A RESOLUTION ACCEPTING EASEMENT TO THE CITY OF MOSES LAKE FROM
ASA DEVELOPMENT GROUP,LLC
Recitals:
1.Resolution No. 238 provides all grants of real estate, or any interesttherein, to the City of
Moses Lake, shall not be accepted until a resolution has been duly passed by the City
Council.
2. ASA DevelopmentGroup,LLChave presentedan easementto the Cityof MosesLake.
Resolved:
1.Easements for municipal purposes and uses for the following described property is to
maintain,repairand operatethe city's designatedutilityis herebyacceptedbythe Cityof
Moses Lake:
Grantors are the owner of real property located in Grant County,Washington,described as follows:
Per Auditor's File Number 920513007 and Record of Survey,Book 36,page 66:
That portion of the Larson Air Force Base located in Sections 27, 28, 33 and 34, Township 20 North,
Range 28 E.W.M.,Grant County Washington,described as follows:
Beginning at the Southeast corner of Section 33,Township 20 North,Range 28 E.W.M.(Whose
Washington State Grid South Zone coordinates are Y =674047.08,X =2298909.20 and are referred
to U.S.C.&G.S.Station "SPAD",whose Washington State Grid South Zone coordinates are Y =
676911.66,X =2288625.74);thence North 00°53'26"West along the Easterly line of said Section 33,

The Cityof Moses Lake desires an easement to construct, repair and maintain public right-of-way for streets
and to construct,maintain and operate public utilities within the above described premises.
The Grantors grant,assign,and set over to the City of Moses Lake to construct,repair and maintain public
right-of-way for streets and to construct,maintain and operate public utilities on a 20 foot wide municipal
easement within Section 34,Township 20 North,Range 28 East, W.M., Grant County,Washington,being 10
feet each side of the following described line:
Commencing at the centerline monument at the intersection of Road 7 NE and Randolph Road NE,
marked by a 3 1/2"brass cap monument,PLS 21651,from which the north 1/4 corner of said Section
34, marked bya USRB brass cap,bears N 85°06'54"E, 1578.46 feet;Thence S 11°34'18"W,
1974.78 feet to the westerly right-of-way of said Randolph Road NE, being the TRUE POINT OF
BEGINNING;Thence N 49°10'19M W,405.22 feet to the POINT OF TERMINUS.
The easement side lines shall lengthen or shorten to form a continuous easement.
The Grantor shall fully use and enjoy the real property described above except as to the easement granted.
There shall be no buildings,trees or other structures placed within the easement.Any plantings,structures or
things placed within the easement may be damaged or destroyed by the City of Moses Lake in the use of this
easement.This easement is non-exclusive.The Grantor may grant easements to others in the area of the
easement so long as such easements are not in conflict with this easement granted the City of Moses Lake.
Any additional easements granted shall reference this easement and the Grantor shall be responsible to the
City of Moses Lake for any damage to its property or interference with the easement granted herein.
The parties have executed this easement the year and day first written above.
