A RESOLUTION ACCEPTING AN EASEMENT FROM MAIERS ENTERPRISES,LLC
RECITALS:
1.Resolution #238 provides that all grants of real estate,or any interest therein,to the City of
Moses Lake,shall not be accepted until a resolution has been duly passed by the City Council.
2.Maiers Enterprises,LLC has presented an easement to the City of Moses Lake.
RESOLVED:
1.The easement for the following described property is hereby accepted by the City of Moses
Lake:
An easement in a portion of Section 32,Township 20 North,Range 28 East,W.M.,said
easement being more fully described as follows:
Commencing at the north one quarter corner of Section 5,Township 19 N,Range 28 East,
W.M.,a brass cap monument from which point the northeast corner of Section 4,a square iron
pin,bears North 88"49'27"East.7,968.45 Feet;thence North 88 "49'27"East,14.49 feet to the
westerly right-of-way of State Highway 17 said right-of-way being 75.00 feet southwesterly
(measured perpendicular)from the centerline,said point on a 9,475.00 foot radius curve
concave to the southwest,a radial line to said curve bears North 66"35'34"East;
Thence northwesterly along said 9,475.00 foot radius State Highway 17 right-of-way curve to
the left,said curve being concave to the southwest,an arc distance of 1,944.18 feet through
a central angle of 11 °45'24"to the true point of beginning;thence continuing northwesterly
along said 9,475.00 foot radius State Highway 17 right-of-way curve to the left,said curve
concave to the southwest,an arc distance of 75.00 feet through a central angle of 00!'27'13",
thence leaving said curve.South 54 36'34"West,40.00 feet;thence South 35=23'22"East,
75.00 feet;thence North 54 '36'34 East,40.00 feet to the true point of beginning.
Together with,an easement for ingress and egress for the purpose of access and maintenance
of the water and sewer lines.Said easement is over the existing unimproved jeep trails,said
easement being 60 feet wide and lying southwest of,parallel and adjacent to the southwest
right-of-way of said State Highway 17,said access easement extends from the intersection of
Randolph Road and Grandview Drive southeast approximately 1,100 feet to the water and
sewer easement described above.Said easement for ingress and egress to be terminated
upon the construction of a public roadway that provides access to the water and sewer
easement above.
