2002RESOLUTION NO.2002 A RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS Recitals: 1. The City of Moses Lake is applying to the State Department of Community, Trade, and Eco nomic Development for funding assistance. 2. It is necessary that certain conditions be met as part of the application requirements. Lj Resolved: 1.That the City of Moses Lake authorizes submission of this application to the State Department of Community, Trade and Economic Development to request $1,200,000 for public facilities and certifies that,if funded,it: 1.1 Will comply with applicable provisions of Title I of the Housing and Community Devel opment Act of 1974,as amended,and other applicable state and federal laws; 1.2 Has adopted a Community Development and Housing Plan that meets,at a minimum, the requirements of Title I of the Housing and Community Development Act of 1974,as amended;or has a draft of a final GMA Comprehensive Plan on file with the State De partment of Community,Trade and Economic Development. 1.3 Has adopted and is following a citizen participation strategy which provides opportuni ties for citizen participation comparable to the state's requirements (those described in Section 104(a)(2)(3)of the Housing and Community Development Act of 1974,as amended);has complied with all public hearing requirements and provided citizens, especially low- and moderate-income persons,with reasonable advance notice of, and the opportunity to present their views during the assessment of community develop ment and housing needs,during the review of available funding and eligible activities, and on the proposed activities. u 1.4 Has provided technical assistance to citizens and groups representative of low- and moderate-income persons that request assistance in developing proposals. 1.5 Will provide opportunities for citizens to review and comment on proposed changes in the funded project and program performance. 1.6 Will not use assessments against properties owned and occupied by low- and moder ate-income persons or charge user fees to recover the capital costs of CDBG-funded public improvements from low- and moderate-income owner-occupants. 1.7 Will establish a plan to minimize displacement as a result of activities assisted with CDBG funds, and assist persons actually displaced as a result of such activities, as provided in the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970,as amended. 1.8 Will conduct and administer its program in conformance withTitleVI of the Civil Rights Act of 1964 and the Fair Housing Act, and will affirmatively further fair housing,(Title VIII of the Civil Rights Act of 1968). 1.9 Has adopted andenforcesa policy prohibiting the use of excessive force by law en forcement agencies within its jurisdiction against any individuals engaged in nonviolent civil rights demonstrations;andhas adopted and implemented a policy of enforcing applicable state and local lawsagainst physically barring entranceto orexit from a facility or location which is the subjectof such nonviolent civil rights demonstration within itsjurisdiction,in accordance with Section 104(1)ofTitle I ofthe Housing and Community Development Act of 1974, as amended. 2. The City of Moses Lake designates Joseph K.Gavinski,City Manager as the authorized\^J representative to act in all official matters in connection with this application and the City of Moses Lake's participation in the Washington State CDBG Program.
