONS AND COMMENTS
EDC FUNDING -AEROSPACE ASSESSMENT
Jon Lane, Mayor, stated that the Washington Aerospace Partnership has requested help in funding
an aerospace assessment by a national consulting firm and to mount a lobbying/PR campaign for
promotion purposes necessary to maintain and increase aerospace activities within Washington
State, including convincing Boeing to locate their next endeavor in the state. The cost of the
assessment is $600,000. The Grant County EDC and the Grant County Commissioners have each
contributed $5,000 and the Port of Moses Lake has committed $1 0,000. The request is forthe City
to also contribute $5,000 towards this study.
Action Taken: Mr. Pearce moved that $5,000 be provided to the Grant County EDC forthis project,
seconded by Dr. Curne!.
There was considerable discussion by the Council and Mr. Ecret and Mrs. Liebrecht felt that
additional information is needed before a decision is made.
The motion passed with Mr. Ecret and Mrs. Liebrecht opposed.
CITY MANAGER REPORTS AND COMMENTS
AIR FORCE -TAKE OFF AND APPROACH CHANGES -DRAFT EIS
Joseph K. Gavinski, City Manager, provided The Notice of Availability of the Draft Environmental
Assessment for the proposed changes in the C-17 flight training operations at the Grant County
CITY COUNCIL MINUTES: 6 September 13, 2011
International Airport. He mentioned that this is an assessrnent of the change in the C-17 flight
training operations which potentially could include aircraft coming in faster and at lower altitudes
which could increase the noise level.
Mr. Pearce stated that there are rules that prohibit airplanes from exceeding 250 knots below
10,000 feet but the armed services need to practice sharp high speed turns for use in landing
planes near hostile territory in times of war. He explained that in order to break the federal aviation
rules by going over 250 knots, the Air force is required to go through this process.
The Council had no objections to the proposed changes in the flight training operations.
PROPERTY TAX RATES
Joseph K. Gavinski, City Manager, provided a comparison of the tax levy for 2010 and 2011. It
shows that the tax rates are slightly less in the City than in the county.
INVESTMENT REPORT
The City received $23,366.32 in investment income for August 2011.
SALES TAX/TRANSIENT RENTAL INCOME
The City received $453,961.67 in sales tax and $57,975.95 in transient rental income in August
2011.
The regular meeting was recessed at 8:40 p.m. and the Council met in a 20 minute executive
session with the City Attorney to discuss litigation. The executive session was adjourned at 9 p.m.

The Code Enforcement Officer has been working with the property owners of 210 Vine,
1151 Grand, and 502 Kentucky on the abatement of nuisances on their property without
success. The Council originally set September 27 as the date for the hearing but,
unfortunately, the 10 day notice to the property owners was missed. The Council should
set October 11 as the date to consider resolutions to abate the nuisances and to hear any
objections thereto.

A RESOLUTION ACCEPTING STREET AND UTILITY IMPROVEMENTS FOR
MUNICIPAL USE AS PART OF THE PIONEER COMMERCIAL PARK 4TH ADDITION
MAJOR PLAT
Recitals:
I. Street and Utility improvements, lying in dedicated right-of-way or easements, are in place and
constructed to the City of Moses Lake's street and utility systems as part of the Pioneer
Commercial Park 4TH Addition Major Plat.
2. Said street and utility improvements have been installed in accordance with the City of Moses
Lake's Community Standards, such installation being completed in August, 2011.
3. RCW 35.91.030 indicated that public street and utility facilities, which are developer installed
should be accepted by the City of Moses Lake upon completion if the facilities are built to city
standards.
Resolved:
1. The City Council of Moses Lake accepts the street and utility improvements as facilities of the
City of Moses Lake and as such will charge for use of such facilities as authorized by
ordinance, contingent upon and the owners providing a maintenance bond for the street and
utility improvements effective for two years from the date of acceptance of the improvements by
Council.
2. After September 27th, 2013, all further maintenance and operation cost of said street and utility
improvements, shall be borne by the City of Moses Lake, as provided by city ordinance.

AN ORDINANCE VACATING A PORTION OF AN ALLEY
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. The following described public right-of-way shall be vacated:
That portion of the alley coincident to Lot 27, Broad Ripple Addition No.1, in the Southwest 1/4,
Section 23, Township 19 North, Range 28 East W.M., City of Moses Lake, Grant County,
Washington, described as follows, and shown in Exhibit A:
A 3.00 foot wide strip of land coincident to the westerly lot line of Lot 27, Broad Ripple Addition,
Number 1, recorded in Grant County major plat records, volume 6, page 24, AND the alley
vacated by City of Moses Lake, WA, through ordinance number 849. More accurately described
as follows:
Beginning at the most westerly corner of said Lot 27; thence along the westerly line of said vacated
alley, N28'00'00"W 22.66 feet, to the northerly line of said vacated alley; thence along the northerly
line of a 20.00 foot alley dedicated on said Broad Ripple Addition, N89'56'1 O"W 3.40 feet; thence
S28'00'00"E 82.66 feet to the extended south line of Lot 27 as described in the Quit Claim Deed
filed under Auditors File Number 523740 of Grant County records; thence along said extended
south line, S89'56'10"E 3.40 feet to the southwesterly corner of Lot 27, as it now exists; thence

Attached is an ordinance that puts into place a moratorium on the establishment of
"collective gardens" for the medical use of marijuana. The ordinance is presented as a
result of the passage of E2SSB 5073 by the Washington State Legislature on April 22nd
and approved by Governor Gregoire on April 29th
A public hearing has been scheduled. The Council should hold a public hearing and take
testimony on the proposed moratorium on the establishment of "collective gardens" for the
medical use of marijuana.
The ordinance is presented for Council consideration. This is the second reading of the
ordinance.

ORDINANCE NO. 2630
AN INTERIM ORDINANCE OF THE CITY OF MOSES LAKE ADOPTING A
MORATORIUM ON THE ESTABLISHMENT OF MEDICAL MARIJUANA COLLECTIVE
GARDENS, DEFINING "MEDICAL MARIJUANA COLLECTIVE GARDENS";
PROVIDING FORA PUBLIC HEARING; ESTABLISHING AN EFFECTIVE DATE,AND
PROVIDING THAT THE MORATORIUM, UNLESS EXTENDED, WILL SUNSET
WITHIN SIX (6) MONTHS OF THE DATE OF ADOPTION
1. The possession or distribution of marijuana has been and continues to be a violation of state law
pursuant to Chapter 69.50 RCW (Washington's Uniform Controlled Substances Act), and federal law,
through the Controlled Substances Act (VUCSA"): and
2. In 1998, the voters of Washington State approved Initiative 692, now codified as Chapter69.51A RCW,
which created a limited defense to marijuana charges under state, not federal, law if the person charged
could demonstrate that he or she was a qualifying patient or designated provider as those terms are
defined in Ch. 69.51A RCW; and
3. In 2011, the state legislature passed Engrossed Second Substitute Senate Bill (E2SSB) 5073 making
significant amendments to the medical marijuana law in Washington; and
4. The Governor signed the E2SSB 5073, but vetoed several portions expressing her reservations about
provisions that involved state employees in activities that could be interpreted as in violation of federal
laws; and
5. E2SSB 5073 became effective on July 22,2011; and
6. E2SSB 5073 authorizes "collective gardens" where up to ten (10) qualifying patients may join together
to produce, grow and deliver up to 45 marijuana or cannabis plants for medical use; and
7. Under E2SSB 5073 there is no limit to the number of medical marijuana collective gardens that may be
located at any site nor restrictions as to where collective gardens may be located in relation to other
uses; and
8. Medical marijuana collective gardens are not currently addressed in the Moses Lake Zoning Code and
under Section 1102 of E2SSB 5073 cities may adopt zoning requirements for collective gardens; and
9. Unless a zoning moratorium is imposed, medical marijuana collective gardens may be located within the
City of Moses Lake while the City lacks the necessary tools to ensure the location is appropriate and that
the potential secondary impacts of collective gardens are minimized and mitigated; and
10. The City Council deems it to be in the public interest to establish a zoning moratorium pending
consideration of land use regulations to address medical marijuana collective gardens; and
11. Under RCW 35A.673.220 and RCW 36.70A.390 a public hearing must be held within sixty (60) days of
the passage of this ordinance.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section1. The recitals set forth above are hereby adopted as the Moses Lake City Council's preliminary
findings in support of the moratorium imposed by this ordinance. The Moses Lake City Council may, in its
discretion, adopt additional findings at the conclusion of the public hearing held prior to considering the
adoption of the ordinance.
Section 2. Pursuant to the provisions of RCW 35A.63.220, a zoning moratorium is hereby enacted in the City
of Moses Lake prohibiting the licensing, establishment, maintenance or continuation of any medical marijuana
collective garden. A "medical marijuana collective garden" is an area or garden where qualifying patients
engage in the production, processing, transporting, and delivery of marijuana for medical use as set forth in
the E2SSB 5073 and subject to the limitations therein.
Section 3. Medical marijuana collective gardens as defined in Section 2 are hereby designated as prohibited
uses in the City of Moses Lake. In accordance with the provisions of RCW 35A.82.020 and Moses Lake
Municipal Code 5.04, no business license shall be issued to any person for a collective garden, which are
hereby defined to be prohibited uses under the ordinances of the City of Moses Lake.
Section 4. The moratorium set forth in this ordinance shall be in effect for a period of six (6) months from the
date this ordinance is passed and shall automatically expire on that date unless extended as provided in RCW
35A.63.220 or unless terminated sooner by the Moses Lake City Council.
Section 5. The Community Development Director is hereby authorized and directed to develop draft
regulations regarding collective gardens. The regulations shall be referred to the Moses Lake Planning
Commission for review and recommendation for inclusion in the Moses Lake Zoning Code.
Section 6. If any provision of this ordinance or its application to any person or circumstance is held invalid,
the remainder of the ordinance, or the application of the provision to other persons or circumstances is not
affected.
Section 7. This ordinance shall take effect and be in force five (5) days after its passage and publication of
its summary as provided by law.

SUBJECT Repeal of MLMC 6.06 "Hazardous Dogs"
Amendment of MLMC 6.05 "Animal Control"
Attached are two ordinances related to animal control and dogs. The first ordinance
repeals MLMC 6.06 titled "Hazardous Dogs" in its entirety. The second proposes
substantial amendments to MLMC 6.05 titled "Animal Control" as follows:
1. Eliminates the vicious animal definition and provision
2. Amends the definition of "potentially dangerous dogs" to include both vicious dogs
and Pit Bulls, Rottweilers and Presa Canarios.
3. Adds new sections related to the determination, regulation, registration, and
exemption of "potentially dangerous dogs", including provisions for notice of
determination, initial meeting with owner, basis of determination, and appeal of
determination.
4. Amends the enforcement provisions to move certain violations out of the
administrative enforcemenUnotice of violation (NOV) process and back to the notice
of infraction (NOI) process.
5. Various minor housekeeping amendments.

AN ORDINANCE AMENDING CHAPTER 6.05 OF THE MOSES LAKE MUNICIPAL
CODE ENTITLED "ANIMAL CONTROL"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Chapter 6.05 of the Moses Lake Municipal Code entitled "Animal Control" is amended as follows:
6.05.020 Definitions: When used in this chapter, the following words shall have the following meanings:
A. "Abandonment" means leaving of an animal by its owner or owners or other person or persons
responsible for its care or custody without making effective provisions for its proper care.
B. "Animal" means any animal other than humans.
C. "Animal Shelter" means the facility designed by the city for the boarding and caring of any
animal impounded under the provisions of this chapter or any other ordinance or law of the
State of Washington.
D. "Cats" means any animal of the species Felidae, regardless of sex.
E. "Common Areas of a Condominium, Town House, or Apartment Buildings" means and
includes but is not limited to the yards, grounds, patios, garden areas, play areas, clubhouses,
swimming pools, sidewalks, walkways, common garage areas, entryways, hallways, and
driveways.
F. "Community Services Officer" means any person or persons empowered by the city to enforce
the provisions of this chapter:
G. "Dogs" means any animal of the species Canidae, regardless of sex.
H. "Dog Owner" means any person, firm, partnership, corporation, trust arrangement, orthe like
who owns, keeps, or harbors a dog or dogs. "Dog Owner" or "Owner" for purposes of this
Chapter means persons who are at least eighteen (18) years old.
I. "Exotic Animal" means any animal which, when in its wild state, or due to its size, habits,
natural propensities, training or instinct, presents a danger or potential dangerto human beings
and is capable of inflicting serious physical harm upon human beings, and includes inherently
dangerous mammals and reptiles as follows:
1. "Inherently dangerous mammal" means any live member of the Canidae, Felidae, or
Ursidae families, including hybrids thereof, which, due to their inherent nature, may be
considered dangerous to humans, and which includes:
a. Canidae, including any member ofthe dog (canid) family not customarily domesticated
by man, or any hybrids thereof, including wolf hybrids which are a cross between a wolf
and domestic dog, but not including domestic dogs (Canis familiaris). Common names
include wolf, coyote, jackal, hyena, fox, and all their hybrids,
b. Felidae, including any member of the cat (felis) family weighing over fifteen pounds (15
Ibs.) not customarily domesticated by man, or any hybrids thereof, but not including
domestic cats (Felis catus).
c. Ursidae, including any member of the bear family, or any hybrids thereof.
2. "Inherently dangerous reptile" means any live member of the class Reptilia which:
a. Is venomous, including but not necessarily limited to, all members of the following
families: Helodermidae (Beaded Lizards including Gila Monster, Mexican Beaded
Lizard); Viperidae (Vipers and Adders); Crotalidae (Pit Vipers); Atraciaspididae (Mole
Vipers); Hydrophilidae (Sea Snakes); and Elapidae (Cobras).
b. Is a "rear fanged" snake of the family Colubridae (rear fanged snakes) that are known
to be dangerous to humans, including, but not necessarily limited to, all members of
the following families: Dispholidus typus (Boom-slang Snake); Thebtornis kirtlandii
(Twig Snake); and Rhabdophis ssp. (Speckled Belly Keelback and Red Necked
Keelback).
c. Is a member of the order Crocodilia (crocodiles, alligators, and caiman) over two feet
(2') in length.
J. "Guard Dog" means a dog trained to protect persons or property by attacking or threatening
to attack any person found within the area patrolled by the dog. These dogs must be
registered with the city as a guard dog.
K. "Household pets" means dogs, cats, rabbits, mice, hamsters, gerbils, parakeets, canaries,
finches, and other similar exotic fowl and songbirds, reptiles, amphibians, fish and similar small
animals and fowl kept inside a residence for companionship and or personal enjoyment so
long as they are not a danger to other persons or property. All other animals are prohibited
within the city unless otherwise provided herein.
L. "Mistreatment" means every act or omission which cause or unreasonably permits the
continuation of unnecessary or unjustifiable pain or suffering.
M. "Neglect" means failure to provide food, water, protection from the elements, opportunity lor
exercise, or other care normal, usual and proper for an animal's health and well-being.
N. "Owner or custodian" means any person, firm, partnership, corporation, trust arrangement, or
the like who shall keep, maintain, control, care lor, or be responsible lor keeping, maintaining,
or caring lor any animal.
O. "Running at Large" means off the premises of the owner and not under the effective control
olthe owner, his agent, servant, or competent member 01 his family by means of a leash, cord,
or chain reasonable in length; except that, lor the purpose of this definition, the "premises of
the owner" shall not include common areas of a condominium complex, town houses, and
apartment buildings, and any animal not in the effective control of its owner upon the common
area of a condominium, town house or apartment building, or the grounds thereof, shall be
deemed to be running at large.

means, while on the owner's property, a potentially dangerous dog shall be securely confined
indoors or in an outside enclosed and locked pen or structure, resistant to tunneling, suitable
to prevent the entrv of young children and designed to prevent the dog from escaping. Such
pen or structure shall have secure sides not less than five feet (5') high and a secure top, and
shall provide protection from the elements for the dog. The reguirement for a secure top on
the enclosure may be waived by the Community Services Officer upon showing that it is
unnecessarv. This section shall not apply to guard dogs or watch dogs utilized to secure
premises enclosed by a fence or wall not less than five feet (5') high and resistant to tunneling,
located within an industrial or commercial zone.

Clla~leF 10.08. "Potentially Dangerous Dog" means any dog that when unprovoked:
L Inflicts injury on a human or a domestic animaL or livestock, or
2." chases or approaches a person upon the streets sidewalks, any public grounds, or upon
private property other than that of the animal's owner, in a menacing fashion or apparent
attitude of attack, or
~ has a known propensity, tendency or disposition to attack, or to cause injury or otherwise
to threaten the safety of humans or domestic animals or
4. is a Pit Bull Terrier which means any American Pit Bull Terrier, Staffordshire Bull Terrier,
American Staffordshire Terrier, Rottweiler, or Presa Canario breed of dog or any mixed
breed of dog which contains as an element of its breeding the breed of American Pit Bull
Terrier, Staffordshire Bull Terrier, American Staffordshire Terrier, Rottweiler, or Presa
Canario so as to be identifiable as partially of the breed American Pit Bull Terrier,
Staffordshire Bull Terrier, American Staffordshire Terrier Rottweiler, or Presa Canario.
Whenever a type or breed of dog is described in this Chapter. it includes any hybrid, cross
breed or mixed breed of such dog to any degree that the type or breed can be identified
by the dog's appearance, behavior or pedigree,
R. "Dangerous Dog" has the meaning given it RCW Chapter 16.08.
RJi. All other words and phrases used herein will have their commonly accepted meanings.
6.05.035 Records Reguired to Obtain and Retain a License: All dog owners shall keep records regarding
their dog ownership. The records shall include the following:
A. Birthday of the dog or the best estimate in month and year.
B. Breed of dog.
C. Name of dog.
D. Brief statement of how the dog ownership was derived.
E. Date when animal was first brought into the City of Moses Lake.
F. Any official actions taken regarding the dog by any law enforcement official.
G. Veterinany records.
H. A rabies inoculation and other vaccinations and spay and neuter records, if appropriate.
I. Injuny and sickness reports as appropriate.
J. Animal shelter records if appropriate.
K. Training records if appropriate.
L. Temperance test, if administered.
M. Obedience classes, if attended.
N. Owner handling classes, if attended.
O. Formal training for service dogs.
P. Service records if appropriate.
Q. Record of microchip, if implanted.
R. A photograph of the dog and the owner.
S. Copy of city license.
T. Copy of any current insurance policy or bond relative to the dog.
The records and file must be available to any law enforcement agent and may become a matter
of public information.

0.05.085 Notice and Order to Correct -Vieieus Alliliials Potentially Dangerous Dogs: If an animal is

and Order to Correct to be issued to the custodian and/or owner of the dog in question as such
can be determined from the city's dog licensing records or other means. During the period
provided in that Notice and Order and during any period of appeal from that Notice and Order the
dog in question shall remain impounded at the expense of the owner or custodian or shall be
required to be maintained in a controlled area under the owner or custodian's control. The animal
shall not be released to the owner or custodian until after compliance with the Notice and Order
to Correct unless the owner agrees with the City Attorney to have the animal placed outside the

0.05.100 Cats -Impoundment and Disposition: Any person residing within the corporate limits of the city
and owning a cat may deliver such cat to the Police Department, upon the execution of the
necessary releases and waivers on forms provided for by the Police Department and upon
payment of the necessary impounding, boarding, and euthansiairiftgJees, for disposition. The
owner of a cat brought in for disposition may request that such cat be euthanized immediately.
Alternately, such cat brought in fordisposition may be held, upon request of the owner, for a period
of forty-eight (48) hours from the time of impounding, exclusive of holidays and Sundays, for the
purpose of attempting to locate an adoptive home for such cat. If such cat remains impounded
after the aforesaid forty-eight (48) hour period, such cat may be euthanized, or otherwise disposed
of as directed by the Police Chief. Any funds received from the sale of any cats, in addition to the
cost of boarding such cats, shall be placed in the current expense fund of the city
0.05.135 Potentially Dangerous Dogs -Determination:
A. Determination: The Community Services Officer has the authority to declare a dog potentially
dangerous and to reguire such dog to have a permit in accordance with this section.
!h Meeting with Owner: Before the Community Services Officer issues a final determination that
a dog is potentially dangerous, the Community Services Officer shall notify the owner in writing
that he or she is entitled to an opportunity to meet with the Community Services Officer at
which meeting the owner may give, orally or in writing, any reasons or information as to why
the dog should not be declared potentially dangerous. The notice shall state the date, time, and
location of the meeting, which must occur prior to the expiration of fifteen (15) calendar days
following deliverv of the notice. The owner may propose an alternative meeting date and time,
but such meeting must occur within the fifteen (15) day period set forth in this section. After
such meeting, the Community Services Officer must issue a final determination, in the form
of a written order, within fifteen (15) calendar days in accordance with the procedures provided
for in subsection C of this section.
C. Basis of Determination: The Community Services Officer has the authority to declare a
dog potentially dangerous and reguire such dog to have a permit in accordance with this
section. The Communitv Services Officer may declare a dog potentially dangerous if he
or she has probable cause to believe that the dog falls within the definition set forth in
section 6.05.020(0). Probable cause may be based upon:
1.,. The written complaint of a citizen who is willing to testify that he or she has personal
knowledge that the dog meets the definition of potentially dangerous dog or that he or
she witnessed the dog acting in a manner which causes it to fall within the definition
of potentially dangerous dog:
£. Actions of the dog witnessed by any Community Services Officer or law enforcement
officer:
~ Any statement by the owner of the animal confirming that the dog meets the definition
of a potentially dangerous dog under MLMC 6.05.020(0).
4. Other substantial evidence.
6.05.140 Notice of Potentially Dangerous Dog Determination.
A. Written Notice: Upon determining that probable cause exists to believe that a dog is potentially
dangerous. the Community Services Officer shall issue a written notice to the owner of the
dog. The notice shall contain the following:
1.,. The name and address of the owner of the dog:
£. A brief description of the dog;
~ A brief statement of why the dog has been found to be a potentially dangerous dog;
4. The specific provision or provisions of paragraph 3 above under which the Communitv
Services Officer has found the dog to be a potentially dangerous dog;
§.,. The reguirements for restraint of the dog. if applicable, as determined by the Community
Services Officer, and when these reguirements must be complied with;
§" The penalty for violation of the requirements for restraint imposed by the Community
Services Officer;
7. A statement advising:
iL That the notice may be appealed'
lL That the failure to file a timely and complete notice of appeal will constitute a waiver
of all rights to an appeal under this chapter. Failure to exhaust this administrative
appeal process shall be a bar to further action in any court.
!l Service of Notice: The notice shall be served on the owner in one of the following methods:
1.,. First class mail and certified mail, return receipt requested, to the owner's last known
address: or
2. Personally, If the notice is personally served, proof of personal service of the notice shall
be made by a written declaration under penalty of perjurv executed by the person effecting
service, declaring the time, date and manner in which service was made.
"Personal service" means handing it to the owner's attorney or to the owner or leaving it
at their office with their clerk or other person in charge thereof; or, if there is no one in
charge, leaving it in a conspicuous place therein; or, if the office is closed or the owner has
no office, leaving it at their dwelling house or usual place of abode with some person of
suitable age and discretion then residing therein,
If the owner of such dog can be readily determined, the Community Services Officer shall
notify the owner personally or by certified mail of the declaration, If, however, the owner
of such dog cannot be readily determined, notification shall be waived,
6,05,145 Appeal of Potentially Dangerous Dog Determination:
A. Any owner of a dog which has been declared potentially dangerous by the Community
Services Officer pursuant to this section may appeal the notice by filing with the City Clerk
within fourteen (14) days from the date of the notice, a written notice of appeal. Said written
notice of appeal shall be on a form provided for that purpose bv the City Clerk and must
contain the following items:
L A caption reading: "Appeal of Potentially Dangerous Dog Determination" giving the name
of the appellant;
~ A brief statement of the finding being appealed, together with any material facts claimed
to support the contentions of the appellant including but not limited to the following written
information and/or documents:
""-Specific basis on which the owner contests the determination of potentially dangerous
dog;
~ Any breed identification or registration paperwork, certificates, pedigrees, or the like
regarding the dog in question;
Q,. Any expert testimony supporting or corroborating the owner's assertion that the dog
is not a potentially dangerous dog;
sl Any certifications orother evidence establishing training courses completed by the dog
and its owner, such as obedience training or canine good citizen training,
~ A brief statement of the relief sought, and the reasons why the finding should be reversed,
modified or otherwise set aside;
4, The current address of the appellant; and
Q,. A verification, by declaration under penalty of perjurv, made by the appellant as to the truth
of the matters stated in the appeal, pursuant to RCW 9A. 72,085,
!t. Failure to file a timely and complete notice of appeal constitutes a waiver of all rights to an
appeal under this chapter,
C, Upon receipt of a timely filed and completed notice of appeal, a notice of hearing shall be sent
to the appellant, setting the date, time and place of the appeal hearing,
Q,. The Hearing Examiner shall set a date and time for hearing the appeal following receipt of a
timely filed and complete notice of appeal. The filing of a notice of appeal shall not stay the
requirements for restraint of the dog provided to the owner pursuant to this chapter,
S The appeal shall be heard before the Hearing Examiner for the City, The burden of proof shall
be on the owner to prove that the potentially dangerous dog determination is arbitrarv and
capricious,
E At the hearing, the owner of the dog found to be a potentially dangerous dog shall be permitted
to present evidence in support of the owner's position at the hearing,
G. Dogs shall not be declared potentially dangerous by the Hearing Examiner if a threat. injury.
or damage sustained by a person forms the probable cause to believe the dog is potentially
dangerous. and the threat. injury. or damage was sustained by a person who. at the time. was
committing a wilful trespass or other tort upon the premises occupied by the owner of the dog.
or was tormenting. abusing. or assaulting the dog or has. in the past. been obseryed or
reported to have tormented. abused. or assaulted the dog. or was committing or attempting
to commit a crime.
!::l At the hearing. the burden shall be on the owner of the dog. by a preponderance of the
evidence. that one (1) or more ofthe circumstances set forth in subsection IG) of this section
exist.
1. Subsection (G) of this section shall not apply if the dog is believed to be a potentially
dangerous dog pursuant to Section 6.05.020IQ)ld).
,!... At the conclusion of the hearing. the Hearing Examiner shall issue a written decision:
1., If the Hearing Examiner finds there is insufficient evidence to support the potentially
dangerous dog determination. it shall be rescinded and the restrictions imposed thereby
annulled. No Hearing Examiner costs shall be assessed and any potentially dangerous
dog registration fee paid shall be refunded.
2. If the Hearing Examiner finds there is sufficient evidence to support the potentially
dangerous dog determination. all costs of the appeal process. including attorney's fees,
shall be assessed against the owner.
K. The decision of the Hearing Examiner shall be final and shall be mailed to the owner.
Proceedings to review the decision must be instituted within fifteen (15) days of the date the
written decision was mailed .
.b. All impound fees are the responsibility of the owner of the dog, no dog impound expense and
feels) shall be assessed against the City of Moses Lake or the animal control authority or
officer.
6.05.150 Registration of Potentially Dangerous Dogs:
A. In addition to any other registration and licensing reguirements required by law it is unlawful
for any person to keep a potentially dangerous dog in the City without a registration issued
under this section. This section shall not apply to dogs used by law enforcement officials for
police work.
!L The City shall issue a certificate of registration to the owner of a potentially dangerous dog if
the owner presents to the City sufficient evidence of the following:
1., A proper enclosure as defined in Section 6.05.020IS).
b. Evidence that microchip has been implanted in the dog, the microchip is registered, and
the annual seryice fee is paid.
;)", Proof that the dog has been spayed or neutered.
4. A policy of liability insurance, such as homeowner's insurance, issued by an insurer
gualified under RCW Title 48 in the amount of at least two hundred fifty thousand dollars
($250,000) insuring the owner against liability to any person for injuries inflicted by the dog.
Q.. The physical address at which the potentially dangerous dog will reside.
C. A fee of one hundred fifty dollars ($150) shall be paid to the City by any person seeking to
register a potentially dangerous dog.
D. This section shall not apply to dogs under the following conditions:
1.,. Dogs which do not reside in the City of Moses Lake.
& Dogs which are brought into the City of Moses Lake for the purposes of participating in a
dog show or canine sporting event for which the owner is able to show proof of entry.
3. Dogs which do not remain in the City of Moses Lake for a period exceeding ninety-six (96)
consecutive hours.
S It is unlawful for any owner to fail to immediately notify the Community Services Officer in
writing of the removal or death of a potentially dangerous dog, or of the new physical address
if the dog is moved to a different location,
6.05.155 Exemption to Certificate of Registration of Potentially Dangerous Dog: A dog that is classified as
a potentially dangerous dog under the provisions of 6.05.020(Q)(d) may be exempted from the
Certificate of Registration requirements of Section 6.05.150, provided such dog has passed the
Canine Good Citizen (CGC) test of the American Kennel Club (AKC) as administered by an AKC
approved evaluator and has received the appropriate certificate from the ACK. Such dog shall be
retested and shall pass such CGC test at least once every two (2) years in order to maintain this
exemption.
6.05.160 Unconfined Potentially Dangerous Dog: The ownerofa potentially dangerous dog shall not permit
or cause such dog to go unconfined. A potentially dangerous dog shall be securely confined in a
proper enclosure as defined in Section 6,05.020(S): provided, however, a potentially dangerous
dog is permitted to be in a secure, fully enclosed fenced yard or pen on the owner's premises,
adequate to prevent escape, so long as the owner is present and is providing supervision of the
dog's activities. Said fenced enclosure shall not include an invisible fence, but shall mean an
above-ground fencing structure designed to prevent escape of the dog and intrusion by other
animals and/or persons. Potentially danqerous dogs shall not be chained or tethered outside.
6.05.165 Impounding of Potentially Dangerous Dogs. Any potentially dangerous dog found at-large without
a certificate of registration will be impounded immediately atthe expense ofthe owner. If the owner
of such dog can be readily determined, the Community Services Officer shall notify the owner
personally or by certified or regular mail of the impoundment. If, however, the owner of such dog
cannot be readily determined, notification shall be by posting at the City Hall.
6,05.446170 Confinement of Females in Heat: Any un-spayed female dog in the stage of estrus (heat) shall
be confined during such period of time in a house, building, or secure enclosure, and such
area of enclosure shall be so constructed that no other dog or dogs may gain access to the
confined animal. The Community Services Officer shall order any un-spayed female that is in
the stage of estrus (heat) and that is not properly confined or any such dog that is creating a
neighborhood nuisance to be removed to a boarding kennel or to a veterinary hospital. All
expenses incurred as a result of the confinement shall be paid by the owner. Failure to comply
with the order of the Community Services Officer shall be a violation of this provision, and the
animal shall then be impounded and a Notice and Orderto Correct shall be issued as provided
in Section .185.
6.05.+5B 175 Responsibility of Owner or Custodian:
A. It shall be the responsibility of the owner or custodian of any animal within the corporate limits
of the city to so control and care for their animal so as to prevent and keep that animal from
being in violation of this chapter. In any proceeding to enforce the provisions of this chapter,
it shall be conclusively presumed that the owner or custodian of any animal within the
corporate limits of the city is aware of the animals whereabouts, condition, or method of being
treated and/or maintained.
B. The owner or custodian of any animal within the corporate limits of the city shall be responsible
for any cost, charge, fee, or expense of any nature incurred by the city in capturing, controlling,
caring for, or destroying any animal in violation of this chapter. Without limitation but by way
of illustration, the following are examples of costs, charges, fees, and expenses which the
owner or custodian shall be responsible to pay to the city: board charges, tranquilizer costs,
euthanasia costs, veterinary expenses.
6.05.4€tl180 Interference With Community Services Officer: It shall be unlawful for any person to interfere
with, molest, hinder or obstruct an Community Services Officer or any city employee or official
in the discharge of his official duties under this chapter.
6.05.4-i'6185 Fees: Any dog impounded under the provisions of this chapter shall not be released until the
owner of such dog shall have paid all fees and charges due and has obtained all permits,
licenses, and registrations as reguired herein.
6.05.+15 190 License and Permit Issuance and Revocation:
A. The City of Moses Lake may revoke any animal permit or license if the person holding the
permit or license refuses or fails to comply with this chapter, the regulations promulgated by
the City of Moses Lake, or any law governing the protection and keeping of animals.
B. Any person whose animal permit or license is revoked shall, within ten (10) days thereafter,
humanely dispose of all animals owned, kept, or harbored by such person and no part of the
permit or license fee shall be refunded.
C. It shall be a condition ofthe issuance of any permit or license thatthe City of Moses Lake shall
be permitted to inspect all animals and the premises where animals are kept at any time and
shall, if permission for such inspection is refused, revoke the permit or license of the refusing
owner.
D. If the applicant has withheld or falsified any information on the application, the City of Moses
Lake shall refuse to issue or may revoke a permit or license.
E. No person who has been convicted of cruelty to animals shall be issued a permit or license to
operate a commercial animal establishment.
F. Any person having been denied a license or permit may not reapply for a period of thirty (30)
days. Each re-application shall be accompanied by a twenty dollar ($20) fee.
G. Any dog impounded under the provisions of this chapter shall not be released until the owner
of such dog shall have paid all fees and charges due and has obtained all required permits,
licenses andlor registrations.
6.05.4€tl195 Records:
A. It shall be the duty of the Community Services Officer to keep, or cause to be kept, accurate
and detailed records of the impoundment and disposition of all dogs coming into his custody
and of all reports of animal bites reported to him.
B. It shall be the duty of the Police Department to keep a record of the names of all persons to
whom licenses are issued with the number of each license and whether for a male or female dog
and whether the male dog has been neutered or the female dog spayed.
6.05.465 200 Enforcement and Penalties: When the Community Services Officer determines that any
violation of Sections 6.05.050, 6.05.075, 6.05.080, 6.05.110, 6.05.130 and 6.05.140 of this
chapter, he or she may proceed against that violation using the procedures provided in this
section and Chapter 1.20.
A. Notice of Violation and Order to Correct or Cease Activity:
1. General. If the Community Services Officer or any Police Officer determines that any
activity or condition, related to the keeping or management of animals as set forth in
Sections 6.05.050,6.05.075,6.05.080,6.05.110,6 .. 05.130 and 6.05.140 of this chapter
exists that does not conform to this chapter, he or she may issue a Notice of Violation and
Order to Correct or Cease Activity. This Notice will specifically indicate the following:
a. The name and address of the person(s) charged with the violation.
b. What provision of this chapter is being violated.
c. The street address of the site on which the violation has been determined to exist.
d. What is necessary to correct the violation.
e. The time by which the violation is to be corrected or activity ceased.
f. A statement that the civil penalties established in Section 1.20.050(E) shall be
assessed against the person(s) cited if the violation is not corrected within the specified
time period.
2. Notice to Occupant and Owner. The Community Services Officer shall deliver or cause to
be delivered the Notice of Violation and Order to Correct or Cease Activity by U.S. postal
mail, or certified mail return receipt requested, or personal service to the occupant or
person in charge of the property.
B. Appeals: Any Notice of Violation and Order to Correct or Cease Activity issued by the
Community Services Officer shall be appealable to the Hearing Examiner as provided in
Chapter 1.20.
C. Penalties: Any violation for which a Notice of Violation and Order to Correct or Cease Activity
has been issued shall be subject to the penalties provided for in Section 1.20.050(E). The
cumulative penalty provided for in Chapter 1.20 shall not preclude the initiation of appropriate
legal action to correct the violation.
D. The Community Services Officer may refer the matter to the City Attorney for civil enforcement
by injunction or other appropriate action.
E. Compromise, Settlement, and Disposition of Disputes or Litigation: The Community Services
Officer and the City Attorney may negotiate a settlement or compromise, or otherwise dispose
of a dispute or litigation when to do so would be in the best interests of the city.
6.05.4-00 205 Penalty: Failure to comply with any provisions of this chapter other than Sections .050, .075,
.080, .110, .130, and .140 shall subject the violator to the following penalties as they are
defined in Chapter 1.08 of this code:

Paul Snelson, Knudsen Land Surveying, requests City Council's approval to connect to the city's
water and sewer systems to serve the proposed Larson Subdivision Lot 588 Short Plat. The city's
water and sewer systems have adequate capacity to serve this two-lot short plat. The parcel is more
than one-half mile from the corporate limits.

A tree lawn, (also verge, sidewalk buffer, nature
strip, tree belt, utility strip, planting strip,
parking strip, devil's strip, city grass etc.) is a
narrow strip of grass, low wildlife gardens or trees
located between a street and its sidewalk. [I] They
are often found in residential areas and along
boulevards and suburban highways. They can be
part of sustainability programs for rainwater
harvesting for water conservation and urban runoff

This term has many synonyms and dialectical differences, with some dialects and idiolects without a

Legal status
Tree lawns and sidewalks are typically public property. Public tree maintenance is usually a municipal
responsibility. Some municipal governments require that abutting private property owners maintain the
public tree lawn-parkway area and safe sidewalk pavement. [13]
In Australia and the United States the tree lawn-nature strip on a city's street or road is public land but by
custom is tended by the owners of the abutting private property, including mowing if a lawn.
Sustainable urban and landscape design
In urban and suburban areas urban runoff from
private and civic properties can be guided by
grading and bioswales for rainwater harvesting
collection and bioretention within the "tree-lawn" -
parkway zone in rain gardens. This is done for
reducing runoff of rain and domestic water: for their
carrying water-born pollution offsite into storm
drains and sewer systems; and for the groundwater
recharge of aquifers. [2]
In some cities, such as Santa Monica, California,
city code mandates for "Parkways, the area between
the outside edge of the sidewalk and the inside edge
of the curb which are a component of the Public
Right of Way (PROW) -that the landscaping should
require little or no irrigation and the area produce no
runoff." [3] For Santa Monica another reason for this

use of "tree-lawns" is to reduce current beach and Santa Monica Bay ocean pollution that's measurably
higher at city outfalls. New construction and remodeling projects needing building permits require that
landscape design submittals include garden design plans showing the means of complianceP]
In some cities and counties, such as Portland, Oregon, street and highway departments are regrading and
planting rain gardens in parkways-tree lawns to reduce boulevard and highway runoff. This practice
can be useful in areas with either independent Storm sewers or combined storm and sanitary sewers,
reducing the frequency of pollution, treatment costs, and released overflows of untreated sewage into
rivers and oceans during rainstorms.[14]
Other advantages
Some other advantages of tree-lawns and parkways include: visual aesthetics; increased safety and
comfort of sidewalk users; wildlife garden habitats for butterflies, small birds, and beneficial insects;
protection of pedestrians from passing vehicles' splash and spray; a storage area for snow plowed off the
street; and space for street trees, benches, bus shelters, street lights and other public amenities.

SUBJECT: Noise Measurement -Operations Facility
On June 23,2011 and on September 21, 2011, Dan Leavitt and I took noise measurements using
a hand-held decibel meter to determine the noise level that different equipment emanated for the
Operations Facility. The purpose was to determine the actual noise levels, and to have base
information to determine if the landscaping that will be installed this fall will reduce the noise
level for the Sloans. The attached map shows the locations of where the measurements were
taken, and the locations of the noise source. The lettered locations are described as follows.
A. The north shoulder of Road 4 near Sloan's driveway -observation point.
B. The south right-of-way line of Road 4 near the fence -observation point.
e. Inside the north fence in line with Sloan's house -noise source.
D. North side of the used asphalt/concrete pile -pile is no longer there -noise source.
E. Concrete slab near the proposed site for the decant station facility -noise source.
F Truck parking spaces at the north end of water division's shop, where the plug-ins
are.

Changes made to reduce the noise for the Sloans'
1. Removed the asphalt/concrete pile and now stockpiling the used asphalt and concrete
at our Penn Street property.
2. The sweeper now uses Road L and Wheeler Road so it does not travel in front of the
Sloans' house.
3. The entrance gate located 200 feet east of the Sloans' house has been locked and will
not be used. All traffic from the Operations Complex is using the Municipal Hanger
Road.
4. The city's contractor will start installing the landscaping along Road 4 the first of
October.
