3500u u RESOLUTION NO.3500 A RESOLUTION ACCEPTING AN EASEMENT TO THE CITY OF MOSES LAKE FROM RUBEN AND MARIA MANCILLA Recitals: 1.Resolution No.238 provides all grants of real estate,or any interest therein,totheCity of Moses Lake,shall notbe accepted until a resolution hasbeen duly passed bythe City Council. 2.Ruben andMaria Mancilla have presented an easement totheCityof Moses Lake. Resolved: 1.Aneasement for municipal purposes and uses for thefollowing described property isto maintain,repair and operate the city'sdesignated utility is hereby accepted bythe City of Moses Lake: For and in consideration ofthe benefits derived and tobe derived by Grantor herein,and other good and valuable consideration,receipt whereof is hereby acknowledged,Grantor,RUBEN MANCILLA and MARIA MANCILLA,husbandand wife (hereinafter "Grantor"),hereby gives,grants,conveys and warrants toGrantee,the CITY OF MOSES LAKE in Grant County,Washington,a Washington municipal corporation,itssuccessors and assigns, a perpetual,permanent,nonexclusive easement on,under,over, through andacrossthe property described below and shown in "Exhibit A",attached hereto and by this reference incorporatedherein,for municipal purposes: Thatportion of Lot 1,Block 2,Longview Tracts,records ofGrant County,Washington,and within the Southeast quarter ofSection 10,Township 19 North,Range 28 East,W.M.,more particularly described as follows: Beginningat the Southeastcornerofsaid Lot 1;ThenceS89°44'54"W along theSouthline of said Lot,3.00 feet; Thence N26°09'22"E,6.70 feet to the East lineofsaid Lot;Thence S00°26'28"E along the East lineofsaid parcel6.00 feet to the Point of Beginning. Parcel #12-0338-000 SUBJECT TO THE FOLLOWING: 1.Grantee shallhavethe right at all timestoenterthe premisesdescribed herein formunicipal purposes. 2. Saidgrantofeasementis for a public use and shall include all rights reasonably necessaryor incident for Grantee's municipal purposes,including the rights ofingressandegress. 3. Grantorshallnotuse or make use ofthe property described herein so as to interfere with,impede, restrict,or otherwise conflict with Grantee's use ofthiseasement. Grantormaygrant easements to others inthe area ofthe easement so long as such easements are not inconflictwithnor interfere with thiseasement granted tothe City ofMosesLake.Any additional easements granted shallreferencethis easement and Grantorshallbe responsible tothe City ofMosesLakeforany damage to its property or interference with the easement granted herein. 4.This grant of easement is a covenant running with the land and shall be binding upon the heirs, personal representatives,successors and assigns of both parties.
