A RESOLUTION INITIATING THE PROCEDURE FOR VACATING RIGHT-OF-WAY
DEDICATED FOR THE DEVELOPMENT OF AN ALLEY ADJACENT TO LOT 27,
LESS TAX #3838 OF BROADRIPPLE ADDITION #1
RECITALS:
1.There exists right-of-way dedicated foran alleyadjacent toLot27, less Tax#3838 ofBroadhppleAddition
2. RCW 35.79 provides that a public street may be vacated upon resolution initiated and passed bythe
legislative authority of the jurisdiction where the street is situated and that such resolution shall fixa time
when the petition will be heard and determined and whichshall not be more than sixtydays norless than
twenty days after the passage of such resolution.
RESOLVED:
1.The vacation of the following described public right-of-way shall be initiated:
That portion of the alley coincident to Lot27, Broad Ripple Addition No.1,inthe Southwest 1/4, Section
23,Township 19 North,Range 28 East W.M.,City ofMoses Lake,Grant County,Washington, described
as follows,and shown in Exhibit A:
A3.00 footwidestripof land coincident tothe westerly lotlineof Lot 27, Broad Ripple Addition,Number
1, recorded in Grant County major plat records, volume 6, page 24,AND the alleyvacated by City of
Moses Lake,WA,through ordinance number 849. More accurately described as follows:
Beginning at the most westerlycorner ofsaid Lot 27;thence along the westerly lineofsaid vacated alley,
N28°00'00"W 22.66 feet, to the northerly line of said vacated alley;thence along the northerly lineof a
20.00 foot alley dedicated on said Broad Ripple Addition,N89°56"I0"W 3.40 feet;thence S28°00'00"E
82.66 feet to the extended south line of Lot 27 as described in the Quit Claim Deed filed under Auditors
File Number 523740 ofGrant County records;thence along said extended south line,S89°56'10"E 3.40
feet to the southwesterly corner of Lot 27, as it now exists;thence along the westerly line of Lot 27,
N28°00'00"W 60.00 feet to the point of beginning.
Containing 248 square feet more or less.
Subject to the following:
1. A municipal easement is retained over the vacated alley described above.
2. Nofence, or other obstruction, isallowed to be installed within the vacated alley described above.

2. A public hearing and the first reading of a vacation ordinance before the City Council shall be set for
September 13,2011,and a second reading ofa vacation ordinance shall be set for September 27,2011.
