A RESOLUTION ESTABLISHING THE BILLING TO BE IMPOSED AGAINST BETTY DUNCAN AS
THE OWNERS OF CERTAIN REAL PROPERTY UPON WHICH THE CITY CAUSED ABATEMENT
OF A NUISANCE TO BE PERFORMED AFTER A FAILURE OF THE PROPERTY OWNER TO
ABATE THE SAME.
RECITALS:
1.Real Property Location and Ownership.The records of Grant County show that BettyDuncan is the
owner of property within the city limits located at 823 Fairbanks.The parcel number of this property is
100880000.BettyDuncan was provided notice ofa hearing held before the CityCouncil on July8, 2014,
to considerthe allegations of the Code Enforcement Officer that a nuisance requiring abatement existed
on property owned by Betty Duncan.
2. On July 8, 2014 the CityCouncil conducted a hearing to determine ifa nuisance existed on the property
at 823 Fairbanks.Atthe conclusion of that hearing,the CityCouncil adopted Resolution No. 3451 which
provided a nuisance existed on the property at 823 Fairbanks,that the owner had fifteen (15)days to
abate such nuisance and if the nuisance was not abated within fifteen (15)days of adoption of that
resolution,the Citywould cause the nuisance to be abated and the costs of that abatement to be charged
against the property owner.
3.The nuisance identified in Resolution No. 3451 was not abated by the property owner withinfifteen (15)
days of the adoption of that resolution. On September 10, 2014 the Citycaused the nuisance identified
to be abated through the use of contracted and/or City labor and equipment.
RESOLVED:
1.The costs to the Cityto abate the nuisance identified in Resolution 3451 on the property at 823 Fairbanks
areset forth below.Those costs are derived from the attached documentswhich detail the costs incurred.
2.The costs to be recovered from Betty Duncan are:
Citylabor and equipment costs $0.00
Contracted labor and equipment (company)$140.00
Tax 11.06
Total $151.06
3. This charge iscertified bythe CityCouncil as due and owingthe City.This charge shall be forwarded in
writing to Betty Duncan for payment. Ifpayment is not received within thirty (30) days of submittal, the
same shall be submitted for collection with other unpaid billingsof the City and collected or reduced to
judgment on the rolls of Grant County Clerk.
