u u u RESOLUTION NO.3463 A RESOLUTION ACCEPTING AN EASEMENT TO THE CITY OF MOSES LAKE FROM PUBLIC UTILITY DISTRICT NO.2 OF GRANT COUNTY Recitals: 1.Resolution No.238 provides all grants ofreal estate,or any interest therein,tothe City of Moses Lake,shall not beaccepted until a resolution has been duly passed by the City Council. 2.Public Utility District No.2ofGrant County have presented an easement to the City of Moses Lake. Resolved: 1.Easements for municipal purposes and uses for the following described property is hereby accepted by the City ofMoses Lake: For and in consideration of the benefits derived and to be derived by Grantor herein,and other good and valuable consideration,receipt whereof is hereby acknowledged,Grantor,Public Utility District No.2of Grant County (hereinafter "Grantor"),hereby gives,grants,conveys and warrants toGrantee,the CITY OF MOSES LAKE in Grant County,Washington,a Washington municipal corporation,its successors and assigns,a perpetual,permanent,nonexclusive easement on,under,over,through and across the property described below and shown in "Exhibit A",attached hereto and by this reference incorporated herein,for municipal purposes: That portion ofa parcel described in a Quit Claim Deed found in Auditor's File Number 120358, Book 71 ofdeeds,pages 482 and 483,records ofGrant County,Washington,and within the Southeast quarter ofSection 10,Township 19 North,Range 28 East,W.M.,more particularly described as follows: Commencing at the Southeast corner ofsaid Section 10;Thence N00°26'28"W along the East line ofsaid Section,30.00 feet;Thence S89044'37HW parallel totheSouth line ofsaid Section 10, a distance of30.00 feet tothePoint of Beginning:Thence continuing S89°44'37"W along the South line ofsaid parcel,3.00 feet;Thence N26°09'40"E,6.70 feet tothe East line ofsaid parcel; Thence S00°26'28"E along the East line ofsaid parcel6.00feettothe Point of Beginning. Parcel #11-0180-002 SUBJECT TO THE FOLLOWING: 1.Grantee shall have the right at all times toenter the premises described herein for municipal purposes. 2.Said grant ofeasement is for a public useand shall include all rights reasonably necessary or incident for Grantee's municipal purposes,including the rights ofingress andegress. 3.Grantor shall not useormake useofthe property described herein soas tointerfere with,impede, restrict,orotherwise conflict with Grantee's useofthis easement.Grantor may grant easements to others in the area ofthe easement so long as such easements are notin conflict with nor W 4. interfere with this easement granted to the City of Moses Lake.Any additional easements granted shall reference this easement and Grantor shall be responsible to the City of Moses Lake for any damageto its property or interference with theeasement granted herein. This grant ofeasement is a covenant running with the land and shall be binding upon the heirs, personal representatives,successors and assigns of both parties.
