RESOLUTION NO. 3043
A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT-
OF-WAY DEDICATED FOR THE DEVELOPMENT OF PENINSULA DRIVE
AND BATTERY ROAD
RECITALS:
1.There exists right-of-way dedicated for Peninsula Drive and Battery Road.
2.RCW 35.79 provides that a public street may be vacated upon resolution initiated and passed by the legislative authority of the jurisdiction where the street is situated and that such resolution shall fix a time when the petition will be heard and determined and which shall not be more than sixty days nor less than twenty days after the passage of such resolution.
RESOLVED:
1. The vacation of the following described public right-of-way shall be initiated:
A portion of Tract 47, Battery Orchard Tracts, in the Northeast 1/4, Southwest 1/4, Section 33,
Township 19 North, Range 28 East W.M., City of Moses Lake, Grant County, Washington,
described as follows:
Commencing at the intersection of Peninsula Drive and Battery Road as shown on the Peninsula
Highlands Short Plat, as recorded in Grant County Auditor plat records volume 7, pages 88 and
89; thence South 32°08'44" West, 94.73 feet along the centerline of Peninsula Drive; thence North
57°51'16" West, 20.00 feet to the westerly right-of-way line of Peninsula Drive and the point of
beginning; thence continuing North 57°51'16" West, 10.00 feet to the east corner of Lot 6,
•Peninsula Highlands Short Plat; thence North 32°08'44" East, 42.77 feet to the westerly right-of-
way of Peninsula Drive and Battery Road as shown on the Battery Orchard Tracts Plat as recorded
in Grant County Auditor plat records volume 1, page 31; thence along said westerly right-of-way
on a 60.00 foot radius non-tangent curve, concave to the north, an arc of 11.03 feet, the chord
being South 33°07'08" East, 11.01 feet to the westerly right-of- way line of Peninsula Drive; thence
along said westerly right-of-way line, South 32°08'44" West, 38.16 feet to the point of beginning.
Containing 403 square feet more or less.

2. A public hearing and the first reading of a vacation ordinance before the City Council shall be
set for April 14, 2009, and a second reading of a vacation ordinance shall be set for April 28,
2009.
